The applicant desires to add 27 new nursing home beds and 42 congregate care beds within a new structure. The existing facility will be remodeled to provide a more ef f i c i ent operat i on . Sect i on 4. 05.130 (a) of the Spokane County Zon i ng Ordinance requires a conditional use permit with minimum standards as set forth in Section 4.24.040. Authority to consider and grant such a request exists pursuant to Section 4.25.030 (a) of the Spokane County Zoning Ordinance. LOCATION: On the southwest corner of Raymond Road and 9th Avenue in the SE 1/4 of Section 20, Township 25, Range 44. DECISION OF THE ZONING ADJUSTOR: Based upon the evidence presented and circumstances associated with the project proposal, the Zoning Adjustor APPROVES the application for a new addition of 69 beds total. PUBLIC HEARING: After examining al l avai lable information on fi le with the appl ication and visiting the subject property and surrounding area, the Zoning Adjustor conducted a public hearing on June 18, 1987, rendered a verbal decision on June 18, 1987, and a written decision on June 23rd, 1987. FINDINGS OF FACT 1. The proposal is generally located at the southwest corner of Raymond Road and 9th Avenue and is further described as Assessors Parcel #20544-1002, being more completely described in Zoning Adjustor File #CUE-18-87. 2. The proposal consists of a new 67 bed health care facility on property being similarily used for 43 years. 3. The adopted Spokane County Future Land Use Plan designates the area of the proposal as Urban and the proposal is consistent with the County's entire Comprehensive Plan, including the Future Land Use Plan. 4. The site is zoned Agriculrural/Suburban which would allow the proposed use upon approval of this application. 5. The existing land uses in the area of the proposal are mixed, including a school, other health care facilities, apartment complexes, duplexes and single family residences, all of which are compatible with the proposal. f ~ FINDINGS, CONCLUSIONS AND DECISION PAGE 2 CUE-18-87; SUNSHINE GARDENS 6. That the provisions of RCW 43.21C (the State Environmental Policy Act) have been complied with, and the acting Zoning Adjustor concurs with the Determination of Non-Significance. 7. That the applicant submitted a letter with 17 signatures supporting the proposal. 8. The applicants have been made aware of the recomnendations of various County/State agencies reviewing this project and has indicated they can comply with those recorcmendations. 9. The proper legal requirements f or advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 10. No one appeared to oppose the proposal nor were any written comments adverse to the proposal received. 11. That the project lacked a detailed site plan but can be adequately conditioned to insure appropriate development. Therefore, strict compliance with every condition of approval is required. 12. Any conclusion hereinafter stated which may be deemed a finding herein is hereby adopted as such. From the Findings, the Zoning Adjustor comes to these: CONCLUSIONS 1. The proposal is not detrimental to and is compatible with the public health, safety and welfare. 2. The proposal is listed in the Spokane County Zoning Ordinance as a conditional use allowed in the Agricultural/Suburban zone and the proposal does meet the established and applicable criteria described for that conditional use. 3. Various perf ormance standards and criteria are additionally needed to make the use compatible with other permitted activities in the same vicinity and zone and to insure against imposing excessive demands upon public utilities and these shall be addressed as conditions of approval. 4. The proposal will not be detrimental to the Comprehensive Plan or the surrounding properties. 5. Any finding hereinbefore stated which may be deemed a conclusion herein is adopted as such. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal. The following CONDITIONS OF APPROVAL ARE STIPULATED. ~ CONDITIONS OF APPROVAL I. GE NE RAL 1. The following conditions shall apply to the applicant, owner and successors in interest. , FINDINGS, CONCLUSIONS AND DECISION PAGE 3 CUE-18-87; SUNSHINE GARDENS 2. Failure to comply with any of the conditions of approval contained in this decision, except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning Ordinance and be subject to such enforcement actions as are appropriate. II. PLANNING DEPARTMENT l. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. Direct light f rom any exterior area lighting fixture shall not extend over the property boundary. 4. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. III. DEPARTMENT OF BUILDING & SAFETY 1. In accordance with Section 301 of the Uniform Bui lding Code, al l buildings and structures, including mobile homes and fences over six (6) feet in height, require the issuance of a bui lding permit by the Department of Bui lding and Safety. 2. Fire apparatus access roads shall be provided and maintained in accardance with the provisions of Section 10.207 of the Uniform Fire Code or as per requirements of the Fire District #1 Chief. 3. The applicant shall provide written verification from the Fire District to the Department of Building & Safety that provisions have been made for adequate fire protection prior to the release of building permits. IV. UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health Officer. 2. The owner(s) or successor(s) in Interest agree to authorize the County to place their name(s) on a petition for the forniation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. A dry sewer connection to the f uture area-wide Sewerage System is to be constructed. FINDINGS, CONCLUSIONS AND DECISION PAGE 4 CUE-18-87; SUNSHINE GARDENS V. HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. 4. If a public sewer system is made available for the project, use of individual on-site sewage disposal systems shall not be authorized. VI. ENGINEERING DEPARTh1ENT 1. The applicant shall dedicate a 20 foot radius on Raymond Rd. and Ninth Avenue prior to any use of the property. 2. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 3. a) The applicant shall improve Ninth Avenue in a manner consistent with Spokane County TYPICAL roadway Section No. 1 minimum paving width access street standard. (Add 10 to 12 feet of pavement plus curbing and sidewalk on south side of Ninth). b) The applicant shall improve Raymond Road in a manner consistent with Spokane County TYPICAL Roadway Section No. 1 minimum paving width access standard. (20 feet of paving plus curb and sidewalk on west side of Raymond). 4. The applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or travelled by vehicles. 7. The word uapplicantu shall include the owner or owners of the property, his heirs, assigns, and successors. 8. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This applies to the improvements specified for Raymond Road. 9. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the ~ i Y FINDINGS, CONCLUSIONS AND DECISION PAGE 5 CUE-18-87; SUNSHINE GARDENS required road improvement. Spokane County will not participate in the cost of these improvements. This applies to the improvements specified for Raymond Road. 10. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 11. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable county standards and or adopted resolutions pertaining to Road Standards and Stormwater htanagement in effect at the date of construction, unless otherwise approved by the County Engineer. 12. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissoners Resolution No. 80-1592 as amended and are applicable to this project. NOTICE: PENDING COMPLETION OF ALL CONDITIONS OF APPROVAL WHICH NEED TO BE COMPLETED PRIOR TO PERMIT ISSUANCE, PERMITS CAN BE RELEASED PRIOR TO THE LAPSE OF THE (10) DAY APPEAL PERIOD. HOWEVER, THE COUNTY HAS NO LIABILITY FOR EXPENSES AND INCONVENIENCE INCURRED BY THE APPLICANT IF THE PROJECT APPROVAL IS OVERTURNED OR ALTERED UPON APPEAL. The applicant desires to add 27 new nursing home beds and 42 congregate care beds within a new structure. The existing facility will be remodeled to provide a anore efficient operation. Section 4.05.130 (a) of the Spokane County Zoning Ordinance requires a conditional use permit with minimum standards as set forth in Section 4.24.040. Authority to consider and grant such a request exists pursuant to Section 4.25.030 (a) of the Spokane County Zoning Ordinance. LOCATION: On the southwest corner of Raymond Road and 9th Avenue in the SE 1/4 of Section 20, Township 259 Range 44. DECISION OF THE ZONING ADJUSTOR: Based upon the evidence presented and circumstances associated with the project proposal, the Zoning Adjustor APPROYES the application for a new addition of 69 beds total. PUBLIC HEARING: After examining al l avai lable information on fi le with the appl ication and visiting the subject property and surrounding area, the Zoning Adjustor conducted a public hearing on June 18, 1987, rendered a verbal decision on June 18, 1987, and a written decision on June 23rd, 1987. FINDINGS OF FACT 1. The proposal is generally located at the southwest corner of Raymond Road and 9th Avenue and is further described as Assessors Parcel #20544-1002, being more cotrQletely described in Zoning Adjustor File #CUE-18-87. 2. The proposal consists of a new 67 bed health care facility on property being simi lari ly used for 43 years. 3. The adopted Spokane County Future Land Use Plan designates the area of the proposal as Urban and the proposal is consistent with the County's entire Cor,tiprehensive Plan, including the Future Land Use Plan. 4. The site is zoned Agriculrural/Suburban which would allow the proposed use upon approval of this application. 5. The existing land uses in the area of the proposal are mixed, including a school, other health care facilities, apartment complexes, duplexes and single family residences, all of which are compatible with the proposal. i ~ . ~ FINDINGS, CONCLUSIONS AND DECISION PAGE 2 CUE-18-87; SUNSNINE GARDENS 6. That the provisions of RCW 43.21C (the State Environmental Policy Act) have been complied with, and the acting Zoning Adjustor concurs with the Determination of Non-Significance. 7. That the applicant submitted a letter with 17 signatures supporting the proposal. 8. The applicants have been made aware of the recomnendations of various County/State agencies reviewing this project and has indicated they can comply with those recomneendations. 9. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 10. No one appeared to oppose the proposal nor were any written comments adverse to the proposal received. 11. That the project lacked a detailed site plan but can be adequately conditioned to insure appropriate developMent. Therefore, strict compliance with every condition of approval is required. 12. Any conclusion hereinafter stated which may be deemed a finding herein is hereby adopted as such. From the Findings, the Zoning Adjustor comes to these: CONCLUSIONS l. The proposal is not detrimental to and is compatible with the public health, safety and welfare. 2. The proposal is listed in the Spokane County Zoning Ordinance as a conditional use allowed in the Agricultural/Suburban zone and the proposal does meet the established and applicable criteria described for that conditional use. 3. Various perf ormance standards and criteria are additionally needed to make the use compatible with other permitted activities in the same vicinity and zone and to insure against imposing excessive demands upon public utilities and these shall be addressed as conditions of approval. 4. The proposal will not be detrimental to the Comprehensive Plan or the surrounding properties. 5. Any finding hereinbefore stated which may be deemed a conclusion herein is adopted as such. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal. The following CONDITIONS OF APPROVAL ARE STIPULATED. CONDITIONS OF APPROVAL I. GENERAL 1. II. PLANNING DEPARTMENT l. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the pro,ject prjor to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 4. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. III. DEPARTMENT OF BUILDING & SAFETY 1. In accordance with Section 301 of the Uniform Building Code, all buildings and structures, including mobile homes and fences over six (6) feet in height, require the issuance of a building permit by the Department of Building and Safety. 2. Fire apparatus access roads shall be provided and maintained in accordance with the provisions of Section 10.207 of the Uniform Fire Code or as per requirements of the Fire District #1 Chief. 3. The applicant shall provide written verification from the Fire District to the Department of Building b Safety that provjsions have been made for adequate fire protection prior to the release of building permits. IV. UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health Officer. 2. The owner(s) or successor(s) in Interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includei the Owner(i) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROYIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social b Health Services. 4. If a public sewer system is made available for the project, use of individual on-site sewage disposal systems shall not be authorized. VI. ENGINEERING DEPARTMENT 1. The applicant shall dedicate a 20 foot radius on Raymond Rd. and Ninth Avenue prior to any use of the property. 2. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 3. a) The applicant shall improve Ninth Avenue in a manner consistent with Spokane County TYPICAL roadway Section No. 1 minimum paving width access street standard. (Add 10 to 12 feet of pavement plus curbing and sidewalk on south side of Ninth). b) The applicant shall improve Raymond Road in a manner consistent with Spokane County 7YPICAL Roadway Section No. 1 minimum paving width access standard. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surf acing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or travelled by vehicles. 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 8. 7o construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended.
