ADDRESS: 20215 E. SPRAGUE AVE. PARCEL NUMBER: 55174.9013 APPLICATION DESCRIPTION: The applicant proposes to temporarily place a manufactuned home on a parcel of land, in
adcution to the existing primary resicience, as a residence for Mildred L. Beck, a dependent
relative. Sections 4.04.170 j. and 4.24.560 of the Spokane County Zoning Ordinance
requires issuance of a condidonal use permit. Authority to consider such a request exists
pursuant to Section 4.25.030 (a) of the Spokane County Zoning Ordinance.
PROJECT LOCATION: Generally located in east Spokane Valley on the northwest corner
of the intersection of Sprague Avenue and Henry Road in the SE 1/4 of Section 17, Township
25N, Range 45 EWM, Spokane County, Washington; 20215 East Sprague Avenue.
OPPONENTS OF RECORD: NONE
PUBLIC HEARING AND DECISION:
After consideration of all available information on file, exhibits submitted and testimony
received during the course of the public hearing held on November 7, 1990, and the Zoning
Adjustor rendered a written decision on Decembe1990 to APPROVE the application.
FINDINGS OF FACT AND CONCLUSIONS
1. The proposal is described above and detailed in documents contained in the file.
2. The adopted Spokane County Comprehensive Plan designates the area of the
proposal Industrial. The proposed uses are generally not consistent with this category.
3. The site is zoned Agricultural, which allows the proposed use upon approval of this
application.
4. The existing land uses in the area of the proposal include residences on varying
parcel lot sizes and agriculture all of which are compatible with the proposal.
5. 1'he proposal is exempt from the provisions of the Washington State Environmental '
Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (6) (c) and Spokane
Environmental Ordinance 11.10.070 (1) (a).

6. The applicant has been made aware of the recommendations of various County
agencies reviewing this project and has indicated those recommendations are acceptable; except
that future right of way acquisition reserve area for Henry Road, along the east property edge
was not d.iscussed.
7. The County's adopted arterial road plan identifies both Sprague Avenue and to,the
south and future right-of-way for Henry Road to the east as minor arterials. These rights-of-
way should be eighty (80) feet in width. In order to reserve space for future acquisidon to
accomplish a total eighty (80) foot right-of-way in this area, an additional ten (10) feet of the
subject property needs to be identified for future right-of-way acquisition on the south edge of
the property and on the east edge of the property a future right-of-way acquisidon area of forty
(40) feet must be reserved for ultimate acquisition by the County. It is also the County's policy
to require future building setbacks to be located thiny-five (35) feet back from these future
right-of-way boundaries. This would establish a building setback of forty-five (45) feet on the
existing property line on Sprague Avenue and an existing building setback of seventy-five (75)
feet on the east side of the subject property with respect to the existing property line.
8. The proper legal requirements for advertising of the hearing before the Zoning
Adjustor of Spokane County have been met.
DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES
the proposal, subject to compliance with the following -
CONDITIONS OF APPROVAL
The following conditions shall apply to the applicant, owner and successors in interest
and shall run with the land.
1. GENERAL
1. The following condidons shall apply to the applicant, owner and successors in
interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this decision,
except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning
Ordinance and be subject to such enforcement as are appropriate.
3. The Zoning Adjustor may administratively make minor adjustments to site plans or
the conditions of approval as may be judged by the Zoning Adjustor to be within the context of
the original decision.

II. PLANNING DEPARTMENT
1. A statement (Title Notice) shall be recorded by the Planning Department in the
. County Auditor's office stating that the manufactured home is temporary and for the use of the
named dependent relative(s) for which the Conditional Use Permit is approved and that the
manufactured home is not a permanent structure to be transferned with the propert}r if it is sold
or leased. _
2. The permit shall be granted for a period of one (1) yeaz and may be renewed
administratively by the Zoning Adjustor/designee upon ttie recertification: (a) by a licensed
physician that a qualifying medical problem still exists; and (b) by the original applicant,
qualifying substitute care giver or the dependent relative that the need still exists.
3. The renewal period shall be the first day of the month occurring after 12 entire
months pass since the date of this decision (December 1, 1991).
4. The manufactured home shall be located in substantial conformance with the site
plan on file in the Planning Department, and any modification of proposed location shall only
be authorized by the Zoning Adjustor prior to location and erection at the site.
5. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Norice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future aoquisition area Tide Notice shall be released, in full or in
part, by the Planning DepartmenL The notice should be recorded within the same time frame
as an appeal and shall provide the following:
a. At least forty (40) feet of reserved future acquisition area for road right-
of-way and utilities, in addition to the existing and/or newly dedicated right-of-
way along Henry Road (extended along east property line). NOTE: The County
Engineer has required ten (10) feet of new dedication.
b. Future building and other setbacks required by the Spokane County
Zoning Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed
signs should be located within the future acquisition area for road right-of-way
and utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisicion area, until acquired, shall be private property and
may be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Tide Notice specifying a future land acquisition area for road right-of-way
and utilities. The reserved future acquisition area Title Notice shall be released, in full or in

part, by the Planning DepartmenL The notice should be recorded within the same time frame
as an appeal and shall provide the following:

and returned to the DepartmenG III. DEPARTMENT OF BUILDINGS -
1. The issuance of a building permit by the Department of Buildings is required.
2. The Deparnnent shall take note of the thirty-five (35) and seventy-five (75) foot
setback from the parcel south and east (respectively) property lines, thus preserving setbacks
from likely future acquisition of rights-of-way. (Secaon U. 5. and 6.above)
IV. UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on
compliance with all rules and regulations of the Spokane County Health I?istrict and is further
condidoned and subject to specific application approval and issuance of permits by the Health
District.
2. The Owner(s) or Successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94
which the petition includes the Owner(s) property and further not to object by the signing of a
protest petition against the formation of a ULID by resolution method pursuant to RCW
Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a

or resolution method under RCW Chapter 36.94.
3. Any water service for this project shall be provided in accordance with the
. Coordinated Water System Plan for Spokane County, as amended.

V. HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Sociai & Health Services. 4. Subject to specific application approval and issuance of permits by the health
officer, the use of an individual on-site sewage disposal system(s) may be authorized.
VI. SPOKANE COUNTY ENGINEER'S OFFICE
1. The regulations of the National Flood Insurance Program shall be observed, since
the subject property is affected by a flood hazard zone. A development pennit shall be obtained
from the County Engineer before construction or development begins within any area of special
flood hazard (reference Spokane County Ordinance 88-0251).
2. The County Arterial Road Plan identifies Sprague Avenue as a Minor Arterial. The
existing right-of-way width of sixty (60) feet is not consistent with that specified in the Plan.
In order to implement the Arterial Road Plan, in addition to the required right-of-way
dedication, a strip of property ten (10) feet in width along the Sprague Avenue froncage shall be
set aside in reserve. This property may be acquired by Spokane County at the time when
arterial improvements are made to Sprague Avenue.
3. The County Arterial Road Plan identifies Henry Road as a Minor arterial and future
reserve area is established as consistent with Planning Department Condition # II.6.
NOTICE: PENDING COMPLETION OF ALL CONDITIONS OF APPROVAL WHICH
NEED 'PO BE COMPLETED PRIOR TO PERMIT ISSUANCE, PERNIITS MAY BE
RELEASED PRIOR TO THE LAPSE OF T'HE TEN (10)-DAY APPEAL PERIOD.
HOWEVER, THE COUNTY HAS NO LIABILITY FOR EXPENSES AND
INCONVENIENCE INCURRED BY THE APPLICANT IF THE PROJECT APPROVAL IS
OVERTURNED OR ALTERED UPON APPEAL.

The County Engineering Depaztment has reviewed the above referenced
application. The following comments are offered for inclusion in
the Findings and Order as "Conditions of Approval" should the
request be approved.
E68 THAT THE REGULATIONS OF THE NATIONAL FLOOD INSURANCE PROGRAM
BE OBSERVED SINCE THE SUBJECT PROPERTY IS AFFECTED BY A FLOOD
HAZARD ZONE. A DEVELOPMENT PERMIT MUST BE OBTAINED FROM THE
COUNTY ENGINEER BEFORE CONSTRUCTION OR DEVELOPMEKT BEGINS
WITHIN ANY AREA OF SPECIAL FLOOD HAZARD REFERENCE SPOKANE
COUNTY ORDINANCE 81-0726).
E61 The County Arterial Road Plan identifies Spraque Avenue as a
Minor Arterial. The existing right of way width of 60 feet is.
not consistent with that specified in the Plan. In order to
implement the Arterial Road Plan, in addition to the required
right of way dedication, a strip of property 10 feet in width
along the Spraque Avenue frontage shall be set aside in
reserve. This property may be acquired by Spokane County at
the time when arterial improvements are made to apraQue
Avenue.
