Applicant: Philip Schmitt
THIS MATTER, an application for a Temporary Use Permit from Philip Schmitt has been received and
decided upon, pursuant to Section 14.510.000 (a) of the Spokane County Zoning Code, on the 17th day
of September, 2001.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for rendering
decisions by the Director of Spokane County Division of Planning. 0
2. Tlle applicant has requested a temporary use permit to develop a corn maze entertainment area,
with a concessions stand and parking, from September through November, 2001.
3. The subject properiy is generally located north of and adjacent to Interstate 90 and east of Cataldo
Avenue, in the NE '/4 of Section 17, Township 25 N., Range 45 EWM, Spokane County,
Washington.
4. Sunounding land uses consist primarily of single family residences, Interstate 90, and vacant,
undeveloped land
5. The existing zoning of the property described in the application is Light Industrial (I-2),
established January 1, 1991. The proposed use does not conform to the requirements of the
existing Light Industrial (1-2) zone. However, the applicant has requested a temporary use permit
to establish the use under the provisions of Chapter 14.510 (Temporary Uses) of the Spokane
County Zoning Code.
6. Chapter 14.510 of the Zoning Code allows the non-renewable, temporary use of a structure and/or
premises in any zone classification for a period of not more than six (6) months, provided the use
is of a temporary nature and does not involve the erection of a substantial structure.
7. The Spokane County Comprehensive Plan designates the subject property as Industrial.
8. Agencies having a potential interest in this proposal were notified and comments solicited.
9. The proposal is exempt from the provisions of the Washington State Environmental Policy
Act, Chapter 43.21 C RCW pursuant to WAC 197-11-800 (1)(c)(i) and the Spokane
Environmental Ordinance 11.10.070(I)(a).
10. The Division of Planning may impose shorter time periods for temporary use permits as
provided for under Chapter 14.510(a) wherein a permit may be granted for not more than a six
(6)-month period. The Division is not required to issue all temporary use permits for six (6)-
months, but rather it has the discretion to issue a permit from one (1) day up to six (6) months.
11. The Division of Planning finds that it is reasonable to limit the time period for which this
permit is valid to three (3) months. The three (3) month time period provides the applicant the
ability to conduct the proposed use within the identified time frame.
12. This decision will be mailed to adjacent property owners as required by Chapter 14.514 of the
Spokane County Zoning Code.

DECISION ~
BASED ON THE ABOVE Findings of Fact and Conclusions,.Temporary Use Permit TUE-2-01, is
hereby APPROVED until November 30, 2001. This decision is final unless appealed in writing,
consistent with adopted appeal procedures and fees. This approval is subject to the conditions of
approval listed below.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant", wliich term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. Any improvements or alterations to the existing structures or land to accommodate the
proposed use shall be of a temporary nature, and must be restored and/or removed, at the
applicant's expense, upon expiration of the temporary use permit.
2. If a violation of any Condition of Approval is found to be valid, the Temporary Use Permit
shall be revoked and the applicant shall cease operations immediately.
3. Signage may be permitted pursuant to Section 14.804.080(7a) of the Spokane County Zoning
Code.
4. The applicant shall maintained clear travel ways for vehicular access to and from the site,
maintain an unobstructed parking area, and maintain adequate turn-around areas for cars to
enter, park and exit the site.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. The applicant should be advised that an approach permit must be obtained from the Spokane .
County Engineer Department prior to the construction of any new driveway approaches. This
must be done prior to the release of a building permit.
Note: The applicant is hereby notified that Cataldo Avenue maintenance ends prior to entering
the proposed site. By allowing a Temporary Use Permit to be issued on the property having
access from an unmaintained County road, Spokane County assumes no obligation of any kind
or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain,
provide drainage or snow removal on said road. The requirement is and shall run with the land
and shall be binding upon the owners, their heirs, successors or assigns, until said road is
improved to Spokane County Road Standards and accepted by the County for maintenance.
The owners, their heirs, successors or assigns hereby release Spokane County, and all its
officers, employees and agents from any responsibility or liability for any damage whatsoever
to the herein above described lands and improvements thereon as a result of allowing atemporary use permit to be issued on property which is served by an unmaintained County
road.
2. A parking plan and traffic circulation plan shall be submitted and accepted by the Spokane
County Engineer. The design, location and anangement of parking stalls shall be in
accordance with standard engineering practices. This plan shall address dust abatement issLies
for the access roads and parking areas.
3. "The applicant is advised that there may exist utilities either underground or overhead
effecting the applicant's property, including property to be dedicated or set aside. for future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities." "The applicant should contact the applicable utilities regarding
responsibility for adjustment or relocation costs and to make arrangements for any necessary
work."

The following "Conditions of Approval" are submitted to the Spokane County Planning Department
for inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be
approved.
Prior to release of a building permit or use of property as proposed:
1. The applicant should be advised that an approach permit must be obtained from the Spokane
County Engineer Department prior to the construction of any new driveway approaches. This

The Maize will use 'aluminum irrigation lines to control dust. Our irrigation
mainline pulls 300 gpm from a water line operated by Consolidated Irrigation in
Greenacres.
Aluminum handlines will be set up along the approach and will be activated almost
daily for a short period of time. Since the approach will only be 40 ft. wide, the
sprinklers will cover the entire area.
The parking lot will be watered as needed with portable lines. The entire area can be
covered in a few houxs.

The Spokane County Engineering Department has reviewed the above referenced application.
The following "Conditions of Approval" are submitted to the Spokane County Planning Department
for inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be
approved.
Prior to release of a building permit or use of property as proposed:
1. The applicant should be advised that an approach permit must be obtained from the Spokane
County Engineer Department prior to the construction of any new driveway approaches. This
must be done prior to the release of a building permit.
2. Applicant shall sign a"Spokane County Notice to the Public Number 4" which will allow access
over unmaintained sections of Cataldo Avenue.
3. A parking plan and traffic circulation plan shall be submitted and accepted by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering practices.
4. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."

"I`he corn maze is a giant puzzle of paths cut into a cornfield, which will be open to
public for the months of September thru November. After paying an admissian fee, ~
people will be able to "get lost" for about an hour as they try to find the exit. There will
be "corn cops" wandering the maze to answer any questions people might have and to '
serve as security.
A concession stand will be located at the front of the maze. C'ustomers will be able to buy
pop, candy, cookies, and souvenirs, such as T-shirts. There will also be 3 portable toilets
equipped with hand washing facilities located outside the maze.
An off street parking lot will be provided to accommodate customer parking. On busy
nights when there are a lot of vehicles in the lot, an employee will patrol the lot to direct
parking.
Corn maze employees are equipped with two-way radios to assist in keeping the peace.
They have perfect knowledge of the maze and can be to any spot in minutes. They will be
able to help anyone who wants out, and will be able to assist emergency technicians in
case of emergency. Employees are able to identify points in the maze and find their way
to those points with no problem. There are emergency exits built into the maze for those
who find themselves needing a little break. Tliese exits will be lighted and Nvell nlarked.
In the event that it should be needed, we have a standard liability insurance provicied by
the National Direct Fanning Association. The policy is in effect and a copy of the binder
will be produced upon request.
We will be open Tuesday thru Sunday with our last day around November 15u'. We will
be closing earlier at night, as the weather gcts colder.
On nights that we expect larger attendance, we will be hiring sheriff deputies to help with
parking and security.
