This matter coming on for public hearing on December 11, 2002, the Hearing Examiner,
after review of the conditional use permit application and the entire record, and finding good
cause therefore, hereby makes the following findings of fact, conclusions of law and decision:
1. FINDINGS OF FACT
1. The application requests a conditional use permit for a home industry in the Urban
Residentlal-3.5 (UR-3.5) zone, to allow the modification, assembly and sale of used plastic
pallets, and the production of similar special products, on a site of 19,208 square feet.
2. The site is located east of and adjacent to Barker Road, approximately 100 feet south of the
intersection of Barker Road and Sprague Avenue, in the NW '/4 of Section 20, Township 25
North, Range 45 EWM, Spokane County, Washington.
3. The site is currently referenced as County Assessor's tax parcel no. 55202.0302, and has an
address of 11 South Barker Road, Greenacres, WA.
4. The applicant for the proposal is Keith Adkins, 11 South Barker Road, Greenacres,
Washington 99016. The owner of the site is Victoria Sandifur, 11 South Barker Road,
Greenacres, Washington 99016.
5. The Hearing Examiner heard the application pursuant to the County Hearing Examiner
Ordinance (County Resolution No. 96-0171) and the County Hearing Examiner Rules of
Procedure (County Resolution No. 96-0294).
6. The Examiner conducted a site visit on December 10, 2002, and conducted a public heanng
on the proposal on December 11, 2002. The requirements for notice of public heanng were met.

8. The County Division of Planning issued a Determination of Nonsignificance for the
proposal on November 26, 2002.
9. The Hearing Examiner takes notice of the County GMA Comprehensive Plan and Capital
Facilities Plan, Phase I Development Regulations, County Resolution Nos. 2-0037 and 2-0470,
County Zoning Code, 2001 County Standards for Road and Sewer Construction, County Code,
other applicable development regulations, and recent land use decisions in the area.
10. The record includes the documents in the project file at the time of the public hearing, the
documents and testimony submitted at the public hearing, and the items taken notice of by the
Heanng Examiner.
11. The site is 19,208 square feet in size and is relatively flat in topography. The property is
improved with a single-family dwelling with attached garage/shop, a detached shop building and
a small storage building. The residence is served by an on-site sewage disposal system and
public water. A cyclone fence is located along all four borders of the property.
12. The site is heavily landscaped, including a variety of conifer shrubs and trees. Sight-
obscuring arborvitae shrubs 6-9 feet in height are located along the north boundary, the easterly
two-thirds of the south boundary, and the southerly half of the east boundary of the site; with
somewhat taller arborvifiae shrubs found along the westerly third of the south boundary.
13. The dwelling portion of the residence is 1,360 square feet in area, the attached garage/shop
area is 1,276 square feet in area, the detached shop building is 1,462 square feet in area, and the
small storage building is 90 square-feet in area. The detached shop building is approximately 20-
23 feet in height. A concrete pad is located between the detached shop and attached garage/shop.
14. The applicant currently uses the detached shop and attached garage/shop to modify,
assemble and resell used plastic pallets (engineered skids) delivered to the site, and to fabricate
other special products (i.e. snaps for 5`h wheel trailers, plastic lumber); with the residence used as
an office. The bulk of the work is done in the detached shop. The applicant has used fnends and
relatives from time to time to help in the business. The business is primanly carried on during
the week, with occasional work and truck visits on Saturdays. The applicant has used friends and
relatives from time to time to help in the business.
15. The business includes the delivery of materials to the site and pick-up of completed items
by a semi-truck and trailer, with such truck trips averaging 22-24 trips per year over the last two
years, and no more than one (1) truck delivery and pick-up per week during peak usage. See
Exhibit B. Some temporary storage occurs on the concrete pad located between the attached
garage/shop and detached shop, wrth piles currently being llmited to a height of eight (S) feet. A

forklift is used both inside and outside to unload, stack and transfer supplies and finished
products. Equipment used in the business includes a compressor; and cutting, dnlling aiid
packaging tools. The applicant recently rented two storage uruts off-site to eliminate excess
storage on the site. Some supplies are delivered to the site by UPS truck. The applicant uses a
pick-up in the business. Customers occasionally visit the site, but not for the purpose of retail
sales.
16. On June 3, 2002, the Division of Planrung approved a home profession pernlit for the site,
to allow the residence with attached garage/shop to be used for the plastic pallet and similar
products manufacture business. Since the business is not confined to the residence and attached
garage/shop, and outside employees are proposed, a conditional use permit for a home industry is
required.
17. The subject application for a conditional use permit and site plan of record were submitted
on Septeinber 17, 2002. The application proposes working hours of 7:00 a.m. to 6:00 p.m.,
Monday through Friday, and 9:00 a.m. to 5:00 p.m. on Saturdays, indicates that all work would
be performed indoors, and no signage would be displayed. The applicant proposes to hire a full-
time or part-time person to help in the business. The site plan of record illustrates four (4) off-
street parking spaces for customers and employees in the driveway of the residence.
18. Effective January 1, 1991, the zoning of the site was reclassified from the Agricultural zone
of the now expired County Zoning Ordinance to the UR-3.5 zone, pursuant to the Program to
Implement the Spokane County Zoning Code.
19. Effective January 15, 2002, the County implemented a new comprehensive plan ("GMA
Comprehensive Plan"), Capltal Facilities Plan, County Urban Growth Area (UGA) boundaries,
and Phase I Development Regulations; all pursuant to the State Growth Management Act
(GMA). The County also repealed the interim development regulations previously adopted by
the County under the State Growth Management Act. See County Resolution No. 2-0037.
Minor revisions were made to the Phase I Development Regulations on May 7, 2002. See
County Resolution No. 2-0470.
20. The Phase I Development Regulations designate the site and neighboring land in the Low
Density Residential category of the GMA Comprehensive Plan, and retained the UR-3.5 zoning of
the site and such land. Such regulations designate the land lying a short distance northwest of the
site, north and west of the intersection of Barker Road and Sprague Avenue, in the Medium Density
Residential category of the Comprehensive Plan. Such land is zoned UR-7. The site and area are
designated in the County UGA.
21. The area is dominated by single-family homes on various sized lots. The property to the
west of the site houses a church complex. Higher density residential uses are found north of
Sprague Avenue.

22. The GMA Comprehensive Plan designates Barker Road in the vicinity, and Sprague
Avenue, west of Barker Road, as Urban Minor Arterials. Sprague Avenue, east of Barker Road,
is designated as an Urban Collector Arterial.
23. Policy UL.7.7 of the Urban Land Use Chapter of the GMA Comprehensive Plan states that
"home occupations" may be allowed as a residential land use, provided they do not disrupt
residential amenities concerning sight, sound, etc, or create traffic that exceeds road design or
which develops traffic hazards within the neighborhood. The Urban Land Use Chapter does not
mention "home industries" or "home professions", but do discuss "home occupations". A"home
profession", which is allowed in the UR-3.5 zone subj ect to certain performance standards, is
typically less intensive than a"home industry", which requires issuance of a conditional use
permit in the UR-3.5 zone. See County Zoning Code 14.300.100, definitions. The term "home
occupations" is broad enough to include a"home industry", as such term is defined in the County
Zoning Code.
24. The GMA Comprehensive Plan indicates that design standards for urban land use ensure
neighborhood character and compatibility with adjacent land uses. Policy UL.2.1 recommends
the establishment of minimum performance standards within the County Zoning Code for
nuisances such as noise, vibration, smoke, and other aspects as appropriate to ensure
compatibility with adjacent land uses and neighborhoods.
25. The proposal is exempt the sewer, water and transportation concurrency requirements of the
Phase I Development Regulations, for the reasons stated in the Staff Report.
26. The intent of the UR-3.5 zone is to promote areas of primarily single-family residential uses
in an urbanized setting, having a high level of public services. The maximum residential density
in the UR-3.5 zone is 4.35 dwelling units per acre.
27. The Zoning Code is intended, iri pertinent part, to encourage orderly growth of the County,
promote compatible uses of land, conserve and stabilize property values, provide desired levels
of population density and intensity of land use, conserve and protect amenities, keep pollution at
or below acceptable levels, and provide workable relationships between land uses and the
transportation system. Zoning Code 14.100.104
28. Five (5) owners of single-family home located adjacent to or near the site submitted letters
in opposition to the proposal, including the owners of residences located directly north, south and
east of the site. The owner of the residence located directly north of the site, Raymond Cote, also
testified at the public hearing.
29. The opponents of record expressed concern regarding the location of a commercial or
industnal use in a residential neighborhood, obstruction of traffic on Barker Road by semi-trucks
dropping off supplies and picking up finished products at the sight, expansion of the business
with added employees and noise, threats by the applicant to adjoining neighbors, existing noise
caused by air tools and traffic, health impacts to the daughter of the owner of the residence
located directly east of the site, noise from truck deliveries and loading, and other concerns.

30. At the public hearing, the applicant provided evidence that he was activ~ly searching for an
industrial buildang for relacatiQn of his business, was in the process of selli.ng ane piece of
prieumatic (azr-driven) equipment, a.~d was working with a cvmpany to develap a new drilling
machine that was electrically powered and rrruch quieter and naore efficient. Raymond Cote
testified that no1se impacts had azxaparoved cansFderably after the nelghbor complaints, but
objected ta work bei_ng performed on vveekends.
31. The site is attractively landscaped and maintained. The home indusiry will nat significantly
impact the transportation system serving the area. There are no n4xious chemicals kept on the
site, ar empincal evrdence ofnaxious air emissions.
32. The residentsal appearance and character of the property can be maintained 1fscmi-truck
tnps to the site +do not exceed an average of once per week, any outdopr storage is temparar} and

standards of f.h.e UR-3.5 zone require the husiness ta coxnply with the maxirnum permissible
noise leve1s in WAC 173-60-040, The Staff Report mdicates thaf the project can meet the vther
standards of the LJR-3.5 zone for a home industry.
33. The Exarx7in.er has imposed conditions of approval ta ensure that the praperty amainta'ms its
residential appearance and character, complies with the other applicable standards for a home
industry in the UR-3.5 zone, is reasonably campatible with neighbor€ng residential uses, and
meets the general requirements for issuance of a candhtional use permit under the Zvning Code.
34. As conditioned, the pz-oposal wi11 not have more than a maderate effect on the qual.ity of the
envlronment and wi11 be reasonably compatible with neighbaring land uses.

6. The Caunty Engineer has designated a 3-Lane Minar Arterial Roadwvay Section for the
Lmprnvement of Barker Road, which is adjacent to the praposal site. This will require the
additLOn af apprvximately 11-13 feet of asphalt along #he. frontage of the developrnent. The
construction of curbing and sidewalk is also required.
7. The applicant is advised that utilities rn.ay exist either undergcvund or overhead that affect
the applicant's property or the adjacent county nght of way. The County assumes no finarrciaI
obligation fQr adjustments ar relocatiQn regardillg these utiXities. The applicant should contact
the applicable utility purveyoars rega-rdin.g the responsibility for adjustment or relocation costs and
to make arrangements for any work. Apermit is required from fihe County Engineer for any
wozk perfarrned in the County right of way
8, The County Engureer has reviewed the project for transportation concurrency and
determined that it is exernpt under Section N(B)(2)(c) of the Phase I Development RegulatFons
adopted by the County.

Pursuant to Spokane County Resolution No. 96-0171, the decision of the Hearing Examiner
on an application for a conditional use permit is final and conclusive unless within twenty-one
(21) calendar days from the issuance of the Examiner's decision, a party with standing files a
land use petition in superior court pursuant to chapter 36.70C RCW. Pursuant to chapter 36.70C
RCW, the date of issuance of the Hearing Examiner's decision is three (3) days after it is mailed,
counting to the next business day when the last day for mailing falls on a weekend or holiday.
This Decision was mailed by Certified Mail to the Applicant, and by first class mail to
other parties of record, on January 24, 2003. The date of issuance of the Hearing Examiner's

ResQonses frQrn the Public: Three persons provided written comments to the Division of
Planning and they are included in the application file. The comments addressed noise and traffic
impacts.
P_q.scriQtion of the $i#e: The subject property is 19,208 square feet in size and is served by an
on-site sewage disposal system and a public water system. The site is relatively flat and includes
a variety of conifer shrubs and trees. Site improvements include asingle family dwelling and
attached garage and shop area, and a detached shop building. The dwelling is 1,360 square feet
in area, the attached garage/shop area is 1,276 square feet in area, the detached shop is 1,462
square feet and shop building and a 90 square-foot storage building exists on the subject
property. The detached shop building is approximately 20 to 23 feet in height. A cyclone fence is
located on all four sides of the property. Shrubs six to nine feet in height are located adjacent to
the north and south perimeters of the property and along the south 1/2 of the eastern property line.
&ackqround: The application for the proposal was submitted to the Division of Planning on
September 17, 2002. A determination of "Completeness" was issued on October 4, 2002 and
Notice of Application was mailed on October 9, 2002 with a 14-day comment period ending on
October 23, 2002. The applicant is currently assembling plastic pellets and this assembly activity
is permitted in the UR-3.5 Zone as a Home Profession. The Division of Planning granted the
applicant "Home Profession° status on June 3, 2002. The applicant applied for a Conditional Use
Permit for a"Home Industry" since he would like to hire employees that are unrelated to the
occupants of the subject single family dwelling and to be allowed to conduct the business in the
existing detached shop building.
DescriQtion of the ProQosal: The applicant proposes assembly of plastic pellets as a Home
Industry in the detached shop building and in the shop area attached to the single family
residence. The existing single family dwelling will not be used for the proposed Home Industry.
However, some of the operations and product storage will occur in the shop building attached to
the residence. The site plan of record illustrates that Barker Road will serve as the sole access
to the site. The site plan illustrates 4 off-street parking spaces for employees and customers and
a graveled driveway connecting Barker Road with the shop building Most of the pallet assembly
operations will occur in the detached shop building. A portion of the operations will continue
within the attached shop building. The site plan illustrates thatno additional improvements will be
installed or constructed in order to operate the business. No additional landscaping, fencing or
other site screening improvements are proposed beyond that which currently exists on the site.
According to the Spokane Regional Health District the on-site sewage disposal system will require

no modifications to accommodate the Home Industry. The application specifies that operations
~ will occur Monday through Friday, 7:00 am to 6:00 pm and 9:00 am to 5:00 pm on Saturdays. The
applicant states that no signage will be disptayed and truck traffc will be miminal, limited to
weekly visits to deliver materials to the business and to pick up finished products. Assembled
products will be stored outside in the back of the residence until they are delivered to customers.
The existing landscaping will obstruct views of the storage area from neighboring properties. On
the average, truck deliveries and pick-ups will occur once a week.
~itffAn I i:
Comprehensive Plan: The Comprehensive Plan designates the subject property and adjacent
properties as Low Density Residential (LDR). The LDR category is one of three residential
categories identified in the Residential Section of Chapter 2 of the Comprehensive Plan, entitled
"Urban Land Use." The other two residential categories are Medium Density Residential and High
Density Residential. The LDR category encourages residential densities varying in density from 1
to 6 dwellings per acre. The Comprehensive Plan does not have goals and policies specific to
Home Industries in urban residential categories. It is presumed that conditional uses are
consistent with the Comprehensive Plan if they are permitted in the zone in which they are to be
Iocated and they are developed and operated consistent with the applicable conditional use
permit criteria and conditions of approval. The following is an analysis of the Comprehensive Plan
Policies that seem to be relevant to the proposal:
Urban Land Goal UL.7 encourages efficient development patterns by locating residential
development in areas where facilities and services can be provided in a cost-effective and timely
fashion. While the proposal is essentially a small scale commercial activity it will be served by an
existing public water facility. Manned fire protection, police protection and solid waste collection
services are also available to the site.
Urban Land Policy UL.7.12 specifies that new development within the UGA be connected to
public sewer consistent with requirements for concurrency. Capital Facilities Goal CF.3 specifies
that public facilities and services must support proposed development at established Levels of
Service. Capital Facilities Policy CF.3.1 specifies that development shall be approved only after it
is determined that public facilities and services will have the capacity to serve the development
without decreasing levels of service below adopted standards. The Division of Planning ev,aluated
the proposal for water and sewer service concurrency as required by Resolution #2-0470. Since
the Spokane Regional Health District has determned that no improvements to the existing on-site
sewage disposal system are required to serve the Home Industry, the Division of Planning has
determined that the proposal is exempt from sewer concurrency certification. This determination
is based on the operation of Resolution #2-0470, Section IV(F), paragraphs 5 and 6. Since
additional water service is not required by the proposed Home Industry the Division of Planning
has determined that the proposal is exempt from water concurrency certification based on the
operation of Resolution #2-0470, Section IV(F), paragraphs 5 and 6. These determinations
implement the intent and spirit of the above cited Urban Land (UL) Policies. The Division of
Engineering and Roads states that the proposal is exempt from transportation concurrency
requirements pursuant to Resolution #2-0470, Section IV (13)(2)(c). In summary, the proposal, as
conditioned, is generally consistent with the goals and Policies of the Low Density Residential and
Capital Facilities Chapters of the Comprehensive Plan.
Zoning: The subject property is zoned Urban Residential-3.5 (UR-3.5) Zone and the UR-3.5
Zone was established in 1991 pursuant to the Program to Implement the Spokane County Zoning
Code. The project site was previously classified as Agricultural (A) in the 1950s. The purpose of
the Urban Residential-3.5 (UR-3.5) Zone is to implement the Low Density Residential category of
the Comprehensive Plan. The intent of this zone is to promote areas of primarily single-family
residential use in an urbanized neighborhood setting, having a high level of public services. A

Home Industry is an allowed use in the Urban Residential-3.5 (UR-3.5) Zone provided the ,
applicant applies for and is granted a Conditional Use Permit, and demonstrates compliance with
the Conditional Use Permit criteria of the Spokane County Zoning Code. Sections 14.616.240(4)
of the Spokane County Zoning Code identifies the criteria governing the approval of a Conditional
Use Permit for a Home Industry. Section 14.404.101 ofthe Zoning Code states that before a
Conditional Use Permit is approved, the Hearing Examiner shall find that 1). Adequate conditions
and restrictions are attached to the development of the property to ensure that the proposed use
will be compatible with uses permitted outright in this location and 2). The special standards for
Home Industries outlined in the Zoning Code, Section 14.616.240(4) applicable to the UR-3.5
Zone shall be met.
Criterion 2 is again repeated in the introduction to the Urban Residention-3.5 (UR-3.5),
Conditional Use Section, Section 14.616.240. Since criterion 2 makes no qualification, the criteria
intends that a proposed conditional use must be consistent with all development criteria listed in
said code for the specific conditional use. In regards to the subject application, the development
criteria specified in Section 14.616.240 (4) apply to any Home Industry locating in an Urban
Residential-3.5 (UR-3.5) Zone. Review of the proposal's compliance with the specific
development criteria for a Home Industry as identified in Section 14.616.240(4) is as follows:
Section 14.616.240(4a): The property shall retain its residential appearance and character;
Response: The property is primadly residential in character. The applicant's business will
generate a minimum of vehicle traffic, produce no extraordinary light or glare, not generate
excessive sewage, not require additional potable water and cause no external commercial signs
or other indications that a business exists on premise. The existing single family dwelling and
accessory buildings will not be altered in any manner to accommodate the proposed Home
Industry. Business patronage will be very minimal and not more than twopersons unrelated to
the applicant will be employed by the Home Industry. Existing landscaping serves as a pleasant
appearing visual buffer between the Home Industry and adjacent single family dwellings. The
proposal, as conditioned, will comply with this criteria.
Section 14.616.240(4b): The use shall be carried on in a primary residence or may be allowed in
accessory, detached structures which are not, in total, larger than two times the gross floor area
of the primary residence; z Response: The business will be conducted in an existing attached shop building and detached
shop building. The shop buildings combined are less than two times the gross floor area of the
primary residence.
Section 14.616.240(4c): Only members of the family residing on the premises, and no more than
two (2) employees outside of the family, may be engaged in the home industry.
Response: The applicant states that he intends to hire no more than 2 employees unrelated to
the applicant.
Section 14.616.240(4d): One (1) sign identifying the home industry shall be unlighted and may
be attached or detached and shall be a maximum of four (4) square feet on a face.
Response: The applicant proposes no signs of any kind.
Section 14.616.240(4e): Window or outside displays may be allowed as approved by the Hearing
Body.

' Section 14.616.240(4)(0: There shail be no stock stored nor commodity kept for sale on the
premises which is not necessary to the occupation, profession, or craft.
Response: No products will be retailed on the premises. The pallets will be stored in the shop
building and outside in the back of the residence until they are delivered to customers.
Section 14.616.240(4)(g): All material or mechanical equipment shall be used in such a manner
as to be in compliance with WAC-173-60 regarding noise.
Response: The proposal as conditioned will be consistent with this criteria.
Section 14,616.240(4)(h): Parking, traffic, and storage requirements shall be as approved by the
Hearing Body.
Response: This criteria provides the Hearing Examiner with the authority to apply additional
conditions to mitigate parking, traffic and product storage impacts if they are deemed appropriate
beyond that which is proposed.

Section 14.616.240(4)(i): All storage areas shall be enclosed or completely screened from view
by a maximum six foot-high sight-obscuring fence meeting accessory use setback requirements.
Response: The applicant does not propose the construction of a site-obscuring fence. The
applicant contends that existing landscaping serves as a site-obscuring visual buffer between the
Home Industry's outdoor storage area and adjacent single family dwellings. .
The proposal is in compliance with UR-3.5 Zone building setback, building coverage and building
height requirements.

1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant," which
term shall include the owner or owners of the property, heirs, assigns and successors.
2. The Conditional Use Permit applies only to the parcel described in the Planning Division
project application file designated CUE-7-02, Assessor's tax parcel # 55202.0302.
3. The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice noting that the property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This Title Notice shall serve as
public notice of the conditions of approval affecting the property in question. The Title
Notice should be recorded within the same time frame as allowed for an appeal and shall
only be released, in full or in part, by the Division of Planning. The Title Notice shall
generally provide as follows:
The parcel of property legally described as [from file No. CUE-7-02], is the subject of
a land use action heard December 11, 2002 by a Spokane County Hearing Examiner

5. The applicant shall develop the property and operate the Home Industry in conformance
with the site plan of record. All aspects of the concept and proposal shall be binding on the
development, including proposed use. Variations, when approved by the Division of
Planning Director/designee, shall only be allowed to meet regulation standards and
conditions of approval. Any other modification must be presented to the Hearing Examiner
for review and approval.
6. The Division of Planning shall file with the Spokane County Auditor, within the same time
frame as allowed for an appeal from the final disposition, including lapsing of appeal period,
a Title Notice, which shall generally provide as follows:
"Prior to the issuance of any building permit for any building or any use on the property
described herein, the applicant shall be responsible for complying with the provisions of
the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay
Zone). The property which is the subject of this notice is more particularly described as

2. Findings:
a) This project lies over the Spokane-Rathdrum Aquifer.
b) The project is within Critical Water Supply Service Area #3 and within the service area of
Consolidated Irrigation District. Water supply will be a public system.
c) The project is inside the Spokane County Comprehensive Wastewater Management Area, inside the
General Sewer Service Area, and inside the Priority Sewer Service Area recommended in the '201'
Study. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane
County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in
the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of
the proper dimensions to permit the use of both an individual well and sewage system.
d) The project lies in a relatively flat area east of Barker Road and south of Sprague Avenue. Local
drainageways are insignificant.
e) Surface soils are classed by the U.S. Soil Conservation Service as Garrison gravelly loam with 0% to
5% slopes. They have a septic tank filter field limitation of slight. There is also possible contamination
of groundwater. This soil would be classified as a Type IV.

Page 2 fl Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate
to very large amounts of water. Data from wells in the area referenced in section 1 g shows they aze
from 60' to 168' deep and have static water levels varying from 23' to 32' below the surface.
3. Required (mandatory) Conditions If Approved:
a) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
b) Water service shall be coordinated through the Director of Utilities, Spokane County.
c) Water service sha11 be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.

d) Disposal of effluent beneath paved surfaces is currently prohibited.
e) Subject to specific application approval and issuance of perrnits by the Health Officer, the use of an
individual on-site sewage disposal system may be authorized.

6. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the
improvement of Barker Road which is adjacent to the proposed development. This will require
the addition of approximately 11-13 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
7. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."

in a Road Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement District
pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)turther agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the R!D
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to Barker Road.
5. Approach Permits are required for any access to the Spokane County road system.
6. The County Engineer has designated a 3-Lane Minor Arterial Roadway Section for the
improvement of Barker Road which is adjacent to the proposed development. This will require
the addition of approximately 11-13 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required.
7. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."
8. The Spokane County Engineer has reviewed this project for transportation concurrency and
determined that this project is exempt under the Spokane County Comprehensive Plan Phase I
- Development Regulations Section IV (B) (2) (c).

PA.RT A: HOME PROFESSION DEFINITION AND CRITERIA
The Spokane County Zoning Code defines Home Profession as a profession or craft, excluding an adult bookstore
or adult entertainment establishment, carried on within a residence by the occupants, which activity is clearly
incidental to the use of said residence as a dwelling and does not change the residential character of the dwelling or
neighborhood, and is conducted in such a manner as to not give any outward appearance of a business in the
ordinary meaning of the term. An activity which does not compty with the following criteria shall not be deemed a
home profession.
(1) There shall be no exterior alterations to the dwelling which changes the residential appearance or character
thereof.
(2) The use, including all storage space, shall not occupy more than forty-nine (49) percent of the residence's
livable floor area. No home profession shall occupy a detached accessory building. A!1 storage shall be enclosed
with the residence.
(3) Only members of the family who reside on the premises shall be engaged in the home profession.
(4) One (1) sign identifying a home profession shall be limited in size to a maximum of four (4) square feet, be
unlighted, and be placed flat against the residence.
(5) There shall be no window display nor shall sample commodities be displayed outside the building, except that
horticultural and floricultural products grown on the premises may be so displayed.
(6) There shall be no stock stored nor commodity kept for sale on the premises which is not necessary to the
profession or craft.
(7) All material or mechanical equipment shall be used in a manner as to be in compliance with W AC 173-60
regarding noise.
(8) Traffic generated which exceeds the following standards shall be prima facie evidence that the activity is a
primary business and not a home profession.
a. The parking of more than two (2) customer vehicles at anyone (I) time.
b. The use of loading docks or other mechanical loading devices.
c. Deliveries of materials or products at such intervals so as to create a nuisance to the neighborhood.
(9) The hours of operation for a home profession shall be limited from seven (7) a.m. to ten ( 10) p.m. The
applicant shall specify on the home profession permit the hours of operation.
(10) A home profession permit shall be issued by the Division of Planning per fee established by the Board
NOTE: The Zoning Code allows Home Professions in the Exclu$ive Agricultural (EA), General Agricultural (GA),
Rural Settlement (RS) zone, and all residential zones. The application fee is as adopted by the Board of County
Commissioners.

impact statement (EIS) musL be prepared for all proposals with probable si~nificant adverse irnpacts on

and the agency identify impact from your proposal (and to reduce or avoid impacts from the proposal,
if it can be done) and to help the agency decide whether an EIS is required.

PERMIT EXPIRATION AND REFUNDS Unless otherwise noted, this permit will be considered null and void by limitation if the work authorized by the permit is not commenced or is stopped for
a period of 180 days, unless a written request for an extension of the permit is received and approved by the Building Official pnor to expiration At a
minimum an inspection should be requested at least once every 180 days to assure the validity of the permit A permit may be renewed within one year
of the date of expiration for one-half the original fee, subject-to certain limitations-please call us if you have any questions
All refund requests must be made in writing by the appticanUpermittee (shown on the reverse) no later than 180 days after the date of fee payment.
