Spok:ane County, has recently purchased the duplex at E. 10619/ 10621 lSth Avenue
for $ 75,000 for the road widening project on University Road (CRP 2296). The County
inherited the renters in the two units and will be relocating them in about three.
months when the construction.begins (sewer phase). •
Presently, 7-8 feet of the East end of the duplex is within. the'-new right of way..;,,
• acquired and will have to be removed in 3-4 months when the -CRP 2298 -construction tbegins. As property owner, Spokane County has two choices: •
(1) Remove that portion of the house that is within the new right of way .
resupport the remainder (temporarary bracing or permanent foundation), . .
'In order to'uridertake this type of major structural work they will need Building
Codes approval (remodeling permit). In addition, the restructured house would
. have to be approved by the Planning Department as to "non conforming" use of the property as a duplex with frontage set back and lot size zoning code-
violations.
(2) Demolish the entire building leaving a remainder lot of 8596 sq. ft. which
is too-small to build a single family house or a duplex under the current
area zoning UR-3.5. Unimproved lot value is @$ 12,000.00 if buildable.

In light of the price paid for the property by the County 75,000) I think that the
logical and prudent action by the County would be to go with option (1) above and
package the parcel for a feasible retrofit.
The continued use of this property as a duplex hinges on whether,the County Planning
Department will allow a retrofit on the property with it sitting 3-4 feet from the
back of the planned sidewalk. I checked with Gary Fergan and Bill Mosier of County
Planning, who studied the problems with the sideyard setback and possible carport
front set back violations. They are studying my proposal of removing 8-10 feet of
the existing building on the East end and retrofitting the duplex. It is definatly
possible to make an exception to the zoning standards due to the "hardship" that the
County has put on the utility of the property. Due to the reduction in size of the
original building, Planning may be able to grant a"non conforming" use status for the
property to allow a retrofit. Otherwise, a full varience would be required, with all
of the forms, mailings and hearings that we followed as with Mr. Art Ladds(#29) duplex
across the road.
The Right of Way Department could prepare the documents required by Planning, (25.4yvw~.D
$225•:.,:1-.=in permit fees would be billed to the County Engineer, and the whole varience
process would take 2-3 months to complete. With Planning approval of a zone varience,
the County would then have a saleable real estate parcel that it could either sell
outright or retrofit later for top dollar resale. Until the Planning issue is resolved,
retrofitting and resale of the deupex is not an option.
