Authonty to consider such a request exists pursuant to section 14 404.100 of the Zonulg Code of Spokane County and Spokane County Board of County Comnussioners resoluaon No 89 0708, as may be amended PROJECT LOCATION: West central Spokane Valley, between Dishman and Dishman- Mica Road, just north of where 4th Avenue would intersect, in NW 1/4 of Secaon 20, Township 25N, Range 44 EWM; 315 S. Dishman Road. OPPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After consideraaon of all available informanon on file, exlubits subnutted and testimony received dunng the course of the pubhc heanng held 1993 on January 27, 1993, the Zonmg Adjustor rendered a wntten decision on February to APPROVE the apphcation FINDINGS OF FACT AND CONCLUSIONS 1 Tesnmony was taken under oath 2 The proposal is descnbed above and detailed in documents contained in the file. 3 The adopted Spokane County Comprehensive Plan designates the area of the proposal as Industnal The proposal is generally consistent with the Industnal category of the Comprehensive Plan and basically complies with RCW 36 70 450. 4 The site is zoned Heavy Industnal (I-3), which does not allow the exishng use. The existing rental wut use a.ad builduig predates the I-3 Zorung and, therefore the use is a lawful nonconforming use The Zorung Code provides that any expansion of a building or use that is deemed to be a lawful nonconforming use must be through the conditional use permit process. The normal reasons to approve or deny a conftonal use permit do not apply, although, the atnlity to unpose condinons, if approved, or to deny does exist. Secnon 14 508 040 states that expansion or extension of nonconforming uses is generally discouraged. However, in this case, the uses are estabhshed in the neighborhood as bemg very compatible and very consistent with this type of use It is unlilcely that property in the i' ~ CASE NO CUN-31-92 SPOK:ANE COUNTY ZONIlVG ADJUSTOR PAGE 2 area will be converted to heavy industrial use, insofar as, west of the site is a steep bluff and Dishman Road. East of the site is an estabhshed railroad nght of way and businesses which are basically compauble with this use exists on either side of the property. Therefore, expansion of ttus nonconforniing use w111 serve the need of the owner and not tend to esta.blish additional nonconfornnng uses to the detnment of the neighborhood 5. The proposal ls exempt from the provisions of the Washington State Envuonmental Policy Act, Chapter 43 21 C RCW pursuant to WAC 197-11-800 (1) (c) (iu) and the Spokane Envvronmental Ordinance 11.10.070 (i) (c). 6. The apphcant has been ma.de aware of the recommendations of vanous County agencies reviewuig this project and has indicated those recommendations are acceptable 7. The proper legal requuements for advernsing of the hearuig before the Zonuig Adjustor of Spokane County have been met, 8. No adverse testimony or written comments were received regarding the proposal 9. The proposed site plan indicates that setbacks, parlang and height of the structure(s) will confornn to the Zorung Code of Spokane County. Site visitation pnor to the hearuig indicated some apparent conflicts between the exishng situation and the proposed site plan Parking on the south side of the property, behind the chain luik secunty fence is shown on site plan as being parking available to the pubhc. At visitation on the day before the heanng, these parking places were occupied by stored rental equipment ui the form of tractors, trailonzed welder and two or three small flat bed trailers The handicap parlang stalls, handicap parking signs and regular parlang stalls ul front of the Sun Rental business were not as mdicated on the site plan. Landscaping at the edge of the street was possibly not completely in comphance, although, it was partially beneath pfles of snow and was difficult to &scem Adequate parkulg to accommodate the business genera.ted by the new addition seems somewhat in question as a result of this mspection. Addstionally, the amount of storage space shown on the site plan d~d not seem consistent wnth the number and amount of items presently stored outside of the store This issue needs to be resolved before a final occupancy permit is granted. 10. The Zorung Adjustor may require such conditions of approval as necessary and appropnate to malce the project most compati.ble wnth the pubhc mterest and general welfare. 11 Vanous performance standards and cntena are additionally needed to make the use compatible wnth other permitted acavities in the sa.me vicmrty and zone and to ensure against unposing excessive demands upon pubhc ualities, and these shall be addressed as conchhons of approval 12 The final comphance of the site with the Zone Code standards and the site plan rests with the building permit process DECISION From the foregoing Findings of Fact and Conclusions, the Zorung Adjustor APPROVES the proposal, subject to comphance with the following CUN•31-92 AI Walls /Sun Rental CA SE NO CUN-31-92 SPOKANE COUNTY ZONING ADNSTOR PAGE 3 CO1`1DI'I'IONS OF APPROVAY..
