TUE-3-92 . ~ BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT IllT THE MATTER OF A ZOIVING ) FINDINGS OF FACT, CERTIFICATE FOR A TEMPORARY ) CONCLUSIONS AND RECTIVFE USE PERMIT ) DECISION ~ TUE-3-92 JAN 07 1993 tE THIS MATTER, an application for a temporary use permit, from Mike Schneider has been received and decided upon, pursuant to the Spokane County Zoning Code regulations, on the 7th day of January, 1993. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Duector of Planning. 2. The proposal is to operate a drive-through espresso shop which is not generally permitted in the existing, Light Industrial (I-2) zone. The site contains an existing grocery store which is vacant. There is adequate paved parking. 3. The proposal is generally located east of and adjacent to Dishman-Mica Road approximately 500 feet north of Fourth Avenue in Section 20, Township 25 North, Range 44 EWM, Spokane County, Washington. 4. The existing zoning of the property described in the application is Light Industrial (I-2) previously established as Restricted Industrial in 1959 (ZE-16-59) and reclassified to Light Industrial (I-2) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. The applicant is also pursuing a zone reclassification to Regional Business (B-3) for the property to allow the use to continue beyond the expiration of the six month temporary use permit. 5. The Spokane County Comprehensive Plan designates this area as Major Commercial. The development and uses proposed are in accord with this category. 6. The required public norice was provided for this proposal and agencies having a potenrial interest in the project were norified and recommendations solicited. 7. Adequate access to the site is provided via Dishman-Mica Road with existing paved approaches. 8. Water will be trucked in. Restroom faciliries will be provided off site for employees. 9. Recognizing the recommended conditions and Spokane County temporary use standards, the proposed use makes appropriate provisions for the public health, safety and general welfare. 10. The project is not exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800. .An Environmental Checklist was provided by the applicant and reviewed by the Plannir ; Department. A Deternunation of Nonsignificance (DNS) was issued on December 11, 1992 for comment by other agencies. No comments were received. DECISION Based upon the above noted Findings of Fact and Conclusions, Temporary Use Application TUE-3-92 is hereby APPROVED. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. i . . ~ I FINDINGS AND DECISION TUE-3-92 Page 2 PLANNING DEPARTMENT CONDITIONS 1. The temporary use permit, as described for a drive-through espresso, is approved for the property legally described in the applicarion for this proposal. 2. The temporary use permit is authorized for a period of six months and is not renewable. The six month period shall begin upor+ the issuance of a building permit, if required by the Deparmnent of Buildings, or on the first day of operation and shall not extend past January 7, 1994. COUNTY ENGINEER'S DEPARTMENT CONDITIONS 1. The applicant should be advised that an approach permit must be obtained from the County Engineer prior to the construcrion of any new driveway approaches. This must be done prior to the release of a build.ing permit. 2. Because of the temporary nature of this permit no additional conditions will be applied, the applicant is in the process of securing a rezone for the site, at the time of rezone hearing additional review and conditions may be applicable. COUNTY HEALTH DISTRICT CONDITIONS 1. The applicant shall make contact with the Food Program Coordinator of the Environmental Health division for Health District requirements regarding the espresso drive-up booth. BUILDING AND SAFETY DEPARTMENT CONDITIONS 1. The issuance of a building permit by the Department of Buildings is required. The members of the Committee present are Harry Gibbons, Chairperson, Frank Yuse and Verona Southern PROPOSAL The sponsor, Gary Hite, requests approval of a Zone Reclassificaaon, ZE-1-92, from Light Industrial (I-2) to Regional Business (B-3) withui the Aquifer Sensitive Area (ASA) Overlay Zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property 1s generally located east of and adjacent to Dishman 1Viica road north of Fourth Avenue in the NW 1/4 of Section 20, Township 25 N, Range 44 EWM, Spokane County, Washington. 2 The comnuttee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area are commercial, industnal and residenaal 4. The Comprehensive Plan designates this site as Major Commercial. The Major Commercial category is for the purpose of intensive commercial development, specif'ically community and regional shopping centers. 5. The .Artenal Road Plan designates Dishman-1Viica Road as a Pnnciple Artenal, wnth a recommended nght of way wndth of 100 feet. The County Engineer has requested a 5 foot dedication of additionai nght of way. Fourth Avenue is designated as a Collector Artenal wnth a proposed nght of way wndth of 70 feet, To implement the Plan, the County Enguieer has requested a 5 foot futune acquisition area along Fourth Avenue 6. The existing zomng of the property described in the apphcaaon is Light Indusmal (I-2), previously established m 1991 7 The provisions of RCW 43 21 C(The State Environmental Pohcy Act) have been comphed with and a Deternunation of Nonsignif'icance was issued. 8. The legal requuements for pubhc notice have been fulfilled. 9. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. ' 10 The proposed zone reclassif'ication is compatible vnth existing commercial uses in the area.
