THIS MATTER, an application for a temporary use permit, from Mike Schneider has been
received and decided upon, pursuant to the Spokane County Zoning Code regulations, on the
7th day of January, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Duector of Planning.
2. The proposal is to operate a drive-through espresso shop which is not generally permitted
in the existing, Light Industrial (I-2) zone. The site contains an existing grocery store
which is vacant. There is adequate paved parking.
3. The proposal is generally located east of and adjacent to Dishman-Mica Road
approximately 500 feet north of Fourth Avenue in Section 20, Township 25 North,
Range 44 EWM, Spokane County, Washington.
4. The existing zoning of the property described in the application is Light Industrial (I-2)
previously established as Restricted Industrial in 1959 (ZE-16-59) and reclassified to
Light Industrial (I-2) on January 1, 1991 pursuant to the Program to Implement the
Spokane County Zoning Code. The applicant is also pursuing a zone reclassification to
Regional Business (B-3) for the property to allow the use to continue beyond the
expiration of the six month temporary use permit.
5. The Spokane County Comprehensive Plan designates this area as Major Commercial.
The development and uses proposed are in accord with this category.
6. The required public norice was provided for this proposal and agencies having a potenrial
interest in the project were norified and recommendations solicited.
7. Adequate access to the site is provided via Dishman-Mica Road with existing paved
approaches.
8. Water will be trucked in. Restroom faciliries will be provided off site for employees.
9. Recognizing the recommended conditions and Spokane County temporary use standards,
the proposed use makes appropriate provisions for the public health, safety and general
welfare.
10. The project is not exempt from environmental review under the State Environmental
Policy Act pursuant to WAC 197-11-800. .An Environmental Checklist was provided by
the applicant and reviewed by the Plannir ; Department. A Deternunation of
Nonsignificance (DNS) was issued on December 11, 1992 for comment by other
agencies. No comments were received.
DECISION
Based upon the above noted Findings of Fact and Conclusions, Temporary Use
Application TUE-3-92 is hereby APPROVED. This decision is final unless appealed in
writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.

PLANNING DEPARTMENT CONDITIONS
1. The temporary use permit, as described for a drive-through espresso, is approved for
the property legally described in the applicarion for this proposal.
2. The temporary use permit is authorized for a period of six months and is not renewable.
The six month period shall begin upor+ the issuance of a building permit, if required by
the Deparmnent of Buildings, or on the first day of operation and shall not extend past
January 7, 1994.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The applicant should be advised that an approach permit must be obtained from the
County Engineer prior to the construcrion of any new driveway approaches. This must
be done prior to the release of a build.ing permit.
2. Because of the temporary nature of this permit no additional conditions will be applied,
the applicant is in the process of securing a rezone for the site, at the time of rezone
hearing additional review and conditions may be applicable.
COUNTY HEALTH DISTRICT CONDITIONS
1. The applicant shall make contact with the Food Program Coordinator of the
Environmental Health division for Health District requirements regarding the espresso
drive-up booth.
BUILDING AND SAFETY DEPARTMENT CONDITIONS
1. The issuance of a building permit by the Department of Buildings is required.

HEARING EXAMINER COMMITTEE
INTRODUCTION
Tlus matter has come befvre the Hearing Examiner Committee on February 20, 1992.
The members of the Committee present are Harry Gibbons, Chairperson, Frank Yuse
and Verona Southern
PROPOSAL
The sponsor, Gary Hite, requests approval of a Zone Reclassificaaon, ZE-1-92, from
Light Industrial (I-2) to Regional Business (B-3) withui the Aquifer Sensitive Area
(ASA) Overlay Zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property 1s generally located east of and adjacent to Dishman 1Viica road north of
Fourth Avenue in the NW 1/4 of Section 20, Township 25 N, Range 44 EWM,
Spokane County, Washington.
2 The comnuttee adopts the Planning Department Report as a part of this record.
3. The existing land uses in the area are commercial, industnal and residenaal
4. The Comprehensive Plan designates this site as Major Commercial. The Major
Commercial category is for the purpose of intensive commercial development,
specif'ically community and regional shopping centers.
5. The .Artenal Road Plan designates Dishman-1Viica Road as a Pnnciple Artenal, wnth a
recommended nght of way wndth of 100 feet. The County Engineer has requested a
5 foot dedication of additionai nght of way. Fourth Avenue is designated as a
Collector Artenal wnth a proposed nght of way wndth of 70 feet, To implement the
Plan, the County Enguieer has requested a 5 foot futune acquisition area along Fourth
Avenue
6. The existing zomng of the property described in the apphcaaon is Light Indusmal (I-2),
previously established m 1991
7 The provisions of RCW 43 21 C(The State Environmental Pohcy Act) have been
comphed with and a Deternunation of Nonsignif'icance was issued.
8. The legal requuements for pubhc notice have been fulfilled.
9. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use. '
10 The proposed zone reclassif'ication is compatible vnth existing commercial uses in the
area. The site contains an existing, developed commercial shoppmg center.

11. The pmposed zaning does unplement and confonm to the Comprehensive Plan.
12. The apphcant has demonstrated that cancittions have substantially changed since the
original zoning of this area and accordingly, the pmposed zone reclassificanon is
justified.
13 The proposed zone reclassffication will not be detrimental to the pubhc health, safety,
morals or welfare.
14. The Committee additionally finds/concludes:
a. The site was devetoped as acomrnercial shopping center under the Resmcbed
Industnal (RI) zone of the Spokane County Zoning Ordinance. The zoning
redesignation on January 1, 1991 to Light Indusmal (I-2) under the "Program
to Implement" the Sgokane County Zonuig Cade unpacted this -commercYal site.
The Heanng Exananner Cc3mnutte.e recommends to the Board of County
Commissianers a 33 1/3°lo refund of all zomng reclassYficativn fees le granted
to the property owner due to the circumstances surmunding thYS existing
development

c. The site is currently served by pubhc water and sewer.

1. The proposal shall comply with the Regional Business (B-3) zone(s) as amended
2. The applica.nt shall develop subject property generally in accor+dance vvithin the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be pernritted, including, but not timited to budding
locadon, landscape plans and general allowable uses of the pennitted zone. All
variations mast conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approval is roquired by the Planning Director/designee of a spmfic lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be subnutted with a performance
bond for the gmject pnor to release of building peamits. Landscaping shall be
mstalled and maintained so that sight distance at access poults is not obscured or
impaired.
5. Direct hght from any exterior anea hghting fixture shall not extend over the property
boundary.
6. The Plannuig Department shall prepare and r+ecord with the Spokane County
Auditor a Tide Noace noting that the property in quesaon is subject to a vanety of
special conditions imposed as a result of approval of a land use actian. This Title
Notice shall seave as public notice of the cond.itions of approval affechng the
property u1 question. The Tide Noace should be recorded widun the same time
frame as allow+ed for an appeal and shall only be released, in full or in part, by the
Planrung Degamnent The Title Notioe shall generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action 6y a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of
special development conditions. File No. ZE-1-92 is available for
inspection and copying in the Spokane County Planning Department.
7. The Planning Department shall notify the Department of Building and Safety to
"flag" the subject property(ies) in order to tngger the required r+eview when a
btulding or change-in-use pernnit may be requested.
8. The Spokane County Plannmg Department shall prepare and record with the
County Audltioir a Tide Notice specifying a future land acquisition area for road
nght-of-way aBd ualities. The reserved future acquisition area. Title Notice shall be
released, in fuD or in part, by the Planrung DepartmenL The notice should be
recorded within the same rime frame as an appeal and shall provide the follownng•
a. At least five (S) feet of reserved future acquisition area for road nght-of-way
and utlhties, in addition to the existing right-of-way along Fourth Avenue
b. Future 1%iiding and other setbacks required by the Spokane County Zonmg
Code shall be measured from the reserved future acquisition area.

c. No requued landscaping, parking, '208' areas, drainfield or allowed signs
should be located wnthin the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "intenm"
unprovements at the time Spokane County ma.kes roadway improvements
after acquiring said future acquisrtion anea.
9. The Planning Department recognizes the non-conforiming elements of the existtng
site unprovements and will, as provided in the Zoning Code, implement the
RegYOnal Business (B-3) standards for any application for change in use or new
biulding pernuts

has been identified by the Spokane County Engineef s office as having stormwater
runoff problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning
and unplementation of a future basinwnde stormwater management system, The
followuig shall apply to this development proposal:
The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through pubhc heanngs for service or benefit obtained by the planning, design,
construcang, mamtaining or operanon of stormwater control facilities
5. No construction work shall be performed withui the exisdng or proposed pubhc
right-of-way until a pernut has been issued by the County Engineer. All work

nght-of-way deciication, a strip of property 5 feet in width along the Fourth Avenue
frontage shall be set aside in reserve. This property may be acquired by Spokane
County at the time when artenal unprovements are made to Fourth Avenue.
9. There may exist utilities, either undergmund or overhead, affectmg the subject
property, including property to be dedhcated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustrnents or relocanon
regarding these utihnes. Apphcant(s) should check with the applicable unlity
purveyor and the Spokane County Engineer to detennine whether applicant(s) or
the utlhty is responsible for adjusanent or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authonzed by the Director of Utiliaes, Spokane
County.
2. Water sernce shall be coordinated thnough the Director of Unlities, Sgokane
County.
3. Water senrice shall be by an existing public water supply when approved by the
Regional Engmeer (Spokane), State Department of Health.
4 A pubhc sewer system will be made available for the platlproject, and individual
service will be provided to each lot/tract pnor to sale. Use of individual on-site
sewage disposal systems shall not be authonzed.
