PUBLIC HEARING AND DECISIQN» After cvnsiderativn of all available informativn
on file, one or mare site visits, exhibits submitted and testimany received during the course vf
the public hearing held on actober 11, 1995, the Zvning Adjustvr rendered a wntten deeisian
an Nvvember 16, 1995 to APPROVE the application.
FINDINGS 1"JF FACT AND CONCLTJSIDNS
1. Testimony was taken under oath.
2. The proposal is described above and detailed in documents contaiaed in the file;
tnore particularly:
a. The pizza parlor, the outdvor dining area, fihe miniature golf area and the
m'tni-kiddie cart area (for children) presentiy exists. The nuniature golf area is a fenced
area accessible frvm the autdvor dining area by a gate and also accessibie from an
unpaved parking area at the rear of the facility (generally the west side vf the facility).
The miniature golf area contains a baoth with a.n vpenable window in vrder to gxve aut
golf materials and supplies. The mini-kiddie-cart area is a.lsv aecessible from the same
parking lot and not accessible directly frvm any controlled restaurant dining area. It does
nat have a ticket taking attendant booth; but, has an equipment shed. The mini-kiddie-
cart a.rea is fenced and it contains a gate appvsite the taol shed.
b. Testimany of the consultantlagent (Ramm Associates) was to the effect that the
applicant's interation was to allow vnly faod and dnnk customers af the pizza parlar to

utilize these facilities. Hawever, the Zoning Ad, justor's observation and camment was
that there appears ta be no assurart+ce that these facilitces cannc►f be run irrdependently Qnd
therefore generate there awn irQffie. The cancern expressed by the Z.aning Adjustor was
that this parking lat is presently unpavcd and if it is to be the primary parking place for
newly generated traffic, it falls under the paving requirements of the Zoning CQ+de. On
the other hartd, ~f the patrons o, f the miniature gotf aruul the kiddie-Gart area must be„foad
cacrxd drink cusxdmers, there is far less likely chance of u documentable increase in rraffic
and the paving of the remainder of the parking lot is not an issue befare th.e Zcxning
Adjustar. In respart,re to this concern, the agent for the prnponent will try to a&tain a
signed dacument indicating rhat food and drink eustomers are to be the only patrons of
rhe miniature gotf and kittdie-rart area. Awindow o}'time ufitil 4. 0Q p.m. on tile
Wednesday following the hearing {OcXober 18, 1995 deadtine} was established for such a
letter. Lacking such a Ietter or written cammitrnent, the outcorne of this decisiort m,ay
refleet a need to pave the unpaved portion of the parking area.
c. An exam.iriation of shart plat file SP-687-91 reveals a concern an the part of the
praperty vwner to the southeast, that lus property may be invaded or vandalizeci by
patrons of the miniatuare golf facility. Possibly in response to this, the applicant has
established a sight-obscuring 6-fvvt-tall fence along the southeasterly side of the vutdavr
eating area and the miniature goif area. This fencing also serves as a virtual solid screen
fvr the mini-kiddie-cart facility. It is apgrapriate and necessary that access tv these
cvmmercial recreation actiwities remain either a source through the restaurant or from the
parking lvt which is best described as the back or rear of the pizza parlor structure. This
will successfully vbscure and iikely keep patrons firom being tempted ta bother the
landscaping property to the southeast.
3. The adapted Spokane County Comprehensive Plan designates the area of the
praposal as industrial. The proposal is generally not consistent with the industrial categvey of
the Carnprehensive Plan hawever, the pizza parlor was and remains a 1ega1 non-confornung
use. The miniature golf use was added after the industrial zarung was in place and is presently
and unautharized nan-canforrning use. The mini-kiddie-cart area, as a propvsed activity would
be an unauthorized non-conforming use, but for a recent amendment to the Zoning Cvde which ~
allflwed c4mmercial recreation areas in Che I-3 zone. Thus, the approval of this conditional use
permit establishes the miniature gvif area and the mini-kiddie-cart area as lawful activities under
the Z,oning Cade section 14.634.24.5. and sectian I4.629.020 of the Zaning Code. A canflict
between aComprehensive P1an an+d a Zoning Ordixtance is resolwed in favor of the Zonin,g
Ordinance [Indian Trait Prop Ass'n v. Sppkane, 76 Wn. App. 430, 431 (1994)].
4. The site is zaned Heavy Industrial (I-3), which ailaws the proposed use upc3n
approval of this appliCativn.
5. The ex.isting land uses in the area of the progasal include business, cornmercial and
industrial, with alandscaping contractor to the southeast being pvssibly the most incompatible.
"Typically, uses listed as a cond.itional use are assumed as pemiitted in the underlying zane,
subject to the listed standards and any ather conditions needed to assure compatibility in the
given instance. But, pursuant tv 14. 404.141, the requested conditianal use permit may be
denied if the Hearxng Bady cannot fin+d that the requested use will be compatible with other
pernutted uses. Section 14.634 240.5 lists certain standards tv achiewe comgatibility, some of
which the Hearing Bady may exercise nominal discretian over in Qrder to achieve the vverall.

intent of compatibility with surrounding properties. Clearly, 14.444.102 allows the Hearring
Bvdy to impvse any and all manner of additianal conditians and requirements in an effort to
achieve maximum compatibility. In the instarit situation, cvncem has been exgressed (abvve)
that traffic, if any, generated uniquely as a result of both recreational areas rnay establish a need
tv pave the unpaved portion of the westerly parking lat.
b. a. Z'he appliGant pravided written assurance of the intention to a]low vnly use of
the recreatian areas by restaurant customers.
7. Pursuant to the State Environmental Folicy Act, the envixonmental ehecklist and
other data have been zeviewed and the groject has been found to na►t hawe any prvbable
significant adve:rse impacts to the physical environment. A. Determination of Nansignificance
(DNS) was issued an 5eptember 11, 1995 and sent ta 8 agencies. The agencies revievving the
checklist neither indicated that a more detailed envirvnmental review shvuld be prvvided nor
commented that the DNS shvuld be reconsidered. Comments regarding the enaironmental
matters were made nvt at the public hearing. There was not sufficient evidenee presented
pursuant to WAC 197-11-340(3)(a) to withdraw the DN5, The proposal is listed in the Zoning Cade of Spvkane Caunty as acvnditional use
allawed i.n the Heavy Industrial (1-3) zvne, and the propasa.l does meet the estabushed and
applicable criteria described for that conditional use.
9. Comments were received from several agencies.
a. Spokane County Water District Na. 3 ulitially stated a concern that the
businesses lvcated at this add.ress, alvng with a dwelling unit, were being served by the
same water meter service, whieh situatiaa violates their regulativns. This issue seems ta
haue been resolved by an agreement recentiy entered into, on October 10, 1995, wherein
the applicant agrees to bring the praperty into conformance with the Water District
regulations. The 2oning Adjustor is of the apinion that the pentuit should be inaalid if
this construction does not actually occur.
b, The Cvunty Engineer's office, the Division of Engineering and Roads,
expressed several cancerns with respect tv surface water disgosal, a parking plan and
traffic ciurculation plan and paving vr surfacing for unpave+d areas. The Division also
expressed cancern that the area is located in the fload hazard zone and that a flvod glaia
development permit must be obtained from the Division.
10. No advers+e testimany or written comments were reeeived regarding the propasal.
11. The applicant has been made aware of the recommendations of various Gvunty
agencxes reviewing this project.
12. The proper legal requirements for advertising the hearing before the Zorling
Adjustor of Spokane Caunry have been met.
13. The Zozung Adjustor may require such conditions of apprvval as necessary and
approgriate to make the project mvst compatible with ttie gublic interest and general welfare.

14. Varivus perfvrmance standards and criteria are additionally needed to make the use
compatible with other pemv.tted activikies in the salme vicinity and zone and tcr ensure against

DECISIGN
From the foregoing Findings of Fact and Conclusi4ns, the Zoning Adjustor
APPRUVES the prvposa.I, subject to compliance with t:he following CCINDITIONS QF APPRaVAL
1. GENEFCAL
I. The fQllawing conditions shall apgly tv the applicant, owner and successors in
interest ,aad shall nzn with the land.
2. Failure to cvmply with any of the conditions of approval contauled in this decision,
except as may be relieved by the Zoning Adjustor, shall constitute avivlation of the Zoning
Code for Spokane Caunry axad be subject to such enforcement as is appropriate.
3. The Zoning Adjustar may admi.nistratively make m.i.nor adjusitments to site plans or
the conditions af appraval as may be judged by the Zaning Adjustor ta be within the context of
the ariginal decisian.
4. The permit is effeetive immediately.
II. DIVISION QF BUILDING & PLANNING
1. The applicant shall cantact the Building 5ectivn af the Divisian of Building and
Plann.ing at the earliest possible stage of designldevelopment in order to be informed of Gvde

2. At sueh time as the pi2za parlar, wh.ich is subject tv this apphcation, allows use of
the miniatlue golf and mini-kiddie-cart area by other than foad and drink custvmers of the
restaurant, the issue of the westerly unpaved parking lvt will necessarily be dealt with, either as
a zvning enforcement issue +ar as an administrative adjustment tv this decision. Alternativeiy,
the unpaved IQt may be closed tv garking if adequate paved parking remains for the restaurant,
ature golf and the mi.ni-kiddie-cart area.
3. The proposal sha11 comgly with all applicable standards of section 14.634.240.5 of
the Zoning +C+Qde of Spokane Gounty unless deviations, variances or exceptic►ns have been
lawfully granted.
4, The I]ivisian of Building & Planning shall prepare and recard with the Spokane
County Auditor a Title Notice noting that the prQperty in question is subject ta a variety of
special conditions unposed as a result of approval of a land use activn. This Title Notice shall
serve as public notice of the conditions of approval affecting the prvperty in yuestion. The
Title Natice should be reevrded within the same t.ime frame as allawed for an appeal and shall
anly be released, in full or in part, by the Division of Building & Planning. The Title Natice
shall generally prQVide as folIows:

2. Sewage disgasal method shall be as authnrized by the Directar of Utilities, Spokane
Cvunty.
3. Water service sha11 be by a newlan existing publi+c water supply when approaed by
the Regional Engineer (Spakane), State Department of Health.
V. DIVISION QF ENGINEERING AND RUADS
1. Because of the commitment of the applicant to nvt generate new traffic by individual
operation of these two businesses, the fallowing cvnditions of apprQVa.l wiil likely not he

effective. However, if it is found that the proposal generates traffic unique to these two
recreational facilities, in addition to traffic normally generated by the restaurant, one or more of
the following conditions of approval may apply at the discretion of the Division of EngineerintT
and Roads.
a. A parking plan and traffic circulation plan shall be submitted and approved by
the Spokane Counry Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or surfacing a~
approved by the County Engineer, will be required for any portion of the project which i~
to be occupied or traveled by vehicles.
b. Roadway standards, typical roadway sections and drainage plan requiremclit~
are found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
c. Prior to the release of a building permit, change of use pernut or certificate of
occupancy or issuance of an approach pernut, the applicant shall submit road and -
drainage plans to the County Engineering Department for review and approval. Road an J
drainage plans shall be prepared in compliance with Spokane Cour~t v R(:V d a ii c' T~r,lin.lc
Standards. This condition may be waived by the County Enginee i-.
d. The following applies regardless of whether traffic may be uniquely and
separately generated by the recreational facilities:
e. The regulations of the National Flood Insurance Program shall be observed,
since the subject property is affected by a flood hazard zone. A development permit shall
be obtained from the County Engineer before construction or development begins within
any area of special flood hazard (reference Spokane County Ordinance 88-0251).
NOTICE: PENDING COMPLETION OF ALL CONDITIONS OF APPROVAL WHICH
NEED TO BE COMPLETED PRIOR TO PERMTT ISSUANCE, PERMITS MAY BE
RELEASED PRIOR TO THE LAPSE OF THE TEN (10)-DAY APPEAL PERIOD.
HOWEVER, THE COUNTY HAS NO LIABILITY FOR EXPENSES AND

The Spokane County Engineering Department has reviewed the above referenced
application. The .following comments are offered for inclusion in the
Findings and Order as "Conditions of Approval" should the request be
approved.
E19 The word "applicant" shall include the owner(s) of the property, his/her heirs,
assigns and successors.
E44 The applicant shall submit for acceptance by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan and
surface water disposal plan for the entire project or portion thereof if the
development is phased.
E45 A parking plan and traffic circulation plan shall be submitted and accepted by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard engineering practices. Paving or surfacing as
