WATER j 1^e l\I'L (i) of,6 SCALE 1"=20' 1/2- at/MPic AYEAlu£' STYLE HOME 3 FHA CASE NO. ot---/oe INDEMNIFICATION AGREEMENT WHEREAS, the Summerfield East First Addition Plan, sponsored by Ken Tupper has not yet been approved and the provisions of RCW Chapter 58.19 have not yet been complied with in regard to the plat; and WHEREAS, Ken Tupper has requested building permits be issued for concrete work on Lots 1 through 8, Block 5 and Lots 1 through 7, Block 6 of Summerfield East First Addition in order to commerce construction and thereby ensure HUD funding will be available; and WHEREAS, Jim Manson, Director of the Spokane County Building and Safety Department has determined that pursuant to RCW 58.17.210 the public interest will not be adversely affected by issuance of the building permits under certain terms and conditions; NOW, THEREFORE, BE IT AGREED that the Spokane County Building and Safety Department will issue building permits for Lots 1 through 8, Block 5 and Lots 1 through 7, Block 6, of Summerfield East First Addition, for concrete work only, in accordance with Spokane County Code Section 3.04.100 on the condition that: (1) The permits are approved by all County depart- ments reviewing them; and (2) No work beyond that allowed by the permit shall be undertaken; and (3) Ken Tupper agrees that he, his successors and assigns at all times shall indemnify and save harmless the County, its successors and assigns, against any and all claims, suits, actions, debts, damages, costs, charges, and expenses including court costs and attorneys' fees, and against all liability, losses and damages of any nature whatsoever, that the County shall or may at any time sustain or be put to by reason of the issuing of building permits set forth above prior to the Summerfield East First Addition Plat being approved; and (4) Ken Tupper shall waive all claims against Spokane County and not bring any action, legal or equitable, against Spokane County arising out of the issuance of building permits set forth above or in the event the Summerfield East First Addition plat is not approved for any reason whatsoever. (5) Ken Tupper agrees that at the option of Spokane County Ken Tupper shall defend at his own expense any claims brought against Spokane County with respect to the subject of this agreement, whether such claims or actions are rightfully or wrongfully brought or filed. Ken Tupper states that he has carefully read this agreement, knows and accepts the terms and conditions placed on the building permits herein and that he has signed this agreement as his own free act and deed.
