Various perforniance standards and criteria are additivnally needed tv make the use compatible with other pennitted activities in the same vicinity and zane and to ensure against impvsing excessive demands upvn gulalic utilities, and these shall be addressed as cvnditions of approval. 11. Immmediately east of this prvgasal, on Robie Road, there are two buildings that were granted f'ront yard variances tv establish the buildings only ten feet fiom the right-of-way line. T'his praposed addition is generally vn the same north-south building line as the existing tavern building on-site as well as the commercial building ta the nvrth across the alley. The variance would allvw a 28' frant yard setbacFc fvr the proposal. Many residences in the area at the time of construction were only required to be setback 25'. All of the above create special circumstances which if the variance wasn't appraveci, wauld be putting a limit vn this propert}r which would be incansistent with the limitation upon other properties in the vicinity, 12. Parldng is currently a problem on Robie Road in front of the existing tavern. This has been pointed vut by resxdents in their petition as well as the County Engineers +CJffice in the Fre-application Canference of July 30, 1990. The prahibitivn of parkin.g an the frant yard would be in the best interest of public safety frvm a aafflc circulation standpaint. 13. GENERAL 1. The following conditions shall apply to the applicant, owner and successors in interest and shall run with the land. 2. Failure to comply with any of the conditions of approval contained in this decision, except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning Code for Spokane County and be subject to such enforcement as is appropriate. 3. The Zoning Adjustor may administratively make minor adjustments to site plans or the conditions of approval as may be judged by the Zoning Adjustor to be within the context of the original decision. II. PLANNING DEPARTMENT 1. This parcel shall not be further subdivided unless consistent with RCW 58.17, the various county subdivision regulations and the Spokane County Comprehensive Plan for the area. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variations, when approved by the Planning Director/designee, may be pernutted, including, but not limited to building location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Zoning Code for Spokane County, and the original intent of the development plans shall be maintained. 3. The applicant shall provide a minimum five foot type III landscaping inside and adjacent to the new right of way line of Robie Road per the five foot right of way dedication. 4. The applicant shall assume, by whatever means available and approvable by the Planning Department that there will be no parking in the front yard or county right of way. Such means could include signage, landscaping berm of such height to negate parking, fencing, a wall or a barrier. 5. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits.
