KNOW ALL MEN 8Y THESE PRESENTS, That Irene Mas.nes, a single person,
being the owners of the fOllowing desaribed lands in consideration of Mutual
eenefits to be hereafter derived do for themeelvee, their heire, qranteee and
aseigne, hereby agree to the followinq:
There may be a need in the future to conatruct a public road to eerve the
lande herein described. Said road ehall be conetructed in accordance with
the then adopted County road etandarde for public roads. Said road to
follow, ae near ae practicable, tbe exieting County road riqht of way.
Zf additional right of way ie required, the ownere, their heire and/or
aseiqns agree to deliver to Spokane County a properly siqned and executed
Right of Way Deed coverinq the required additional riqht of way.
The owner(e) or eucceeeor(e) fn intereet agree to authorize Spokane County
to place their name(e) on a petition for the fcrmation of a Road
Improvement Dietrict (RID) by the petition method pureuant to Chapter
36.88 RCW, which petitioa inaludee the owner(e) property, and further not
to object, by the eigninq of a ballot, or not to proteet to the formation
of a RID by the reeolution method pureuant to Chapter 36.86 RCW, which
resolution inoludee the owner(e) property. It a RID ie formed by either
the petition or reeolution mstbod, ae provided Por in Chapter 36.88 RCW,
the owner(e) or euaaesaor(e) further aqree: (1) that the improvemente or
conetruction contemplated within the propoeed RtD ie feaeible, (2) that
the benefite to be derived from the fos-mation oP the RID by the property
included therein, together with the amount of any County participation,
. exceeds the coet and expense of formation of the RID, and (3) that the
property within the propoeed RID is eufficiently developed. Provided,
further, the owmer(e) or eucceesor(e) ehall retain the right, ao
authorized under RCW 36.88.090, to object to any aseeeament(s) nn tha
property as a reault of the iraprovemente called for in conjunqtion with
the formation of a RID by either petition or reeolution metTiod uncler .
