reqiures a muiunum of 65 feet of frontage on a public road Authonty to consider such a

FINDINGS OF FACT AND CONCLUSIONS
1 Ile proposal is generally descnbed above The action by the apphcant to estabhsb
several parcels, and parncularly the one which is the subject of tlus apphcation, is with the
mtennon of prepanrig a larger ownership of land for eventual subdivision The cr+eanon of this
pamcular landlocked parcel will locate rt on a future pubhc road. In fact, the County
Enguieer's recommended that a Tract 'X" Future Pubhc Road be extended to ttus parcel of land
from the south on the extension of Vencler Road At a later time 13th Avenue will be extended
from the west to front on the south side of the subject parcel In the meantime, the apphcant
will maintain a larger ownerslup adJacent to his current residence In tlus respect the current
proposal establishes an opportunity for the effecave, efficient development of this area at some
point in the future
2 The adopted Spokane County Comprehensive Plan designates the area of the
proposal as Urban The proposed uses are generally consistent with this category
3 The site is zoned Agncultural Suburban, which allows the proposed use upon
approval of this applicahon

CONDITIONS OF APPROVAL
The followuig condiaons shall apply to the apphcant, owner and successors in interest

I. PLANNIIVG DEPARTMENT
1 The front yard area shall be from the south property line to a line 30 feet north of
that property line
2 Thss parcel shall not be further subdivided unless consistent with RCW 58 17, the
vanous county subdhvisions regulations and the Spoka.ne County Comprehensive Plan for the
area
3 Pnor to the issuance of any bwlding pernuts, the apphcant shall file wnth the
Planning Department a copy of the segregation application necessary to recogiuze the subject
property as an individual tax parcel, except that ttus condition shall not apply if the pamel is
presently estabhshed wnth a parcel number
4 The east and west property hnes shall be considered side property lmes and the
north property luie shall be considered a rear property luie

easement servuig the parcel(s) should be designated as a Tract "X" Future Public Right-of-Way
TracL In order to accomplish tius, the apphcant must sign "Spokane County Notice To The

A) The pnvate road shall be constructed m accordance wnth Spokane County
standanis for Future Pubhc Right-of-Way Tract "X "
B) Should Spokane County be requested to create a Road Improvement Distnct for
the purpose of unprovmg the pnvate road easement to a pubhc road standard,
the apphcant agrees to dehver to Spokane County the nght-of-way necessary
for a pubhc road.
C) The apphcant agrees to join ui and not oppose the creation of a Road
Improvement Ihstnct (RID) or Counry Road Project created for the purpose of
improving the pnvate roa,dway to a public raad standard
D) Serves noace to future property owners that Spokane County is not responsible
for pnvate roadway construcaon, maintenance, snow removal or any other
services on the pnvate road.
2 The pnvate road must be named and signed in accordance with the provisions of
Spokane County road standards

to Spokane CounCy the then estimated coet of the required improvements to enable the
County to complete the same; or furnish a bond or other secure method suitable to
the County, providing for or securing to the County the actual construction of the

Timing of the formation of Satct RID or other road improvement pro,ject
shall be determined by Spokane County consfstent with KCW 36 88 The
street improvement authorfzed by the RID or other improvement pro,ject
shall call for the improvement of Tract "X" and its immediate street
system to at least the minimum Spokane County Road etandards applicable to
Tract "X" and the immediaCe street system at the time the RID, or other
road improvement project is constructed. If a majority of the property
owners desire a higher standard of consCruction, e g., gutters,
underground drainage, etc., that sCandard shall prevail.
Any building constructed on any parcel abutting Tract "X" shall be set
back from the Tract "X" boundary by that distance which equals the set
back requirements of the zocte.

The RID waiver contained in this agreement shall expire after ten (10)
years from the daCe of execution below. Nowever, aC the expiration date
the owner(s) or successor(s) agree to construct the required improvements
at their own expense; pay to Spokane County the then estimated cost of the
required improvementa to enable the County to complete the same, or
furnish a bond or other secure method suitable to the County, providing
for or securing to the County the actual construction of the improvements
Spokane County has no responsibility to build, improve, maintain or
otherwise service the private roads contained within or providing service
to the lands herein described. By allowing a building permit to be issued
on property on a private road, Spokane County assumes no obligations for
said private road ancl the owners hereby acknowledge that the County has no
obl.tgation of any kind or nature whatsoever to establisti, examine, cur%ey,
cotistruct, alter, repair, improve, maintaiii, provlde drainage or snow
removal on a private road
The above conditions and covenant apply to the following desctibed property
The East 92 feet vf the South 145 feet of the North 323 feet of the East
Half (E0 of the Southwest Quarter (SWI) of the Southeast Quarter (SEJ)
of Section 22, Township 25 North, Range 44 E W M, TOGETHER WITH the West
33 feet of the South 145 feet of the North 323 feet of the Southeast
Quarter (SEI) of the Southwest Quarter (SWI) of said Section 22

I have attached a drawinq showing a profile of the existing
driveway approach for Tract "C" of Case No. VE-27-90, which
starts at 14th and Vercler and runs 195 feet north.
The topoqraphy and length of the area proposed for access does
not pose any problems for qrade or drainage as a gravel road. as
per our conversation on March 8th, no other calculations are
neccessary at this time.
Please let me know if there is anything else that we need to do
