APPLICATION DESCRIPTION The applicant proposes to demolish exlsting garage/shed
of 32' - 1' and rebuild a new metal built garage 6 feet longer (38' - 1") Both the existing
and new buiiding are only 2 5 feet from the side yard, whereas, section 14 616 325 B 2 of
the Zoning Code of Spokane County requires a mmimum side yard setback of 5 feet for each
story of building Authorjty to consider such a request exists pursuant to section
14 404 080 of the Zoning Code for Spokane County and Spokane County Board of County
Commissioners resolution No 89 0708, as may be amended

PUBLIC HEARING AND DECISION After oonsideration of all available information on
file, exhibits submitted and testimony received durmg the course of the public hearing heid
on March 25, 1992, the Zoning Adjustor rendered a written decision on April,,?J, 1992
to APPROVE the application as set forth in the file documents and as conditioned below
FINDINGS OF FACT AND CONCLUSIONS
1 The proposal is described above and detailed in documents contamed m the file
2 In compliance with RCW 36 70 450, the Planrnng Department determmed that
this proposal is generally consistent, as oonditioned, with the urban category of the
Comprehensnre Plan
3 The sne is zoned UR-3 5, which allows the proposed use upon approval of this
application
4 The predominant existing land uses in the area of the proposal are single family
resrdences, includmg 6 situations m the same subdNision of 2' - 3' side yard garage
setbacks, all of which are compatible with the proposal
5 The proposal is exempt from the provisions of the Washmgton State
Environmental Policy Act, Chapter 43 21 C RCW pursuant to WAC 197-11-800 (6) (b)
6 The applicant has been made aware of the recommendations of various County
agencies reviewmg this project and has indicated those rec;ommendations are acceptable

complicating a properly setbadc double garage Additionally, existing fencing from the house
to garage site and a two-level back yard with a rock retaining wali complicate a lawfully
setback garage None of the above existmg improvements are the applicant's initiation, that
is, he purchased the property with exfsting Improvements
12 The garage shali have the lowest possibie profile consistent with a low side wall
appearance
13 With the conditions of approval set forth below, the vanance will a) not
constitute a grant of special privileges inoonsistent with limitations on other properties in
the vicmity and similar zone, b) ensure that the intent and purpose of the Zornng Code is
achieved with regard to location, site design, appearance, landscaping, etc, and c) protect
the environment, public interest and generai welfare
DECISION
From the foregomg Findings and Conclusions, the Zornng Adjustor APPROVES
the proposed 2' - 6" (south) side yard setback for a garage as generally set forth m the file
documents, subject to oompliance with the foilowing
CONDITIONS OF APPROVAL

1 The foliowing oonditions shall apply to the appljcant, owner and successors in
interest and shall run with the land
2 Failure to oomply with any of the oonditions of approval contamed m this
decision, except as may be relieved by the Zornng Adjustor, shall oonstitute a violation of the
Zoning Code for Spokane County and be subject to such enforcement as fs appropriate
