OPPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After consideranon of all available uiformaaon on file, exhibits submitted and testimony received duruzg the course of the pubhc heanng held on January 13,1993, the Zonuig Adjustor rendered a wntten decision on February , 1993 to APPROVE the apphcation as set forth in the file documents and as condinoned be ow FINDINGS OF FACT AND CONCLUSIONS 1 TestUmony was taken under oath 2 The proposal is descnbed above and detailed in documents contauned in the file 3 In comphance wnth RCW 36 70 450, the Planning Department deterrmined that this proposal is generally consistent, as cond.itioned, with the Urban category of the Comprehensive Plan 4 The site is zoned UR-3 5, which allows the proposed use upon approval of this apphcation 5 The eansting land uses in the area of the proposal mclude smgle famuly readennal propernes in all directiQns, all of which are companble with the pmpwsal 6 The proposal is exempt from the provisions of the 'VVashmgton State Envimnmental Pohcy Act, Chapter 43 21C RCW pursuant to WAC 197-11-800 (6) (b), however, the proposal would requme SEPA review at the bwldiag permit stage and the Planning Department assumed the SEPA role for the Bwlding DepartmenL Pursuant to the State Eavuonmental Pohcy Act, the envmnmental checkhst and other data have been reviewed and the project has GASE NO VE-37-92 SPOR:ANE COUNTY ZONING ADJUST'OR PAGE 2 been found to not have any probable signficant adverse unpacts to the physical environment A Deternunanon of Nonsignxficance (DNS) was issued on December 10, 1992 and sent to 7 agencies The agencies revxewing the checklist neither indicated that a more detailed environmental review should be provided nar commented that the DNS should be r+econsidered Cotnments regarding the envmnmental matteTS were not made at the pubhc hearmg There was not sufficient evldence presented pursuant to WAC 197-11-340(3)(a) to vsnthdraw the DNS ? The reasons for granting the vanance, as setforth by the apphcant, are as follows a added height allows compatibihty vvith adjacent chstncts for mteraes to provide unproved pressure, fire flows and generally better service, b added height nmplements the Spokane County Coordinated Water System Plan, October,1989, and the Comprehensive Watcr PIan for Modern Electnc Water Company; and c construction of a 125 foot tall tower would do neither of the above, thus resulting m connnued uzfenor servxce 8 Section 14 404 082 of the Zonuig Code addresses the requirements for granttng a variance " 1 Any vanaace from the terms of the Zorung Code shall be sub~ect to such conditions as will (a) ensure that the adJusanent shall not constitute a grant of special pnvilege inconslstent with the Imutations upon other propernes m the vicuuty aad similar zone classif'ication in which the property is siiuated, (b) ensure that the intent and pwrpose of the Zoiung Code is maintained wnth regard to location, site design, appearaace, landscaping and other features of the proposal, and (c) protect the environment, pubhc mterest and general welfane, and that the following circumstainces are found to apply a Because of special cucumstances apphcable to the property, lncluding size, shape, topography, location or sunrounduigs, the stnct application of the Zonuig Code creates practical dffficulties and is found to depnve the property of nghts and pnv2leges enjoyed by other prnperaes m the vicuuty and smular zone classification, and b That the granting of the vanance will neither be matenally detnmental ro the pubhc welfue nar mjunous to the property or improvements in the vicuuty and zone w which the property is located 2 The followuig, while not to be considered as sole substantiation, shall be considered m the grantmg of a vananee a Stnct apphcaaon of the Zonuig Code standard(s) creates an unreasonable burden in hght of the purpose to be sErved by ttus Code, VE-37-82, Modem Eleqric . . CASE NO VE-37-92 SPOKANE C4UNTY ZONIIVG ADNSTOR PAGE 3 c A broader pubhc or community need or mterest will be served by granting the vanance as opposed to denyuig the apphcanon 3 The granting of a vanance generally should not b Estabhsh a precedent which will adversely affect the zomng concept for an area or the county as a whole, c Be substanually based upon a lack of reasonable econonuc return or a claun that the existing savcture is too small, d Be mconsistent with the general purpase and mtent of Spokane County's comprehensive Plan, f Result m a de facto zone reclassificauon, or g Be substantially far the purpose of cucumventing density regulations designed to protect groundwater 4 For the purpose of umplementation of Secuon 14 404 082 of this Code, the followuig terms and concepts shall have the following meaning e ?ractical diff'iculties" are one or more of any number of differences in pnvileges charactenstic of a property due to a combmanon of special cmumstances and the standards of Zomng Code Provided, T'hat a practical ddficulty u may be the gross resmction ar preemption of uinovaave ar state-of-the- art technology not anticxpated by the drafters of this Code " (Parqal cttanon) 9 The apphcant's pnoperty at tlus location is fully developed with an eJUSting pump house and transfanner station and the exisung water tower (proposed to be demolished after construction of the new one) The eastern pamon of the property is/will be two vacant lots as a buffer east to 14th Avenue The only use for this property, short of a total relocation of all existtng unprovements, is to continue as 1ts present function. The present functaon is oneated toward providing water seivice for customers throughout the service area. 10 One of the major ob3ecnves of tlus proposal is to increase the wat,er pressur+e ttiroughout the much of the water service area far the apphcant company Construction of the taller tower presents a gneater "head" for water pressure It also bnngs the hydraulic level of water to a Ievel comparable to surrounduig water distncts, thus, greatly unprovuzg the possibihnes and opparduuties for exchange of water as may be needed to meet emergency needs, includuig low water pressure dunng certa,ui penods of the year and extra-needed water volumes and pressures for fne fighting purposes 11 Rohan, in Zomne and Land Use Controls, § 43 02 [5], states that over the years a number of factors have been considered by courts with respect to granting vanances. These VE-37-92, Modem Electric > CASE NO VE-37-92 SPOK:ANE COUNTY ZONIlVG ADNSTOR PAGE 4 include (1) whether stnct compliance with the temas of the ord.uiance will preclude a pernaitted use from beuig pursued, (2) whether the land will yleld a reasonable retuin, (3) the degree to wluch, the apphcant seeks to vary firom the onhnance, (4) the degree of harm which anll be unposed on the swrrounchng area if the vanance is granted, (5) whether some other method can be pursued to avoid the need for the vatiaace, (6) whether the difficulty is self unposed, and (7) whether the mterest of jusace and the general welfare will be served Rohan contlnues thax no factor alone controls and all must be considered. It is a balancing act of the compeang mterest between the landowner and the commuruty, as expressed through the zonuag document 12 After examuung the vanous cntena cited in number S above and using Rohan's 'balancmg act; the Zomng Adjustor concludes the followvzg a Vanance request is not a classic one in which the property is depnved of some pnvileges However, the need to consider deviating from the regulations qualifies very well m seveFal other areas b Considertng the unlque nature of the apphcant, a water distnct, rts request to maintain proper water pressure and better serve its customers, wlule at the same time intertieuig effciendy and effectively with neighborulg dzstncts is of paramount unportance It can best be achieved through a deviation from the 125 foot maximum c The pubhc mterest and general welfaze will be best served by granting the vana.nce d Nothing suggests that granting the vanance will be matenally detmmental to pubhc welfare nor injunous to property improvements in the vicinity e Stnctly applyuig the Zonuig Code standard creates an unreasonable, possibly unsafe, burden in hght of the purpose to be served by the Zorung Code and ttus height standard f A broader pubhc ar commumty need or mterest will be served by granting the vanance as opposed to denying iL g Granting the vanance will be consistent with the general purpose and untient of the County's Comprehensive Plan, the Coordinated Water System Plan and the Distnct's comprehensive plan h The "practical difficulty" being overcome by the apphcant's request for a vanance is ia response to a pruicipal of hydraulic design to achieve certain Tmnimum water pressures and promote coor(hnauon between water distncts, a pmncipal not anticipated by the drafters of the Zonng Code when they unpased the 125 foot height limitation for pubhc utthty transnussion facihty 13 As the Zoiung Adjustor considered all the facts, testimony, relevant case law and instructive usefulness of Rohan's Zonmg and Land Use Controls~ it is concluded that the balancuig test of competmg mterest hes with approving the vanance VE-37-92 Modem Eledric CASE NO VE-37-92 SPOKANE COUNTY 7ANIlVG ADNSTOR PAGE 5 14 The Planning Department perfcmned the State Envuonmental Pohcy Act (SEPA) responsrbilities noanaUy to be performed by the Btulchng Department at the Buil&ng Pemut stage The Determination of Nonsigruficance was issued by the Plannuig Department on December 10,1992 No uifozm,ation was received sufficient to cause that Determuiation of Nonagiuficance to be vvithdrawn The Department of Ecology, commented about its concern about any possible erosion dunng construcaon The Department requested that temporary measures necessary to control erosion and sdtation to natural drainage ways be implemented dunng the construction phase 15 The apphcant has been made aware of the recommendations of vanous County agencies reviewing ttus project 16 The proper legal requmments for advemsuig of the heanng before the Zotung Adjustar of Spokane County have been met DECISION From the foregoing Finduigs and Conclusions, the Zomng Adjustor APPROVES the prvposal as generally set forth in the file documents, subject to camphance with the followuig CONDITIONS OF APPROVAL I. GENERAL 1 The followuig condiaons shall apply to the apphcant, owner and successors in mterest and shall run with the land 2 Failure to comply vcnth any of the conditions of approval contained ia ttus decision, except as may be reheved by the Zorung Adjustor, shall consutute a violanon of the Zonag Code for Spokane County and be subject to such enforcement as is appropnate 3 The Zorung Adjustor may admuustratively make muiar adjustments to site plans or the conditions of approval as may be judged by the Zonung Adjustor to be witlun the context of the onginal decision H. PLANNING DEPARTMENT 1 The apphcant shall develop subject property generally in accordance with the concept presented m the Hearuig Baly Vananons, when approved by the Planning Director/designee, may be permitted, mcludhng, but not lumted to structure locanon, landscape plans and general allowable uses of the permitted tione All vanations must conform to regulations set forth m the Zonuig Code for Spokane County, and the onguial intent of the develapment plans shall be maintained. 2 Subsequent to construction and demohtion, seeding and landscaping sufficient to control erosion shall occur VE-37-92.
