self-service carwash, m the Neighborhood Busmess (B-1) zone 2 The srte is located at the northeast comer of the mtersection of State Route No 27 (Pines Road) and Third Avenue, in the NW 1/a of Secfiion 22, Townslup 25 North, Range 44 EWM, Spokane County The site address is 205 S Puies Road 3 The srte is currently referenced as County Assessor's tax parcel nos 45222 0538 and 45222 0539, and is legally descnbed ui an attachment to the condltional use pemut apphcahon 4 The apphcant for the proposal is CLC Associates, c/o Dwight Hume, 707 W 7th Avenue, Swte 200, Spokane, WA 99204 The site owner i.s Joseph Ward, 717 N Pmes Road, Spokane, WA 99206 5 The Heanng Examiner visited the site on September 4, 2002, and held a public heanng on the proposal on September 4, 2002 The requuements for nobce of pubhc hearuig were met 6 The Heanng Exammer heard the apphcahon pursuant to the County Heanng Examiner Ordlnance (County Resolutton No 96-0171) and the County Heanng Examiner Rules of Determination of Nonsiguificance for the proposal on August 21, 2002 9 The Heanng Examuier takes notice of the County GMA Comprehensive Plan, Phase I Development Regvlations, County Resoluhon Nos 2-0037 and 2-0470, the County Zorung Code, the County Code, other apphcable development regulations, and recent land use decisions in the area. 10 The record includes the documents in File No CLTE-4-02 at the time of the pubhc heanng, the documents and testunony subnutted at the public hearing, and the items taken nohce of by the Heanng Exammer 11 On July 8, 2002, the apphcant subnutted a complete apphcation to the County Division of Planrung for the proposed condihonal use permrt 12 The site is approximately 12 acres in size, square in shape and flat m topography The west half of tlie site is developed wrth a concrete ornamental manufacturing and sales business, including a large display yard and a residence used as an office The east half of the site is undeveloped The site is accessed from both SR-27 and Third Avenue, and is served with pubhc sewer and water 13 In 1978, the zoYUng of the srte was rezoned to the Local Busmess zone, under the now expued County Zomng Ordinance, for development of a 2-story, retall commercial building The rezone required that the site be developed m substanhal conformance vvith the srte plan for such development, and unposed other condihons of approval See decision in File No ZE-185-77 14 On January 1, 1991, the zonuig of the srte was reclassified to the Neighborhood Busmess (B-1) zone, pursuant to the Program to Implement the Spokane County Zonuig Code The Program to Implement preserved conditions of approval unposed by pnor rezones, to the extent that such condihons were more resmchve or specific than the new zone See County Resoluhon No 85-0900 15 Effecnve January 15, 2002, the County adopted a new Comprehensive Plan ("GMA Comprehensive Plan"), Capital Facihhes Plan, County Urban Growth Area (UGA) boundanes, and Phase I Development Regulahons, all pursuant to the State Growth Management Act Such action also repealed the intenm development regulahons previously adopted by the County under the State Growth Management Act See County Resoluhon No 2-0037 On May 7, 2002, the County made ttunor text revisions to the Phase I Development Regulations See County Resoluhon No 2-0470 16 The Phase I Development Regulahons designate the srte and land lymg south and west of the site along SR-27 in the Mixed Use category of the GMA Comprehensive Plan The land lyuig northerly of the site is designated m the Regional Commercial category, and the land lying east of the site is designated in the Medium Density category of the GMA Comprehensive Plan HE Fmdings, Conclusions and Decision CLJE-04-02 Page 2 A ~ The Phase I Development Regulahons designates the area in the Urban Growth Area, and retained the zoiung of the site and neighboruig land designated m the Mixed Use category 17 A complete applicanon for the condihonal use permit was submitted on January 22, 2002 A 1-bay, self-service car wash is permitted as a condihonal use m the B-1 zone, subject to specific development standards 18 The srte plan of record subnutted on June 21, 2002 illustrates development of a 3,250- square foot, 17-foot, 2-mch ta11 convenience store, gas fuel islands covered by a 24-foot tall canopy, vvith five fuel pump dispensers and underground storage tanks, and an 840-square foot carwash located between the convenience store and the east property luie Cars would enter the carwash from the north and exit from the south, with pnmary egress being via Thud Avenue The carwash is intended to complement the convenience store and fuel dispensing facihty on the site The site would be surfaced in asphalt Reqwred penmeter landscaping would be installed, ' and an 8-foot tall, sight-obscunng fence would be constructed along the east property hne 19 The land lymg north of the site is zoned Urban Residenhai-3 5 and Light Industnal(I-2), and is zoned Regional Business (B-3) further to the north near and adjacent to Sprague The land lymg dzrectly north of the site consists of an abandoned railroad nght of way conveyed to Spokane County, which contams a sewer interceptor and is planned for use as a future one-way roa.d nght of way The land lymg north of the nght of way is developed for commercial uses 20 The land lymg east of the site is zoned Urban Residential-22 (UR-22) The land lymg dhrectly east of the site is developed wnth a single-fanuly home, wlule the land lying further to the east is developed wnth apartments The land lymg directly south of the site is zoned UR-3 5 and developed wnth a single-family home Some UR-7 zoiung is found southeast of the site Commercial uses donunate SR-27 m the vicuuty 21 Sprague Avenue, and SR-27 to the north, compnse major transportahon and commercial comdors in the Spokane Valley area The County Artenal Road Plan designates Sprague Avenue as an Urban Principal Artenal 22 The only concerns regarduig the proposal were subtrutted by the owner of land located a few lots southeast of the site, wluch land is zoned UR-22 and developed for mulh-family dwellings Such owner expressed concern regarding increased traffic along Third Avenue, and impacts on pnvacy and noise 23 Informanon provided by the applicant at the public hearing estabhshed that the car wash wdl generate httle traffic east of the site, due to the dead-end nature of Third Avenue to the east County Engineeruig found that the proposal would have little traffic unpact and would not alter traffic flows or volumes in the PM peak hour County Enguieeruig condihons reqture the apphcant to widen Tlurd Avenue, and add curb and sidewalk, along the frontage of the site 24 County Planning conditions requue the proposed car wash to comply wnth the maxunum noise levels estabhshed by chapter 173-60 WAC The fencing and landscapi.ng proposed by the HE Fmdings, Conclusions and Decision CUE-04-02 Page 3 A ~ apphcant, the proposed height of the car wash, and the design of the proposal, adequately buffer the proposal from neighboruig properhes The B-1 zone is the least intensive commercial zone in the Zonmg Code 25 The Staff Report adequately analyzes the consistency of the condihonal use permit with the GMA Comprehensive Plan, the standards of the B-1 zone for a conditional use pernut for a 1- bay, self-sernce car wash, the general development standards of the B-1 zone, and the cntena for issuing condinonal use permrts contauled in the Zorung Code The Examiner concurs wnth such analysis and hereby incorporates such analysis by reference as fin(hngs of fact herein 26 No public agencies opposed the proposal As conchtioned, the proposal wnll be reasonably compahble with neighbonng land uses and vvill not have a sigiuficant adverse unpact on the envuonment ~ Based on the above findulgs of fact, the Heanng Examiner enters the following II CONCLUSIONS OF LAW 1 The condinonal use pernut apphcahon conforms to the GMA Comprehensive Plan 2 The proposal, as condirioned, is consistent wnth the purpose and intent, the standards for a 1-bay, self-service caz wash, and the general development standards of the B-1 zone, the Spokane County Zorung Code, the Phase I Development Regulahons, and other apphcable development regulahons 3 The proposal, as conchtioned, is reasonably companble wrth other uses pernutted in the B-1 zone or located m the vicuuty of the proposed use 4 The proposal, as conchtioned, reasonably mingates any adverse unpacts on adjacent properties by reason of use, extension, construchon or alteration allowed with respect to the condihonal use 5 The proposal, as conchtioned, will not have more than a modera.te effect on the quahty of the environment The requ.irements of the State Environmental Pohcy Act and the County's Loca1 Environmental Ord.nance have been met 6 The proposal, as condihoned, satisfies the reqturements for issuance of a condihonal use permrt under chapter 14 404 of the County Zonuig Code 7 Approval of the land use apphcation, as conditioned, is appropnate under secrion 11 of the County Heanng Exanuner Ordinance, as adopted by County Resolution No 96-0171 HE Fmduigs, Conclusions and Decision CUE-04-02 Page 4 . ~ III DECISION Based on the above Fmduigs of Fact and Conclusions of Law, the apphcation for a condihonal use permit for a 1-bay, self-service car wash, in the Neighborhood Business (B-1) zone, is hereby approved, subject to the condihons of approval specified below Any public agency conditions that have been sigruficantly altered or added to are itahczzed Failure to comply with the condihons of thus approval may result in revocation or suspension of tlus approval by the Hearuig Examiner This approval does not waive the apphcant's obligation to comply with all other reqwrements of other agencies withjunsdichon over land development ~ SPOKANE COUNTY DIVISION OF PLANNING 1 All condirions unposed by the Heanng Examiner shall be bmdulg on the "Applicant", wluch term shall include the owners and developers of the subject property, and theu heus, assigns and successors 2 The conditional use pernut applies to the land currently referenced as County Assessor's tax parcel nos 45222 0538 and 45222 0539, wluch land is legally descnbed m an attachment to the conditional use pennut apphcarion 3 The proposal shall comply with the Neighborhood Business (B-1) zone, in particular Section 14 624 240 (2) of the Spokane County Zoxung Code, the Aquifer Sensinve Overlay zone, and all other apphcable provisions of the County Zoiung Code, as amended 4 The applicant shall develop the subject property in substantial conformance with the site plan of record subrnitted on June 21, 2002, subject to comphance with condltions of approval and development regulations The County Division of Planiung Duector/designee may approve nunor revisions to the site plan of record pursuant to Section 14 504 040 of the County Zoiung Code Any other revisions must be presented to the Heanng Exammer through the subnuttal of a change of condibon apphcation and its review and approval at a pubhc heanng All vanations must conform to the County Zonuig Code, and the ongmal mtent of the development plans shall be malntamed 5 Approval is requued from the Duector of the Division of Planning/designee of a specific hghhng and sigrung plan for the 1-bay self-service car wash pnor to the release of any bwlduig pernuts Direct hght from any extenor area lighting fixture shall not extend over the property boundary 6 A specific landscape plan, planting schedule and provisions for the mauitenance acceptable to the Duector of the Division of Plannmg/designee shall be submitted with a surtable guarantee for uistallahon of landscapmg pnor to the release of any building permrts Landscaping sha11 be HE Findings, Conclusions and Decision CUE-04-02 Page 5 ~ mstalled and mmntauied so that sight distance at access points is not obscured or unpaired Reqwred landscaping shall be maurtained and installed consistent with the approved landscape plan 7 The Division of Plamning shall file with the Spokane County Auditor, wrthin the same time frame as allowed for an appeal from the final disposihon, uicluduig lapsing of appeal penod, a Title Nohce, wluch shall generally provide as follows "Pnor to the issuance of any bmlding pernut for any building or any use on the property descnbed herein, the applicant shall be responsible for complying with the provisions of the Zoiung Code for Spokane County, Section 14 706 (Aquifer Sensitive Area Overlay Zone) The property that is the subject of this nohce is more partzcularly descnbed as [insert legal description] 8 Assessor's tax parcel nos 45222 0538 and 45222 0539 shall be aggregated consistent with the Spokane County Subd.ivision Orcunance, pnor to the release of a buildmg permit 9 Noise levels generated by the car wash at the extenor boundanes of the srte shall not exceed the maxunum permissible noise levels estabhshed in chapter 173-60 WAC 10 The Condihonal Use Permit may be suspended or revoked if, after pubhc heanng with nohce as provided in Secnon 14 404 060, the Heanrig Body finds that a grantee or their successors in i.nterest fasled to comply with conditions or restnctions included m the permrt 11 The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, which notes that the property in queshon is subject to a vanety of special conditions unposed as a result of approval of a land use achon The Title Notice shall serve as pubuc notice of the condihons of approval a.ffectmg the property in question The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or m part, by the Division of Plammng The Title Notice shall generally provide as follows "The parcel of Plannmg " SPOKANE COUNTY DIVISION OF BUILDING AND CODE ENFORCEMENT 1 The apphcant should contact the Division of Building and Code Enforcement at the earhest possible stage in order to be ulfonned final road and drauiage plans, a drainage report and calculahons that conform to the 2001 Spokane County Standards for Road and Sewer Construction, the current edition of the Spokane County Guideluies for Stormwater Management, and all other apphcable standards The plans and report shall receive the County Engineer's acceptance pnor to release of a construcUon or buildzng pernut or approval of the final plat 2 A pazkulg plan and traffic cuculation plan shall be subnutted and accepted by the Spokane County Engmeer The design, locatton and arrangement of parking stalls shall be in accordance wnth standard enguieenng practices Paving or surfacing as approved by the County Engmeer vvill be requued for any portion of tlie project wluch is to be occupied or traveled by velucles 3 Roadway is advised that there may exist utihties either underground or overhead effechng the applicant's property, includuig property to be dedicated or set aside future acqwsihon Spokane County will assume no financial obhganon for ad~ustments or relocanon regardmg these uhhties The apphcant should contact the apphcable uhlities regarding responslbihty for adjustment or relocanon costs and to make arrangements for any necessary work. 13 Erosion Control A Temporary Erosion and Sedimentation Control (TESC) plan sha11 be prepazed by a WA State licensed Professional Engineer and unplemented throughout the duration of construchon The TESC plan is to be prepared using best management prachces (BMP's) currently accepted withm the Civil Engmeering profession The TESC plan shall mclude, at a nununum, a grading plan, location and details of silt control structures, and street cleaning program Runoff from exposed areas shall be filtered pnor to discharguig into a detenhon pond, swale, infiltrahon facility, or natural dramageway The TESC plan shall be included m the road and drainage plans The applicant's Engineer sha11 subnut the TESC plan and supportuig calculations to Spokane County pnor to srte disturbance The TESC major structures (such as sflt ponds, silt traps) shall be uLStalled pnor to other site work, and the TESC measures shall be unplemented and mauitamed throughout the durarion of construchon, including house construction 14 The Spokane County Enguieer has reviewed tlus project for transportanon concurrency and has determuied that it is exempt under Section IV (B)(2c) of the Phase I Development Regulations SPOKANE COUNTY DIVISION OF UTILITIES 1 The apphcant shall subnut expressly to Spokane County Division of Utlhhes, "under separate cover", only September 4 2002 Hearing 6 of7 S Urban Land Poticy UL 12 4(b) statas that the mix of land uses m a mixed-use area mcludes a full range of retait goods and services-grocery stores serving several neighborhoods, theaters and restaurants, drycleaners, hardware stores and specialty shops The proposal is essentially a commurnty servmg busmess serving pnmanly nearby neighborhoods Capital Facilities and Utilibes Goal CF3 and Policy CF 31, taken together specify that public facilities and services must have the capacity to support proposed development at established Levels of Service and is consistent with public water and sewer system piannmg Transportation Goal T2 specifes that transportation system improvements must be provided concurrent with new development and consistent with adopted land use and transportation plans The application for the proposed zone reclassffication is consistent mnth sewer, water and transportation concurrency requirements The water and sewer service providers have certified that adequate water and sewer services are available to meet the needs of the proposal The DNision of Engineenng has stated that Evergreen Road wdl accommodate the traffic generated by the proposal and that a Transportation Certificate of Concurrency wdl be issued at tEie bme bwldmg peRnits are issued Policy CF 81 requires stormwater management systems for new development within the Urban Growth Area (UGA) The Sde Plan of Record identifies proposed stomnwater management areas Additionaily, the proposal as condiboned will comply mnth Spokane County Stormwater Management Guidelines In summary, the proposal, as conditioned, is generaliy consistent with the Poticies of the Muced Use and Capital Facddies Chapters of the Comprehensive Plan Phase i Development Regulabons Resolution 2-0470, Section IV (F) requires the applicant to demonstrate sewer and water service concurrency and the sewer and water purveyors have signed pCertificates of Sewer and Water Concurrency,° therefore, the proposal is consistent with Section IV (F) The Division of Engmeenng and Roads has reviewed the project for transportation concurrency and determined that it is exempt under the Phase I Development Regulations, Section IV(6)(2c) Zoning: The purpose of the B-1 zone is to allow for limited, small scale neighborhood sennng retail and office uses as a means of implementing the Mixed Use, Urban ActNity Center and Neighborhood Commercial categones of the Comprehensive Pian by providing local facilities to serve the everyday needs of the suROUndmg neighborthood In addition to serving the everyday needs of the surrounding neighborhood, B-1 Zones are intended to provide land use transition between the Commercial categories and less intense land use categones of the Comprehensive Pian The uses allowed in the B-1 Zone are generally less intense than those of the other busmess zones and the development standards, associated with compatibility and aesthetics, provide appropnate land use transition The proposal, as conditioned, is generally consistent wdh the purpose and development standards of the Neighborhood Busmess (B-1) zone The site is located adjacent to a major transportation comdor, SR-27 Other services available to the subject site include manned fire protection, pubiic transit, pubfic sewer and water services and solid waste collection Section 14 404101 of the Zornng Code states that before a Conditional Use Permit is approved, the Heanng Exammer shall find that 1) Adequate conditions and restnctions are attached to the development of the property to ensure that the proposed use wdl be compatible with uses permitted outnght in this location, and 2) The special standards as outlined m the Zonmg Code for the underlying zone shall be met Section 14 624 240 of the Spokane County Zornng Code pertainmg to the Neighborhood Busmess (B-1) Zone sets forth special devetopment standards for 1 bay self service car wash facilities Review of the proposal's compliance with the special development standards is as follows CUE-402 Staff Report -
