This matter bemg an appeal of an mterpretation of Secnon 14 808 060 of the Zonuig Code of
Spokane County, and the Board of Adjustment, hereinafter refened to as the "Board", havuig
held a pubhc heanng on June 19, 1991 and having fully considered the Planiung Duector's
interpretauon, all testimony and exhibits and the file in this matter, does hereby make the
following.
FINDINGS OF FACT
1. On January 30, 1991, the Spokane County Zorung Adjustor granted an
a,dminisbrauve exception to Raymond Biggars for street frontage on Parcel No 452341211
(15006 East 13th Avenue)
2 On Maich 7, 1991, a buildhng permit apphcanon for a double-wide mobile home on
Parcel No 45234 1211 was filed
3 On March 26, 1991, the building pernut for the double-wnde mobile home Parcel
No 45234 1211 was issued
4 On Apn110, 1991, the Planning Department placed a stop work order on Parcel
No 45234.1211, to review whether the manufactured home complied wnth Section
14 808 060 of the Zoning Code of Spokane County
5 The Planrung Ihrector issued a wntten interpretation of Section 14 808 060 of the
Zorung Code of Spokane County on April 16, 1991, that provided, in part
" Class A manufactured homes in the UR-3 5 and UR-7 zones shall be new as noted by
date of aianufacture or shall meet all the appearance standards of being new as deterimined
by the Planning Dvrector or designee "
6 The mterpretation was issued pursuant to Secaon 14 504 of the Zomng Code
7 The mterpretation is attached hereto as Attachment "A"
8 On May 3, 1991, the mterpretation was appealed
9 Noace of the appeal heanng was given pursuant to Section 14 412 041 of the
Zoning Code
10 Section 14.808 060 3 provides that the pitch of the main roof shall not be less than
one foot (1') of nse for each four feet (4') of honzontal run The roof pitch of the
manufactured home on Parcel No 452341211 is one and two-thuds inches (12/311) 12
inches

11. The Board has been advised by the Prosecuang Attorney's Office that an
interpretation by the Planiung Duector, who is charged wnth interpreting and enforcing the
Zoning Code is entided to considerable weight
12. That Class "A" mobile homes by uidustry standards can have a vanety of roof
pitches including the roof pitches specified in Secaon 14 808 060 3 as well as the roof prtch
on the manufactured home on Parcel No 452341211
Any Fuiduig hereinabove stated which may be deemed a Conclusion is hereby adopted as
the same.
From these Finchngs, the Board comes to the following•
CONCLUSIONS
1. The interpretaaon by the Planiung Duector is apphcable to all manufactured homes
in the zones specif'ied by Secuon 14 808 060 of the Zomng Ordinance, and is not limited to
the manufactured home on pazcel No 45234 1211
2. The Board concurs with the interpretation and suppornng analysis of the Plannmg
Duector dated Apnl 16,1991, and attached hereto as Attachment "A".
3. The Planning Duector has the responsibility to enforce the provislons of the Zoning
Code pursuant to Section 14 406 020 of the Zorung Code Any enforcement acaon regarriing
the roof pitch of the manufactured home on Parcel No 452341211 is therefore outside the
junsdiction of the Board.
Any Conclusion heremabove stated which may be deemed a Fuiding is hereby adopted as
the same.
From the foregoing Finchngs and Conclusions, the Board renders the followuig.
DECISION
The Board DEr1IES the appeal of the interpretation of Secnon 14 808 060 of the
Zomng Code of Spokane County, and adopts the interpretation of the Planrung Duector dated
Apnl 16, 1991.
The Board, in making this Decision, notes that the manufactured home on Parcel No
45345.1211 does not comply with the roof pitch specified by Secnon 14 808 060 3. of the
Zonuig Code Resolution of that issue is not before the Board, by rather is an enforcement
issue, and an appropnate matter for the Planning Department to consider and resolve

FINDINGS OF FACT AND CONCLUSIONS
1. The uidlvidual signing below has been delegated the responsibdity for
rendermg this decision by the Spokane County Duector of Plannmg.
2. The proposal is for the development of a single family dwellmg on a lot of
30,360 square feet vinth 25 feet of frontage, all as detailed in the Department file.
3 The proposal is generally located in the west of Spokane Valley at the end

of perauts by the Health DistncL

theu name(s) on a peaaon for the formaaon of a ULID by petitioo method pursuant to
RCW 36.94 which the peaaon includes the Owner(s) property and fiuther not to object by
the sigrung of a protest peuaon against the formation of a ULID by resoluaon method
pursuant to RCW Chapter 36 94 which includes the Owner(s) property. PROVIDED,

A r+esidenaal structure is subject to applicanon and approval of permits for building(s) and
on-site sewage d.isposal system(s). Parcel size may be a cnucal factor.
VI. SPOKANE COUNTY ENGINEER'S OFFICE
1. The County Engmeenng Department has deteTUUned that the pnvate roadway
easement servuig the parcel(s) should not be designated as a Tract "X" Future Pubhc
Right-of-Way Tract Pnor to the release of a building penmit, the apphcant must sign and
record "Spokane County Nouce To Tne pubhc No. 4." Tius document specifies the
following•
a) The pnvate road withm the pubhc nght-of-way shall be construeted in
accordance wnth Spokane County standards for pnvate roads
b) The appucant agrees to join in and not oppose the creation of a Road
Improvement Distnct (RID) or County Road Project created for the
purpose of unprovmg the pnvate roadway to a pubhc road standard
c) Serves notice to future property owneis that Spokane County is not
responsible for pnvate roadway construcuon, maintenance, snow removal
or any other services on the pnvate road.
2. The pnvate road shall be named and signed in accordance wnth provisions of
Spokane County Road Standards

assigns, hereby agree to the following:
There may be a need in the future to construct a public road to serve the
lands herein described. Said road ahall be constructed in accordance with
the then adopted County road standards for public roads. Said road to
follow, as near as practicable, the existing County road right of way.
If additional right of way is required, the owners, their heirs and/or
assigns agree to deliver to Spokane County a properly signed and executed
Right of Way Deed covering the required additional right of way.
The owner(s) or successor(s) in intereat agree to authorize Spokane County
to place their name(s) on a petition for the formation of a Road
Improvement District (RID) by the petition meChod pursuant to Chapter
36.88 RCW, which petition includes the owner(s) property, and further not
to ob,ject, by the signing of a ballot, to the formation of a RID by the
reaolution method purauent to Chapcer 36.88 RCW, which resolution includes
the owner(s) property. If a RID is formed by either the petition or
resolution method, ae provided for in Chapter 36.88 RCW, the owner(s) or
succeseor(s) further agree: (1) that the improvements or construction
contemplated within the proposed RID is feasible, (2) that the benefits
to be derived, from the formation of the RID by the property included
therein, togetber with the amount of any County participation, exceeds the
cost and expense of formation of the RID, and (3) that the property
within the proposed RID is sufficiently developed. Provided, further, the
owner(s) or successor(s) shall retain the right, as suthorized under RCW
36.88.090, to object to any assessment(s) on the property as a result of
the improvements called for in con3unction with the formation of a RID by
either petition or reaolution method under Chapter 36.88 RCW and to appeal
to the Superior Court the decision of the Board of County Commissioners
aff irming the final assessment roll.
By allowing a building permit to be issued on property having access f rom
an unmaintained County road, Spokane County aseumes no obligation for said
road, and the ownera hereby acknowledge that the Couaty has no obligation
of any kind or neture whateoever to establish, examine, aurvey, construct,
alter, repair, improve, maintain, provide drainage or snow removal on said
road. The requirement is and shell run with the land and shall be binding
upon the owners, their heirs, successors or aseigns, until said road is
improved to County standards and accepted by the County for maintenance.
The above conditiona and covenant apply to the following deseribed property:
The North 184 feet of the South 342 feet of the West Half (WJ) of the
East Half (EJ) of Tract 168 VERA, as recorded in Volume "0" of Plats,
Page 30, in Spokane County, Washington. Located in Section 23, Township
25 North, Range 44 E.W.M., in Spokane County, Washington.

The undersigned owners, their heirs, successors or assigns hereby release Spokane
County, and all its officera, employees and agents from any responsibility or
liability for any damage whatsoever to the hereinabove described lands and
improvements thereon as a result of allowing a building permit to be issued on

The RID waiver contained in this agreement shall expire after ten (10) years from

to Spokane County the then estimated coat of the required improvements to enable the
County to complete the same; or furnish a bond or other secure method suitable to
the County, providing for or securing to the County the actual construction of the
improvements.
