Eighth Avenue located south of the site is designated as a Mulor Artenal by the County Artenal Road Plan The subject property is surrounded by UR-3 5 zoning, and single-family homes on simllarly sized lots Project I)escription: The application requests a condihonal use permit to install a conditional accessory urut in an exlsting owner-occupied single-family residence, pursuant to Chapter 14 816 of the Spokane County Zorung Code The site plan of record subnutted on 11-12-96 illustrates the floor plan of the existing residence, with 640 square feet of existmg living area in the lower level of the home devoted to the accessory unit The applicant, who is a licensed contractor, previously remodeled the home to accommodate the accessory urut The living area for the accessory urut would contain a 3/4 bath, laundry, bedroom, and latchenette area, and is modified for handicap access The accessory unit would be used to accommodate the applicant's father in law, who is 93 years old, in poor health, and requires 24-hour care The upstairs of the home, where the homeowners and their family would reside, contams 3 bedrooms, 2 baths, lutchen, and other standazd livuig arrangements B. charactenzed by a high level of public services and facihties, and modern utility systems See Comprehensive Plan, Section 1 The Urban category encourages urban development in areas having adequate power supplies, water, saiutary and storm sewers, and school and fire sernces, provided that other relevant policies of the Comprehensive Plan are met Decision Guidelines 1 1 1 and 13 3 Base net density for single-family dwelling areas may be increased through vanous methods when meeting the "fill-in" cntena Decision Guideline 1 12 The Urban category encourages a vanety of densities and residential uses, including combulahons and a mix thereof Decision Guideline 1 14 The Urban category indicates that new residenhal development should be buffered from existing adjacent land uses where adverse effects may develop, using buffenng and/or landscaping to mitigate the difference between proposed development and existing uses See Objective 15 a and Decision Guideline 15 1 The Urban category indicates that the structure height and impact of new structures on the architectural character of the neighborhood should be considered when changes are proposed to an existing neighborhood Decision Guideline 1 5 8 The proposed use of the site is allowed as a conditional use in the UR-3 5 zone The purpose of the UR-3 5 zone is to implement the lower residential density range of the Urban category of the Comprehensive Plan Such zone is intended to promote areas of pnmanly single- family residential use in an urbanized neighborhood setting, having a high level of pubhc services Zoning Code 14 616 100 The residence on the site witlun an existing developed area, served by a high level of urban services, includmg public sewer The project constitutes "fill-in development" within the mearung of the Urban category See Comprehensive Plan, glossary definiti'on of "fill-in development" Chapter 14 816 of the Zorung Code contains vanous standards and cntena to assure that the accessory unit will be compahble in the neighborhood m which it is situated Section 14 816 00 of the Zoning Code indicates that the purpose of accessory uruts is to develop housing umts ul single-family neighborhoods appropnate for people at a vanety of stages in theu hfe cycle, and to provide rental housing for handicapped persons The applicant has requested the accessory umt to provide care and housing for a dependent relahve who is aged and m poor health HE Findings, Conclusions and Decision CLJE-15-96 Page 4 L Zoning Code 14 816 020 (10) specifically pernuts accessory uruts in the UR-3 5 zone A notanzed letter from the owner was received on March 4, 1997, statuig that the owner will occupy one of the dwelling u.rut in the exishng residence on the site A site development plan was submitted, showing landscaping, off-street parkuig, etc The floor plan submitted does not meet the one-fourth ('/4) to a foot detail requued by Zomng Code 14 816 040 (b), but is adequate to venfy that the application meets the requirements of Zoiung Code 14 816 020 The conditions of approval requue the applicant to subnut a final site development plan meehng the requirements of Zoning Code Chapter 14 816 The apphcation requuements of Zoning Code 14 816 040 (1) have been met The property owners will be occup}nng the pnncipal umt upstaus and the dependent relative will be occupying the downstaus There will be some shared use of some facilities, such as the homeowners fanuly using the laundry facilities downstaus and the dependent relative using the duung area upstairs However, the accessory umt is a complete and separate housekeeping unit, that will be sufficiently isolated from the pnncipal umt to satisfy Zorung Code 14 816 020 (1)(2) Zoiung Code 14 616 020 (14) authonzes reasonable deviation from the accessory unit standards to install features that facilitate access and mobility for handicapped persons The remodel of the home for the accessory umt appears to meet the mmimum requirements of the Uruform Building Code, as required The project will create only a single accessory urut, permanently occupied by no more than one family, as requued by Zorung Code 14 816 020 (4)(15) The umt does not requue any extenor remodeling, such that the appearance of the existmg home will be that of a one-fanuly residence There is an existing door that leads from the basement to the rear of the house These features satisfy Zorung Code 14 816 020 (4) The addition does not add any floor space to the exishng structure, so Zomng Code 14 816 020 (5) is met The total livable floor space of the accessory unit and pnncipal umt combined is 2,488 square feet, more than twice the combined floor space for such units required by Zorung Code 14 816 020 (6) The project will not create a home profession, fanuly day care home or mmi-day care home, as proscnbed by Zoning Code 14 616 020 (7) The design and size of the accessory unit appears to meet all applicable standards in health, building or other applicable codes See Zoning Code 14 816 020 (8) Certification by the Health Distnct that the water supply and sewage disposal facilities are adequate for the resident of the accessory umt vvill be assured through the buildmg pernut process The conditions of approval reqwre the apphcant to file the Declaration of Covenant required by Zorung Code 14 816 020 (13) upon receipt of the conditional use pernut The record indicates that 3 off-street parkmg spaces will be available for use by the owner- occupants and/or tenants, as required by Zoning Code 14 816 020 (9) The residence has a 3-car garage, the resident of the accessory unit will not be dnving, and cars can be parked vn the dnveway The accessory umt is clearly subordinate to the pruicipal umt It meets the limitations of Zorung Code 14 816 020 (11), m compnsmg 25% of the residence's total floor area, occupying 640 square feet, and not having more than 2 bedrooms The Examiner has conditioned the conditional use permit so that it will need to be renewed within 2 years of the date the dependent relative began using the accessory urut, as requued by Zomng Code 14 816 020 (12) and 14 816 040 (3) HE Findings, Conclusions and Decision CUE-15-96 Page 5 ~ The Staff Report recommended approval of the project The only opposihon to the project was received in the form of a letter received by the Division of Building and Planrung by facsimile on January 6, 1997, from Todd and Diane Pocock, the residents and owners of a home located at E 15215 Kallas Court Such residence is located in the cul-de-sac which the residence contairung the subject accessory urut abuts on the north Such residents objected to the use of a "secondary appliance" in the basement of the subject property, and the precedent that the conditional use pemut might create for multi-fanuly housing The nelghboruig residents also expressed concern over lunited parkuig in the cul-de-sac, drawing attention to the narrow frontage (50 feet) of the subject home on St Charles Street, a dnveway taking up 20-30 feet, and emergency service linvtations based on the turn around radius for fire trucks The site plan indicates that there is parking available on the site for 6 cars, more than twice that required for the subject residence with the accessory urut The subject home has a 3-car garage, and the resident i.n the proposed accessory unit will not be dnving The project will not have any significant effect on parkuig and congestion in the cul-de-sac A realtor testif}nng for the applicant testified that the subject residence was the most expensive home in the neighborhood, and blended in well with the neighborhood See testimony of Sharon Winter The project will be compatible with surrounding land uses, and no special buffenng or landscaping are needed to protect the character, or welfare of the neighborhood The requuements of the State Environmental Pohcy Act and the County's Local Envuonmental Ordulance have been met No pubhc agencies objected to the project, as condihoned The Heanng Examiner concurs with the Deternunation of Nonsigruficance issued by the Division of Building and Plamvng The proposal generally complies with the Comprehensive Plan, and as conditioned complies vvith the Zorung Code and apphcable development regulations IV.
