FINQINGS QF FACT AND CONCLUSIONS
1 The individual signing below has been properiy delegated the responsibilEty for rendering
this deasion by the director of the Spokane Counfy Djvision o# Bui(ding and Pianrnng
2 The applicant has requested a temporary use permit to estab{ish a prafessionaUlaw office
on a parcel of land for r►vhich a zone reclassification application from Urban Residential-3 5
(UR-3 5) to Urban Residential-22 (UR-22) for a professEVnaUlaw office is currently being
processed (file no ZE-2-9$)
3 The subject property is generaily located on the narthwest cvrner of the intersection of 41h
Avenue and Sullivan Road in the Nor#heast Quarter of Section 23, Township 25 North,
Range 44 E W M, Spokane County, Washington
4 The surrounding land uses inciude single family residences located north, west and
southwest of the subject site, multi-family residences located east and south of the subject
site and neighborhood type businesses located southeast of the subject site
5 The site is presently zoned Urban Residenbal-3 5(UR-3 5) The proposed use is not an
allowable use within the existing Urban Residential-3 5(UR-3 5) zone and does not conform
to the requirements of the Urban Residential-3 5(UR-3 5) zone However, the appficant
has requested a temporary use permit to establish the use under the provisions of Chapter
14 510 (Temporary Uses) of the Spokane County Zonmg Code while the Spokane County
Division of Building and Planning processes the applicants' request for a zone
reclassiftca#ion from k)rban Residential-3 5(UR-3 5) to Urban Residential-22 (UR-22) to
establish the appropriate zoning for the subject profess+onal/law office (fi!e no ZE-2-98)
6 Chapter 14 510(a) provides that any owner of any property may submit an application for
the temporary use of a structure or premises m any zone classification for a purpose or use
that does not conform ta the regulations prescnbed elsewhere in the Zoning Code for the
zone classification in which it is Iocated, provided that such use is of a temporary nature and
does not cnvoive the erection of a substantial structure A nonrenewabie zoning certificate
for such use may be granted by the Diviscvn in the form of a temporary and revocable
permit, for not mare than a six (6)-month period
7 On January 26, 1998, the applicant submitted an application for a zone reciassrfication from
Urban Residential-3 5(UR-3 5) to Urban Residential-22 (UR-22) ta the Divisron of Buildong
and Planning for the purpose of establishing the appropriate zone fvr the subject
professionai/law office (file no ZE-2-98)

8 On February 11, 1998, Division of Buifding and Planning inspection staff notified the
applicant that construction activity was operating without the proper permits required by the
Spokane County Cade
9 On February 12, 1998, a Technical Review Meeting was held with the applicant to provide
review comments for the requested zone reclassification from Urban Residenbai-3 5(UR-
3 5) to Urban Residentia!-22 (UR-22) (file no ZE-2-98) At the Technical Review meeting
the applicant was notified that an approval of a Temporary Use Permit would be required in
order to allow the appilcant to occupy the existing structure located on site as a
professconaillaw office white the zone reclassification request was berng processed if the
zone reclassification request is denied, the applicant will be required to compiy with the
terms of the Temporary Use Permit 1f the zone reclassification request is approved, the
terms of the Temporary Use Permit will become null and void and the applicant wiil be
required to compfy with the Conditions of Approval imposed by the Spokane County
Heanng Examiner
10 The Diviston of Budding and Planning may impose shorter time penods for temporary use
permi#s as provided for under Chapter 14 510(a) wherein a permrt may be granted for not
rnore fhan a six (6)-month penvd (emphasis added) The Division is not required to issue
al( temporary use permits for six (6)-months, but rather it has the discretion to fssue a permit
from one (1) day up to six (6) months
11 The Division of Building and Planning finds that i# is reasonabie to limit the bme penod for
which this permit is vaiid to six (fi) months The six (6) month time penod provides the
_ applicant the ability to occupy the existing structure and conduct a professionaUlaw _
office/business while #he zone reciassificabon is being processed (file no ZE-2-98)
12 The proposal is exempt from the provisions of the Washington State Environmental Policy
act, Chapter 43 21 C RCW pursuant to WAC 197-11-800 (1)(c)(i) and the Spokane
Environmental Ordmance 11 10 070 (!)(a)
13 The proper legal notice will be accomplished when this decESion is mailed to adjacent
property owners as required by Chapter 14 514 vf the Spokane County Zoning Code
14 The Division finds that the conditions of approval are appropnate to safeguard the public
health, safety, and generai welfare

CC►NDITIONS OF APPROVAL
1 The foflowing conditrons shall only apply to the applican#(s) and owner(s) and do not run
with the land Failure to comply with any of the condrtions of approval contatned in this
decision shall constitute a violation of the Spokane County Zoning Code and be subject to
such enforcement and penalties The permit authonzes the operation of a professionalllaw
office only, for a perrod of six (6) months endmg on January 1, 1999
2 if the zone reciassification request (file no ZE-2-98) from Urban Residential-3 5(UR-3 5) to
Urban Residen#ia!-22 (UR-22) is approved prior ta January 1, 1999, the terms of this

Temporary Use Permit will become null and void and the applicant shaii compiy with the
Conditions of Approval for the zone reclassification (file no ZE-2-98) as imposed by the
Spokane County Hearing Examiner if the zone reclassification request is denied, the
professional/law office may remam on site as stipulated in these Findings and Conditions of
Approval
3 If a violation of any condition of approval is found, the temporary use perrrtit may be revoked
as provided for under Chapter 14 510(a) If the temporary use permit is revoked, the
applicant shall cease the operation of the professional/law ofFce immediately upon
notification by the Division that the permit has been revoked
4 Signage may be permitted pursuant to Sectbn 14 804 080(7a) of the Spokane County
Zonmg Code
5 Off-premise signs are not permitted
6 The applicant shall mamtain clear travel ways for vehicular access to and from the site,
maintain an unobstructed parkrng area, and mamtain adequate turn-around areas for cars
to enter, park and exit the site
7 Any improvements or alterations to the land to accommodate the proposed temporary use
shall be temporary in nature, and must be restored and/or removed at the appiicanYs
expense upon expiration of the temporary use permit only if the zone reclassificabon
request (fiie no ZE-2-98) is denied

8 A temporary building permit and subsequent temporary Certificate of Occupancy may be
issued for the duration of this temporary use permit subject to compiiance with appropnate
building, land use and sewage disposal requirements
9 The applicant shall obtain budding permits approval for any construction activity tha# may
occur on site
10 The applicant shall obtain approval from the Spokane Regional Heafth Distnct for proper
water service and waste water disposal
11 Use of prrvate wells and water systems are prohibited
, 12 The applicant shall compiy with Spokane County Air Pollution 'Control Authonty (SCAPCA)
standards to control dust produced on the site
