County, Washington. 2. The proposal consists of Certificates of Exemption to divide 24.11 acres into four (4) parcels known as parcels A, B, C and D. The parcels range in size from 5 a-, i-`- to 8.77 acres. A single family residence is located on Parcel A, and the construction of single family residences on parcels B, C, and D is proposed. T~i~: Planning Department approved the Certificates of Exemption, CE-750-92 (A-D), url November 19, 1992. 3. The proposed density of four (4) dwelling units on 24.11 acres is generally consistent with the densities for adjacent development and serves to implement the Urban and Suburban Plus categories of the Comprehensive Plan. 4. The Board finds that the adopted Spokane County Generalized Comprehensive Land Use plan designates the area encompassed by the proposal as Urban and Suburban Plus. The proposal is generally consistent with the Urban and Suburh.in Plus categories. 5. An appeal of the Planning Department decisi~~iI's tu ~;~)l)rt~~C, i>~:)-~~? filed on December 24, 1992 by Danny Mclntyre. The Hearing Examiner Committee held a public hearing on February 18, 1993 subsequent to whicii h%- c h~- Findings of Fact, Conclusion and Decision dated February 23, 1993, it derlieLi if"c proposal. 6. The applica.nt timely appealed the Hearing Examiner conullittee's decision on February 22, 1993. 7. To meet road frontage requirements for Certificates of Exemption, CE-750-92 (A- D), the applicant recorded an access easement with the Spokane County Auditor (-.)[1 the west 60 feet of the property to meet road frontage requirements. 8. The Board adopts the Planning Department Report and file of CE-750-92 (A-ll), part of this record, as may be modified by this action. The Planning Department recommended that the Certificate of Exemption be approved. v ~ . I BOCC FINDINGS CE-750-92 (A-D) Page 2 9. The existing land uses in this area include single family residences and agriculture. The proposal is consistent with the surrounding uses in terms of densities and land uses. 10. The existing zoning of the property described in the application is Urban Residential-3.5 (UR-3.5) and Suburban Residenrial-1 (SR-1). The proposal is consistent with the standards and maximum density required in this zone. 11. Danny Mclntyre's appeal of the Planning Departments decision to approve the proposal was timely because he did not receive notice of the decision until after the appeal period had expired, and timely appealed the decision according to a letter received from the Planning Department. 12. The legal requirements for public notice have been fulfilled. 13. The owners of adjacent properties expressed concerns regarding the proposal including the following: a. A portion of the subject property is located in a 100 year flood zone which has not been precisely delineated. b. Approval of the Certificates of Exemption was based on access to a county road although the easement does not connect direcdy to a county road (12th Avenue) since a one foot wide strip of land owned by Spokane County exists between the easement and the 12th Avenue right of way. c. The short plat administrators decision is not exempt from environmental review under WAC 197-11-800 (6) (a) as portions of land designated for road easement are covered by water at least seasonally. d. The parcel was divided more than four (4) times contrary to the Short Plat Ordinance. 14. Flood plain considerations for the parcels created through the Certificates of Exemption process are normally addressed at the building pemut stage and the parcels appear sufficiently sized to accommodate such considerations. 15. Prior to issuance of a building pemut for a residence on parcels B, C or D, vacation of the one foot strip at the end of 12th Avenue must be approved by the Board in order to allow access from 12th Avenue. 16. The approval of Certificates of Exemprion either does not constitute an "action" subject to review under the State Environmental Policy Act (SEPA), or is exempt under WAC 197-11-800 (6). The proposal is not "covered by water" as characterized. 17. The applicant requested and received approval for Certificates of Exemption to create a total of four (4) parcels, which is the maximum number allowed under the County's Short Flat Ordinance. The applicant owns two (2) lots located north of the subject property, but the applicant was not the subdivider of these lots and no intent to circumvent the Short Plat Ordinance can be infened from the information presented at the hearing. The proposal does not violate the requirements of the Short Plat Ordinance. 18. The Certificates of Exemption, as conditioned, comply with the review factors listed in the County Code, includ.ing size and access requirements. DECISION The Board does hereby approve the Certificates of Exemption, subject to the following additional conditions: 1. The existing 60 foot wide easement located on the subject property shall be revised and recorded with the Spokane County Auditor. The new easement shall be 60 feet in width and extend along the west side of parcels B, C and D from the south line of 12th Avenue extended a sufficient distance northerly into parcels B to satisfy County road frontage requirements. BULC I=INllIiNGS CE-750-92 (A-U) Pa~~ 2. A turn around acceptable to Fire District No. 1 shall be constructed at the north end of the 60 foot easement ternunating on parcel B. 3. Vehicular access to or through parcel A from 12th Avenue shall be prohibited. Vacation of the one foot at the end of 12th Avenue must still be approved by the Board of County Commissioners in order to access 12th Avenue from parcel B, C and D. That the regulations of the National Flood Insurance Program be observed since th~: proposed segregadon is associated with an area of special flood hazard. A development pernut shall be obtained from the County Engineer before constructiori or development begins on any property, all or a portion of which is in any area of special flaod hazard. Development widiin these segregatiocis shall coilfornl to tlie requireitients of tlle National Flood Insurance Program and Chapter 3.20 of the Spokane Counry CWe. Purchasers of property in this proposal are warned of possible flooding or pondin g and the potential requirement to purchase Flood Insurance. 2. Prior to any approach pernuts being granted for parcels B, C or D proper road frontage and access from 12th Avenue shall be demonstrated. There currently exists a one foot strip which precludes access. The applicant shall request vacacioll of the one foot strip, which can only be approved by the Spokane County Board ol County Conunissioners. Vacation of the one foot strip known as Lot 9, Block 6 or Rotchford Acre Tracts shall occur prior to issuance of any building pernuts for parcels B, C, or D. The members of the Committee present are Harry Gibbons, Chairperson, Frank Ytise and Phil Harris. THE APPEAL The appellant, Danny D. McIntyre, requests denial of Certificates of Exemptions file No. CE-750-92 (A-D), to divide 24.11 acres into three, five (5) acre parcels and one, eight (8) acre parcel. Certificates of Exemption, CE-750-92 (A-D) were approved on November 19, 1992 and the appeal was filed on December 24, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located east of Shelly Lake and approximately 700 feet south of Steen Road in Section 24, Township 25 N., Range 44 E.W.M. Spokane County, Washington. 2. The committee adopts the Plaruling Department Report as a part of this record. The Planning Department has recommended that the appeal be denied. 3. The existing land use in the area is primarily single family residences. Residential parcels range in size from 1 to 2.5 acres. Vacant parcels exist to the east and west of the subject property up to 40 acres in size. 4. The proposed use is comparible with existing uses in the area. 5. The Comprehensive Plan designates the area as Urban and Suburban Plus with approximately the north 1/2 of the site being within the Urban Category and the soudi 1/2 in the Suburban Plus category. Both of these categories are primarily residential categories. The Urban category provides for residential densities from 1 to 17 dwelling units per acre. The Suburban Plus category provides for residential densiries between 1 and 5 acres per dwelling unit. The proposal meets the guidelines of both categories. 6. The north 660 feet of the site is currently zoned Urban Residential-3.5 (UR-3.5). The remainder of the site is zoned Suburban Residential-1 (SR-1). Urban Residenrial-3.5 zone allows up to 3.5 dwelling units per acre. The Suburban Residential-1 zone allows a minimum lot size of 1 acre. The proposal meets the standards of both zones. The existing zoning was established pursuant to the program to implement the Spokane County Zoning Code in 1991. s HEC Order fvr CE-750-92 (A-L7) ' pager 2 . 7. The Certificates of Exernption were approved according to Secrion 3.3b.2 of the Spokane County Short Plat [h-dinance. The sectivn exempts from the short plat process +divisions of land into faur or fewer parcels which are five acres or more but less than ten acres in size upon deternnination of compliance with lacal land use plans and regulatians, 8. The appeal is based on the following concerns as expressed by the appelpant: a. The road easement included in the Certificate of Exemption application crosses the high water line of Shelley Lake andlor its vutletlinlet stream. , b. ApprQval was based on access to caunty road aithough the easement does nat c4nnect clirectly tQ aCounty road since a one foot strip of land owned by the Caunty exists between the gublic road right of way and the pnyate easement. c. Short plat administrators decisian is not exempt from environmental review under WAC 197-1 I-800 (6)(a) as portions of land designated for road easement in lots A and B are covered by water at least seasonally. d. Parcel was divided mare than four times. 9. The Planning Department respnnse to the appeal consisted of the following: 1 a. Under current regulations the applicant has the right to place an easement anywhere vn his,lher property. The easement submitted meets rvad frontage requirements under the existing zoning. b. It is true that a one faflt strip of land the wxdth of I 2th avenue exists at the 12th Avenue temunus vvhich is adjacent to the propasal. The one foot strip is owned by the County and is intended to controi access to adjacent prvperty. As part of the building perrrn3t process, the one foot strip may be vacateci in Qrder tc► allow access fram the subject site to 12th Avenue. c. WAC 197-1I-800 (6)(a) categorically exetnpts short plats from environmental review unless the land is cavered by water. A seasonal dxainage way crosses the northwest corner of the site. The site is nat covered by water. WAC 197- 11--800 (f)(a) exempts shart plats frQm envisonmental review. This pzoposal is nvt a short plat. d. The applicant requeste.d and received approval for Certificates of Exemption to create atatal of four parcels which is the maximum allowed under the Shart Plat Ch-dinance Section 3.313.2. 10. The Hearing Examiner Committee after consideration of all tesring and information upheld the appeal and thereby denies the Certificates of Exemgtian, CE-750-92 (A- D). Each lot conforms to Spokane County Comprehensive Plan and Zoning Code. Specifically, lot A and B are located in the Urban category and zoned Urban Residential-3.5 (UR-3.5); and lot C and D are located in the Suburban Plus category and zoned Suburban Residential-1 (SR-1). All lots exceeds the minimum lot size requirements permitted in their respective zones, and meets the density guidelines of the Comprehensive Plan. Moreover, the applicant has recorded a sixty (60) foot wide road access easement running length of lots A through D, along the west property lines to intersect at 12th Avenue.The private easement provides for the Zoning Code requirement for road frontage. The Appeal The appeal document makes the following allegations: 1. Retenrion of one (1) foot strips by the County is a standard platring procedural requirement to control access to adjacent unplatted property. 3. WAC 197-11-800 (6)(a) categorically exempts short plat, unless covered by water, from any SEPA review.The Spokane County Wetlands inventory/map shows no seasonal or wetlands affecting the site.No building allowed within fifty (50) feet of wedands associated with Shelley Lake. 4. The applicant requested and received administrative exemptions to create four (4) lots. No additional lots were requested or approved for segregation. - Division of Engineering and Roads Response to the Appeal The regulations of the National Flood Insurance Program be observed since the proposed segregarion is associated with an area of special flood hazard. A development pennit shall be obtained from the County Engineer before construction or development begins on any property all or a portion of which is in any area of special flood hazard (reference Spokane County Ordinance 88-0521). Prior to any approach permits being granted for the created parcels, access from 12th Avenue shall be demonstrated. There currently exists a one (1) foot strip which precludes access. The vacation of the one (1) foot strip, both of these actions can only approved by the Spokane County Board of County Commissioners. This vacation of the one (1) foot strip known as Lot 9 Block 6th of Rotchford Acre Tracts shall occur prior to issuance of any building permits. IV. PLANNING DEPARTMENT RECOMMENDATION: The application for Certificate of Exemption meets the density guidelines of the Urban and Suburban Plus categories, and the standards of the UR-3.5 and SR-1 zoning in which the property is located. The members of the Committee present are Harry Gibbons, Chairperson, Frank Yuse and Phil Harris. THE APPEAL The appellant, Danny D. McIntyre, requests denial of Certificates of Exemptions file No. CE-750-92 (A-D), to divide 24.11 acres into three, five (5) acre parcels and one, eight (8) acre parcel. Certificates of Exemption, CE-750-92 (A-D) were approved on November 19, 1992 and the appeal was filed on December 24, 1992. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located east of Shelly Lake and approximately 700 feet south of Steen Road in Section 24, Township 25 N., Range 44 E.W.M. Spokane County, Washington. 2. The committee adopts the Planning Department Report as a pan of this record. The Planning Department has recommended that the appeal be denied. 3. The existing land use in the area is primarily single family residences. Residential parcels range in size from 1 to 2.5 acres. Vacant parcels exist to the east and west of the subject property up to 40 acres in size. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates the area as Urban and Suburban Plus with approximately the north 1/2 of the site being within the Urban Category and the south 1l2 in the Suburban Plus category. Both of these categories are primarily residential categories. The Urban category provides for residential densities frorn 1 to 17 dwelling units per acre. The Suburban Plus category provides for residential densities between 1 and 5 acres per dwelling Linit. The proposal meets the guidelines of both categories. 6. The north 660 feet of the site is currently zoned Urbari Residential-3.5 (UR-3.5). The remainder of the site is zoned S u burban Residential-1 (SR-1). Urban Residential-3.5 zone allows up to 3.5 dwelling units per acre. The Suburban Residential-1 zone allows a minimum lot size of 1 acre. The proposal meets che standards of both zones. The Certificates of Exempcion were approved according to Section 3.3b.2 of the Spokane County Short Plat Qrdinance. The appeal is based on the following concerns as expressed by the appellant: a. The road easement included in the Certificate of Exemption application crosses the high water line of Shelley Lake and/or its outlet/inlet strearn. b. Approval was based on access to county road although the easerllent does not connect directly to a County road since a one foot strip of land owried by the Counry exists between the public road right of way and the private easement. c. Short plat administrators decision is not exempt from environmental review under WAC 197-11-800 (6)(a) as portions of land designated for road easement in lots A and B are covered by water at least seasonally. d. Parcel was divided more than four times. 9. The Planning Department response to the appeal consisted of the following: a. Under current regulations the applicant has the right to place an easement anywhere on his/her property. The easement submitted meets road frontage requirements under the existing zoning. b. It is true that a one foot strip of land the width of 12th avenue exists at the 12th Avenue terminus which is adjacent to the proposal. The one foot strip is owned by the County and is intended to control access to adjacent property. As part of the building permit process, the one foot strip may be vacated in order to allow access from the subject site to 12th Avenue. c. WAC 197-11-800 (6)(a) categorically exempts short plats from environmen tal review unless the land is covered by water. A seasonal drainage way crosses the northwest corner of the site. The site is not covered by water. WAC 197- 11-800 (6)(a) exempts short plats from environmental review. This proposal is not a short plat. d. The applicant requested and received approval for Certificates of Exemption to create a total of four parcels which is the maximum allowed under the Short Plat Ordinance Section 3.3B.2. 10. The Hearing Examiner Committee after consideration of all testing and infomiation upheld the appeal and thereby denies the Cemficates of Exemption, CE-750-92 (A- D).
