APPLICATION DESCRIPTION:
The applicant proposes to locate a garage with an appmximately 36-foot setback from the flanking
street centerline of the roadway right-of-way, whereas Section 4.04A.090 of the Spokane County
Zoning Ordinance requires a 45-foot setbacck from the flanking stroet centerluie of the roadway
right of-way. Authority to consider such a request exists pursuant to Section 4.25 of the Spokane
County Zoning Ordinance.
PROJECT LOCATION:
Genemlly located approximately 1/4 mile east of Pines Road and at the SW corner of Lenora Drive
and Vercler Street in the SW 1/4 of Sectian 27, Township 25 N., Range 44 EWM.
PARTIES OF RECORD: None
PUBLIC HEARING:
After examining all available iaformation on file with the application and visiting the subject
property and surnounding area, the Zoning Adjustar conductod a public hearing on June 21, 1989
and rendered a written decision on July 7, 1989
FINDINGS OF FACT AND CONCLUSIONS
1. The proposal is described above.
2. The adopted Spokane County Futune Land Use Plan designates the ama of the proposal
as Urban. The proposal uses are generally consistent with this category.
3. The site is zoned R-1, which allows the proposed use upon approval of tlus
applicaaon.
4. The existing land uses in the ana of the proposal are predominandy smgle-family
residences and vacant land, both of which ame compatible with the proposal.

197-11-800(6)(b)

6. The appucant has been made aware of the reconunendations of vanous countylstate
agencies reviewnng this project and has indicated he can comply with those recommendations
7. No one appeared to oppose the progasal. No written comments adverse to the proposal
have been received.
8. The proper legal requirements far advertising of the hearing before the Zoning Adjustor
of Spokane County have been met
9. The applicant present,ed numerous examples of other homes and garages which have
less than the forty-five (45)-foot setback in this sanae area and zone.
10. The apphcant indicated the proposed oonstruction will not intrude into the clear view
tnangle area which has been established for traff'ic safety.
11. The applicant agreed that no other visual obstructions, e.g., fencing or landscaping,
would be placed in the front yard along the flanking street.
DECISION AND ORDER
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal,
subject to compliance wnth the following.
CONDITIONS OF APPROVAL
I. GENERAL
The following conditions shall apply to the applicant, owner and successors in interest and shall
run with the land.
H. PLANAIING DEPARTMENT
1. The applicant develop the property in conformance with the site plan submitced to the
file.
2. Only sce-through fencing be established along the front yard of the flanking sueet,
Vercler Road.
III. DEPARTMEN'1' OF BUILDING & SAFETY
The nsuance of a bwilding pennit by the Departrnent of Building and Safety is required.
VI. ENGINEERING DEPARTMENT
It is requu•ed that, prior to the release of a building pernut, the site plan be reviewed to assure
that the clear view sight distance mangle will not be obstructed by the proposed swcture
