I. FINDINGS OF FACT AND CUNCLUSIONS
Proposal: Application for a Conchtional Use Pernut for a Home Industry in the existing
Urban Residential-3 5(CJR-3 5) zane, pursuant to Sectivn 14 616 240(4) and 14 404 100 o►f the
Spokane County Zomng Code, to allow an affice and storage for Parent Electrical, Inc
Procedural Matter: The matter was brought before the Hearing Examiner for pubPic hearmg
on Wednesday, October 23, 1996 at 1 30 p m The Hearing Examiner waited fa►r the apphcant to
arnve By 1 40 p m, the applicant had not appeared fvr said hearing and the Heanng Examiner
deternuned to dismiss the above-referenced matter w2th prejudice Division of Building and
Planning staff testified that the apphcant had left a telephone message vath Division staff dunng
the previous week requeshng that his apphcatian be withdrawn, but chd not submrt anything in
wnting The apphcant's request for withdrawal was made after notice of hearing was maded by
the apphcant to those entitled to notice Since the apphcant was responsible for providing notice
of hearing, the apphcant obviously knew the date, time and place of the hearing
Anaiysis: Sectivn 14 of the Heaaring Examiner Rules of Procedure, adopted by County
Resoluti4n No 96-0294, requires ciistnissal of a land use application with prejudice if the
apphcant requests withdrawal of an appficarion after publrc notice of hearing for the application
has been mailed Such section also authorizes the Hearing Examiner to dhsnuss an apphcation if
the apphcant fails to attend the pubhc heanng on the applicabon Based on the apphcant's
untllmely request to wrthdraw the application as well as his faulure to agpear at the Uctober 23,
1995 pubhc hea.rmg, the Heanag Exanuner finds good cause ta dismiss the apphcation ui this
matter with prejudice Thrs preciudes the apphcant from submitting the same or similar
apphcation for a one year penod, comnencin,g from the date the uutial application was deemed
complete by the County Division of Bwldang Planrung The apphcation was deemed complete on
August 22, 1996

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submi.tted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permzt or uae of property as proposed:
1. Applicant shall submit for acceptance by the Spokane County Engineer
drainage and acceas plans.
2. The applicant shall aubmit for acceptance by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project or portion thereof if the development is phased.
3. A parking plan and traffic circulation plan shall be submitted and
accepted by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which ia to be
occupied or traveled by vehicles
.
4. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 ae amended and are applicable to this propoaal.
5. Applicant shall sign "Spokane County Notice to the Public Number 6"
which specifies the following:

The owner(s) or euccessor(s) in interest agree that in consideration of
Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, granteea, assigns and successor(s) in intereat hereby
request and authorize Spokane County to include the above described
property in a Road Improvement District (RID) and to aupport the
formation of a Road Improvement District for improvement of the road(s)
described below by requesting and authorizing Spokane County to place
their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID being formed
under the resolution method pursuant to RCW 36.88.030, and/or by not
filing a protest against the formation of a RID being formed under the
alternative resolution method provided for in RCW 36.88.065 and Chapter
35.43 RCW.
If a RID is proposed for improvement of the road (s) described below,
said owner ( s) and successor (s) f urther agree :(1 ) that the improvements
or construction ccntemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themeelves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessmenta may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and f air value improvement ( s) add ( s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. Thia provision is applicable
to Blake Road.
` 6. The applicant should be advised that an approach permit must be
obtained from the Spokane County Engineer Department prior to the
conatruction of any new driveway approaches. This must be done prior
to the release of a building permit.
7. The County Engineer has designated a Local Acceas Roadway Section for
the improvement of Blake Road which is adjacent to the proposed
development. This will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
` curbing and sidewalk is also required.

II. SITE INFORMATION
A. Site Size: Approximately 33,319 square feet.
1. Comprehensive Plan: The Comprehensive Plan category of the subject
property is Urban and the subject property is wit,hun the Prionty Sewer
Service Area (PSSA) and the Aquifer Sensitive Area (ASA) Overlay
Zone.
The Urban (U) category is mtended to provide the opportunity for
development of a"city-like" environment wluch includes vanous land
uses, mtensive residential development and public facilities and services
(water, sarutary and storm sewer lines, police a.nd fire protection and other

features) Residential net densities are suggested to range from 1 to 17
dwelling uruts per acre in the Urban category Since Urban areas will be
the most intensely developed of all the categones, rt is pnmanly a
residential Category of single-family, two-fanuly, mulufamily, and
condomuuum builduigs along with neighborhood commercial, hght
industnal and pubhc and recreational facilihes The more intensive land
uses such as light mdustrial and neighborhood commercial will be located
near the heavily traveled streets, while the least intensive single-family
residential uses will be isolated from the noise and heavy traffic
Mulhfamily structures vall usually be a transrtional use located between
single-fanuly residential and the more intensive areas The Urban
Category of the Comprehensive Plan is pnmanly a residential land use
category but the proposed Home Industiy is an allowed use provided the
applicant applies for and receives a Conditional Use Pernut.
2. Arterial Road Plan: The subject property is located on Blake Road,
which is idenUfied by the Spokane County Artenal Road Plan as a Local
Access Street
3. County Parks Plan: Terrace View Park is located less than a nule west
of the subject property and is the county park closest to the subject
property
B. Site Characteristics. The site is fully developed with a single family residence
and shop as shown on the site plan Chainluik fence surrounds a portion of the
subject property The site and surrounduig area is flat. The subject property
appears to be a residence although rt is not lilce properties in the vicuuty wluch
tend to be heavily landscaped. The designated pazkulg areas north and south of
the shop are graveled as is the roadway along the north property line
C. Neighborhood Characteristics: The neighborhood is composed of similar
single family residences on similar sized parcels. Many residences in the
vicuuty are heavily landscaped
E. Zoning A►nalysis. The purpose of the Urban Residential-3 5(UR-3 5) zone is to
implement the lower density range of the Urban Category of the Comprehensive
Plan The intent of tlus zone is to promote azeas of pnmanly single-fanuly
residential use in an urbaruzed neighborhood settmg, having ahugh level of public
services. Lots shall be served by a public water system and shall reqwre
connecnon to a public centrai sewer system when available. Roadways shall be
paved and curbed and may have sidewalks A Home Industry is an allowed use in
the Urban Residential-3 5(UR-3.5) zone provided the applicant obtains a
Conditional Use Pernut and demonstrates comphance with Condihonal Use
Permit standards of the Spokane County Zorung Code

a Conditional Use for Home Industry subject to specific nutigating
measures necessary to make it compatible with adjacent uses
Section 14 404 101 of the Spokane County Zoning Code states that "a
conditional use is subject to specific review during wluch addrtional
conditions may be unposed to assure companbility of the use with other
uses in the zone " Section 14 404 101 reqwres that the Hearing
Examiner find that the following facts and conditions exist• 1.)
Adequate conditions and restnctions are attached to the developmeat of
the property to ensure that the proposed use will be compatible wnth

dnveways and designated parkuig areas. The property is developed and the site
plan represents what exists on the subject property

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a builclsng permit or use of property as proposed:
1. Applicant shall submit for acceptance by the Spokane County Engineer
drainage and access plans.
2. The applicant shall submit for acceptance by the Spokane County
Engineer and the Spokane County Health District a detailed combined
on-site sewage system plan and surface water disposal plan for the
entire project or portion thereof if the development is phased
3. A parking plan and traffic circulation plan shall be submitted and
accepted by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the pro3ect which is to be
occupied or traveled by vehicles
4. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal.

The owner(s) or successor(s) in interest agree that in consideration of
Mutual Benefits now or to be hereafter derived, do for themselves,
their heirs, grantees, assigns and successor(s) in interest hereby
request and authorize Spokane County to include the above described
property in a Road Improvement District (RID) and to support the
formation of a Road Improvement District for improvement of the road(s)
described below by requesting and authorizing Spokane County to place
their name(s) on a petition for the formation of a Road Improvement
District pursuant to RCW 36.88.050, or by requesting and authorizing
Spokane County to cast their ballot in favor of a RID being formed
under the resolution method pursuant to RCW 36.88.030, and/or by not
filing a protest against the formation of a RID being formed under the
alternative resolution method provided for in RCW 36.88.065 and Chapter
35.43 RCW.
If a RID is proposed for improvement of the road(s) described below,
said owner ( s) and successor (s) further agree :(1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benef its to be derived f rom the f ormation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID is sufficiently
developed; provided, themselves, their heirs, grantees, assigns and
successor(s) shall retain the right, as authorized under RCW 36.88.090,
to object to any assessment(s) on the property as a result of the
improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36.88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final assessment roll; provided further,
it is recognized that actual assessments may vary from assessment
estimate so long as they do not exceed a figure equal to the increased
true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane
County, the improvements required shall be at the sole expense of the
owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10)
years from the date of execution below. This provision is applicable
to Blake Road.
6. The applicant should be advised that an approach permit must be
obtained from the Spokane County Engineer Department prior to the
construction of any new driveway approaches This must be done prior
to the release of a building permit.
7. The County Engineer has designated a Local Access Roadway Section for
the improvement of Blake Road which is adjacent to the proposed
development. This will require the addition of approximately 5-7 feet
of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required.

B. Preliminary Subm ittal
Prior to filing an application, the project sponsor shall become familiar with the cuirent '
procedures and forms. Division of Planning personnel are available for advice on current
procedures, past actions which may affect the proposal and the Zoning Cale requirements.
C. Scheduling an Application for Public Hearing
Completed apgIications received by the Division of Planning will be scheduled for public
heanng on the earliest possible date. A completed application includes fees; hut may be later
rejected if found to be substandard or otherwise lacking in data or required information.
Deparnnent personnel will contact the applicant approximately 28 calendar days prior to the
public hearing, and provide the informarion needed to fulf'ill the notificarion requirements
outlined in "E" below. Occasionally, excessive and unpredictable workloads in the Department
may cause scheduling at a later date.

,E: Conditional Use Permits
The applicant is responsible for meeting all standards of the Code with respect to both the
conditional use secrion and the underlying zone. Any uncertainty should be clarified at
applicarion preconference or application submittal. Failure to meet such standards may result in
significant delay or cancellation of hearing. (Example: a home industry accessory building
must be less than 2 times the gross floor area of the primary residence. Failure to meet this
standard invalidates an application.)
F. Notification Requirements -
The applicant is to provide notification as follows. More detailed instructions are provided
when notification packet is picked up at the Department. You will be notified when to pick up
the packet- Step 1: All property owners and taxpayers within four hundred (400) feet of the property,.
including all additional contiguous ownership or optional land by the owner or agent for the
owner and any easement lands providing access shall be notified by the proponent. Urilizing a
list of such property owners and taxpayers obtai.ned -f-tow- a title comp:.ny and copivs of uhe
Agenda Notification prepared by the Department, the applicant shall accomplish notification by
mailing the agend.a notification as directed by the Department personneI.
Step 2: The apRlicant shall provide the original of the title company-prepared
mailing list, Affidavit of Mailing, all returned mailings (addressee unknown, etc.), and
certain other information to the Department at least two (2) d.ays prior to the public hearing for
inclusion in the file. Failure to do so may jeopardize the hearing process. NOTE: The address list obtained from the title company must be dated no more than 30 days
before the hearing date. When you plan to pick up your mailing packet from this department,
please allow 1 week for the title company to prepare the address list and time for you to do the
mailing by the deadline date.
G. Public Hearing The applicant or representative must be present at the public hearing. If the
owner is not at the meeting, the "representarive" must have written authorization from all
property owner(s) to act on their behalf.
