NOTICE
It is the responsibility of the permittee, not Spokane County, to see to it that the use described on the front of this permit
complies with applicable codes and requirements and that required inspections are requested. Failure to request required
inspections and obtain the necessary approvals prior to progressing beyond the point where inspections are required may
necessitate removal of certain parts of the construction at the owner's/permittee's expense. At a minimum, the following
inspections ARE REQUIRED by County Code:
1. FOOTING — when forms and reinforcement are in place and prior to placement of concrete.
NOTE: This inspection includes review of the structure's setbacks from property lines. Minimum setbacks are
established by County zoning regulations. Typically, side and rear yard setbacks are measured from property
lines, while setbacks for yards abutting streets are measured from the property line or the center line of the
roadway right-of-way, whichever provides the greater setback from the center line of the roadway right-of-way.
Curb linesand fence lines are not necessarily indicative of property lines. In some residential areas, the County
can own as much as 20 feet of right-of-way between your property and the actual improved street/curb. The
responsibility to comply with applicable setback provisions lies solely with the permittee — neither Spokane
County nor its authorized representatives assume any responsibility for the verification or location of your
property lines. Please verify their location priorto locating yourstructure. Failureto properly locate thestructure
may require its relocation at the owner's/permittee's expense.
2. FOUNDATION — when formsand reinforcement are in placeand prior to placement of concrete. (Blocking for a
manufactured home is required to be inspected prior to the installation of skirting.)
3. FRAMING — after all framing, bracing and blocking is in place, and prior to concealing.
4. INSULATION — prior to the installation of drywall.
5. PLUMBING — after rough -in, before covering, and final.
6. MECHANICAL — rough -in of piping, before covering, metal chimneys before concealment, and final.
7. FINAL — when complete and prior to occupancy and/or use. Please provide 24 hours notice.
NOTE: In addition to inspection of the structure, this inspection includes review of site improvements (typically
depicted on theapproved site plan) required by ordinance orasacondition of approval of this permit. Itemssuch
as the installation of fire hydrants, fire department access, on-site drainage ("208 swales"), road improvements,
parking, and landscaping are common requirements of a permit/site plan which must be completed priorto final
approval of a building or issurance of a Certificate of Occupancy.
In addition to the above any plumbing or mechanical systems or materials which would be concealed by framing, drywall,

Unless otherwise noted, this permit will be considered null and void by limitation of the work authorized by the permit is not
commenced or is stopped for a period of 180 days, unless a written request for an extension of the permit is received and

The four code violations listed on my letter of March 14, 1995 regarding your residence
have been inspected and found to be in conformance with applicable code requirements.
The one exception would be, that a single handrail is required for the new steps that are
attached to the landing built in the garage. This handrail needs to be placed between 34"
and 38" above the nosing of the stairs treads, with the handgrip portion constructed from
material that is l-1/4" to 2" in cross sectional dimension.
With the above items completed, the residence now appears to be in conformance with the
Building Codes. This department will record a final approved inspection into the building
records of this residence:

As a follow-up to our conversations and with referenced to the attached, as you saw in the
photos and at the site:
1) Top soil is being and has been removed. While the result of the removal is a level
lot, it is understood that the soil being removed is being used for commercial purposes,
however that has not been verified. As I understand, a permit for topsoil removal as
required by the Zoning Code has not been issued to date.
2) The top soil being removed is not in conformance with the requirements of
14.810.040 (e.g., the removal greatly exceeds a depth of three (3) feet below the existing
natural elevation). In accordance with item #5, it would therefore appear to constitute a
mining operation and would require a mining zone.
3) Excavation in excess of 500 cubic yards would appear to require the submission of
a SEPA checklist at a minimum.

The following items were noted during a walk through inspection of 11012 East Ponderosa
Drive on March 13, 1995. These items are code violations and need to be corrected.
1. A landing is required in the garage at the threshold level of the door that enters the
back yard. The landing needs to be three feet by three feet minimum, due to the door
swinging into the garage area. Then provide steps to the landing that have a minimum tread
of 9 inches and a maximum rise of 8 inches.
2. There needs to be two grills or openings of a hundred square inches each placed in
the wall between the water heater and the furnace. These openings need to be placed one
within 12 inches of the ceiling of the mechanical room and one within 12 inches of the
floor. These openings will allow combustion air from the water heater space to communicate
with the furnace area.
3. This department's records do not reflect any permits for the gas fired fireplace in the
basement family room. A mechanical permit is required for this appliance. The entire gas
line in the house needs to be retested due to the addition of the new gas line to the fire
place.
4. The window well around the egress window has a depth of approximately 48 inches.
Maximum sill height of an egress window is 44 inches. A step of 4 inches or more placed at
the bottom of the well, in front of the non-operable portion of the window, will correct this
violation.

Your memo of May 25, 1995 is acknowledged. It was received on May 26, 1995. Immediately, I
went to ask Wally Hubbard for instructions. He said to request a legal opinion from the
Prosecuting Attorney's office. At 4:40 p.m. on May 26, 1995 I explained the issue to Frank
Christoff, the Deputy Prosecuting Attorney assigned the question and as I write this I still have no
answer. Because time is of the essence in matters like this I am proceeding with a reply without the
legal opinion I was instructed to get.
After inspection of the property, do I believe that there is sufficient cause to initiate legal action?
No, for the following reasons:
1. When a term is not defined in the Zoning Code, section 14.300.000 says such term means its
definition in the Webster's Collegiate Dictionary. "Top soil" is such a term. (see attachment - p
1245). Most of what is being removed from the subject site is not "top soil."
2. Mining is another such term. (see attachment - page 740). It speaks about "ore, metal, or
valuable material. You know as well as I that the material is being given away and is not classified
as ore or metal. We have no evidence that the material involved fits the definition of mining. If it
did, every time a hole that was dug or any time natural grade is changed would be mining and liable
to criminal prosecution. That is not reasonable and zoning must be "reasonable" or it can't be
enforced. There appears to be a potential action between property owners in this case.
If you wish to initiate such action, I will prepare the paper work for you.
