IN THE MATTER OF real property adjacent to Alki Avenue ROW , Road File No. 2166
KNOW ALL MEN BY 'THESE PRESENTS, that the Grantor(s), Spokane Valley Villas, LLC, for and in
consideration of mutual benefits, the receipt of which is hereby acknowledged, warrants and conveys to
the City of Spokane Valley,a municipal corporation of the State of Washington,a PEDESTRIAN
ACCESS EASEMENT over the following described real property, situated in the City of Spokane Valley,
Spokane County, State of Washington, to-wit:
SEE ATTACHED EXHIBIT"A"AND EXHIBIT"B"
The Pedestrian Easement as shown hereon is hereby granted to the City of Spokane Valley and its
authorized agents,and to the public a conveyance easement for use of pedestrian right-of-way, including
but not limited to curbs,sidewalks, grading,drainage, signage, usage by the utility companies and other
usage deemed necessary by City of Spokane Valley Development Engineering Division for the safety and
welfare of the public. Utility easements may cross the Pedestrian Access Easement but cannot be entirely
located within the Pedestrian Access Easement.
No fence or portion thereof will be constructed within said Pedestrian Access Easement without
permission of the City of Spokane Valley Development Engineering Division, nor will any objects be
placed in said Easement that would obstruct the sight distance necessary for safe and efficient vehicular
movement. Any other Easements,except right-of-way granted or dedicated within this Pedestrian Access
Easement,and are subject to Spokane Valley permit process prior to usage.
The Pedestrian Access Easement and the agreements and duties provided for herein shall run with the
land and shall be binding on,and shall inure to the benefit of the parties referenced herein,their heirs,
successors and assigns.
The Grantor(s)or their successors in interest agree to and shall maintain in good repair any pedestrian
access infrastructure to be installed on such property, and when so doing shall not be considered agents of
the City of Spokane Valley.

other drainage structures and appurtenances used for the disposal of public drainage.

All that certain real property lying in Section 15,Township 25 North, Range 44 East,W.M., Spokane
County,Washington,and being more particularly described as follows:
COMMENCING at the Northeast corner of the Southwest Quarter of the West half of Tract 116 of VERA
as per plat recorded in Volume"O", Page 30,
Thence along the East line of said Southwest Quarter of the West half of Tract 116, South 00°07'07"
West, a distance of 321.71 feet to the South line of said Tract 116 and being the POINT OF BEGINNING;
Thence along said South line and also along the South line of Tract 117, North 89°51'39"West, a
distance of 500.23 feet to a point on the East right of way of Alki Avenue;
