MICHAEL HUFFMAN being first duly sworn on oath deposes and says that he is the EDITOR of the Spokane Valley News
Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six months prior
to the date of publication hereinafter referred to, published in the English language continually as a weekly newspaper in Spokane
County, Washington, and it is now and during all of said time was printed in an office maintained at the aforesaid place of
publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the Superior Court of
the State of Washington in and for Spokane County. That the following is a true copy of a Legal Notice as it was published in
regular issues commencing on the 12th day of February, 2016, and ending on the 12th day of February, 2016, all dates

This decision was made after review of �% 4F \NPS '4,
the completed environmental checklist, //X\
the application, Spokane Valley Municipal /
Code (SVMC) Titles 19, 21 and 22, a site
assessment. and comments from the public
and affected agencies. This information is
available to the public on request.
Determination: This MDNS is issued under
WAC 197-11.340 (2); the lead agency will
not act on this proposal for 14,days from
the date issued.
Mitigation: The City of Spokane Valley
shall notify the Spokane Tribe the existing
paving is being removed 48 hours prior to
removal of the pavement to allow a Spokane
Tribe representative to conduct a site visit to
determine if the potential for the discovery
of cultural artifacts exist. If the potential for
discovery exists then an action plan will be
coordinated between the City of Spokane
Valley and the Spokane Tribe. A note shall
be placed on the construction plan with
instructions to notify the City three days prior
to pavement removal to allow notification of
the Spokane Tribe.

Appeal: An appeal of this determination -
shall be submitted to the Community De-
velopment Department within fourteen (14)
calendar days atter the date issued. The
appeal must be written and make specific
factual objections to the City's threshold
determination. Appeals shall be conducted
in conformance with SVMC 17.90 Appeals,
and any required fees pursuant to the City's
adopted Fee Schedule shall be paid at time
of appeal submittal. Pursuant to WAC 197-
11-680, appeals shall be limited to a review
of a final threshold determination.
