use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is condltionedion compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approrl and issuance of permits by the Health District

1. VE 247-83 - Rowe - A review of thie application raises a number of questions
concerning acceas to the property in question as well as other parcels in the
vicinity.
From the information submitted for our review, we are unable to determine to
which county road (established and maintained) the access easement makes a con-
nection. The location of the easement as described is vague and cannot be
aurveyed.
It appears as if other parcels may be served by this easement. It is our
recommendation that the zoning adjustor require the followin,g prior to approval -
of this application.
1. That the access easement to the property be described in a manner which
accurately defines its location and which wfll permit perpetuation of the
easement.
2. That the applicant demonstrate that the right of access does exist from an
established and maintained county road.
3. That the access easement must comply with Spokane County Standards for
Private Rosds (horizontal and vertical alig►nment as well as easement width
and improved roadway surface width).
The Zoning Adjustor should note that Judkins Rnad Ext. No. 86-S as depicted on
the County Engineer's section map is not established or maintained. Its
status as a county road right-of-way is questionable and in all likelihood has
been vacated.
I have attached "conditione of approval" which are applicable should the appli-
cation be approved. However, it is our recommendation that approval of the
application be held in abeyaace until the access quesitons are resolved.
2. VE 3-84 & CUE 1-84 - Bates - No comments concerning this application.
3• CUW 4-84 - Mott - Applicant should be advised that an approach permit must be
obtained from the County Engineer prior to construction of any new drfveway
approaches to the County Road System.

2. Findings:
a. This project lies over the Spokane Aquifer.
b. It is within Critical Water Supply Service Area No. 3 and within the ser-
vice area of Trentwood Irrigation District. 6roun.dwater resources appear
adequate to support development at the proposed density.
c. The project is inside the Spokane County Comprehensive Wastewater Manage-
ment Area; and inside the Priority Sewer Service Area recomnnended in the
'201' Study. The method of sewage disposal is subject to approval of the
Director of Utilities pursuant to County Resolution 80.0418 adopted March 24,
1480. The topography and soils in the area are generally suitable for use
of individual on-site sewage systems. The lot is not of the proper dimen-
sions to permit use of both an individual well and sewage system.
d. The project lies i.n a relatively flat area east of Adams Road and north
of Rockwell Avenue. Local drainageways are insignificant.
e. Surface soils are classed as Garrison gravelly loam with 0% to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of growadwater.

f. Geologically, the soils are glaciofluvial deposits. These geological
structures generally yield moderate to very large amounts of water.
Data from wells in the area shows they are from 65' to 305' deep and
have static water levels varying from 12' to I60' below the surface.
The Trentwood Irrigation District has indicated that it can supply
domestic use water for the project.
3. Recommendations:
a. Sewage disposal method shall be as authorized bp the Director of Utilaties,
Spokane Countp.
b. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individual on-site sewage system map be
authorized.
c. Water service must be coordinated through the Director of Utilities,
Spokane County.
d. Water service shall be by an egisting public water supply when approved
by the Regional Engineer (Spokane), State Department of Social & Health
Services.

CONDITIONAL USE PERMTT FOR A DUPLEX IN THE J DECISION AND
AGRICULTURAL ZONE CONDITIONS
THIS MATTER, Being the consideration by the Zoning Adjusto r of Spokane
County, in hearing the application (CUE-1-84 and VE-3-84), for the purpose of
establishing a duplex in the Agricultural Zone on a lot of approximately 11,000
square feet and with only 90 feet of frontage, hereinafter referred to as the
"Proposal", and the Zoning Adjustor of Spokane County having hel d a publ ic
hearing on February 8, 1984, and having fully considered all testimony presented
thereat, and further having visited the site and vicinity in question, and having
rendered a decision on the 15th day of February, 1984, APPROVING said proposal,
does hereby make the fol l owing:
FINDINGS OF FACT
1. That the proposal is generally located on the northeast corner of Adams
Road and Rockwell Avenue in Section 2-25-44. Parcel #02541-3907.
2. That the p roposal consists of establishing a duplex in the Agricultural
Zone on a lot whi ch has 90.36 feet of frontage and 11,294 square feet of area where-
as the Spokane County Zoning Ordinance requi res 100 feet of frontage and 1500 square
feet 1 ot area fo r th i s use.
3. That the adopted Spokane County General ized Comprehensive Land Use P1 an
indicates Urban usage of the area encompassed by the proposal.
4. Th att the s i te i s zone d Ag ri cul tu ral .
5. That the existing land uses in the area of proposal include single family
resi dences to the east, south and north. To the west i s mul ti pl e fami ly resi dences
and commercial uses along Trent Road.
6. That the applicant has been made aware of the recommendations of various
County/State agencies reviewing this project which include: Department of Building
and Safety, County Health Distrlct and County Utilities Departrrent and has indicated
he can comply with those recommendations.
7. That the proposal does not appear to be detrimental to adjacent properties
nor have an adverse impdct upon the property and improvements in the area.
8. That the appl i cant submi tted a copy of the area covenants i ndi cati ng
duplexes were not excl uded.
9. That the zoning and development trends indicate residential uses of higher
densi ty are cQmpati bl e i n thi s area.
10. That the proposed 1 ot ls located at a corner whi ch provi des two street
fronts and the lot 1s of ample size to accomrrrodate the two dwelling unit structure.
11. That no one appeared to oppose the proposal nor were any written comments
adve rse to the propos al recei ve d.
12. That the proper legal requi rertents for advertising of the hearing before
the Zoning Ad,justor of Spokane County have been met.
CONCLUSION
Following review af the Planning Departrrent File, consideration of the public
testimony, and ci rcumstances in the area of proposal, the Zoning Adjustor concl udes
that the proposal 1s not detrimental and is compatible to the publ ic health, safety
and welfare.
DECISION
From the foregoing Findings, a►^evlew of the Planning Department file No.
CUE-1-84 and YE-3-84, testimony at the public hearing, and a site visit, the Zoning
Ad,justor hereby in APPROyING the proposal establishes the following conditions:

1) The project must meet ali setback requirements of the Agricultural Zone.
2) The proposed structure shall not exceed two (2) stories.
3) Pursuant to the Board of County Commissione rs Resolution No. 80-0418, the use
of on,site sewer d1sposal systems is hereby authorized. This authorization is
con d1t1Qned on compliance with all rules and regulations of the Spokane County
Heal th Di stri ct and i s further condi ti oned and subject to speci fi c appl i cation
app roval and issuance of pe rmits by the Health District.
4) The OwnerCs) or Successor(s) in interest agree to authoriie the County to place
their names on a petition for the formation of a ULID by petition method pur-
suant to RCW 36.94 which the petition indudes the Owner(s) property and
further not to object by the si,gning of a protest petition against the for-
mation of a ULID by petition metho d pursuant to RCW Chapte r 36.94 which includes
the OwnerCs ) property. PROVIDED, thi s condi tion shal 1 not prohi bi t the Owner(s)
or SuccessQrCs1 fram objection to any assessment(s) on the property as a result
of imp rovements cal l ed for i n con j un cti on wi th the fo rmati on o f a UL ID by
e1ther petition or resolutlon rrethod under RCW Chapter 36.94.
5) Any water servlce for this project shall be provided in accordance with the
Cqordinated Water System P1 an for Spokane County.
6) Each dwel ling unlt shatl l be doubl e pl umbed for connection to future area-wi de

7) Sub3ect to speci fi c appl i cati on approval and i ssuance of pe rmi ts by the Heal th
Officer, the use of an individual on-site sewage system may be authorized.
Water service shal l be by an existing publ ic water supply when approved by the
Regional Engineer CSpokane) State Department of Soci al and Heal th Servi ces.
9) Use of prlvate wells and water systems is prohibited.
10) Applicant should be advised that prior to the construction of any new approaches
an approach pemit must be obtained from the County Engineer.
