Dear Mr. Adams:
Our site plan has been carefully designed to reduce the impace of traffic and
cars parking on Willow Road and, therefore, encouraging on-site parking and
access from Muilan Road and Main Street which is the main entrance to our
facility.
In keeping with our objective regarding Willow Road, we are willing to berm
and densely landscape Willow Road thereby creating a restrictive barrier thus
making access to the building from Willow Road very inconvenient because of
the distance one would have to walk around the barrier to gain access to the
building. This will also eliminate headlights shining across Willow Road during
the winter months with the early sunsets.
It should also be noted that our building set back was 25 feet to the property
line prior to the County requesting dedication of 5 feet. Our requested set back
of 20 feet is only for a small portion of the building's angle and well within
the dense landscaping area causing no negative impact.
Regarding the Group Nealth Building, with the cooperation of Group Nealth, we
have now relocated the parking assignment of the four employees who had been
previously parking on Willow Road to on-site parking. They were parking on
that portion of Willow Road improved by us alongside the building. We have
always had ample parking within that facility it was just a matter of assigning
specific parking stalls to individuals.
This is consistent with our goal to maintain a first class business park in
harmony within the community and in keeping with our growing list of major
professional corporate tenants that demand first class office space.
We plan to cooperate with the County Planni.ng Department in review and approval
of our final landscaping plan accomplishing the above.

5. YE 247-83 - Rowe - Since my memorandwn of February 3, 1984, applicant's agent has
provi'd'e'd ocumentation that the applicant does have the right to access the parcel in
question via an easement which extends from Judkins Road. The description of the n
easement is very general, however, a roadway has been constructed to serve the prop- t
erty. This roadway, according to the applicant's agent represents the alignment of
the access easement. Based upon this information, the County Engineer would not
object to approval of this application subj ect to the "Conditions of Approval" which
~ were attached to my February 3 memo.
Prior to the consideration of any additional appl icationswhich propose the use ?of
this or other easements, it is the Engineer s reconmendation that the easements be

2. Findings:
a. This project lies over the Spokane Aquifer.
b. It is within Critical Water Supply Service Area No. 3 and within the ser-
vice area of Modern Electric Water Company. Groundwater resources appear
adequate to support development at the proposed density.
c. The project is inside the Spokane County Comprehensive Wastewater Manage-
ment Area; and inside the Priority Sewer Service Area recommended in the
'201' Study. The method of sewage disposal is subject to approval of the
Director of Utilities pursuant to County Resolution 80.0418 adopted March 24,
1980. The topography and soils in the area are generally suitable for use
of i.ndividual on-site sewage systems. The lot is not of the proper dimen-
sions to permi.t use of both an individual well and sewage system.
d. The project lies in a relatively flat area east of Mullan Road and south
of Main Avenue. Local drainagewaps are insignificant.
e. Surface soils are classed as Garrison gravelly loam with 0% to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater.

f. Geologically, the soils are glaciofluvial deposits. These geological
structures generallp yield moderate to very large amounts of water.
Data from wells in the area shows they are from 78' to 196' deep and
have static water levels earying from 40' to 136' below the surface.
The Modern Electric Water Company has not indicated that it can supply
domestic use water for the project.
3. Recommendations:
a. A combined surface water and sewage disposal detailed plan shall be ap-
proved bq the County Engineer and the Spokane County Health District
prior to the issuance of any building permit for this project.
b. Sewage disposal method shall be as suthorized by the Director of Utilities,
Spokane County.
c. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an individual on-site sewage system may be
authorized.
d. Water service must be coordinated through the Director of Utilities, Spokane
County.
e. Water service shall be bp an existing public water supply when approved
bq the Regional Eagineer (Spokane), State Department of Social & Health
Services.
f. Use of private wells and water systems is prohiba.ted.
g. Disposal of sewage effluent beneath paved surfaces is currently prohibited.

THIS MATTER, Being the consideration by the Zoning Adjusto r of Spokane
County, in hearing the application (VE-8-84), fo r the purpose of considering
requests for variances to front yard and parking requirements, hereinafter
referred to as the "Proposal", and the Zoning Ad,justor of Spokane County
having held a public hearing on February 22, 1984, and having fully considered
all testimony presented thereat, and further having visited the site and
vicinity in question, and having rendered a decision on the 29th day of
February, 1984, APPROVIfVG said proposal subject to landscaping and other
conditions, does he reby make the following:
FIIVDIfVGS OF FACT
1. That the proposal i s general ly 1 ocated on the southeast corner of
Main Avenue and Mul l an Road and/or the southwest corner of Main Avenue and
Willow Road in Section 17-25-44. Parcel #17543-1310.
2. That the proposal consists of allowing an office building to be
located 20' from the property line (on Willow Road) whereas the Spokane County
Zoning Ordinance, Section 4.07A.090 (1) requi res a 25' front yard setback
from the property i n thi s zone. A1 so, the appl i cant requested a vari ance to
locate an off-street parking area within a requi red fl anking street yard,
front yard and interior si de yard. Section 4.07A.110 (A) of the Spokane
County Zoning Ordinance states than an off-street parking area shall not
occupy a requi red fl anking street yard, the front 20' of a requi red front
yard or a 5' space from the side property line of a required interior side
yard.
3. That the adopted Spokane County Generalized Comprehensive Land Use
P1 an indi cates Major Commerci al and Urban usage of the area encompassed by the
p ropos al .
4. That the site is zoned Local Business and Residential Office.
5. That the existing land uses in the area of proposal include
residences to the east, office buildings to the north and west and undeveloped
1 and immediately south.
6. That the proposed site plan appears to be in general compliance with
the concept approved by the Spokane County Hearing Examiner Committee.
7. That in approving the proposal, the Hearing Examiner Committee
approved Residential Office rather than Local Business zoning on the easterly
side of the site to insure a high degree of compatibility with residential
uses across Willow Road.
8. That the easterly portion of the site plan indicates that a sub-
stanti al amount of 1 andscapi ng and screening wi 11 be provi ded to the resi denti al
properties. The applicant has indicated that screening or buffering up to
42" in hei ght is pl anned whi ch wi 11 greatly reduce ni ght traffi c 1 i ghts i nto
nearby resi dences and wi 11 provi de a bufferning between the offi ce and
resi denti al uses.
9. That the variances requested do not appear to be detrimental to the
concept approved by the Hearing Examiner Committee and further the setback
requested on Wiilow Road would normally comply with zoning ordinance provisions
as a fl anking street. The appi i cant i n addressing the unit off Mul l an Road
is technically required to meet front yard setbacks off Willow Road.
10. That a major concern of the party appearing in opposition to the
propos al i s that there wi 11 be addi ti onal street parki ng al ong Wi 11 ow whi ch i s
incompatible with existing uses. The Zoning Adjustor agrees that off-street
parki ng al ong Wi 11 ow may occur however i t wi 11 not be a resul t of the current
proposal.
The appl i cant has not requested any reduction of the number of
requi red parking stalls and appears to have oriented his buil ding to minimize
the off-street parking on Willow.

11. That the project has been conditioned and approved by the Spokane
County Hearing Examiner Committee and the Zoning Acjustor incorporates the
conditions of Zone Change File ZE-57-83 he rewith except for the provisions
of screening and buffering along Willow Road.
12. That the proper legal requirements for advertising of the hearing
befo re the Zoning Adjustor of Spokane County have been met.
CONCLUSION
Fol 1 owi ng review of the P1 anni ng Department fi l e, consi deration of the
publ ic testimony and ci rcumstances in the area of proposal, the Zoning Adjustor
concludes that the proposal is not detrimental and is compatible to the public
heal th, safety and wel fare.
DECISION
From the foregoing Findings, a review of the Planning Department File No.
VE-8-84, testimony at the publ ic hearing, and a site visit, the Zoning Adjustor
hereby in APPROVING the proposal establishes the following conditions:
A. CONDITIONS OF APPROVAL
1) That the Spokane County Zoning Administ rato r determine that the
proposed site plan is consistent with the Hearing Examiner Committee
decision in approving File ZE-57-83.
2) That the appl i cant obtain Zoning Administrator approval of a sol i d
landscaping or screening plan which substantially eliminates motor
vehicle lights from the site towards Willow Road.
3) A11 othe r con di ti ons an d req ui rements o f the Zone Ch an ge -app roval
for File ZE-57-83 are hereby incorporated in this decision.

The office facility across the street from our proposed facility is utilizing
the same variance in the R/o zone as our request. :dithout variances, our
proposed facility would not be economically feasible.
