Recommendations are as circled•
(1) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health Oistrict and is further conditioned and subject to
specific application approval and issuance of permits by the Nealth District.
(2) The Owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of a ULID by petition
method pursuant to RCW 36.94 which the petition includes the Owner(s)
property and further not to object by the signing of a protest petition
against the formation of a ULID by resolution method pursuant to RCW 36.94
which includes the Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessment's)
on the property as a result of improvements called for in conjunction with
the formation of a ULID by either petition or resolution under RCW Chapter
36.94.
(3) Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
(4) There are no recommendations concerning the method of sewaqe disposal as
the project is outside of the 201 sewer study area.
(5) Water service as approved by the Spokane County Health DistriCt and/or the
Washington State Department of Social and Health Services.
(6) Each dwelling unit shall be double plumbed for connection to future area-
wide collection systems.
(7) A dry sewer connection to the future area-wide Sewerage System is to be con-
structed. Plans and specifications for the dry sewer connection are to be
reviewed and approved by the Utilities Department.
(8) Located within the Critical Water Suppiy Service Area but not within any
purveyo r's district. May be serviced by an individual well owned and oper-
ated by 1 ot owner.
(9) Any sewerage service for this project shall be provided in accordance with
the Comprehensive Wastewtaer Management Plan for Spokane County, as amended.

which are specified by the Spokane County Zoning Ordinance for the Commercial Zone.
The property is presently zoned Multiple Family Suburban. It is unclear as to how
relief may be granted from the provisions of the ordinance when, in fact, the provi-
sions of the Commercial Zone do not apply to property which is zoned Multiple Family
Suburban.
The appllcant appears to be familiar with the requirements of the Spokane Countq
Zoning Ordinance. He has made application for a zone change action which proposes
the rezone of the property from Multiple Family Suburban to Commercial. This will
go before the Spokane County Hearing Examiner Committee for consideration May 3,
1984. If the project as proposed does not comply with the provisions of the County
Zoning statute at the time of application for the zone change hearing, is it not the
responsibilitq of the applicant to bring that project into compliance with the
zoning? If relief from the provisions of the County Zoning statute is in order,
then should relief be granted after approval of the proposed zone change?
Does approval of the variance by the Zoning Adjustor prior to the approval of the
zone change constitute an implied sanction or approval of the zone change?
Fourth Avenue is a designated Secondary Arterial within the Spokane County Roadway
System. The County Engineer would request two feet of additional right-of-way along
Fourth so that the necessary roadway improvements might be constructed. Normally,
this right-of-way would be requested at the zone change hearing; however, since this
variance action is right-of-way associated, the County Engineer requests that the
dedication of two (2) feet additional right-of-way be a requirement of this variance
approval. This request is being made pursuant to the provisions of Board of County
Commissioners Resolution 80-1592 which authorizes requirements for right-of-way
dedication in association with variance requests.

THIS MATTER, Being the conside ration by the Zoninq Adjustor of Spokane
County, in hearing the application (VE-16-84), for the purpose of establishing
a detached sign of 42 squane feet in size and 10 feet in heiqht within the
Resi denti al Offi ce Zone, herei nafter referred to as the "Proposal", and the
Zoning Ad,justo r of Spokane County having held a public hearing on March 14,
1984 and having fully considered all testimony presented thereat, and further
having visited the site and vicinity in question, and havinq rendered a
decision on the 16th day of March, 1984, APPROVING said proposal, does here-
by make the following:
FINDINGS OF FACT
1. That the proposal is generally located on the northeast corner of
Mullan and Valleyway in Section 17-25-44. Parcel #17543-0618.
2. That the adopted Spokane County Generalized Comprehensive Land Use
Plan indicates Comme rcial usage of the a rea encompassed by the p roposal.
3. That the site is zoned Residential Office.
4. That the exi sti ng 1 and uses i n the area of proposal i ncl ude qeneral 1y
offi ce and commerci al devel opment on major arteri al s.
5. That the sign requested is solely for purpose of indicatin4 tenants
within the office structure on the property.
6. That there are at least five (5) simllar signs for other buildin4s in
the immediate vicinity of the p roposal.
7. That no adverse comments to the proposal have been recei ved from County
departments reviewing the proposal.
8. That no one appeared to oppose the proposal nor were any wri tten comments
adverse to the proposal recei ved.
CONCLUSION
Following review of the Planning Department file, conside ration of the
public testimony, and circumstances in the area of proposal, the Zoning Ad,justor
concl udes that the proposal i s not detrimental and i s compatible to the publ i c
heal th, safety and wel fare.
DECISION
From the foregoing Findings, a review of the Planning Oepartment Fi1e No,
VE-16-84, testimony at the public hearing, and a site visit, the Zoning Ad,justor
