BEFORE THE BOARD OF ADJUSTMENT OF
SPOKANNE COUNTY, WASHINGTON
IN THE MATTER OF REVIEWING AN ACTION )
OF THE SPOKANE COUNTY ZONING ADJUSTOR ~ FINDINGS & ORDER
IN A DECISION TO APPROYE YARIANCE )
#YE-53-84, WAM ENTERPRISES, INC )
THIS MATTER, Being the consideration by the Board of AdJustment for
Spokane County, is an appeal of an action by the Spokane County Zoning
Adjustor approving the variance #VE-53-84, for the purpose of establishing a
commerci al structure 15' from the property 1 i ne al ong Stout Road, herei nafter
referred to as the "Proposal", and the Board of Ad3ustment of Spokane County
having held a public hearing on September 19, 1984 and having fully considered
all testimony presented thereat, and having rendered a decision on the 19th
day of September, 1984, approving as modified said proposal, does hereby make
the following
FINDINGS OF FACT
1 That the proposal is generally located between Mullan and Stout Road,
ad3 acent and directly south of Sinto Avenue in Section 17-25-44
2 That the proposal consists of establishing a building for retail
business and office space use having a front yard setback of 15' from the
property line along Stout Road
3 That the Generalized Comprehensive Land Use Plan for Spokane County
indicates Commercial designation for the area encompassed by the proposal.
4 That the site lies at a transition point between Major Conenercial and
Urban categories of the Spokane County Comprehensive Plan Goal 6 1 indicates
that commercial development should occur in the manner compatible with
adjacesnt uses in the surrounding environment Objective 6 1 A indicates
buffering between uses should be provided and provisions made for
landscaping Objective 6 1 B and 6 1 C indicates that off-street parking and
circualtion patterns be designed to insure compatible and complimentary
development for all uses affected. Decision Guideline 6 1 4 and 6 1 5 stress
the need for adequate provisions for parking and public facilities When
these are not adequate, commercial parking vnll occur on sides streets and
commercial traffic can adversely affect residential uses
5. That the site was zoned to Local Business by the Spokane County
Heari ng Exami ner Commi ttee on July 15, 1984, wi th formal f indings entered on
July 12, 1984 A minimum 35' front yard setback is required in this zone
6. That the Spokane County Hearing Examiner Comnittee in considering the
proposed zone change approved the zoning without consideration of a specific
stte plan and noted that the Spokane County Zoning Ad3ustor was to consider
the needs of specific site development and access due to the variance request
which affects properties along Stout Road
7. That the Spokane County Zoning Adjustor held a concurrent public
hearing wi th the Heari ng Exami ner Connni ttee on July 5, 1984, concerni ng the
proposal, and that on July 12, 1984 the Spokane County Zoning Adjustor by
Conclusions of Law and Findings of Fact did render a decision to approve the
proposal with the condition that the site be designed in a manner not to allow
auto and truck traffic to the site onto Stout Road
8 That on July 19, 1984, an appeal from the decision of the Zoning
Adjustor of Spokane County was ffled by Walt Miller, the applicant. The
purpose of the fi1ed appeal was to request the Board of Adjustment to delete
the condition placed on the proposal by the Zoning Ad3ustor which restricted
access to Stout Road

IN THE MATTER OF VE-53-84 (ZE-47-84) ; 4JAM ) FINDIhGS OF FACT,
ENTERPRISES, INC. RELAXATION OF FRONT ) DECISION AND
YARD SETBACK REQU I REMENTS ) COND IT IONS
THIS MATTER, Beirig the consideratiori by the Zoning Adjustor of Spolcarie
Courity in hearing the application (VE-53-84), for the purpose of establishing
a commercial structure 15' from the property line alorig Stout Road, herein-
after referred to as the "Proposal", and the Zoriing Adjustor of Spokane County
havirig hel d a publ i c hearing on July 5, 1984 and havi ng ful ly considered al l
testimoriy presented thereat, and further having visited the site and vicinity
in question, and having rendered a decision on the 12th day of July, 1984
APPROV ING s ai d p ropos al , does he reby make the fol 1 owi rig:
FINDINGS OF FACT
l. That the proposal is generally located between Mullari and Stout Road,
adjacent and di rectly south of Sinto Avenue.
2. That the adopted Spokane County Getieral i zed Comprehensi ve Land Use
Pl ari indicates Comnerci al usage of the area encompassed by the proposal.
3. That the site was zoned to Local Business by the Spokarie County Hearing
Examirier Committee on July 5th, with formal findings to be entered on July 12,
1984. A minimum 35' frorit yard setback is required in this zone.
4. That the existing 1 and uses in the area of proposal incl ude resi dential
uni ts adj acent to and di rectly east of the proposal , si ngle fami ly resi deriti al
arid offi ce to the south of the proposal, commerci al uses to the west, arid vacant
1 an d to the no rth .
5. That the site 1 ies at a transition point between the Major Commercial
and Urban categories of the Spokane County Compreherisi ve Plari. Goal 6.1 indi cates
that commerci al devel opment shoul d occur i n the manner compati bl e wi th adj acerit
uses in the surrounding envi ronment. Objecti ve 6.1 . A indi cates buffering between
uses shoul d be provided and provisions made for 1 andscaping. Objective 6.1.B
and 6.1. C indicates that off-street parkirig and ci rcul ation patterns be desigried
to irisure compatible and complimentary development for all uses affected.
Decision Guideline 6.1.4 and 6.1.5 stress the need for adequate provisioris for
parkirig and public facilities. When these are not adequate, commercial parkirig
wi 11 occur on si de streets and commerci al traffi c can adversely affect resi deriti al
uses.
6. That the Spokane Cou►ity Hearing Exami►ier Commi ttee in consi dering the
proposed zone change approved the zoning wi thout consi derati on of a speci fi c
si te pl an arid noted that the Spokane County Zoning Ac~justor was to consi der the
rieeds of speci fi c si te devel opment arid access due to the vari ance request whi ch
affects properties along Stout Road.
7. That the appl i caiit submi tted a revi sed si te pl an ; i denti f i ed as si te
plan "B", ori July 5, 1984 which has beeri subsequently reviewed by the Spokane
Courity Plarining Department, Health District arid County Engirieers Department
fol 1 owi ng the heari ng.
FINDINGS OF FACT, DECISION AND CONDITIONS VE-53-84 PAGE 2
8. The appl i cant i n di cated that the si te i s dep ri ved of no rmal devel opment
opportunities in that it is bound by three (3) public streets which require
substantial setbacks be maintained.
9. That the appl i cants si te pl an and publ i c testi mony i ndi cate that
substanti al parki ng and vehi cl e access wi 11 be di rected towards Stout Road whi ch
appears to confl i ct wi th the res i de►iti al uses al orig the easterly si de of Stout
Road. The Zoning Adjustor finds this can be eliminated by prohibitirig access to
Stout Road.
10. The Zoni rig Ad,j usto r fi nds that i t mi ght be advi sabl e to 1 ocate the
proposed structure somewhat closer to Stout Road and provide all vehicle access
to the west of the si te. Such re-desi gn woul d el imiriate potenti al ly dangerous
access poirits near the intersectiori of Mullan and Sinto, and Stout Road and Sinto.
Addi ti orial ly, i t does not appear that there woul d be any si gni fi cant publ i c
objection to such re-desi gn.
11. That the p ropos al can be compati bl e wi th the adj acent res i deriti al uses
if the site were designed in a fashion to minimize or eliminate commercial and
truck traffi c on Stout Road to promote compati bi 1 i ty wi th the adj acent resi deriti al
uses.
12. That the proper legal requi rements for advertising of the hearing before
the Zoning Ac~justor of Spokane County have beeri met.
CONCLUSION
Fol lowirig review of the Pl arining Departmerit Fi le, corisideration of the publ i c
testi moriy and ci rcumstances i n the area of proposal, the Zoni ng Adj ustor concl udes
that the proposal as coriditioned would riot be detrimerital to adjacent land uses.

PROJECT DESGKiPTIU:;
The proposal is a requested variance to allow a front yard setback, along Stout Road,
of 15 feet from the property 1 irie whereas the Spokane County Zoning Ordinance, Sectiori
4.09.070 ( dl )(the centerl ine setback forniul a) requi res a 40 foot property 1 ine setback.
. The proposed variance was heard by the Zoriing Adjustor on July 5, 1984 duririg a
concurrerit sessiori with the Zoning Hearirig Exami►ier Committee's action on a requested
zone charige for the sanie parcel. On July 12, 1984 the Spokane County Zoriing Adjustor
by Findings of Fact, Decision and Conditions approved the requested variance subject
to specific conditions of approval. One of those conditioris would prohibit ingress
and egress to the site from Stout Road.
On July 19, 1984, the applicant appealed the decision of the Zonirig Adjustor. The
appeal req uests the del eti on of the coridi ti ori prohi bi ti ng access to Stout Road. The
appl i cant cites a need for del ivery vans and trucks to access the rear of the proposed

FOLDDoug, as per attached memo, we are not proposing semi-truck delivery to this
building. If I understood the motion for approval by Jane Myers, she mistook the issue
of Stout Rd. access as an issue to be settled by the zoning adjustor, yourself.
Obviousl it was a HEC condition and that will ave to be clarified next Thursda durin I

FOLD After the hearing today, I was corrected in regards to the delivery vehicles for
the proposed local business zone. That is to ay that the delivery will be by single__ _
axle vehicle only, and that semi-trailers are not expected to the site. We will be
seeking a clarification from the Planning Commission regarding access onto Stout Road
- at the July 12 Planning Commission meeting. Please consider this_information_when_the__.
subject comes up next Thursday.
