THIS MATTER, Be1ng the consideration by the Zoning Ac~justor of Spokane
County, in hearing the application (VE-65-84), for the purpose of allowing
commercial structures to meet the minimum zoning ordinance setback require-
ments between Argonne and Mul l an Roads and Catal do Avenue, he reinafter
referred to as the "Proposal", and the Zoning Adjustor of Spokane County
having held a public hearing on July 5, 1984 and having fully considered all
testimony presented thereat, and further having visited the site and vicinity
in question, and having reviewed the applicants revised site plan submitted
on July 5, 1984 does hereby render a decision on the 12th day of July, 1984,
APPROVING said proposa1, and does hereby make the following
FINDINGS OF FACT
1 That the proposal is located between Argonne and Mullan Roads, adjacent
to and north of Catal do Avenue
2 That the proposal consists of adopting the minimum setback requi rements
wi th i n the Comme rcial zone fo r setbacks f rom the p rope rty 1 i ne whe reas the
Spokane County Zoning Ordinance requi res such setbacks to be rreasured from the
property 1 ine or centerl ine of the ri ght of way and to apply the greater setback
3 That the adopted Spokane County Generalized Comprehensive Land Use Plan
indi cates Major Commerci al usage of the area encompassed by the proposal
4 That the site was approved for Commercia1 zoning on July 5, 1984 with
formal fi ndi ngs to be entered July 12 , 1984
5 That the existing land uses in the area of proposal include a church to
the no rth , to the east si ng1 e fami 1y resi denti al uses, to the south a vacant 1 ot
and single fami ly resi denti al uses, to the west mul ti-fami ly and commerci al uses
6 That in review of the zone change and variance applications, the Spokane
County Engineers Department has indicated that future road improvements in this
vicinity are not contemplated
7 That one of the basic reasons for the dual setback requirements within
the Spokarie County Zoning Ordinance was to provide adequate setbacks in the event
of road expansion, and in this instance road improvements are not contemplated
8 That in acting upon the proposal, the Zoning Adjustor makes no determina-
ti on of the adequacy of the site to meet Spokane County Engi neer ' 208' require-
ments, the Spokane County Health District on-site wastewater disposal requirements,
or the siting, sizing or the number of parking stalls indicated within the plot
plan
9 That a party of record appeared siimply to express concern regarding the
hei ght of the proposed structures and havi ng been i nformed of the 35' hei ght

Following review of the Planning Department File, ZE-45-84 and VE-61C-84, con-
si deration of the publ ic testl~mony, and ci rcumstances in the area of proposal, the
Zoning Acjustor concl udes that the proposal is not detrimental and can be compatible
to the publ ic heal th, safety and wel fare

From the foregoing F1 ndings , a revi ew of the P1 anni ng Department Fi 1 e No
VE-65-84, testimony at the public hearing, and a site visit, the Zoning Adjustor
he reby in APPROVTNG the proposal establishes the following conditions

viding of these services is subject to campliance with Washington Administrative
Gvde and Spokane County ardinances. Prior to service, the company requires explicit

Doug, as a matter of clarification to the variance being reviewed by you, the site
was zoned Commercial to accomodate a school which was not non-profit in nature. (See _"O~
Section 4.10.030 e14 uses permitted; hence, the need for Commercial zoning). Additionally,
because of the computer school tenant we are in excess of the required parking for that us ,
but mav very well be below the required number of parking stalls for other typical retail
uses. Please consider these points in reviewing your amended site plan. Additionally,
keep in mind that this variance request is similar to that which was approved for Millwood _
^urniture along Argonne Road with the same type of issue. That is to say meeting property
Lines set-backs but not center line set-backs. Thank you for your considerations in this

FINDINGS AND ORDER
A. INTRODUCTION '
This matter having come bef ore the Zoning Hearing Examiner Committee on
July S, 1984, and the members of the Committee present being
Kenneth Kennedy, Chairman, Jane E. Myers and Richard L. Skalstad.
B. PROPOSAL
The sponsor, WAM Enterprises, Inc., is requesting approval of a zone
reclassification, File No. ZE-45-84, Single Family Residential (R-1) and
Residential Office to Commercial, for the purpose of developing a
Commercial Office; and a Variance request, VE-65-84, to allow variances to
the Front Yard and Flanking Street Setback Requirements.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial,
church and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial development.
3. That the existing zoning of the property described in the application
is Single Family Residential (R-1) and Residential Office.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs'with the
Declaration of Non-Signif icance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have

D. CONDITIONS OR CONTINGENCIES A.PPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to instailation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
2. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.

a) COUNTY PLANIVING DEPARTMENT (continued)
3, A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Adwinistrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
4. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations wtien approved by the Zoning Administirator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
5. That the site plan submitted for Building Permits be designed to
comply with yard setbacks, garking criteria and landscaping,
which may result in a reduction in building coverage.
6. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
7. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site.
8. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4,16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the f inal decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:

9. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs.
10. A pplicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
11. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
12. That the provisions of SCPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated Alay 4, 1982.
13. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least f ifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environ ment are anticipated as a
result of the project; and a final declaration of
non-signif icance is liereby to be issued.
b) CUUNTY ENGIi1EERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water di
plan f or the entire project prior to the issuance of any

3. A parking plan and traffic circulation plan shall be submitted
and approved by the Spolcane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required f or any portion of the project which is to be occupied
or traveled by vehicles.
4. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
5. The construction of tlle road improvements stated herein shall be
acc omplished as approved by the Spokane County Engineer.
6. All required improvements S11311 conform to the current State of
Wasliington Standard Specifications for Road and Bridge
Cunstruction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
i-tanagement in effect at the date of construction, unless
otherwise approved by the County Engineer.
7. Roadway standards, typical roadway sections and drainage plan
requirements are f ound in S pokane Board of County
Commissioners'Resolution No. 80-1592 as amended.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
Uistrict and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
2, The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in cunjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.

3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. Each unit shall be double- plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan
shallbe approved by the County Engineer and the Health District
prior to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
ti. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUN'TY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District # 1.
2, Installation of fire hydrants are required to be installed and
serviceable in accordance with the Spokane County Department of
Building and Safety prior to development. A water plan showing

construction of water service. The water plan shall specify the
gallons per minute for each fire hydrant at residual pressure of

3. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.

1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.

demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surf aces.
3. Al1 travelled surfaces (ingress, egress, parking areas, acCess
roads) must be paved and kept clean.
4. Sone objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. All air pollution regulations must be met.
