Board of County Commissioners Resol ution #55-104, adopted in 1955 and never repealed, waived the rear yard setback requi rements in the area of thl s property (see attached copy of resol uti on Thi s obs cure resalution, which fis not contained in the Spokane County Zoning Ordinance, explains our original concern that other existing structures in the area have no rear yard setback from the rai 1 road ri ght-of-way. Based on your concurrence, I have wi thdrawn the vari ance appl i cation from its scheduled agenda. I have begun the process of obtaining a refund of your $135.00 vari ance fee pai d to the P1 anning Department. Actual return of the money may take a few weeks. Refund of review fees paid separately from any other department i s your responsi bi 1 i ty. When you are ready to apply for your bui 1 ding permi t we wi 11 review the permi t based on the above stated resol ution. My previous comments on the parking requi red by the Spokane County Zoning Ordinance shou1 d be resol ved.
