O Pursuant to the 6oard of County Cormnissioners Resolution No. 80-0418, the
use of on-site sewer disposal systems is hereby authorized. This authoriza-
tion is conditioned on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned and subject to
specific application approval and issuance of permits by the Nea-lth District.
Q The Owner(s) or Successor(s) in interest agree to authorize the County to
place their name(s) on a petition for the formation of a ULID by petition
method pursuant to RCW 36.94 which the petition includes the Owner(s)
property and further not to object by the signing of a protest petition
against the formation of a ULID by resolution method pursuant to RCIJ 36.94
which includes the Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any assessmentk's)
on the property as a result of improvements called for in conjunction with
the formation of a ULIO by ei ther peti tion or resol ution under RCW Chapter
36.94.
~ Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
(4) There are no recommendations concerning the method of sewaQe disposal as
the project is outside of the 201 sewer study area.
(5) Water service as approved by the Spokane County Health District and/or the
Washington State Department of Social and Nealth Services.

1. VN 6-85 Wells - This proposal is served by a private drive. Consequently, public
notice acknowledging this must be executed by the applicant. This public notice
will be prepared and recorded with the Spokane County Auditor by the Office of the
County Engineer. The notice must be signed by the applicant. Once recorded, the
Notice to the Public will appear in future title reports on the property. See
attached comments.
Applicant shall submit to the County Engineer for review and approval road and
drainage plans. The private road and drainage structures must be designed in
compliance with Spokane County Road and Drainage Standards.
~ VE 15-85 - Cedar Builders - Any parking facilities and landscape areas which are
the receptors of stormwater drainage ('208' swales) must be constructed outside of
the County Road right-of-way as depicted on the site plan.

contamination of groundwater The soll, based on textural classification
is Type I
f Geologically, the soils are glaciofluvial deposits These geological struc-
tures generally yield moderate to very large amounts of water Data from
wells in the area shows they are from 78' to 225' deep and have static water
levels varying from 45' to 106' below the surface The Hutchinson Irrigation
District has not indicated that it can supply domestic use water for the
project
Recommendations
a A combined surface water and sewage disposal detailed plan shall be ap-
proved by the Spokaae County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this project

TNIS MATTLIt, Bei ng the consideration by the Zom ng Adjustor of Spokane
County, in hearing appl i cation CUE-1-85/VE-15-85, herei nafter referred to as
the "Proposal", and the Zom ng Adjustor of Spokane County having held a public
hearing on March 27, 1985 and having fully considered all testimony presented
thereat, and further having visited the site nd vicinity in question, and
having rendered a verba] deci si on on the ~ day of Apri 1, 1985, APPROV INb
the ProPosal, makes the follownn

FINUINGS UF FNCT
1. That the proposal is generally located west of and adjacent to
Argonne Itoad, approxi mately 4uU feet north of Sprague Avenue and i s further
described as E►ssessors Parcel #18544-2044, being more accurately described in
documents contained i n Fi1 e CUE-1-85/VE-15-85
2. That the proposal consists of a conditional use permit application to
locate an off-street parking facility in the N ricultural Zone and the
application also consists of variances to (1~ allow the parking facility to
be located on a parcel of land having an area of 5,643 square feet whereas the
Spokane l.ounty Zoni ng Ordinance requires a minimum 1 ot size of 7, 5UU square
feet, and (2) to allow the Qarking facility to be located 5 feet from Argonne
Itoad whereas the Zom ng urdinance requires a 2y foot setback from the front
property 1 i ne.
3. That the adopted Spokane (.ounty Future Land Use Plan designates the
area of the proposal as Major Commercial and the proposal is consi stent wi th
the County m s enti re Comprehensive Pl an, i ncl uding the Future Land Use P1 an
4. That the site is zoned Agricultural which would allow the proposed
use upon approval of this appl i cation.
5. That the existing land uses in the area of the proposal include
vacant apartments to the south (soon to become offices and parking),
comnercial and local business to the east, a residence (deteriorated) to the
north and business/comnerclal to the west all of which are compatible wnth the
proposal
b That the proposal is exempt from the provisions of Lhapter 4J 21C RCW
pursuant to WA(. 1 y7-11-8UU (1) (c) and ( 6)(b) and Spokane Envirornmental
Urdi nance 11 10 070 (d).
7. That property irmnediately to the south, by Hearing t-acaminer Committee
Action ZE-99-84, granted approval to an office complex and related parking,
with said parking lot designed wtth a 5 foot landscape strip at the street
B. That previous Zoning Adjustor action CUE-59-84/VE-219-84, did
recently approve a very si mi1 ar proposal for a parking l ot in rel ati on to an
adjacent piece of property.
y That the subject property is only 43 feet wide, contains a
deteriorated residence, i s 1 ocated in an area of increasi ngly greater business
and commercial land uses and that no single commercial or business land use
coul d reasonably occupy thi s narrow si te and sti 11 conform with the Spokane
County Zoning Urdinance.
10 That other busi ness and commerci al property i n the area are
characterized by parking lot, landscaping and street relationships similar to
the proposal.

lU. That the businesses to the south and the public in general will
benefit from adequate and increased off-street parking stalls
11. That the proposal will impose no excessive demands upon public
utilities in the area.
12 The proposal will not be detrimental to the l.omprehensive Plan or to
surroundi ng properties
13. That special circumstances, particularly lot size, when combined with
the strict application of the zoning ordinance standards do deprive the
property of rights and privileges erW oyed by others in the area under
identical zones
14. That the applicant has been made aware of the recommendations of
various County/State agencies revi ewing this project and has indicated they
can comply wnth those recommendations
15. That no one appeared to oppose the proposal nor were any written
comments adverse to the proposal received.
16 That the proper legal requirements for advertising of the hearing
before the Zoning Adjustor of Spokane Lounty have been met
From the Fi ndi ngs of Fact, the Zom ng Adjustor comes to these
CONCLUSIONS
1. The proposed parking area is listed as a permitted conditional use in
the Agricultural Zone and it meets all of the required established and
applicable criteria except that it is less than the mi m mum 7,5UU square foot
and does not conform to the 25 foot setback from the front yard, and it i s
these 1 ater two criteri a which has prompted this submissi on of a vari ance
application concurrent with the conditional use permit, both of which are
dimensional variances which the Zom ng Adjustor is empowered to grant.
2. The performance standards which will be used to make the parking
faci1ity compatibl e r+n th other permitted activiti es in the same vi cim ty and
zone wn11 be the numerous condi ti ons of approval from zone change Fi1 e
ZE-y9-t34
3. The proposal imposes no excessive demands upon public utilities in
the vi ci nity
4. 6ranting the condi ti onal uses pemit as condi tioned wi 11 not be
detrimental to the Comprehensi ve P1 an nor to surrounding properties
5 Various reasonable restrictions, conditions and safeguards designed
to uphol d the spirit and i ntent of the Zom ng Ordinance hel p to miti gate any
adverse affects to neighboring properties will be imposed through conditions
of approval.
6 The proposal is not detrimental to and is compatible with the public
heal th, safety and wel fare.
7. The subject property, r+n thout the condi tional use granted, is
deprived of privi 1 eges commonly erjoyed by other properties i n the same
vi cini ty and zone and the granting of the variance an 11 remedy the difference
i n privi1 eges
8. The granting of the variance is not a grant of special privileges
i nconsi stent with privi1 eges enjoyed by other properties in the vi cinity and
zone.
9 The strict appl icati on of the standards of the Spokane County Zom ng
Urdinance deprives the subject property of rights and privileges of other
properties in the area and under identical zones
10. The granting of the variance is not materially detrimental to the
publ ic wel fare or irW urious to property or improvements i n the vici m ty or
zone in whi ch the subject property i s 1 ocated.

DEG IS ION
From the foregoing Fi ndings of Fact and Concl usions, the Zoning Adj ustor
APPftOVES the proposed conditional use permit and variances. The following
CONU ITONS OF IiPPftOVAl. are stipul ated.
CUND IT IONS OF APPKUYAL
1. The fol l owing condi ti ons shal l apply to the appl i cant, owner and
successors i n interest
2. ArUr parking facilities and landscape areas which are receptors of
stormwater drainage (!208! swales) must be constructed outside of the
county ri ght-of-way as depicted on the site pl an contai ned i n the fi 1 e
3. In general, al 1 condi ti ons of ZE-99-84 which woul d al so apply to the
subject proposal shall become conditions of approval, but specifically the
following conditions of approval are stipulated
a. x mim mum 5 foot landscape strip shall be provided along the north
property line and along the east property line consistent with
ingress and egress requirements, and the north property line
landscaping theme shall be carried along the west property line for
aesthetic conti nui ty of 1 andscaping, in addi ti on to the ; 2UU," grass
perculation area and catch basin which shall also be located in the
westerly end of the property, between the paving and the landscape at
the fenced and landscaped west edge of the property
b The Zoning Administrator shall also approve the specific exterior
lighting plan for this parking area at the same time that he/she
approves the exteri or 1 i ghti ng pl an for ZE-99-84 and said 1ighti ng
plan shall be an extension of and consistent with the lighting plan
for ZL-y9-84
c. A specific landscape plan, planting schedule and provisions for
maintenance shall be included for this subject proposal with the
approval of ZE-99-84 and in the same manner and cl rcumstances of
approval.
d The applicant shall develop the subject property generally in
accordance with the concept presented in subject file of the Zoning
Adjustor action and ZE-99-84.
e The specific site plan for the subject proposal shall be submitted
with the specific development plan for ZE-99-84 for Planning
Uepartment review and approval prior to issuance of building permits.
4. Access permits for approaches to the County road system shal 1 be obtat ned
from the Spokane County Engi neer
y. The appl i cant shal lincl ude in the detai1 ed pl an for combi ned on-si te
sewage system and surface water d1 sposal the subject property, pri or to
the issuance of any bui1 ding permi t for this property or the property to
the south
6. This property shall also be included in the parking plan and circulation
pl an required to be submi tted to the County Engineer i n fi1 e ZE-99-84
7. The construction of atUr road improvements associated with this parking lot
sha11 be accompl ished as approved by the (.ounty Engineer.
8 Thi s parcel of 1 and may, at the di scretion of the Spokane County Engineer,
contain all or a portion of one of the two paved and delineated access
approaches on Argonne Road
