Enclosed are the forms necessary for the applicant, of the above-referenced Zoning
Adjustor action, to complete the public information requirements.
5TEP 1: Take the Title Company packet to any local Title Company for a search and
development of a list of property owners and taxpayers (including a listing of lending
institution names and addresses, as appropriate) for properties within four hundred
(400) feet of the periphery of the proposal. In those instances where any portion of the
abutting property is owned, or controlled or under option by the applicant or his
management/representative, then the four hundred (400) foot notification radius shall
be based on the total combined ownership. Additionally, easements leading to the
property from a public road are considered part of the proposal. The subject site,
adjoining ownerships and easements are shown on the Assessor's map(s). The Title
Company listing shall be current to within thirty (30) days of the public Hearing.
STEP 2: Utilizing the addresses obtained in STEP 1 and copies of the Notice of Public
Hearing, including the vicinity map (enclosed), the applicant shall notify by CERTIFIED
MAII,, RETURN RECEIPT REQUESTED all property owners and taxpayers abutting (or
directly across a street or road from) the proposal by placing in the U. S. Postal Service
mail at least fifteen (15) calendar days prior to the Hearing. The applicant shall also
notify all other property owners and taxpayers not abutting the subject site, yet
within the 400 foot radius, by 'regular mail by placing in the U. S. Postal Service mail at
least fifteen (15) calendar days prior to the Hearing. Property owners and taxpayers are .
those shown on the most current Treasurer's computer records, that is, no older than ,
thirty (30) days prior to the Hearing, obtained by the applicant from the Title Company.
Whenever a bank or lending institution is shown as the taxpayer then the notice (a
special attached memo is provided for this purpose) to that institution shall also
reference the mortgage number provided by the Title Company. NOTE- The applicant is responsible for verifying the completeness of the Title Company's ownership/taxpayer list against the Assessor's map(s) and must certify ,
same.
$TEP 3: The applicant shall provide to the Planning Department no later than two (2)
working days prior to the public hearing: a) Affidavit of Mailing; b) Title Company Certification; c) assessor's map; d) mailing list; e) certified mail receipts; f) all returned
letters; and g) a copy of the Hearing notification and vicinity map.
NOTE If the above affidavits and documents are not in the filed two (2) working days
prior to the public hearing or the public notification requirements are not met,
then the Zoning Adjustor may, at his/her discretion, not conduct the public
h e a r i n g and would then continue the case to the next available hearing opening
with re-advertisement costs as those of the applicant's expense.

We have lived in this house for 20 years and it was not
until after the development of the Centennial Trail that we
found it necessary to construct a fence. Because of the
Centennial Trail we have been degrived of privacy by the
hundreds vf bicyeles, joggers, and strangers who enter and
exit the Centennial Trail access road which is located at
the end of our driveway.
In the early spring until late falY there are up to a dozen
automobiles lined up along the perimeter of vur
property.This problem is unique to us because the location
of the Centennial Trail access road borders caur property.
The reason our fence is 7 feet high on our side yard is
because the grade of Flora Road is approximately 4 feet
higher then the grade of our property. This grade variance
is unique to our property.
The only way to achieve any privacy from tri.e cars which line
up along our property is to have a fence that is high
enough to block them vut.
The violation we have been issued is against a front yard
fence that measures over 3 feet high. But this is not our
front yard, it is our side yard. Qur frant yard a+ctually
faces north. It is the counties opinion that the area in
violation is our front yard.
Our front doQr faces north, and outside of that c3oor is our
frvnt yard, and we do have a 3 foat fence in our front yard.
We cannot do anything about the hundreds of strangers that
wander a].ong our property boundary vr those who park along
our property. But we can try to maintain some privacy with
aur fenee. Besides providing privacy, our fence protects
our yaung children from the traffic and the strangers that
the Centennial Trail has braught so close to our home.

E. Notification Requirements .
The applicant is to provide notification as follows. Moze detaiJ.ed instructions are provided
when notification packet is picked up at the Department. You will be notified when to pick up the packet.
Step 1: A11 property owners and taxpayers within four hundred (400) feet of the property,
including all additional contiguous ovcmership or optional land by the owner or agent for the
owner and any easement lands providing access shall be notified by the proponent. Utilizing a
list of such property owners and taxpayezs obtained from a title company and copies of the
Agenda Notification prepared by the Departnnent, the applicant shall accomplish notification by
mailing the agenda notification as d.irected by the Deparnnent personnel.
Step 2: The appiicant shall provide a copy of the title company-prepared
mailing list, Affidavit of Mailing, all returned mailings (addressee unknown, etc.), and
certain other infomlation to the Deparnnent at least two (2) days prior to the public hearing for
inclusion in the file.
NOTE: The addxess list obtained from the title compa.ny must be dated no more than 30 days
before the hearing date. When you plan to pick up your mailing packet from this department,
please allow 1 week for the title company to prepare the address list and time for you to do the
mailing by the deadline date.
F. Public Hearing
The applicant or representative must he present at the public hearing. If the owner is not at the
