1 Because of special circumstances apphcable to the property, stnct apphcarion of the front
yard setback requirement of Zomng Code 14 616 325 (1) creates prachcal difficultces and
depnves the property of nghts and pnvileges enjoyed by other properties in the vicuuty and
suYUlazly zoned
2 Gzantmg of the vanance will neither be detnxnental to the pubhc welfare nor injunous to
the properiy or improvements in the vicuuty and the UR-3 5 zone m which the srte is located
3 The proposal, as condihoned, generally conforms to the Comprehensive Plan
4 The proposal, aside from the requested vanance, comphes with the UR-3 5 zone and other
apphcable development regulations

III DECISION
Based on the Fmdzngs of Fact and Conclusions of Law stated above, the apphcarion for a
vanance from the front yard setback reqwrements of the Urban Residenhal-3 5(UR 3 5) zone,
for development of an addihon to a pump house for domesric water for a pubhc utihty, is hereby
approved, subject to the conditions of approval hsted below
Any conditions of pubhc agencies that have been added to or significantly revised are

pump house is approximately 412 square feet and is arguably a nvn-conforming use. The applicant states
thue originas building was constructed in the 1944's, prior to the unceptian of building permits, with an addition
built in the early 1980's. The Division af Building and Code Enforcement has no recard of a permit being
issued far the existing structure. The site is a corner !ot and has frantage 4n both Progress Road, to the
east, and Rich Avenue, to the svuth. The topography af the site is gently sloping down from the east to wes#
and frQm svuth to north. The site is completely fenced with a 4-faot cyclane fence and is larrdscaped wfth
lawn.

The applicatian was submitted to the Division of Pianning vn April 12, 2001. The applicat{on was

Project Description:
The subject property is located within the Urban Residential-3.5 (UR-3.5) zone, and Section 14.616.325 of
the Spokane County Zoning Code requires a minimum front yard setback of 35 feet from the property line.
The applicant has requested a variance from these dimensional standards in order to construct a pump
house addition to the existing pump house at the north end of the property, within 3 feet of the east property
line, adjacent to Progress Road. The site plan of record illustrates the proposed addition to be 12'x 15'4" in
size or approximately 185 square feet. The addition is to enclose an existing well located to the north of the
existing structure.
Staff Analysis:
Comprehensive Plan:
The subject property is located within the Urban category of the Spokane County Comprehensive Plan. The
Urban category is intended to provide the opportunity for the development of a"citylike" environment with
intensive residential uses. Since Urban areas will be the most intensely developed of all the categories, it is
primarily a residential category of single-family, two-family, multifamily, and condominium buildings along
with neighborhood commercial, light industrial, and public and recreational facilities.
Decision Guideline 1.1.1 states that urban development wilt be allowed in areas having a full line of public
services available. The requested variance is for the purpose of expanding a water district pump house to
enclose an existing domestic water pump.
Zoning: ~
The subject property is located within the Urban Residential-3.5 (UR-3.5) zone, and the purpose and intent
of the Urban Residential-3.5 (UR-3.5) zone is to implement the lower density range of the Urban category
and to promote areas of primarily single-family residential use in an urbanized neighborhood setting.
Zoning within the general area of the site is primarily Urban Residential-3.5 (UR-3.5).
Section 14.404.081 of the Zoning Code recognizes that circumstances may exist such that strict application
of the Zoning Code may cause practical difficulties regarding the use of the property. Upon demonstration
to the Hearing Examiner by the property owner of circumstances which create practical difficulties, the
Hearing Examiner may grant a variance from the provisions of the Zoning Code.
In order for a variance request to receive approval, compliance with Section 14.404.082(1-3) of the Spokane
County Zoning Code must be demonstrated by the applicant. Any variance from the terms of the Zoning
Code shall be subject to those conditions specifically identified in Section 14.404.082 (1a & b). Analysis of
the proposal with regards to Section 14.404.082 (1a & b) is as follows:
Response to 14.404.082(1a): The application states that due to the location of the existing well
(currently inoperable) and where the replacement pump will be installed, there is no other reasonable
location for the addition. The proposed addition is 12 feet in width and 15 feet 4 inches deep.
Response to 14.404.082(1b): The applicant has responded to question D on the Variance Burden of
Proof form by stating that the proposed variance will not be harmful to the public welfare nor injurious to the
property or improvements within the vicinity of the property.
The fotlowing analysis of Section 14.404.082(2 & 3), while not to be considered as sole
substantiation, shall be considered in the granting of a variance:
Response to 14.404.082(2a): Strict application of the Zoning Code standards may create an
unreasonable burden on the applicant since without the requested variance the applicant would not be able
replace the existing burned up submersible pump. The new high efficiency vertical turbine must be
enclosed for noise and security.
Response to 14.404.082(2b): Relaxation of the front yard setback standards will allow a more
environmentally sensitive, energy conserving design or result in the adaptive reuse of a historic property.
The applicant states that the District will save electricity by installing a higher efficiency motor.

Response to 14.404.Oaz(2c): A broader community need will be surved by the granting of this
variance request. The applicant states that they will be replacing the submersible pump (that burned up)
with a higher efficiency vertical turbine.
Response to 14.404. 082(3a): The granting of the variance will not be based upon a precedent
established by illegal or non-conforming circumstances.
Response to 14.404.082(3b): No precedent will be established which will adversely effect the zoning
concept for the existing neighborhood or the County as a whole. There have been three (3) similar
variances requested and granted in the general area of the site.
Response to 14.404.082(3C): The variance is not being requested based upon reasonable economic
return from the subject property, as the applicant is a public utility.
Response to 14.404.082(3d): The Goals, 4bjectives and Decision Guidelines of the Urban category
of the Comprehensive Plan do not specifically address variance requests. However, the proposed variance
is not inconsistent with the purpose and intent of the Comprehensive Plan as the Urban category is intended
to be primarily a residential land use category.
Response to 14.404.082(3e): The practical difficulties related to the property did not exist when the
applicant purchased the property, however this site was the first well site of the district, which was formed in
1918. The first well was established on the property in the 1930's.
Response to 14.404.082(3t): The proposed variance for a pump house addition will not result in a de
facto zone reclassification.
Response to 14.404.082(3g): The proposal does not impact the density recommendations of the
Urban category of the Comprehensive Plan.
Summary:
The requested variance from the minimum setback standards of Section 14.616.325 of the Spokane County
Zoning Code is based on special circumstances applicable to the properiy and strict application of the
Spokane County Zoning Code development standards does create an unreasonable burden on the
applicant. The applicant has demonstrated compliance with the criteria for a variance as specified within
Section 14.404.082.

Building Code, Spokane County Standards for Road and Sewer Construction, Spokane
County Guidelines for Stormwater Management and the regulations of the Spokane
Regional Health District.
ACTION: This project is subject to a future public hearing. You will be receiving a
Notice of Hearing which will be issued a minimum of fifteen (15) days prior to the public
hearing. A written report, including a staff analysis of the project and recommended
conditions of approval, will be available for inspection seven (7) calendar days prior to
the public hearing. Participation in the public hearing is encouraged. A copy of the
Notice of Decision issued by the Spokane County Hearing Examiner which identifies the
findings of fact, conclusion, decision and appeal rights will be provided to those
individuals who testify at the public hearing and will be available to all others upon
request.

It is the responsibiliry of the applicanUpermittee, not Spokane County, to see to it that the use described on the front of this permit complies with
applicable codes and requirements and that required inspections are requested. Failure to request required inspections and obtain the necessary
epprovals prior to progressing beyond the point where inspections are required may necessitate removal of certain parts of the construction at the
applicant's/permittee's or property owner's expense. At a minimum, the following inspections ARE REGIUIRED by County Code:
1. FOOTING - when forms and reinforcement are in place and prior to placement of concrete-all structures, including manufactured homes.
NOTE: This inspection includes review of the structure's setbacks from property lines. Minimum setbacks are established by County zoning
regulations. Typically, side and rear yard setbacks are measured from property lines, while setbacks for yards abutting streets are measured from
the property line or the center line of the roadway right-of-way, whichever provides the greater setback from the center line of the roadway right-of-
way. Curb lines and fence lines are not necessarily indicative of property lines. In some residential areas, the County can own as much as 20 feet of
right-of-way between your property and the actual improved street/curb. The responsibitity to comply with applicable setback provisions lies solely
with the permittee-neither Spokane County nor its authorized representa6ves assume any responsibility for the verification or location of your
property lines. Please verify their location prior to locating your structure. Failure to properly locate the structure may require its relocation at the
owner's/permittee's expense.
2. FOUNDATION - when forms and reinforcement are in place and prior to placement of concrete.
3. FRAMING - after all framing, bracing and blocking is in place, and prior to concealing.
4. INSULATION - prior to the installation of drywall.
5. PLUMBING - after rough-in, before covering, and final.
6. MECHANICAL - rough-in of piping, before covering, metal chimneys before concealment, and final.
7. FINAL - when complete and prior to occupancy and/or use. Please provide 24 hours notice. All permits require final inspection.
NOTE: In addition to inspection of the structure, this inspection includes review of site improvements (typically depicted on the approved site plan)
required by ordinance or as a condition of approval of this permit. Items such as the installation of flre hydrants, fire department access, on-stte
drefnage ("208 swales"), road Improvements, parking, and landscaping are common requirements of a permiUsite plan which must be com-
pleted prior to final approval of a building or issuance of a Certificate of Occupancy.
8. MANUFACTURED NOMES - Final inspection required when complete, stairs, handrails, skirting, etc. installed, and prior to accupancy; completed
inspection record card must be available on site.
In addition to the above, any plumbing or mechanical systems or material which would be concealed by framing, drywall, concrete, etc., must be
inspected prior to cover. Check with the department for "special inspections" in conjunction with commercial projects.

PERMIT EXPIRATION AND REFUIVDS
Unless otherwise noted, this permit will be considered null and void by limitation if the work authorized by the permit is not commenced or is stopped
for a period of 180 days, unless a written request for an extension of the permit is received and approved by the Building Official prior to expiration. At
a minlmum an inspection should be requested at least once every 180 days to assure the validity of the permit. A permit may be renewed within one
year of the date of expiration for one-half the original fee, subject to certain limitations-please call us if you have any questions.
All refund requests must be made in writing by the applicanUpermittee (shown on the reverse) no later than 180 days atter the date ot fee payment.
Refunds of not more than 80% of the permit fee paid may be authorized when no work has been done under the permit. No refunds may be authorized
more than 180 days after fee payment.

If you think we've made an error in processing this permit or in conducting inspections pertaining to it, or find erroneous information in the permit,
please bring it to our attention immediately by filing a written request for correction within 10 working days of discovery. All such requests should be

submitted if it is found that such information is needed to clarify the file documents.
A. ADDITIONAL FEE REQUIREMENTS
In order to assist you with your financial planning regarding this application, please be advised
that other departments and aqencies with which you are required to consult may charqe you an
additional fee. The fees charged by the Division of Planning only partially defer our
administrative costs and are not shared with other departments or agencies.
B. Preliminary Submittal
Prior to filing an application, the project sponsor shall become familiar with the current
procedures and forms. Division of Planning personnel are available for advice on current
procedures, past actions which may affect the proposal and the Zone Code requirements.
C. SCHEDULING AND APPLICATION FOR PUBLIC HEARING
Completed applications received the Division of Planning will be scheduled for public hearing on
the earliest possible date. A completed application includes fees; but may be later rejected if
found to be substandard or otherwise lacking in data or required information. Division
personnel will contact the applicant approximately 28 calendar days prior to the public hearing
and provide the information needed to fulfill the notification requirements outlined in "E" below.
Occasionally, excessive and unpredictable workloads in the Division may cause scheduling at a
later date.

\ ~The applicant is responsible for meeting all standards of the Code with respect to both the
conditional use section and the underlying zone. Any uncertainty should be clarified at
application preconference or application submittal. Failure to meet such standards may result
in significant delay or cancellation of hearing. (Example: A home industry accessory building
must be less than 2 times the gross floor area of the primary residence. Failure to meet this
standard invalidates an application.)
F. NOTIFICATION REQUIREMENTS
The applicant is to provide legal notification. More detailed instructions are provided when the
notification packet is picked up at the Division. You will be notified when to pick up the packet.
STEP 1: All property owners and taxpayers within four hundred (400) feet of the property,
including all additional contiguous ownership or optional land by the owner or agent for the
owner and any easement lands providing access shall be notified by the proponent. Utilizing a
list of such property owners and taxpayers obtained from a title company and copies of the
Agenda Notification prepared by the Division, the applicant shall accomplish notification by
mailing the agenda notification as directed by the Division personnel.

STEP 2: The applicant shall provide the original of the mailing list prepared by the title
company, Affidavit of Mailing, all returned mailings (addressee unknown, etc.) and certain other
information to the Division at least two (2) days prior to the public hearing for inclusion in the
file. Failure to do so may jeopardize the hearing process.
NOTE: The address list obtained from the title company must be dated no more than thirty (30)
days before the hearing date. When you plan to pick up your mailing packet from this division
please allow one (1) week for the title company to prepare the address list and time for you to
do the mailing by the deadline date.
G. PUBLIC HEARING
THE APPLICANT OR REPRESENTATIVE MUST BE PRESENT AT THE PUBLIC HEARING. If the owner is
not at the meeting, the "representative" must have written authorization from all property
owner(s) to act on their behalf.

Spokane County Resolution No. 96-0294. All interested persons may testify at the public hearing, and
may submit written comments and documents before or at the hearing. The Hearing Examiner may limit
the time given to speakers. A speaker representing each side of the issue is encouraged. Any appeal of- ,
the Hearing Examiner's decision will be based on the record established before the Hearing Examiner,
pursuant to County Resolution Nos. 96-0171. Environmental appeals will follow the same procedural
route as the underlying action. All hearings will be conducted in facilities that are accessible to persons
with physical disabilities.
Inspection of File, Copies of Documents: A Staff Report will generally be available for inspection
seven days before the hearing. The Staff Report and application file may be inspected at the Spokane
County Division of Planning, 15t Floor Permit Center, Public Works Building, 1026 W. Broadway,
Spokane, WA 99260-0220, between 8:30 a.m. and 5:00 p.m., weekdays, M-F, except holidays. Copies
of documents will be made available for the cost of reproduction. If you have any questions or special
