review of the land use apphcahon and the entire record, and finding good cause therefore,
hereby makes the following finduigs of fact, conclusions of law and decision
I FINDINGS OF FACT
1 The apphcation requests a vanance from the maxunum height permitted for a fence in
the Regional Business (B-3) zone, to allow the uistallahon of a 10-foot high, chaui lulk fence
with three (3) strands of barbed wire on the lot rear lme, lot side hne and adjacent to an
easement on the srte
2 The srte is generally located south of and adjacent to Spra.gue Avenue, west of
McDonald Road, m the NW 1/4 of Section 22, Townslup 25 North, Range 44 EWM,
Spokane County, Washington
3 The site is currently referenced as County Assessor's tax parcel no 45222 0227 The
address of the srte is 12710 East Sprague Avenue The subject property is legally descnbed
m an attachment to the vanance application
4 The apphcant for the proposal and the site owner is Spokane County, c/o Gary Fuher,

11 The site is approxunately 2 6 acres m size and is relarively flat m topography The
property is unproved wrth a smgle-story, approxunately 21,859 square foot, commercial
builduig, and associated parlang azeas and landscaping A 25-foot vvide access easement is
located along the east border of the site, and an approximately 35-foot wide drasnage area is
located along the south border of the site
12 The apphcahon was subnutted as complete on March 25, 2002 The srte plan of record
subrmtted on March 8, 2002 illustrates the subject site and the location of the existmg
builduig with parking and landscaping azeas The site plan also illustrates location of the
proposed 10-foot lugh chaulluik fence, wlth three (3) strands of barbed wue at the top,
located along the west and south property hnes, and along the west border of the access
easement located a.long the east properly luie of the site The proposed fence would be
located a minunum of 175 feet from the property line along Sprague Avenue and will
mclude an electnc shduig gate at the two access points along Sprague
13 The apphcanon states that the purpose of the proposed fencing is to enclose a storage
area for velucles and other properiy related to a future "Spokane Valley Service Center"
The center would include a shenff's sub-sta.hon, distnct court and county clerk offices
14 Effechve January 15, 2002, the County unplemented a new Comprehensive Plan
("GMA Comprehensive Plan"), County Urban Grrowth Area (UGA) boundanes, and Phase I
Development Regalations, pursuant to the State Growth Management Act The County also
repealed the intenm development regulations previously adopted by the County under the
State Growth Management Act See County Resoluhon Nos 2-0037 and 2-0470
15 The Phase I Development Regulanons desigaate the site and neatby land in the
Regional Commercial category of the GMA Comprehensive Plan Further to the south, the
land is designated m the Medium Densrty Residennal category The site and area aze Iocated
ui the UGA
16 1'he land lyuig north, east and west of the srte is zoned Regional Busmess (B-3), while
the land lyuig south of the site is zoned Light Industnal (I 2) Surrounduig uses generally
include intensive commercial uses along the Sprague Avenue commercial comdor, and
vacant, undeveloped land and a vacated railroa.d nght of way owned by Spokane County

located to the south The parcel lying west of the srte has a su7ular fence to the proposed
fence located along its penmeter, but there is no record of a. vanance bemg granted for the
height of such fenee
17 The County Zoning Code lumts fence height witlun the Regional Busmess (B-3) zone
to a maxunum of eight (8) feet Barbed wlre fencing may be used for secunty purposes in
the B-3 zone only on the upper one-quarter (1/4) of the fence Zoiung Code 14 810 020 (5)
and (6)
18 Fences may be constructed on the property line, with certam exceptions not relevant
herein, provided they comply wlth Zonuig Code 14 810 020 (1) through (6) Fences
exceedulg the maxunum height may be constructed outside the muumum setbacks required
by the Zonuig Code
19 The County Artenal Road Plan in the GMA Comprehensive Plan designates Sprague
Avenue as an Urban Principal Artenal Such road is unproved to five (5) lanes, mcluduig
center turn lane, adjacent to the srte State Route No 27 (Pines Road), to the west, and
Evergreen Road, to the east, provide direct routes to Interstate 90, which is located a few miles
north of the srte
20 The srte is located adjacent to a major transportation and commercial category, where
secunty has been an issue A restaurant, casmo and bar are located directly southeast of the
subject property Law enforcement and pubhc court facihties can be a target for vandalism
Testimony presented at the public heanng indlcated that trespassers can easily breach an 8-
foot fence, but that a 9-10 foot lugh fence topped by barbed wue is much harder to penetrate
21 The location of the srte, the location of the drawa.ge easement and dramage swale on the
srte, and the pamcular use of the srte compnse special cucumstances, such that stnct
apphcarion of the fencmg requirements of the B-3 zone creates prachcal dhfficulties and
depnves the subject property of nghts and pnvileges (the abihty to provide proper secunty for
the use developed on the property) enjoyed by other properhes m the vicuuty zoned B-3
22 Stnct apphcation of the B-3 zone development standards creates an unreasonable
burden in light of the purpose to be served by the Zoiung Code The purposes of the Zorung
Code are, in relevant part, to encourage orderly growth of the county, conserve and stabihze
property values, promote compatible use of land, facihtate adequate levels of commuruty
services and utilihes, conserve and protect arneruti.es, and provide workable relanonslups
between land uses and the transportation system See Zoiung Code 14100 104
23 A broader pubhc or commuruty need or interest vvill be served by grantmg the
proposed varlance as opposed to denyuig it
24 The proposal is consistent wrth the GMA Comprehensive Plan, as set forth in the Staff
Report
25 Zozung Code 14 404 082 (2)(b) and (3)(a g) do not apply or will not result from
grantuig of the vanance

Based on the above fincbngs of fact, the Hearmg Examiner enters the following
II CONCLUSIONS OF LAW
1 Because of special cucumstances appucable to the properiy, stnct apphcarion of the
maximum fence height reqwrements applicable m the Regional Business (B-3) zone, as
contalned m Zoning Code 14 810 020 (6) and (7), creates practical difficulties and depnves
the subject property of nghts and pnvileges enjoyed by other properties m the vicuuty and
smularly zoned
2 As conditioned, grantulg of the vanance will nerther be detnmental to the pubhc
welfare nor injunous to the properiy or unprovements in the vicuuty and the Regional
Business (B-3) zone in whlch the site is located
3 The proposal, as conditioned, conforms to the GMA Comprehensive Plan
4 The proposal, aside from the requested vanance, comphes vvitli the B-3 zone and other
apphcable development regulations
5 Approval of the vanance apphcation, as conditioned, is appropnate under sechon 11 of
the County Heanng Exanuner Ordinance, adopted by County Resoluhon No 96-0171
III DECISION
Based on the Finduigs of Fact and Conclusions of Law stated above, the apphcatton for
a vanance from the fencmg requiremen.ts of the Regional Business (B-3) zone, to provide
secunty for the stora.ge of pubhc velucles and personal property, is hereby approved subject
to the conditions of approval hsted below
Any condihons of public agencies that have been added to or sigruficantly revised are
atalacazed
Failure to comply with the condirions of tlus appraval may result m suspension or
revocation of the vanance by the Heanng Exanuner

height of the proposed fence shall not exceed ten (10) feet All vanahons must conform to
regulahons set forth m the Spokane County Zoiung Code and the ongYnal mtent of the
development plans sha11 be mavltamed
5 The Divrsion of Plannuig shall prepare and record with the Spokane County Audltor a
Trtle Nohce, notulg that the property in question is subject to a vanety of special condihons
unposed as a result of approval of a land use action The Title Nohce shall serve as public
nohce of the conditions of approval affectmg the property m queshon The Trtle Norice
should be recorded wnthun the same tune frame as allowed for an appeal and shall only be

Hearing Process and Appeals: The hearing will be conducted under the rules of procedure adopted in
Spokane County Resolution No. 1-0700. All interested persons may testify at the public hearing, and

the time given to speakers. A speaker representing each side of the issue is encouraged. Any appeal of
the Hearing Examiner's decision will be based on the record established before the Hearing Examiner,
pursuant to County Resolution Nos. 96-0171. Environmental appeals will follow the same procedural
route as the underlying action. All hearings will be conducted in facilities that are accessible to persons
with physical disabilities.
Inspection of File, Copies of Documcnts: A Staff Report will generally be available for inspection
seven days before the hearing. The Staff Report and application file may be inspected at the Spokane
County Division of Planning, ls` Floor Permit Center, Public Works Building, 1026 W. Broadway,

Project Description:
The subject site is located within the Regional Business (B-3) zone, established on January 1, 1991, and
remains unaffected by the adoption of the Phase I Development Regulations by the Board of County
Commissioners on January 15, 2002, Resolution #2-0037. The appticant is requesting a Variance to allow
the installation of a fence, to be located approximately 175 feet south of Sprague Avenue, along the west
and south property lines and adjacent to the easement on the east of the site, with a maximum height of 10
feet, whereas Section 14.810.020(6) of the Spokane County Zoning Code limits fence height within the
Regional Business (B-3) zone to a maximum of 8 feet. The application states that the purpose of the
proposed fencing is to enclose a storage area on the south of the site for vehicles and other property related
to a future "Spokane Valley Service Center" to include a Sheriff sub-station, District Court and County Clerk
offices.
Site Plan:
The site plan of record illustrates the subject site and the location of the existing 21,859 square foot building
with parking and landscaping areas. The site plan also illustrates the location of the proposed 10-foot high
chain link fence, with a 3-strand barb wire top to be located along the west and south property lines and
adjacent to an existing easement located on the east side of the site. The proposed fence is to be located a
minimum of 175 feet from the property line along Sprague Avenue and will include an electric sliding gate at
both access points.
Backqround:
The application was submitted to the Division of Planning on March 25, 2002. The application was
determined to be "Complete" on April 8, 2002, and a Notice of Application was circulated to all property
owners within 400 feet of the subject property at that time.
Comprehensive Plan:
The subject site is located within the Regional Commercial category of the Urban Land Use chapter
(Chapter 2) of the Spokane County Comprehensive Plan. The Regional Commercial classification identifies
intensive commercial areas intended to draw customers from the County-at-large and outlying areas.
Regional shopping centers and major commercial areas have been designated with this classification.
Policies UL.13.4, UL.13.5 and UL.13.6 of the Urban Land Use Chapter recommend that development
standards relating to setbacks, landscaping and physical buffers, etc. be established for commercial uses to
ensure development will have minimal impacts and complement related community appearance. The
proposed variance for fence height should result in minimal impact to surrounding commercial uses. An
existing 10-foot high chain link fence currently surrounds a storage area for property located directly west of
and adjacent to the subject site. There are no records with the Division of Planning indicating that a
Variance application was ever submitted for the existing adjacent fence.
The Regional Commercial category of the Urban Land Use chapter of the Comprehensive Plan does not
specifically address variance requests as provided for in Chapter 14.404 of the Spokane County Zoning
Code.
Staff Analvsis:
Section 14.404.081 of the Zoning Code recognizes that circumstances may exist such that strict application
of the Zoning Code may cause practical difficulties regarding the use of the property. Upon demonstration
to the Hearing Examiner by the property owner of circumstances, which create practical difficulties, the
Hearing Examiner may grant a variance from the provisions of the Zoning Code.
In order for a variance request to receive approval, compliance with Section 14.404.082(1-3) of the Spokane
County Zoning Code must be demonstrated by the applicant. Any variance from the terms of the Zoning
Code shall be subject to those conditions specifically identified in Section 14.404.082 (1a & b). Analysis of
the proposal with regards to Section 14.404.082 (1a & b) is as follows:
Response to 14.404.082(1a): The applicant has stated that due to the nature of the future use of the
subject site, the proposed 10-foot high fence is necessary to provide security for the storage of County

property and equipment. -I I iC Subject site is located adjacent to a major iransportation corridor and also
adjacent to the parking and access driveways for existing commercial and retail uses.
Response to 94.404.082(1b): The applicant has responded to question D on the Variance Burden of Proof
form by stating that the proposed variance will not be harmful to the public welfare nor injurious to the
property or improvements within the vicinity of the property.
The following analysis of Section 14.404.082(2 & 3), while not to be considered as sole
substantiation, shall be considered in the granting of a variance:
Response to 14.404.082(2a): Strict application of the Zoning Code standards may not create an
unreasonable burden on the applicant.
Response to 14.404.082(2b): Relaxation of the maximum fence height standards will not allow a more
environmentally sensitive, energy conserving design or result in the adaptive reuse of a historic property.
Response to 14.404.082(2c): The applicant has stated that a broader public interest will be served in that
the proposed 10-foot high fence will result in a higher level of security for the facility and for County vehicles
and equipment stored within.
Response to 14.404.082(3a): The granting of the variance will not be based upon a precedent established
by illegal or non-conforming circumstances.
Response to 14.404.082(3b): No precedent will be established which will adversely effect the zoning
concept for the existing neighborhood or the County as a whole.
Response t0 14.404.082(3c): The applicant has stated on the Variance Burden of Proof form that the
variance is not based upon lack of a reasonable economic return.
Response to 14.404.082(3d): The Goals and Policies of the Urban Land Use chapter of the
Comprehensive Plan do not specifically address variance requests.
Response to 14.404.082(3e): The practical difficulties related to the property did not exist when the
applicant purchased the property.
Response to 14.404.082(3t): The proposed variance for the construction of a 10-foot high security fence
for a related office use will not result in a de facto zone change.
Response to 14.404.082(3g): The proposal will not impact the density requirements of the Regional
Commercial category of the Comprehensive Plan.
Summary: The requested variance from the maximum fence height requirements of Section 14.810.020(6)
of the Spokane County Zoning Code is for reasons related to security of the future storage area and may be
generally based on the location of the site within a busy commercial area.

B. Preliminary Submittal
Prior to filing an application, the project sponsor shall become familiar with the current
procedures and forms. Division of Planning personnel are available for advice on current
procedures, past actions which may affect the proposal and the Zone Code requirements.
C. SCHEDULING AND APPLICATION FOR PUBLIC HEARING
Completed applications received the Division of Planning will be scheduled for public hearing on
the earliest possible date. A completed application includes fees; but may be later rejected if
found to be substandard or otherwise lacking in data or required information. Division
personnel will contact the applicant approximately 28 calendar days prior to the public hearing
and provide the information needed to fulfill the notification requirements outlined in "E" below.
Occasionally, excessive and unpredictable workloads in the Division may cause scheduling at a
later date.

E. CONOITIONAL USE PERMITS
The applicant is responsible for meeting all standards of the Code with respect to both the
conditional use section and the underlying zone. Any uncertainty should be clarified at
application preconference or application submittal. Failure to meet such standards may result
in significant delay or cancellation of hearing. (Example: A home industry accessory building
must be less than 2 times the gross floor area of the primary residence. Failure to meet this
standard invalidates an application.)

NOTIFICATION REQUIREMENTS
The applicant is to provide legal notification. More detailed instructions are provided when the
notification packet is picked up at the Division. You will be notified when to pick up the packet.

✓STEP 1: All property owners and taxpayers within four hundred (400) feet of the property,
including all additional contiguous ownership or optional land by the owner or agent for the
owner and any easement lands providing access shall be notified by the proponent. Utilizing a
list of such property owners and taxpayers obtained from a title company and copies of the
Agenda Notification prepared by the Division, the applicant shall accomplish notification by
mailing the agenda notification as directed by the Division personnel.

STEP 2: The applicant shall provide the original of the mailing list prepared by the title
~ company, Affidavit of Mailing, all returned mailings (addressee unknown, etc.) and certain other
information to the Division at least two (2) days prior to the public hearing for inclusion in the
file. Failure to do so may jeopardize the hearing process.
NOTE: The address list obtained from the title company must be dated no more than thirty (30)
days before the hearing date. When you plan to pick up your mailing packet from this division
please allow one (1) week for the title company to prepare the address list and time for you to
do the mailing by the deadline date.
G. PUBLIC HEARING
THE APPLICANT OR REPRESENTATIVE MUST BE PRE3ENT AT THE PUBLIC HEARING. If the owner is
not at the meeting, the "representative" must have written authorization from all property

applicable codes and requirements and that required inspections are requested. Failure to request required inspections and obtain the necessary
approvals prior to progressing beyond the point where inspections are required may necessitate removal of certain parts of the construction at the
applicanYs/permittee's or property owner's expense. At a minimum, the following inspections ARE REOUIRED by Couniy Code:
1. FOOTING - when forms and reinforcement are in place and prior to placement of concrete-all structures, including manufactured homes.
NOTE: This inspection includes review of the structure's setbacks from property lines. Minimum setbacks are established by County zoning
regulations. Typically, side and rear yard setbacks are measured from property lines, while setbacks for yards abutting streets are measured from
the property line or the center line of the roadway right-of-way, whichever provides the greater setback from the center line of the roadway right-of-
way. Curb lines and fence lines are not necessarily indicative of property lines. In some residential areas, the County can own as much as 20 feet of
right-of-way between your property and the actual improved streeUcurb. The responsibility to comply with applicable setback provisions lies solely
with the permittee-neither Spokane County nor its authorized representatives assume any responsibility for the verification or location of your
property lines. Please verify their location prior to locating your structure. Failure to properly locate the structure may require its relocation at the
owner'slpermittee's expense.
2. FOUNDATION - when forms and reinforcement are in place and prior to placement of concrete.
3. FRAMING - after all framing, bracing and blocking is in place, and prior to concealing.
4. INSULATION - prior to the installation of drywall.
5. PLUMBING - after rough-in, before covering, and final.
6. MECHANICAL - rough-in of piping, before covering, metal chimneys before concealment, and final.
7. FtNAL - when complete and prior to occupancy and/or use. Plsase provide 24 hours notice. II permits require final inspection.
NOTE: In addition to inspection of the structure, this inspection includes review of site improvements (typically depicted on the approved site plan)
required by ordinance or as a condition of approval of this permit. Items such as the installation of fire hydrants, fire department access, on-site
drainage ("208 sweles"), road improvements, parking, and landscaping are common requirements of a permiUsite plan which must be com-
pleted prior to final approval of a building or issuance of a Certificate of Occupancy.
8. MANUFACTURED HOMES - Final inspection required when complete, stairs, handrails, skirting, etc. installed, and prior to occupancy; completed
inspection record card must be available on site.
9. SEWERS - prior to cover
10. RIGHT-OF-WAY/APPROACH - prior to placement of concrete, or, if gravel approach, after completion.
In addition to the above, any plumbing or mechanical systems or material which would be concealed by framing, drywall, concrete, etc., must be inspected
prior to cover. Check with the department for "special inspections" in conjunction with commercial projects.

PERMIT EXPIRATION AND REFUNDS
Unless otherwise noted, this permit will be considered null and void by limitation if the work authorized by the permit is not commenced or is stopped for
a period of 180 days, unless a written request for an extension of the permit is received and approved by the Building Official prior to expiration. At a
minimum an inspection should be requested at least once every 180 days to assure the validity of the permit. A permit may be renewed within one year
of the date of expiration for one-half the original fee, subject to certain limitations-please call us if you have any questions.
All refund requests must be made in writing by the applicant/permittee (shown on the reverse) no later than 180 days after the date ot fee payment.
Refunds of not more than 80% of the permit fee paid may be authorized when no work has been done under the permit. No refunds may be authorized
more than 180 days after fee payment.
MISTAKE?
If you think we've made an error in processing this permit or in conducting inspections pertaining to it, or find erroneous information in the permit, please
bring it to our attention immediately by filing a written request for correction within 10 working days of discovery. All such requests should be directed to
the Division of Building and Code Enforcement at the below address.
