FINDINGS AND ORDER REGARDING CONDITIONAL USE PERMIT, CUE-4-72
WHEREAS, Application has been presented to the Zoning Adjustor
Spokane County by Darrell G. and Jerry Condron requesting a Conditiona
Use Permit, CUE-4-72, to allow multiple family dwelling units in the
'ommercial Zone classification on property generally located south of
Iission between Center Road and Ella Road, Spokane County, Washington,
nd more narticularly desr-ribed as follows:

WHEREAS, The Zoning Adjustor of Spokane County did, on the 20th
day of March, 1972, hold a public hearing as provided in Section 4.25 of
Title 4 on the application of Darrell G. and Jerry Condron for a Conditional
Use Permit on the property in question,
and,
WHEREAS, The Zoriing Adjustor of Spokane County did, on the 20th day
of March, 1972, formally act upon said application and did approve said
application based upon findings of fact, reasons, and conditions,
and,
WHEREAS, An appeal from the decision of tne Zoning Adjustor of
Spokane County was f iled on the 25th day of February, 1972, by E.W. Kivett,
and others,
and,
WHEREAS, The Board of Adjustment of Spokane County did, on the
2 Oth day of March, 1972, hold a public hearing as prescribed in Section 4. 2 5
of Title 4 on the application of Darrell G. and Jerry Condron for a Conditional
Use Permit to allow multiple family dwelling units on the property in question,
and,
WHEREAS, at said hearing, opportunity was afforded those favoring and
those opposing said application, and the Board of Adjustment having fully
considered the official records, evidence, and testimony given, and having
made investigation of the matter does hereby find:
,
1. That tne property in question is approximately 26,445 sq, ft,
2, That the property in question has been zoned "Commercial" since
April 21, 1953.
3. That the surrounding land uses include single family residences
and duplexe s ,
4. That the Zonirig Adjustor approved the application, CUE-4-72,
because he was of the opinion that the proposed use as a multiple family
apartment is more desireable and maintains the residential character of the
immediate neighborhooci more than other uses allowed in the Commercial Zone.
5. That the restrictions and provisions stipulated below as conditions
of approval of the Conditional Use Permit will serve to uphold the spirit and
intent of the Zoning Ordinance; and further, that such use will not be detrimental
to the general Comprehensive Plan and surrounding properties.
NOW, THEREFORE, The Board of Adjustment does hereby approve the
application of Darrell G. and Jerry Condron for a Conditional Use Permit,
CUE-4-72, to allow multiple family dwelling units in the Commercial Zone

Processing of the referenced application has been suspended and we
must reject the proposal at this time.
Our analysis of the market in the Spokane Valley indicates that a
small nwnber of units in the proposed location should rent well and
would not be greatly affected by the large number of units being
built in the central and eastern sections of the valley.
The site, however, is not adequately zoned and until multifami:'y
zoning is obta.ined we are unable to proceed with your proposal.
The case ma.y be reopened when exhibits are sutanitted confirming the
estab, ishrnent of a zone change.
