BOARD OF ADjUSTMENT OF SPOKANE COUl\lTY
FINDTNGS AND ORDER REGARDING CONDITIONAL USE PERMIT, CUE-122-71
WHEREAS, Application has been presented to the Act ing Zoning Adjustor
of Spokane County by Claude & Oneata Howerton, requesting a Conditional Use
Permit, CUE-122-71, to allow a trailer as a residence in the Agrfcultural Zone
clas s ification on property generally located South of Sprague Avenue and We st
of Long Road in Spokane County, Washington, and more particularly described
as follows:
The North 100 feet of the East 386 feet of Lot 10, Block 25,
Corbin Addition to Greenacres, located in Spokane County
in Section 19, Township ZS N. , Range 45, E.W. M.
and,
WHEREAS, The Acting Zoning Adjustor of Spokane County did, on the
2 6th day of C?ctober, 1971, hold a public hearing as provided in Section 4.25
of Title 4 on the application of Claude & Oneata Hawerton for a Conditional Use
Permit on the property in question
and,
WHEREAS, The Acfng Zoning Adjustor of Spokane County did, on the
2 6th day of October, 1971, formally act upon safd application and did approve
said application based upon findings of fact and reasons
and,
WHEREAS, An appeal from the decision of the Acting Zoning Adjustor
of Spokane County was filed on the 26th day of October, 1971, by Wilmar W.
and Martha B. Fischer
and,
WHEREAS, The Board of Adjustment of Spokane County did, on the
6th day of December, 1971, hold a public hearing as prescribed in Section 4.25 of
Title 4 on the application of Ciaude & Oneata Howerton for a Conditional Use
Permit to allow a trailer as a residence on the property in questfon
and,
WHEREAS, At said hearing, opportunity was afforded those favoring
and those opposing said application, and the Board of Adjustment having fully
considered the official records, evidence and testimony given and having made
investigation of the matter does hereby find:

1. That the property in question is approximately 28, 000 square feet
in area.
2. That the property in question has been zoned Agricultural since
july 3 0, 1957 .
3. That surrounding land uses fnclude residences on acreage tracts to
the North and South of the subject property, and Agricultural tracts to the East
and We st of the s ubje ct property.
4. That two mobile homes have been established in accordance with the
Conditional Use procedure within 400 feet of the subject property.
5. That the applicants have indicated to the Board of Adjustment that they
intend to utilize the mobile home for their occupancy for a period of three (3) years
or more.
6, That at least one resident in the area as indicated by letter and
testimony before the Board of Adjustment, is opposed to the establishment of mobile
homes in the immediate area.
7. That the restrictions and provisions stipulated below as conditions of
approval of the Conditional Use Permft will serve to uphold the spirit and intent
of the Zon ing Ordinance; and further, that such use will not be detrimental to the
general Comprehensive Plan and surrounding properties.
NOW THEREFORE, the Board of Adjustment does hereby approve the
application for a Conditional Use Permit, Claude & Oneata Howerton, CUE-122-71,
to allow the use of a trailer as a residence in the Agricultural Zone classffication on the
said described property and subject to the following conditions:
1. The trailer shall be located on the subject property in compliance
with yard (setbac)~ requirements for a single family dwelling as prescribed in
Section 4.05.110a of the Zoning Ordinance of Spokane County.
2, This approval fs granted to November 1, 1974, at which time any
permit issued pursuant to this approval shall become null and void.
3. The trailer shall be skirted with a fire resistant material.
4. The trailer shall not be mounted on a permanent foundation in such
a manner as to constitute a permanent residence.
5. The trailer shall not be attached to other re sidential or acce s sory
structures. Metal canopies, tip outs, and awnings may be attached to the trailer;
however, all wooden structures and accessory buildings, except open porches,
must be detached and placed at least three (3) feet from the trailer.
