MOSHER~ DATE: 1/14/"94 SUBJECT: OLD CONDTTIONAL USE PERMITS In the process of reviewing some possible enforcement actions for conditional use permits which have expired, it was discovered that these two files are more than likely legal. Although they were conditional use permits issued in the 1970's, approximately 1978-1979 a single-wide manufactured home became a permitted use in the Agricultural Zone. Thus, when the Zoning Code went into effect on January 1, 1991, the single-wide manufactured homes existing on these parcels became legal nonconforming uses. MOSHER, AICP Zoning Adjustor ~ DATE: January 10, 1994 ~ SUBJECT: HISTORICAL Si:TMMARY AND UPDATE A conditional use permit for a single-wide manufactured home in the Agricultural zone was issued in 1970. This permit expired in 1973. For some reason, in 1978, the same applicant (Henry Harms, who was at that time 85 ~ years old) applied for a renewal of the conditional use permit. The Planning Department decided to subject this to the public hearing process as if it were a new applicarion. The permit was granted under the provisions of the Code involving a pernut for a manufactured home; and not specifically for a dependent relative manufactured home. There is, however, some mention of inedical problems; but, the actual pernut is not associated with a dependent relative situation. On 11/17/93, due to no renewal of this permit, the Zoning Enforcement Officer inspected and found a manufactured home, approximately of the size depicted on the site plan and a large carport, enclosed on two sides plus the side of the dwelling unit The neighborhood was generally devoted to similar type uses and the older manufactured home was very compatible with surrounding land uses. The lot itself is probably substand.ard in size, and may or may not have nonconfornung rights. The manfuactured home probably has nonconforming rights since it began at least as early as 1978 and continues through the present. The only criteria for renewal has to do with Conditional of Approval number 5 in which an adminismxive review is to take place after five years to determine if the trailer is still a compatible land use. The suggestion is to review this in another five years. There aLso may be the circumstance that a permit to replace this manufacttued home may run into problems, depending on the language associated with replacement of older, nonconfonning manufactured homes. The Zoning Enforcement Officer noted a site built structure in the southwest corner of the lot, which had smoke coming from its chimney. This may be an unautharized dwelling I unit or it may be a simple a build.ing use as a shop, hobby or craft room. Suggestion is for a review on approximatley January 1, 1999, using the same criteria as in ~ original Conditional of Approval number 5. Also a suggestion is made that a Tide Notice be filed referring to the possible difficulty in replacing a manufactured home unit and that ~ -13- 3 r such replacement needs to be in compliance with the present Zoning Regulations at the time of replacement.
