SUBJECT: OLD CONDTTIONAL USE PERMITS
In the process of reviewing some possible enforcement actions for conditional use permits
which have expired, it was discovered that these two files are more than likely legal.
Although they were conditional use permits issued in the 1970's, approximately 1978-1979
a single-wide manufactured home became a permitted use in the Agricultural Zone. Thus,
when the Zoning Code went into effect on January 1, 1991, the single-wide manufactured
homes existing on these parcels became legal nonconforming uses.
Replacement of these manufactured homes, either single-wide or double-wide, must
conform to whatever regulations exist with respect to replacement of manufactured homes.

SUBJECT: HISTORICAL Si:TMMARY AND UPDATE
A conditional use permit for a single-wide manufactured home in the Agricultural zone was issued in 1970. This permit expired in 1973.
For some reason, in 1978, the same applicant (Henry Harms, who was at that time 85 ~
years old) applied for a renewal of the conditional use permit. The Planning Department
decided to subject this to the public hearing process as if it were a new applicarion. The
permit was granted under the provisions of the Code involving a pernut for a manufactured
home; and not specifically for a dependent relative manufactured home. There is, however,
some mention of inedical problems; but, the actual pernut is not associated with a
dependent relative situation.
On 11/17/93, due to no renewal of this permit, the Zoning Enforcement Officer inspected
and found a manufactured home, approximately of the size depicted on the site plan and a
large carport, enclosed on two sides plus the side of the dwelling unit The neighborhood
was generally devoted to similar type uses and the older manufactured home was very
compatible with surrounding land uses. The lot itself is probably substand.ard in size, and
may or may not have nonconfornung rights. The manfuactured home probably has
nonconforming rights since it began at least as early as 1978 and continues through the
present. The only criteria for renewal has to do with Conditional of Approval number 5 in
which an adminismxive review is to take place after five years to determine if the trailer is
still a compatible land use. The suggestion is to review this in another five years. There aLso may be the circumstance that a permit to replace this manufacttued home may run into problems, depending on the language associated with replacement of older, nonconfonning
manufactured homes.
The Zoning Enforcement Officer noted a site built structure in the southwest corner of the
lot, which had smoke coming from its chimney. This may be an unautharized dwelling I
unit or it may be a simple a build.ing use as a shop, hobby or craft room.
Suggestion is for a review on approximatley January 1, 1999, using the same criteria as in ~
original Conditional of Approval number 5. Also a suggestion is made that a Tide Notice
be filed referring to the possible difficulty in replacing a manufactured home unit and that

such replacement needs to be in compliance with the present Zoning Regulations at the time
of replacement.

ZONING ADJUSTOR DECISION: After public testimony and review, the decision of the 'I
I
Zoning Adjustor is to (-approvel (_deny) the applicant's request to allow a mobile
home as a residence within the Agricultural Zone.
A. FINDINGS FOR APPROVAL OR DENIAL: Pursuant to Section 4.24.010 (_b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility of
determi ni:ng that a use wil l not be detrimental to the surroundi ng properti:es.
In determining compatibility, the Zoni.ng Adjustor based his decision on the testi-
mony presented at the 3 L) LV I,;~ Ic{ 78 Zoning Adjustor Hearing as well
as criteria set forth in the Spokane County Zoning Ordinance for issuance of a
Conditional Use. The Zoning Adjustor hereby finds the following:
J l. The proposed mobile home is compati.ble with the area as evidenced by
either other mobile homes and/or mi.xed land uses in the immediate vicinity.
J 2. The described property meets the requirements as set forth in the Spokane
County Zoni_ng Ordinance, for a Conditional Use Permit.
~ 3. The aPPlicant demonstrated to the satisfaction of the Zoning Adjustor that
sufficient screeni:ng can be provi'ded so as not to conflict with adjacent
land uses.
4. It was substantiated 6y evidence from the staff presentation, the lot was
found to be a non-conforming lot of record by definition from the Spokane
County Zoning Ordi nance.
5. The applicant was able to demonstrate to the satisfaction of the Zoning
Adjustor 6y means of a letter from a practicing physican, that there is,
in fact, a dependency which is medical i.n nature.

6. ORDER:
1. Before a building permit can be issued, the applicant shall submit to the
Planning Department evidence that the proposed property is in compliance with
the Spokane County Short Plat Ordinance.
2. Subsequent to a building permit being issued, access permits must be
obtained from the County Engineers' Office.
~ The location of the trailer must be in such a fashion as to use ground
cover for sufficient screening.
~ The permit shall be subject to the conditions that existed in the previous
permit.
5. The trailer shall be located on the subject property in compliance with
yard (setback) requirements for a single-family dwelling as prescribed in
Section 4.05.110 (a) of the Zoning Ordinance of Spokane County.
The trailer shall be located on the subject property in substantial con-
formance with the "approved" plot plan on file with this application, and
in any case, shall observe the yard (setback) requirements for a single-
family dwelling as prescribed in Section 4.05.110 (a) of the Zoning

The trailer shall be skirted with a fire resistant material.
9. This approval is granted for the use of a trailer as a residence for a
caretaker of the subject property. This approval is granted for an
indefinite time period in connection with the previously described use.
10. The existing residence on the subject property shall be removed prior
to the occupancy of the trailer hbuse.
11. The trailer can be mounted on a permanent foundation in such a manner as
to constitute a permanent residence, with or without a basement.

r.3. The trailer shall not be attached to other residential or accessory

structures. Metal canopies, tip outs and awnings may be attached to
the trailer, however, all wooden structures and accessory buildings,
except open porches, must be detached and placed at least three (3)

this occurrence, the applicant shall remove the trailer from the site
within thirty (30) days.
