FINDINGS AND ORDER REGARDING CONDITIONAL USE PERMIT, CUE-26-70
WHEREAS,, Application has been presented to the Zoning Adjustor of
Spokane County by Mr Elmer L. Oehler requesting a Condi#.ional Use Permit,
CUE-26-70, to allow the temporary use of a trailer as a residence in the
Agricultural Zone classification on property generally located north of Indiana
Avenue and west of Greenacres Road, Spokane County, Washinqton, and more
particularly described as follows
The VVest 100 feet of the E 1/2 of Tract 20 of Greenacres
Irrigation District Plat "A" in Section 7, Township 25 N. ,
Ranqe 45, E W. M, Spokane County, Washington,
and,
WHEREAS,, The Zoning Adjustor of Spokane County did, on the 4th day of
May, 1970, hold a public hearing as provided in Section 4.25 of Title 4 on the
application of Mr. Elmer L. Oehler for a Conditional Use Permit on the property
in que stion,
and,
WHEREAS,, The Zoning Adf ustor of Spokane County on the 4th day of May,
1970, dfd formally act upon said application and did agprove said applicatian
based upon finding of fact, reasons, and conditions,
and,
WHEREAS, An appeal from the decision of the Zoning Adjustor of Spokane
County was filed on the 14th day of May, 1970, by john B. MacKay,
and,
WHEREAS,, The Board of Adjustment of Spokane County dfd, on the 8th day
of june t 19 70, hold a public hearing as prescribed in Section 4.25 0# Title 4 on
the application of Mr. Elmer L. Oehler #or a Conditional Use Permit to allow the
temporary use of a trailer as a residence on the property in question,
and,
VdHEREAS.. At said hearinq, opportunity was afforded those favoring and
those opposing said application, and the Board of Adjustment having fully con-
sidered the official records, evidence, and testimony qiven, and having made
investigation of the matter, does hereby find

1 That the property in question is approximately 64, 000 square
feet in area.
2 That the property in question has been zoned "Agricultural"
since july 30, 1957.
3 That the exfsting land uses adjacent to the property in
question include single family resfdences on acreage tracts
4 That the applicants have indicated to the Board of Adjustment
that they intend to occupy the mobile home on a temporary basis while a standard
residence is being constructed on the property in question
5. That many residents in the area have indicated that they are
opposed to the establishment of mobile homes or trailer courts in the nefghbor-
hood
6 That the Zoning Adjustor was of the opinion, after personal
inspection of the property and vicinity in question, that the temporary use of the
subject property for a mobile home while a standard residence was being con-
structed would not be materially detrimental to the General Comprehensive Plan
or surrounding properties
7 That the restrictions and provisions stipulated below as
conditions of approval of the Conditional Use Permit will serve to uphold the
spirit and intent of the Zoning Ordinance, and, further, that such use will,
therefore, not be detrimental to the General Comprehensive Plan and surrounding
propertie s
NOW, THEREFORE, The Board of Adjustment does hereby approve the
applicatfon of Elmer L. Oehler for a Conditional Use Permit, CUE-26-70, to
allow the temporary use of a trailer as a residence fn the Aqricultural Zone
classification on said described property, and subject to the following conditions
1. The contemplated standard residence must be substantially
under construction within a two-year period or no renewal of this permit may be
considered
2 The trailer shall be located on the property in question in
accordance with the requirements for a single family dwelling as prescrlbed in
Chapter 4.04 of Title 4
3. Sewerage facilities and water supply shall be installed as
prescribed by the Spokane County Health District
4. This permit is qranted to june 1, 1973, at which time such
permit shall become null and void
5 The placement of the trailer on the property will be subject to
the plot plan as submitted by the applicant.

6. The trailer shall display a current State trailer license unless
the undercarriage and towing yoke are entirely removed, in which case it shall
be classed as real property and shall comply with all applicable codes and laws
for such use.

Zoning Adjustor Decision: Approved for a 3 year period.
A. REASONS:
In the opinion of the Zoning Adjustor, and after personal inspection of
the property and vicinity, the temporary use of the subject property for
a mobile home while a standard residence is being constructed will not
be materially detrimental to the general comprehensive plan or surrounding
properties.
B. Conditions:
1. The contemplated standard residence must be substantially under construction
within the three year period or no renewal of this permit maybe considered.
2. The trailer shall be located on the property ia question in accordanc
with the requirements for a single family dwelling as prescribed in
Chapter 4.04 of Title 4..
3. Sewerage facilities and water supply shall be installed as prescribed
by the County Health Department.
4e This permit is granted to June 1, 1973 at which time such permit shall
become null and void.
5. The placement of the trailer on the property will be subject to the plot
plan as submitted by the applicant.
6. The trailer shall display a current state trailer license unless the
undercarriage and taring yoke are entirely removed, in which ease it
shall be classed as real property and shall comply with all applicable
codes and laws for such use.
