SUBJECT: DISPOSTTION OF CUE-48-73
Everything indicates that this propety was established with a single-wide manufactured
home on it under Section 4.04.170(fl of the Zoning Ordinance. Although reference is '
made to this being for the purpose of a dependent relative, Subsection 4.04.170(f) has
nothing to do with dependent relative. Additionally, and more importandy, a single-wide
manufactured home became outright permitted between 11/78 and 6/19. Over the years this
single-wide manufactured home was probably replaced or exchanged from time to time.
The Assessor's records show that, as far back as 1988, the present unit appears to have
existed. It existed through January 1, 1991 when the Zoning Code went into effect. The
effect of the Zoning Code is to make the single-wide unit nonconforming in the UR-3.5
zone. Any future replacement of this unit, as presendy a lawful nonconforming structure,
will be based on the language of the Zoning Code at the time of replacement. Replacement
may require only a class "A" manufactured home or, depending on the language in effect at
the rime, replacement by another single-wide may also be allowed.
At the present time, there is no zoning violation and the present unit exists lawfully, not
based on the conditional use permit, but, more than likely on the basis that it was a lawful
nonconforming building established prior to the adopdon of the Zoning Code.

(f) Off-street parking area.
(g) Defined points of access and egress.
(h) Topographic features pertinent to applications (such as rock outcrop,
canyons, hills, etc. ) .
