SUBJECT: Clarifications of Gflnditions of Approval of Minutes Written by
Zoning Adjustor on July 21, 1976
A praspectlve purchaser of this property and dog kennel ssked for clarification of the canditians of
approval. The conditians of approval has language to the effect that a 28 dog kennel permit was issued
a~nd that all doqs are to be kept in interior, sound-proofed kennel areas. The praspective purchaser
asked if it was intended thst dogs would not be parmitted to be exercised, trained arrd/or kept outside
during the period of time that the interior kennels are being cleaned.
The written decision rather clearly states that the dogs are to be kept inside of a kennel building. Such o
a kennel building was built. The matter of dogs being trained, handled, kept temparariiy outside or
exercised was not addressed.
I cflntacted the Zoning Adjustor of that decision, Dwfgnt Hume, who presently resides in Spokane. I
faxed to him the decision and a site plan which had two kennels shown: an existing kennel with 8
outdoor runs and a new kennal building with no apparent outdoor runs or exercise area. The pian has
on it an "approved plot plan" stamp of 7-21-76, amended by a statement "sub)ect to combining
existing 8 run facility into the new kennei building." Hawever that amended stetement was crossed
out; but, was subject to a note by Mr. Hume saying "OK." I asked Mr. Hume if he oouid ciarify the
situation.
He did remember the circumstances and situation. FGe said that after the approval was granted the
owner came in and asked if he could not make the 8 interior/exterior kennel arrangement into an
interlor only kennel arrangement and build a new building for only 20 intErior kennels. His
reasoning was, since he already had an existing kennel building, why go to the expense of 8 additional
newly constructed units if he cauld make 8 interior kennels in the old kennel buiiding?
The praspective purchaser has assured me that there is an interior kennel sftuation for 8 and an
interior situation for 20, both in separate buildings; apparently, the exisfing kennel and the new
kennei referred to by Mr. Hume. It is reparted that the older kennel does still have eight exterior
runs ettached to the building, but each individual run is capable of being closed off. The intErior of the
smaller, older, kennei building also appears to be reasanably sound insulated.

Mr. Hume said the issue of outdoor exercising, training an0 ternparary storage of the dogs outside
. during the cleaning of the interior kennel was just not ever an issue. He maintafned that the primary
objective of stressing the indoar kennel situation was to keep dogs frofn befng stored outslde wlthout
supervision, as that resulted jn enaugh complaints from neighbors that tha condition for interlar
kennels were therefore lmposed. He 6id not intend that there be neither the exterior exercising of
dogs, training of dogs nor keeping of dogs outside while interiar kennels were being cleaned.
Had hs ever been asked to clarify that situation at the time, he would have clarified it alang the lines
that the animals can be outside for limited aeriods of time under supervision; but, that they are not to
ba stared autside for arry perfod of time in which thair lack of supervision would allow a nuisance
situation to develop in the neighborhootl,

SUBJECT: Review With Owner, Uon I..ovell (Regarding Status of Kennel Permit)
Mr. Lovell asked what status his kennel Condidonal Use Permit had since the zoning had changed
on January 1, 1991.
T'he zoning is presently UR 3.5. UR 3.5 dces not peimit a commercial kennel and allows a privatc kennel only by a Condicional Use Permit. I told Lovell that if he could maintain between 11 an 28
(inclusive) adult dogs, he could maintain his non-conforming commercial kennel. I said if he
dropped below 11 dogs continually for more than 1 year he would technically loose his non-
conforming rights to a commercial kennel. We also discussed that a would-be buyer, upon
inquiring of our office, would be told that the commercial kennel rights associated with his 30 by
50 kennel building would be in jeopardy if, upon challenge, it could not be shown that the kennel
operated continuously with 11 or more (but less than 29) adult dogs.
Mr. Lovell said that he had backcd off on his interest in operating as a commercial kennel and
wanted to know what he could do to maintain it at a minimum threshold so he would not lose the
non-conforming right. We looked up the definirion of kennel and found that he had to have ll or
more dogs on the site for the purposes of being housed, goomed, bred, boarded, trained or sold
or to be kept as pets. I offered the observarion that if he had 11 dogs there for purposes of
housing, grooming, breeding, boarding, training or to be sold commercially or just as pets during
any year's period of dme (that is, without a 365 day lapse between instances) and he could
document that year after year from January l, 1991 on, he would maintain his non-conforming
status for the kennel use on his property. I stressed that documentation of this would be a very
important factor if we ever had to make a decision on whether or not the property had non-
confornung rights.

STAFF ENVIRONMENTAL REVIEW AND RECOMMENDATIOYJ
As required in WAC 197-10-320, the staff of the County Planning Commission has
reviewed the environmental checklist submitted by Michael T. Ki.nney for a proposed
50-run dog kennel at 2010 Flora Road. This proposal is intended to expand an
existing 8 run dflg kennel already on the site.
The staff review has identified one area of potential environmental impact concern-
ing the aesthetic intrusion of noise and odor into the surroundinq agricultural/
residential area. At least one complaint is on record from a neighbor in regard to
noise generated by the existing 8 run kennel. The facility expanszon, however,
will be fully enclosed with adequate insul&tion to mitigate any potention noise
or odor impacts.
The conclusion of the review of this Environmental Checklist is that no significant
environmental impact will likely result from the proposal. Therefore, it is recommend-
ed that a Declaration of TVon-Significance be issued and an environmental impact
statement not be required.

Dearsir:
We feel that lack of proper kennel facilities in the Valley
necessitatias a newer and more modern kennel. For this reason
our propoeed newkennel house will have comolete enclosed facili-
ties. It will be more sanitary, more comfortable, with oroper
heating andventilation, for the animals. We, also, feel the new
building will give a better apgearance to the oublic,with suit-
able landscaping and off street aarking.
With proner management the proposed new building will have
little or no effect on the adjacent prooerty owners and having
Che animals enclosed, the noise factor involved will be at a
minimum.

8. SJhat happens when a dog is found in violation?,- A notice of the violation
is given to the owner. The dog will be apprehended and may be impounded.
The owner must pay $3.00 to redeem the dog. After three violations in one
year the dog may be ordered removed permanently from the County or.humanely
destroyed. .
9. 4Jhere may a dog be apprehended? - A dog control officer can pursue and
apprehend a dog observed to be in violation on any public or private property
except any private dwelling. No person is allawed to obstruct Lhe dag con-
trol officer from abating a dog violation.
10. What happens when a dog is impounded? - If licensed, the owner will be
notified within 48 hours and the dog will be held 108 hours to be redeemed.
Unlicensed dogs will be held 72 hours. Dogs not redeemed within the time
limit rnay be sold or humanely destroyed.
11. How can a dog be redeemed? - By payment of $3.00 redemption fee plus $2.00
,per day impounded. Unlicensed dogs must have a license before being released
by the pound.
12. Are there penalties for violation? - Any violation of the dog control
ordinances constitutes a•misdemeanor and upon conviction is subject to a
$25.00 fine and/or 90 days in jail.

.ARTICLE I PROVISZONS Section 1. Purpase It is declared the public policy of Spolcane County to
' seeure and maintain such levels of animal control with-
in the unincorporated areas of Spolcane County as wi11
protect human health and safety, and to the greaLest
degree practicable to prevent injury to property. To
-this end, it is the purpose of this ordinance to provida '
a means of licensing dogs and eontrolling errant dog
behavior.so that it sha11 not become a public nuisance. '
• Section 2.• Definitions ' , •
• In CQnutruing provisions of this ordinance, except where
otherwise plainly declared or clearly apparent from the
eontext, t,rords used herein shall be given4"heir common
and ordinary meaning; 1.n addition, the following defini-
tions shall apply:
(1) "Abatemen-V" means the terminat3on of any violation .
by reasonable and lataful means. determined by the
dvg control offiaer in order that a person or per-
sor3 presumed to be the owner.'shall comply with-this
ordinance. _
(Z) "At Large" means a dog Vrhfch is physically off the premises of the owner oSx the dog, and Vrhich is not
- under the immediate control of the owner of the dog,
or a competent person; or secured by a leash not _ exceeding eight feet in length. PROVIDED, "At
Larga" does not include dogs exhibited in dog shows,
field trials, obedience training,or 4rials, or the
training of dogs the'refor, or the use of a dog under -
the supexvision of a person to hunt; L-o;chase or tree
predatory an3ma2s or game birds; or the use of a dog '
to eontrol or protect 1ivestoc)c or property or in .
other related agricultural activlties; or a dog
when otherwise.safely and securely confined or
completely controlled within or upon any vehicle.
(3) "Dog Control Officer" means any ind3vidual employed,
contracted or appo3nted by the Board of County

(4) "Euthanasia" means the human,- destruction of an animal
ar.complished by a me'thod that 1nvolves instantaneous _
unconsciousness and immediate death, o7r by a method '
. that cauyes painless loss of consciousness, and death during such loss of consc3.ousness. .
(5~• "Owner" means any person having an interzst in or •
right of possession to a dog or any person having
"control, custody, or possession of a dog,'or by rea-
son of the dog being seen r2siding consistently at

Provided, that a veterinarian'or a kEnneZ operator'
insofar as they keep dogs in the course of'their'
business shall not be owners.-
(6) "Premises" means tlie-area of land surrounding a

It shall be unlawful for any person to steal or rer,►ove the

,deprive the owner thereof. . . -ARTXCLE ITI ENFORCEMENT, PENALTIES AND-PROCEDURES.
Section 1. rnforcement Potiver
(l) The dog control ofziccr or his authorized dog con-
trol RgPnts are hereby authori2ed to take such law-
ful action as may be required to enforce the pro- -
. visions of thls ordinance. • - (2) The -3ag control officer or his authorized dog con--
trol agents,.unless authorized by•the owner thereof,.
shall not enter private dweZling houses unless a
proper warran4 has been issued upon a shoiiing that _
the dog control officcr or his authorized dog control
agent has reasonable cause to believ.e an animal is,
being maintained 3n the building in violatian of

The dog control offir.er or h:ls authorized representatives
may apprehend dogs found doing any of the acts defined as
public nuisances under Secti.on 3 herein. The dog control
. ofi'icer or his authorized representative upon apprehension•
of any dog or dogs shall make a complete register, enter"-- -
' ing the breed, color and sex of each dog, and whether -
lfcensed or not. If licensed, the dog control officer or '
his authori2ed representative shall enter the name and
address of the owner and the number of tihe license tag'.
If reasonably possible, the dog control officer or his -
duly authorized representative shall return the dog to
the ].icensed owner togetfier tatLth a notice of violation
of this ordinance, provided, 3.f it is not reasonably
possible to immediately reL-urn the dog to its owner, the
dog control offieer sha11 notify t-lhe owner within 48 hours •
by certified mail or telephone or personal notice that the

eye dog; to veterinarian offices or hospitals; or to
dog shows, exhlbitions or organized dog training
classes; or to dogs used by Armored Car Service. (3) Any c:og whether licensed or not whfle in •
heat accessible to other animals for purposes other

(4) Any dog which cbases, runs after, or jumps at vehicles•

III herein may be redeemed upon payment of the redempt'oion

shall be $3.00 for eacn dog plus an addi.tional fee of $2.00
for. each 24-hour period or portior} thereof during wh1ch such
dog is retained by the impound3.ng agency. The redemption
~fee nhall be made payaUle to the Spokane County Treasurer.

tiJHEREAS, the Board of County Co;nmissioners of Spokane
County pursuant to the Revised Code of Llashington, Sect3.on '
36.32.120 (Povrers of the Board) subsection 7 has the authority
to make and enforce by appropriate resolutions or ordinances
all such police and sani~ary regulations as are not in conflict'o
• vrith state law svithin the unincorporated area of Spokane Counky;
and ' •
. ~ WHEREAS, the Board of County Commissl.oners of Spokane .
County, by Resolution No. 75-503 enacted a dog control ordinance
to be effective in all uni.ncorporated areas of Spokane County; .
and .
• WHEREAS, the Board of County Commissioners of Spokane
County pursuant to the above cited statu'cory language feel.s that it Vtould be in the best interest of Spokane County that the dog
control ordinance presently in effect in the unincorporated areas
of Spokane County be amended so that the dog control•off3cer as .
defined in Resolution No. 75-503 or his duly appoi:-tted agent be
authorized to issue criminal citations for violations of the dog
control ordinance and add3tionall.y that a bond forfeiture sche-
dule be set up for violations; and WHEREAS, the Board of County Commissioners of Spokane ,
Count,y, after 10 days notice held a hearing on the day -
_ of ~.r/~i7.~1~"i`~' , 1Q'~~ to consider amendment to the dog con-
trol ordinanc% (Resolution No. 75-503) wh3.ch would authorize the
dog control officer or his duly authorized agent to issue criminal
citat3ons for vlolations• of the ordinance and additianally estab,-- •
lish a bond forfeiture schedule; and WHCREAS, the Board of County Commissioners of Spolcane
County at the tirae of the hearing ivere adv:tsed by the Spokane -
. County Engineering Department that the department had made an
environmental review of the proposed amendments as.mandated by.
' the State Environmental Policy Act of 1971 and had determined that
the proposed ordiriance would not significa.ntly affect the environ-
ment; and . '
WHEREAS, the Board of County Commissioners after-consider-
ing the evidence submitted at such hearing fcels that the adoption
' of the amendments to the dog control ordinance would be in the best
interest of the public; _ -NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Spokane County, Washington that the attached clog"

made a part of the Spokane County nog Control Orclinance (Spokane
County Resolution No. 75--503). .
