The question arises as to whether or not 1208' treatment needs to be provided for these driveways. '208' Swales are not required, but biofiltration treatment will be needed. No plans shall be prepared, but language shall be included in the final short plat documents requiring sheet f low treatment, or grass-lined ditches. ' 20 i • . Standard Drainage Language for Short Plats The property owners within this plat shall be held responsible for keeping open and maintaining the surface path of natural or man-made drainage flow over and across their respective properties. If the properiy owner(s) fails to maintain the surface path of natural or man-made dra,inage flow, or the drainage swale, a notice of such failure may be given to the property owner(s). If not cornected within the period ind.icated on said notice, Spokane County has the right to conect the maintenance failure, or have it cornected, at the expense of the property owner. Any natural drainage channels, creeks with internuttent or constant flow, or well-defined natural draws periodically subject to concentrared flow of stormwaLer, shall be pla.ced within an easement granted to Spokane County. No buildings shall be constructed within the easement, and no fill placed within the easement without the expressed written consent of the Spokane County Faigineer. The easement shaU be of sufficient width to enoompass the stormwaier flow width and allow for emergency m,aintenance, but in no ' case shaU the easement be less than 10 ft. in width. The property owner or authorized representative shall inform each succeeding purchaser of all drainage easements on the property and their responsibility for ma.intaining surface drainage paihs and swales within said easements. Any building that is constructed on a lot in this plat shaU be set at such an elevation so as to provide positive drainage away from any drainage entry point to the building (including but not limited to a window well, a window unprotected by a window well, or a dooiway). Said positive drainage shall consist of a minimum slope of 3% away from the building for a distance of at least 10 feet from the building. 'Ihe lots shaU be graded so that either a) all nuioff is routed away from the building, and conveyed over the lot to a nattual dra.inage swale or approved drainage facility, or b) drainage intercepted on the lot is disposed of on the lot in an approved drainage facility. The approved drainage facility shall be constructed in accordance with any applicable a.ccepted plans on file at the County Engineer's Office. Any revisions to the accepted drainage plans must be accepted by tile County Engineer's Office prior to construction of said revisions. Vanhoff has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the day of February, 1996. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Spokane County Director of the Division of Building and Planning. 2. The proposal is to divide approximately 3.9 acres into 2 lots for commercial uses and those uses permitted in the Regional Business (B-3) zone. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of lots to be recorded over time, individually or in groups; provided each lot and the proposed use can meet the minimum development standai•ds of Spokane County. Specific lots can be recorded at different times, but prior to sale, lease, or transfer of the particular lot. 3. The proposal is generally located 170 feet north of the northwest corner of the intersection of Sullivan Road and Sprague Avenue, in the SE 1/4 of Section 14, Township 25 North, Range 44 E.W.M. Spokane County, Washington. 4. The existing zoning of the property described in the application is Regional Business (B-3) zone, previously established as Commercial in 1953 (File No. 311-53) and redesignated Regional Business (B-3) on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of the existing zone. 5. The Spokane County Comprehensive Plan designates this area as Major Commercial. The development and uses proposed are generally in accord with this category, as conditioned. 6. Surrounding uses include commercial uses. 7. The site is located inside the Public Transportation Benefit Area (PTBA) of Spokane County. 8. The Spokane County Arterial Road Plan identifies Sullivan Road as a Principal Arterial with a future right of way width of 100 feet. The existing right of way is 1 10 feet. Therefore, the proposal conforms to the Plan. 9. The proposed binding site plan will be served by a public water system, requiring only simple connections. Waste water disposal will be as authorized by the Spokane County Division of Utilities. 10. An Environmental Checklist was submitted to the County Division of Building and Planning - Building Section in association with the proposed construction of a 40,000 square-foot retail building and a 2,000 square-foot fast food restaurant on the subject site. The Division of Building and Planning - Building Section deternuned that "No pi-obable significant adverse impacts" would result from the proposed construction of said buildings and issued a Determination of NonSignificance ("DNS") on September 18, 1995. The September 18, 1995, "DNS" was circulated to seven other agencies of jurisdiction and other agencies/departments affected by the proposed construction for review and comment. The "DNS" comment period ended October 16, 1995. No comments were received by reviewing agencies. Because an Environmental Checklist was previously submitted, reviewed by the County Division of Building and Planning - Buildinb Section, and circulated for comments rclatinb to proposed construction on the subject site, an aclditional Environmental Checklist associated with proposed Binding Site Plan BSP-47-96 was not required. 11. The i-equired public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 12. Written coinments were received by one adjoining property owner who supported development on the subject site, however, wanted to be assured that traffic circulation and access to and from the proposed site will not in any way impact current traffic movement for their adjacent property. ~ a 13. The following is a response to the comments received by an adjoining property owner: • traffic movement to and from lhe pi-oposed site will impact cucrent ti-affic movement in the vicinity in that the site is being developed for uses permitted within the existing zone, and thus traffic will be generated. However, as per the Determination of NonSignificance ("DNS") that was issued by the County Division of Building and Planning - Building Section (see Finding #10), the project does not have a probable significant adverse impact on the environment as conditioned and as regulated under present local and state regulations. • In addition, the Spokane County Division of Engineering and Roads is the proper abency for reviewing traffic circulation and access issues and ensuring that land use actions such as short plats are in conformance with adopted local and state standards. Conditions of approval attached hereto from the Counry Division of Engineei-ing and Roads are measures to ensure conformance with said standards. 14. The subdivision proposal is generally consistent with RCW 58.17 and the County subdivision regulations, promoting the public health, safety and general welfare in accordance with standards established by the state and Spokane County. Spokane County Planning has considered the provision of public facilities as cited in RCW 58.17.110 (2). More specifically: a. open spaces b. drainage ways c. public and/or private rights-of-way d. transit . e. potable water f. sanitary waste disposal g. parks and recreation facilities h . playgrounds i . schools and schoolgrounds j . sidewalks DECISInN Based upon the above noted Findings ot f~F~~ 6@nclu, Binding Site Plan Application BSP-47-96 is hereby APPROVED u rc , ject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. All conditions imposed by the Division of Building and Planning shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns and successors. COUNTY DIVISION OF BUILDING AND PLANNING CONDITIONS 1. The Spokane County Planning Director/designee shall review any proposed Final Binding Site Plan and future building permits to ensure compliance with these Findings and Conditions of Approval. 2. Any proposed Final Binding Site Plan and future building permits shall comply with the Regional Business (B-3) zone of the Spokane County Zoning Code, as amended. 3. The preliminar ' j,n,g site plan is given conditional approval for ~j, ~6r~ally . e applicant may reguest an extension of time by submitting a written re approximately forty-five (45) days prior to the above expiration date. 4. The Final Binding Site Plan shall be designed substantially in conformance with the preliminary binding site plan of record. The initial recording of this Final Binding Site Plan shall show, at a minimum, the perimeter boundary of the total site plan and any specific internal lots which lot size and proposed use on the lot are known and that can comply with the development standards at that time. It is not recommended to record lots until the specific use and lot size are known, such as a preliminary site development plan by a potential lot purchaser. FINDINGS AND DECISION BSP-47-96 Page 2 L 5. The number of lots within subsequent recorded Final Binding Site Plan(s) shall be deterinined by the development standards, such as the Zoning Code and others. Each subsequent Final Binding Site Plan shall be Flexible within the terms of the conditions of appcoval, and lot lines may be adjusted diffei-ently than the approved preliminary binding site plan of record in a manner prescribed by procedures established by the Division of Building and Planning and the Binding Site Plan Chapter of the Spokane County Subdivision Oi-dinance. As a specific ownership size is determined for a particular proposed land use, a Final Binding Site Plan can be recorded for that lot after c-eview and approval is granted by the reviewing agencies and the Division of Building and Planning. Once recorded, the lot may then be sold, leased or transferred to another party. 6. A binding site plan number and parceUtract numbei-s shall be indicated before the Final Binding Site Plan is filed, such numbers to be approved by the Division of Building and Planning Director/Designee. Lots should have a proposed buyer and land use before being recorded in a Final Binding Site Plan. Lots shall be named as Tr«cts followed by a capital Letter (i.e. Tract "A"). That portion of the Final Binding Site Plan that is not designated as Tracts shal l be named as a Parcel fol lowed by a IVunrber (i.e., Pai-cel-1). Any time the legal description of a Tract or a Parcel changes, the next sequence letter or rauniber, respectively, shall be used to create a clear record of property boundary changes over time. For example, if Tract "A" wei•e changed to add more land, then its title Tract "A" would be drawn with dotted lettering (no solid lines) and the original property line drawn as small thin dashed lines, 50°Io spaced (no solid lines). The new title would be drawn with solid lines as Tract "B" (or the next sequenced letter not yet used) and the new property line drawn as a solid line. Parcel-1 would be drawn in the same transparent lettering style as described for the changed Tract title and the next sequence number used for the remaining parcel (i.e., Parcel-2). Tract and Parcel title Letters and Numbers, respectively, are to be used only once. 7. Three (3) current certificates of title shall be furnished to the Division of Building and Planning prior to filing the final binding site plan. 8. Appropriate road name(s) shall be indicated. The final binding site plan shall be addressed at the time of building permit application for individual lots. 9. Appropriate utility easements shall be indicated on copies of the proposed final binding site plan. Written appi•oval of utility easements by appropi-iate utility companies shall be i-eceived with the submittal of the final binding site plan. 10. The final binding site plan map shall indicate by a clear, dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following state ent: "S' yard and rear yard setbacks shall be determined at the time building perinits are r sted unless these setbacks are specifically drafted on this final plat. The setbacks ated on this binding site plan may be varied from if proper zoning approvals are tained." 11. The Spokane County Division of Building and Planning shall prepare and recoi•d with the Spokane County Auditor a"Title Notice" noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This "Title Notice" shall serve as official public notice regarding conditions of appi-oval affecting the property in question. The "Title Notice" shall be recorded within fifteen (15) days of final disposition of the approved land use action and shall only be extinguished by the Spokane County Division of Building and Planning. The following statement shall be placed in the dedication of the final binding site plan document: "WARNING: Spokane County has no responsibiliry to build, improve, maintain or otherwise service the private roads contained within or provide service to the property described in this binding site plan. By accepting this Binding Site Plan or subsequently by allowing a building permit, change of use permit or certificate of occupancy to be issued on property on a private road, Spokane County assumes no obligation for said private road, and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain or provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner(s), their heirs, successors or assigns, including the obligation to participate in the maintenance of the private road as provided herein." 5. The proposed binding site plan sha11 be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 95-0498, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 6. Reciprocal easements shall be executed to provide for access and pal-king between the two subject parcels. COUNTY DIVISION OF UTILITIES CONDITIONS 1. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. A Sewer connection permit is required. 2. The applicant shall submit expressly to the Spokane County Utilities Department "under separate cover", only those plan sheets showing sewer plans and specifications for: Public Sewer/Double Plumbing/Private Sewer or Dry Sewer connections for review and approval by the Utilities Department prior to issuance of permit to connect. 3. Security shall be deposited with the Utilities Department for construction of the Public Facilities/Double Plumbing/Private Sewer or Dryline connections. 4. AiTangements for payments of additional sewer charges must be made for prior to issuance of sewer connection permit. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. COUNTY HEALTH DISTRICT CONDITIONS 1. The final binding site plan shall be designed as indicated on the preliminary binding site plan of record and/or any attached sheets as noted. 2. Written approval of the easements by the utility companies must be received prior to the submittal of the final binding site plan. 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final binding site plan, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that an adequate and potable water supply is available to each tract of the BSP. 7. Prior to filing the final binding site plan, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the BSP. 8. Aipuplic sewer system will be made available for the project and individual service will be vided to each lot prior to sale. Use of individual on-site sewage disposal system shall not authorized. 9.
