Re: Shamrock Lane Tract X
Dear Mr. and Mrs. Lappen,
Last May, I wrote to you regarding the Shamrock Lane Tract X on your property. The
purpose of this letter is to clarify the city's intentions about the Tract X and to let you know
about a possible development happening next to Shamrock Lane, to the west.
When your property was subdivided, the County required Shamrock Lane to be in a "Tract
X" which was supposed to reserve the Lane for future public right of way. However, the
wording of the document does not clearly dedicate it to the county or the city so it turns out
that Shamrock Lane is legally a private road.
The City is requesting that you would let the pavement area of Shamrock Lane on your
property be made into part of a public street. The grassy or landscaped areas alongside the
street would remain private.
If Shamrock Lane is allowed to become public then —
1. it would be part of the Shamrock Street connection between Valleyway and
Broadway,
2. the turn -around located on the southern portion of Shamrock Lane would no longer
be needed,
3. the City would take over the responsibility for the future care and maintenance of the
pavement and the drywells in the swales, although the care of the landscaping within
the swales and along the edge of the street would still rest with the homeowner, and,
4. the homeowners will no longer have to pay the portions of the stormwater utility fees
that are assessed on the roadway area.
The property immediately west of yours is proposing to be subdivided. As a part of this
subdivision, a public half -street will be constructed next to Shamrock Lane. If your portion
of Shamrock Lane is not able to become a public street then, for safety reasons, a barrier will
need to be built by the developer along the west edge of the lane, between the two streets.
The City does not see this as an ideal situation for the owners adjacent to Shamrock Lane.
As we mentioned in our previous letter, the City, at its own expense, would prepare and
record all the necessary paperwork to turn Shamrock Lane into a public street.
