Sandusky River Lane Gentlemen: On July 17, 1998, I called your office and left a message for Chris Swanson to return my call in relation to Mr. and Mrs. Bolt's home. Apparently Chris did not feel that it was important enough to take his time to discuss the Bolt's complaint. I am, therefore, relegated to writing this letter to request that action be taken by you to resolve some problems of misrepresentation in relation to Mr. and Mrs. Bolt. As I am sure you are aware, both the listing and selling realtors misrepresented the property boundary line to Mr. and Mrs. Bolt, indicating to them that they had substantially more back yard, approximately 20 feet more, than what they actually have. Under Washington law, the seller/builder is responsible for the misrepresentations of his agent. Even worse, the placement of the home on the lot violates the set back requirements of Spokane County from the rear lot line. Spokane County ordinance requires the set back to the rear lot line be 15 feet, whereas the house is actually built within 11.4 feet of the rear property line. This gives your company two options, the first being to jack the house up to move it forward so that the set back is appropriate, the second being to add additional property to the Lot acceptable to my client by a minor lot line adjustment. A third option, that the County of Spokane waives strict compliance with rear lot line set back is not acceptable to my client.
