SITE PLAN, BSP-82-02 ) CONCLUSIONS AND
APPLICANT: ROMAX ASSOCIATES ) DECISION
THIS MATTER, an application to divide commercial land from Romax Associates has been received
and was decided upon, pursuant to Spokane County Subdivision regulations, on the 111 day of June,
2002.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering the
decision by the Director of Spokane County Division of Planning.
2. The proposal is to divide approximately 10.95 acres into seven (7) lots for the development of
those uses allowed in the existing Regional Business (B-3) zone.
3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any
number of parcels to be recorded over time, individually or in groups; provided each parcel
and the proposed use can meet the minimum development standards of Spokane County.
Specific parcels can be recorded at different times, but prior to sale, lease or transfer of the
particular parcel.
4. The proposal is located north of and adjacent to Montgomery Avenue, and east of and
adjacent to Argonne Road in the SW'/ of the NW'/4 of Section 8, Township 25 N., Range 44
EWM., Spokane County, WA. Tax Parcel Nos. 45082.1847 & 45082.1848.
5. The existing zoning of the property described in the application is Regional Business (B-3),
established in 1991, and previously classified as Commercial (C) in 1957. Pursuant to RCW
58.17.195 the proposal does conform to the requirements of the existing Regional Business
(B-3) zone.
6. The Spokane County Comprehensive Plan designates this area as Community Center. The
development and uses, as proposed and conditioned, are in accord with the Community
Center category. This proposal is compatible with the surrounding uses.
7. The proposed site is located within the Public Transportation Benefit Area (PTBA), Urban
Growth Area (UGA), Aquifer Sensitive Area (ASA), and the 30,000 foot Conical Area for Felts
Field.
8. The Spokane County Arterial Road Plan identifies Montgomery Avenue as an Urban Minor
Arterial. The Arterial Road Plan identifies Argonne Road as an Urban Principal Arterial The
Division of Engineering and Roads has not requested the dedication of additional right-of-way;
therefore, as conditioned, the proposal conforms to the Arterial Road Plan.
9. The required public notice was provided for this proposal on May 16, 2002. Agencies having
a potential interest in the project were notified on May 8, 2002 and recommendations solicited.
No written comments were received from any adjoining property owners regarding this
proposal.
10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane
County Division of Planning. The review considered the specifics of the proposal, other
available information, County ordinances, other regulations and laws, possible standard
Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and
guidelines. The Division of Planning has determined that "No probable significant adverse
impacts" would result from the proposal being developed and issued a Determination of Non- -
Significance (DNS) on May 25, 2002.
The DNS was circulated for review and comments to those agencies of jurisdiction affected by
this proposal. The DNS was also advertised in the newspaper to the public 14 calendar days
before the comment period ended on June 10, 2002.

11. In conjunction with the conditions of approval and Spokane County development standards,
the proposed binding site plan is not detrimental to the public health, safety and general
welfare. Moreover, this proposal implements the underlying zoning and complies with the
provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision
Ordinance. _
DECISION
Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-82-02 is
hereby APPROVED for five (5) years, specifically until June 11, 2007, and subject to the conditions
noted below. This decision is final unless appealed in writing, consistent with adopted appeal
procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF PLANNING
1. The proposal shall comply with the Regional Business (B-3) and other applicable Zoning Code
chapters, as amended.
2. T liminary Binding Site Plan is given conditional approval for five (5) years, specifically to

ove expiration date, but no later than May 12, 2007. Application(s) for

extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension
of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the
criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to
reflect the adopted policy and development regulations at the time of the extension
application.
3. Prior to recording the final Binding Site Plan, the applicant shall submit to the Planning
Director/designee for review any proposed final binding site plan to ensure compliance with
these Findings and Conditions of Approval.
4. The initial overall final binding site plan shall be designed substantially in conformance with the
"Preliminary Binding Site Plan of Record.n The initial recording of this final binding site plan
shall show, at a minimum, the perimeter boundary of the total site and any specific internal
parcels that can comply with the development standards at that time.
5. Any subsequent divisions of land within the recorded original final binding site plan shall be
reviewed by the Planning Director/designee. The number of parcels proposed will be
determined by the development standards, such as the Zoning Code and shall be flexible
within the terms of the original final Binding Site Plan's conditions of approval. After the
Division of Planning has reviewed the specific parcel(s) and determined their compliance with
all applicable regulations and provisions of the original final Binding Site Plan, an uAmendment
to the Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor.
6. A survey is required of the subject property prior to recording the final Binding Site Plan.
7. Appropriate road name(s) and street address for each parcel shall be indicated on the final
Binding Site Plan map.
8. Appropriate utility easements shall be indicated on the final Binding Site Plan map. Written
approval of utility easements by utility companies must be received prior to recording the final .
binding site plan.

9. The final ding Site Plan map shall indicate by a dashed line the required setbacks from all
private public roads. The dedication shall contain the following statement:

oper zoning or variance approvals are obtained."
10. Four (4) current certificates of title shall be furnished to the County Division of Planning prior
to recording the final Binding Site Plan.
11. A specific and detailed Site Development Plan will be submitted to the Division of Planning for
review and approval prior to issuance of a building permit, Change of Use Permit or Certificate
of Occupancy.
12. Extensions of time shall not be granted based upon unavailability of sewer and/or failure of the
applicant to make application to, and receive approval from, the Boundary Review Board for
sewer service extensions/annexations.
13. A filed avigation easement satisfactory to the Spokane International Airport Board, for Felts
Field, shall be provided prior to filing of the Binding Site Plan.
SPOKANE COUNTY DIVISION OF BUILDING & CODE ENFORCEMENT
1. The applicant shall contact the Division of Building and Code Enforcement at the earliest
possible stage in order to be informed of code requirements administered/enforced as
authorized by the State Building Code Act. Design/development concems include: addressing, fire apparatus access roads, fire hydranUflow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, exterior wall protection, and
energy code regulations.
2. Prior to the issuance of the initial building permit(s), the applicant shall submit to the Division
of Building and Code Enforcement documentation signed by the water purveyor and the
applicable fire district stating that the public water system has been installed, tested and
accepted as operational pursuant to the approved water plan.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. Conditional approval of the Binding Site Plan by the County Engineer is given subject to
approval of the road system as indicated in the Preliminary Binding Site Plan of record.
2. A Professional Engineer (P.E.), licensed in the State of Washington, shall submit road and
storm drainage construction plans and a drainage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater
Management, and all applicable federal, state, and local regulations and laws that are in effect
at the time of the plan submittal or at the time of the development permit application(s). The
final road and storm drainage plans and drainage report shall receive the County Engineer's
acceptance prior to release of any associated Grading, Building, or Right-of-Way Permit.
3. Private drainage easements and maintenance covenants need to be dedicated by or granted
together with the final Binding Site Plan for site drainage facilities shared between differing
parcels or parcel ownership blocks. A reciprocal use agreement covering the operations and
maintenance of the stormwater facilities as well as other uses such as parking, access, and
utilities may be recorded together with the final Binding Site Plan in lieu of the above-
mentioned drainage easements and maintenance covenants.
4. All construction within the existing or proposed Public Right of Way is to be completed prior to
the release of a building permit or a bond in the amount estimated by the County Engineer to
cover the cost of construction of improvements, construction certification, "As Built" plans and
monumenting the street centerlines shall be filed with the County Engineer.
5. No construction work is to be performed within the existing or proposed public right-of-way
until a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.

6. No road improvements are required for Argonne Road because road improvements were
performed by CRP #2415 and CRP #2273.
7. No road improvements are required for Montgomery Avenue because road improvements
were performed by Building Permit #B-01008919.
8. The County Engineer has designated a Local Access Roadway Section for the improvement
of Locust Road which is adjacent to the proposed Binding Site Plan. This will require the
addition of approximately 5-7 feet of asphalt along the frontage of the development. The
construction of curbing and sidewalk is also required. The applicant shall grant applicable
border easements adjacent to Spokane County Right of Way per Spokane County Standards.
Note: Road and Drainage plans for the improvement of Locust Road have been accepted by
the Spokane County Engineer with Building Permit # B-01008919.
9. Approach Permits are required for any access to the Spokane County road system.
10. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 1-0298, as amended, which establishes
regulations for roads, approaches, drainage and fees in new constn.iction.
11. "The applicant is advised that there may exist utilities either underground or overhead
effectin~ the applicant's property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities.° "The applicant should contact the applicable utilities regarding
responsibility for adjustment or relocation costs and to make arrangements for any necessary
work."
12. This proposed Binding Site Plan is not being requested for a specific development proposal,
building permit application or site plan at this time. At such time a specific site plan is
submitted for review, the applicant shall submit detailed traffic information for review by the
County Engineer to determine what traffic impacts, if any, that the development would have on
surrounding infrastructure. The applicant is advised that mitigation maybe required for off-site
improvements.
Note: When a specific development proposal, building permit application or site plan is
submitted, these plans will be reviewed for concurrency with the Spokane County
Comprehensive Plan and a concurrency certificate shall be issued in accordance with the
Phase 1 - Development Regulations.
SPOKANE COUNTY DIVISION OF UTILITIES
1. As per the Spokane County Zoning Code Phase One Development Regulations the dedication
shall state: Public sewers shall be constructed to provide for the connection of each parcel to
the County's system of sewerage. Uses on properties within the project shall be required to
connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer
connection permits shall be required.
2. A"Short Form Survey - Non-Residential Establishments" must be completed and returned to
the Utilities Department before any sewer pretreatment requirements can be determined.
Sewer connection cannot be made until pretreatment requirements have been met. A copy of
the survey will be mailed to you. If you have any questions, please contact Chad Coles at
509-477-7280. 3. The facility is currently connected to sewer, however depending on the nature of the new use
and or expansion, additional facilities may also need to be connected. Commercial
developments shall submit historical and or estimated water usage prior to the issuance of the
connection permit in order to establish sewer fees.
4. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover", only those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and or estimated water usage as part of the sewer plan submittal.

5. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of
the project. Any water service for this project shall be provided in accordance with the
coordinated Water System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
6. The final BSP shall be designed as indicated on the preliminary BSP of record and/or any
attached sheets as noted.
7. Appropriate utility easements shall be indicated on copies of the preliminary BSP of record for
distribution by the Planning Department to the utility companies, Spokane County Engineer,
and the Spokane Regional Health District. Written approval of the easements by the utility
companies shall be received prior to the submittal of the final BSP.
8. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
9. Water service shall be coordinated through the Director of Utilities, Spokane County.
10. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
11. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each tract of
the plat.
12. Prior to filing the final BSP, the sponsor shall present evidence that the BSP lies within the
recorded service area of the water system proposed to serve the plat.
13. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire
protection use shall be approved by the water purveyor. Said water plan must have been
approved by the fire protection district and the appropriate health authorities. The health
authorities, water supplier (purveyor), and the fire protection district will certify, prior to the
filing of the final plant, on the face of said water plan that the plan is in conformance with their
requirements and will adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.
14. The purveyor will also certify prior to filing the final plant on a copy of said water plan that
appropriate contractual arrangements have been made with the plat sponsor for construction
of the water system, in accordance with the approved plan and time schedule. The time
schedule will provide, in any case, for completion of the water system and inspection by the
appropriate health authorities prior to application for building permits within the BSP. The
contractual arrangement will include a provision holding Spokane County, Spokane Regional
Health District, and the purveyor harmless from claims by any tract purchaser refused a
building permit due to failure of the plat sponsor to satisfactorily complete the approved water
system.
15. A public sewer system will be made available for the BSP and individual service will be
provided to each tract prior to sale. Use of individual on-site sewage disposal systems shall
not be authorized.

18. The final BSP dedication shall contain the following statement:
"The public water system, pursuant to the Water Plan approved by county and state heaith

water purveyor, shall be installed within this subdivision and the applicant shall provide for
individual domestic water service as well as fire protection to each tract prior to sale of
each tract and prior to issuance of a building permit for each tract."

The Spokane County Division of Engineering and Roads has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the Spokane County Division of
Planning for inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be
approved.
Prior to release of a building permit or use of property as proposed:
1. Conditional approval of the Binding Site Plan by the County Engineer is given subject to
approval of the road system as indicated in the Preliminary Binding Site Plan of record.
2. A Professional Engineer (P.E.), licensed in the State of Washington, shall submit road and
storm drainage construction plans and a drainage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater
Management, and all applicable federal, state, and local regulations and laws that are in effect
at the time of the plan submittal or at the time of the development permit application(s). The
final road and storm drainage plans and drainage report shall receive the County Engineer's
acceptance prior to release of any associated Grading, Building, or Right-of-Way Permit.
3. Private drainage easements and maintenance covenants need to be dedicated by or granted
together with the final Binding Site Plan for site drainage facilities shared between differing
parcels or parcel ownership blocks. A reciprocal use agreement covering the operations and
maintenance of the stormwater facilities as well as other uses such as parking, access, and
utilities may be recorded together with the final Binding Site Plan in lieu of the above-mentioned
drainage easements and maintenance covenants.
4. All construction within the existing or proposed Public Right of Way is to be completed prior to
the release of a building permit or a bond in the amount estimated by the County Engineer to
cover the cost of construction of improvements, construction certification, "As Built" plans and

monumenting the street centerlines shall be filed with the County Engineer.
5. No construction work is to be performed within the existing or proposed public right-of-way until
a permit has been issued by the County Engineer. All work is subject to -inspection and
approval by the County Engineer.
6. No road improvements are required for Argonne Road because road improvements were
performed by CRP #2415 and CRP #2273.
7. No road improvements are required for Montgomery Avenue because road improvements were
performed by Building Permit #B-01008919.
8. The County Engineer has designated a Local Access Roadway Section for the improvement of
Locust Road which is adjacent to the proposed Binding Site Plan. This will require the addition
of approximately 5-7 feet of asphalt along the frontage of the development. The construction of
curbing and sidewalk is also required. The applicant shall grant applicable border easements
adjacent to Spokane County Right of Way per Spokane County Standards.
Note: Road and Drainage plans for the improvement of Locust Road have been accepted by
the Spokane County Engineer with Building Permit # B-01008919.
9. Approach Permits are required for any access to the Spokane County road system.
10. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 1-0298, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
11. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation- for adjustments or relocation regarding
these utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."
12. This proposed Binding Site Plan is not being requested for a specific development proposal,
building permit application or site plan at this time. At such time a specific site plan is submitted
for review, the applicant shall submit detailed traffic information for review by the County
Engineer to determine what traffic impacts, if any, that the development would have on
surrounding infrastructure. The applicant is advised that mitigation maybe required for off-site
improvements.
Note: When a specific development proposal, building permit application or site plan is
submitted, these plans will be reviewed for concurrency with the Spokane County
Comprehensive Plan and a concurrency certificate shall be issued in accordance with the
Phase 1 - Development Regulations.

l. Reimburse SPokane County for project review and inspection tees as specified in Chapter 9.14 of
the Spokane County Code. The fees will be based on actual salary costs incurred by Spokane
County for project reviews and / or inspections plus a tcn percent administrative chargE, and will
be billed montklly as accrued. Any billing amounts due, inclucling any expenses incurred in the
coliection of an overdue account, must be paid prior to the County's acceptance of the project for
tiling, [f a project is approved andlor filed with a balance still owing, the unpaid balance shall be
paid within 30 days of the invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the billing as specified
above.
3. Any invoices not paid within 30 days of the invoice date will be considered delinquent. If any
outstanding balance on the account tor this project is not paid within 30 days of the invoice date,
no furthcr reviews of the project documcnts will be conducted until the entire account balance is
paid. Any balance on the account fox this project not paid within 65 days of the invoice date may
result in legal action or the initiation of other collection procedures, including referral to a
collection agency. The Sponsor will be liable for any and all expenses incuri•ed by tlle CouYity for
Che collection of overdue accounts.

Re: Binding Site Plan #82
Dear Mr. Nyberg:
I represent Romax Associates, the applicant for Binding Site Plan #82. I understand from
my client that the Binding Site Plan involves only creation of four building sites within an
existing parcel and that no public or private improvements are contemplated or required in
connection with the application. In connection with the application you have required the
following language be set forth on the plat:
"The developer, property owners, and homeowners association
waive an_v and all claims for damages against any governmental
authority rising from the construction, ownership or maintenance
of public facilities. This waiver includes claims of any nature,
including but not limited to persons and real property damages as
well as any inverse condemnation claims."
On behalf of my client, I request the requirement of the language quoted above be
waived. Since no improvements are contemplated in connection with the application, the
requested waiver of claims is inappropriate - there is no nexus between the required waiver and
the proposed land use action. Moreover, to the extent the waiver does not relate to
improvements associated with the application, it is unreasonably broad because it appears to be
an attempt to condition approval on an up front, blanket waiver of all claims of any kind or
nature whatsoever by the landowner against any governmental authority. I do not believe that
such a broad waiver would be enforced by the courts.
