FINDINGS OF FACT AND CONCLUSIONS 1. 'i'he individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Planning. 2. The proposal is to divide approximately 7 acres into 2 lots for existing industrial uses and those uses allowed in the existing Heavy Industrial (I-3) zone. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of parcels to be recorded over time, individually or in groups; provided each parcel and the proposed use can meet the minimum development standards of Spokane County Zoning Code. Specific parcels can be recorded at different times, but must be recorded prior to sale, lease or transfer of the particular parcel. 4. The subject property is generally located at the southwest corner of the intersection of Valleyway Avenue and Ella Road, in the SW '/4 of Section 18, Township 25 North, Range 44 EWM, Spokane County, Washington. , 5. The existing zoning of the property described in the application is Heavy Industrial (I-3) established in 1991, previously classified as Manufacturing (M) in 1941 (ZE-231-41). The existing Heavy Industrial (I-3) zone remains unaffected by the adoption of the Phase I Development Regulations by the Board of County Commissioners (BOCC) on January 15, 2002, Resolution # 2- 0037. Zoning in the area of the site consists of Heavy Industrial (I-3), Light Industrial (I-2) and Urban Residential-3.5 (LJR-3.5). 6. The Spokane County Comprehensive Plan identifies the subject property as being within the Heavy Industrial (I-3) category of the Comprehensive Plan as a result of the adoption of the Phase I Development Regulations by the Board of County Commissioners (BOCC) on January 15, 2002, Resolution #2-0037. 7. 1'he proposed site is located within the Public Transportation Benefit Area (PTBA) of Spokane County. The nearest connecting services are located along Valleyway Avenue. 8. The Spokane County Arterial Road Plan identifies Valleyway Avenue as and Urban Collector Arterial and Ella Road as a Local Access Street. The, Spokane County Division of Engineering and Roads is requesting 2.5 feet of dedication along Valleyway Avenue. 9. - The required public notice was provided for this proposal and agencies having a potential interest - in the project were notified and recommendations solicited. Written comments have been received by surrounding property owners expressing concerns over the potential impacts to the adjacent residential area to the north and east of the subject site in the form of increased traffic and incompatibility of future industrial uses. 10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County Division of Planning. The review considered specifics of the proposal, other available information, County Ordinances, other regulations and laws, possible standard Conditions of . , _ . ~ • Approval, the Generalized Comprehensive Plan, and other- County policies and guidelines. The = - Planning Division has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a Determination of Nonsignificance ("DNS") on ' September 9, 2002. The "DNS" was circulated to ten (10) agencies_ of jurisdiction affected by this proposal for review and comments. The "DNS" was advertised in the newspaper to the public 15 calendar days before the comment period ended on October 7, 2002. No written comments were received regarding this determination. 11. In conjunction with the conditions of approval and Spokane County development standards, the proposed binding site plan is not detrimental to. the public health, safety and general welfare. Moreover, this proposal implements the underlying zoning and complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance. All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner . or owners of the property, heirs, assigns and successors: ' SPOKANE COUNTY DIVISION OF PLANNING 1. The proposal shall comply with the Heavy Industrial (I-3) zone, and all other applicable chapters of . the Spokane County Zoning Code, as amended. 2. The preliminary Binding Site Plan was given conditional approval for five (5) years, specifically to October 8, 2007. The applicant may submit an extension of time application no later than thirty (30) days prior to the above expiration date. Application(s) for extension of time shall be - processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions will be changed to reflect the adopted policy and development regulations at the time of the extension application. 3. Prior to recording the final binding site plan, the applicant shall submit to the Planning _ Director/designee for review any proposed final binding site plan to ensure compliance with these Findings and Conditions of Approval. .4. The initiai overall final binding site plan shall be designed substantially in conformance with the _ "Preliminary Binding Site Plan of Record." The initial recording of this final binding site plan shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can comply with the development standards at that time. 5. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by the Planning Director/designee. The number of parcels proposed will be determined by the development standards, such as the Zoning Code and shall be flexible within tlle terms of tlle original final binding site plan's conditions of approval. After the Division of Planning has reviewed the specific parcel(s) and determined their compliance with all applicable regulations and provisions of the original final binding site plan, an "Amendment to the Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor. Appropriate road name(s) and street address for each parcel shall be indicated on the final binding ' site plan map. 8. Appropriate utility easements shall be indicated on the final binding site plan map. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to issuance of a building permit or at t6e request of the County Engioeer in conjunction with a County Road Project/Road Improvement District, whichever comes first: 1. Applicant shall dedicate 2.5 feet on Valleyway Avenue and the applicable radius on Valleyway . Avenue and Ella Road. Prior to release of a building permit or use of property as proposed: 2. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage plans, a drainage report and calculations that conform to the 2001 Edition of the Spokane County Standards for Road and Sewer Consfruction, the current edition of the Spokane County Guidelines " for Stormwater Management, and all other applicable standards. The plans and report shall receive the County Engineer's acceptance prior to release of a construction or building permit. 4. All construction within the existing or proposed public right-of-way is to be completed prior to filing the release of a Building Permit or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans and monumenting the street centerlines shall be filed with the County Engineer. 5. No construction work is to be performed within the existing or proposed public right-of-way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by . the County Engineer. 6. The County Engineer has designated a Collector Roadway Section for the improvement of Valleyway Avenue which is adjacent to the proposed Binding Site Plan. This will require the addition of approximately 9-11 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. 7. The County Engineer has designated a Local Access Roadway-Section for the improvement of Ella Road which is adjacent to the proposed Binding Site Plan. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 1-0298, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 10. "The applicant is advised that there may exist utilities either underground or overhead effecting the applicant's property, including properly to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities." "The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work." 11. The Spokane County Engineer will review this project for transportation concurrency requirements at the time of building permit application review. 12. Erosion Control: A Temporary Erosion and Sedimentation Control (TESC) plan shall be prepared by a WA State licensed Professional Engineer and implemented throughout the duration of construction. The TESC plan is to be prepared using best management practices (BMP's) currently accepted within the Civil Engineering profession. The TESC plan is to include, at a minimum, a grading plan, location and details of silt control structures, and street cleaning program. Runoff from exposed areas shall be filtered prior to discharging into a detention pond, swale, infiltration . facility, or natural drainageway. The. TESC plan is to be included in the road and drainage plans. The applicant's Engineer is to submit the TESC plan and supporting calculations to Spokane County prior to site disturbance. The TESC major structures (such as silt ponds, silt traps) are to be installed prior to other site work and the TESC measures are to be implemented and maintained throughout the duration of construction, including house construction. 13. " Any part of the drainage system that lies outside of the public right-of-way will neither be maintai 'ed nor operated by Spokane County forces. Prior to. plan acceptance by the County Enginee , the Sponsor shall provide a mechanism, acceptable to the County Engineer, for the perpetua maintenance of the stormwater drainage system. This mechanism shall also provide for the fund ng of routine maintenance and the replacement of the various components of the drainage system a the end of the service life of the respective components, and any other improvements that may be 1 gally required in the future. An Operations and Maintenance Manual for the stormwater managem nt system shall be prepared by the Sponsor's Engineer, and included in the project , documents~submitted to the County Engineer for acceptance, along with a discussion of the design _ life of the various components, a calculated annual cost for repair and maintenance, and a calculated repl`acement cost. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance of the sewer connection permit. SPOKANE REGIONAL HEALTH DISTRICT 1. The final Binding Site Plan shall be designed as indicated on the preliminary plat of record and/or any attached sheets as noted. 2. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer, and the Spokane Regional Health District. Written approval of the easements by the utility companies shall be received prior to the submittal of the final Binding Site Plan (BSP). 3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final BSP, the sponsor shall deraonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each lot of the BSP. . 7. Prior to filing the final BSP, the sponsor shall present evidence that the BSP lies within the recorded service area of the water system proposed to serve the Binding Site Plan. 8. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection district and the appropriate health authorities. The health authorities, water supplier (purveyor), and the fire protection district will certify, prior to the fling of the final BSP, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for repr, ction. 9. The purveyor will al certify prior to fling the fnal BSP on a copy of said water plan that appropriate contrachial angements have been made witli the BSP sponsor for construction of the water system, in accordan with the approved -plan and time schedule. The time schedule will provide, in any case, for com\p~letion of the water system and inspection by the appropriate health _ authorities prior to application r building permits within the BSP. This agreement needs to address the shared existing ten-inch (10") fire line that services the onsite fire hydrants. The minimum amount of issues that need to be included in the agreement are maintenance, replacement and repair of the fire line and related appurtenances as well as responsibility for monthly fire line charges. 2. A double detector check valve assembly must also be installed on the existing ten-inch (10") fire line to provide backflow protection to the public water system in accordance with Washington State Law and SCWD #3 Bylaws.
