FINDINGS DF FACT AiND CONCLUS'IONS

2. The propasal is tn divide appraxtmately 4.79 acres into four tracts. Three tracts will be for an
eX1StCI1g church, an existing prvfessronal ❑ffice building and an existing matel. 'P`he 4th tract may
be for a restaurant ar for another use allvwed in the exasting Comtrrunity Business {B-2} zone.
3. The Binding Site Plan Chapter of the Spakane Caunty Subdivision Ordinance altaws any number
of parcels to be recarded over time, individually ar in groups; pravided each parcel and the
propased use can meet the minimum develapment standards of Spokane Couiitv Zoning Code.
Specific parcels can be recnrded at different times, but must be recorded prior ta sale, lease or
transfer af the particular parcel.
4. The proposai is located at the nartheast corner of Pines Road and MissiQn Avenue in the SW 114
of Sectian 10, Township 25 N., Range 44 EWM., Spakane Count}r, Washingtoii. The site address
is 12323 E. li!Iission Avenue to 12415 E. Mission Avenue.
5. The existing zoning of the subject property described in the appltcation is Community Business
(S-2) and Regional Business (B-3). The portion of the subject praperty zoned Community
B1isiness (P-2) was the subject of an approved zvne change -from Unclassifed to Agricultural (A)
{file # 424-42) in 1942 and was re-desionated Community Business (B-2) pursuant to the Program
to implement the Zoning Code. The portian of the subject property zoned Regionaf Business (B-3)
was the subjeet of an approved zone change from Urban Ttesidential ,3.5 (UR-3.5) to Regional
Business {B-3} (f le ft 23-95C) in 1995. Pursuant to RCW 58.17.195 the prnpasal daes confarm fio
the requirements ofthe existin~ Community~ Business (B-2) and Regi,~nal $usi€~ess (B-3) zones.
6, The Spokane Caunty Comprehenstve Flan designates the subject property as Commercial and
Urban. The development and uses, as proposed are campati6le wi#h the Cams-nercial Categary but
not #he Urban Category. The Hearing Examiner Comrrtittee found that the Regional Business (8-
3) zone was generally inconsistent with the Goajs, Dbjectives and Decision Guidelines of thc
. Urban Category but that it mav be consistent when cansidering the "fransition" policy of the
Comprehensive Plan,
7. The site is €ocated within the Pubiic Transportatiorr Benefit Area (P°I'BA) of Spokane County. The
nearest cannecting services are on Pines Raad and Missian Aven,ue, immediatel}r adjacent to the
site.
8. The Spokane County Arteria1 Road Plan identifies Mission Avenue as Minor Arterial and Pines
Raad as a state high4vay. As cvnditioned, the praposal canfarms ta the ►Atterial Road P1an,
9. The required publrtc natice was provided far this proposal and agencies ~avin~ a poten#ial interest
in the project were notified and recommendations solicited. Six vvritten eornments were recerved
frarn adjoining property owners regarding this prQposal. Coneerns were expressed regarding
traff e and parking prahlems in the area and about liow these matters were tliaught to be resolved

when the property was rezoned in 1995 (see file # ZE-23-95). Inspection of the approved site plan
from the public hearing conducted on July 20, 1995 indicates that a 200 room motel was approved
for the proposed Parcels B and D. The Pheasant Hill Best Western Motel built on Parcel B has
only 105 rooms leaving a balance of 95 rooms. Washington State Department of Transportation
and the Spokane County Division of Engineering and Roads commented that if the level of
development exceeds that which was contemplated when the zone reclassification was approved,
the traffic study will need to be updated, at a minimum.
10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane
County Division of Building and Planning. The review considered the specifcs of the proposal,
other available information, County ordinances, other regulations and laws, possible standard
Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and
guidelines. The Building and Planning Division had determined that "No probable significant
adverse impacts" would result from the proposal being developed and issued a Determination of
Nonsignificance (DNS) on September 14, 1999. The DNS was circulated to those agencies of
jurisdiction affected by this proposal and advertised in the newspaper to the public. No written
comments were received.
11. In conjunction with the conditions of approval and Spokane County development standards, the
proposed binding site plan is not detrimental to the public health, safety and general welfare.
Moreover, this proposal implements the underlying zoning and complies with the provisions of
Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance.
DECISION
Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-65-98 is
hereby APPROVED for five (5) years, specifically until September 30, 2004, and subject to the
conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal
procedures.
CONDITIONS OF APPROVAL .
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING
1. The proposal shall comply with the Community Business (B-2) and Regional Business (B-3) zones
and other applicable Zoning Code chapters, as amended.
2. The preliminary Bindings Site Plan is given conditional approval for five (5) years, specifically to
September 30, 2004. The applicant may submit an extension of time application at least thirty (30)
days prior to the above expiration date. Application(s) for eYtension of time shall be processed
under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County
Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the
preliminary approval and conditions will be changed to reflect the adopted policy and development
regulations at the time of the extension application.
3. Prior to recording the final binding site plan, the applicant shall submit to the Building and
rlanning Director/designee for review any proposed final binding site plan to ensure compliance
with these Findings and Conditions of Approval.
4. The initial overalt final binding site plan shall be designed substantially in conformance with the
"Preliminary Binding Site Plan of Record." The initial recording of this final binding site plan
shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels
that can comply with the development standards at that time.

5. Any subsequent divisions of land within the recorded original final binding site plan shall be
reviewed by the Building and Planning Director/designee. The number of parcels proposed will be
determined by the development standards, such as the Zoning Code and shall be flexible within the
terms of the original final binding site plan's conditions of approval. After the Division of
Building and Planning has reviewed the specific parcel(s) and determined their compliance with all
applicable regulations and provisions of the original final binding site plan, an "Arnendment to the
Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor.
6. A survey is required of the subject property prior to recording the fina) binding site plan.
7. Appropriate road name(s) and street address for each parcel shall be indicated on the final binding
site plan map.
8. Appropriate utility easements shall be indicated on the final bindinj site plan map. Approval of
utility easements by utility companies must be received prior to recording the final binding site
plan.
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all
private and public roads. The dedication shall contain the following statement: "Side yard and
rear yard setbacks shall be determined at the time building permits are requested unless these
setbacks are specifically drafted on this final binding site plan. The setbacks indicated on this
binding site plan may be varied from if proper zonin~ or variance approvals are obtained."
10. Four (4) current certificates of title shall be furnished to the County Division of Building and
Planning prior to recording the final binding site plan.
11. The applicant shall contact the Division of Building and Planning at the earliest possible stage in
order to be informed of code requirements administeredlenforced as authorized by the State
Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydrantlflow, approved water systems, building accessibility, construction type,
occupancy classification, exiting, exterior wall protection, and energy code regulations.
12. A specific and detailed Site Development Plan will be submitted to the Division of Building and
Planning for review and approval prior to issuance of a building permit, Change of Use Permit or
Certificate of Occupancy.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
1. The Binding Site shall comply with those conditions found in Zone Change File ZE-23-95.
2. Conditional approval of the Binding Site Plan by the County Engineer is given subject to approval
of the road system as indicated in the Preliminary Binding Site Plan of record.
3. Drainage plans and design calculations showing the alignment of drainage facilities be submitted
to the County Engineer for acceptance prior to the release of a building permit. Drainage plans to
be prepared under the direction of a licensed Professional Civil Engineer.
4. No construction work is to be performed within the existing or proposed Public ri~ht-of-way until
a permit has been issued by the County Engineer. All work is subject to inspection and approval
by the County Engineer.
5. Approach permits are required for any access to the County Road system.
6. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.

7. A traffic study was prepared and accepted for this site in conjunction with ZE-23-95. Should
development proposals in this proposed Binding Site Plan eYCeed the remaining 82 PM peak hour
trips available for the site, the traffic study shall be updated and accepted by Spokane County and
WSDOT.
8. The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public hearings
for service or benefit obtained by the planning, design, constructing, maintaining or operation of
stormwater control facilities.
SPOKANE COUNTY DIVISION OF UTTLITIES
1. Side sewer easement with a width acceptable to the Division of Utilities shall be shown on the face
of the plat as "Sewer and Utilities Easement". The easement will be on lot D to provide sewer
service to lot C.
2. The dedication shall state: "Public sewers shall be constructed to provide for the connection of
each parcel to the County's system of sewerage." Uses on properties within the project shall be
required to connect to the sewer and pay applicable charges per the County Sewer Ordinance.
Sewer connection permits shall be required.
3. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover",
only those plan sheets showing sewer plans and specifications for the public sewer connections and
facilities for revietiv and approval. Commercial developments shall submit historical and or
estimated water usage as part of the sewer plan submittal.
4. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the
project. .
5. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. The final Binding Site Plan shall be designed as indicated on the preliminary BSP of record and/or
any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary BSP of record for
distribution by the Planning Department to the utility companies, Spokane County Engineer, and
the Spokane Regional Health District. Written approval of the easements by the utility companies
shall be received prior to the submittal of the f nal BSP.
3. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
4. Water service shall be coordinated through the Director of Utilities, Spokane County.
5. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
6. Prior to filing the final BSP, the sponsor shall demonstrate to the satisfaction of the Spokane
Regional Health District that an adequate and potable water supply is available to each lot of the
BSP.
7. Prior to filing the final BSP, the sponsor shall present evidence that the BSP lies within the
recorded service area of the water syste.m proposed to serve the BSP.

8. A plan for water facilities adequate for domestic use, domestic irrigation use, and fire protection
use shall be approved by the water purveyor. Said water plan must have been approved by the fire
protection district and the appropriate health authorities. The health authorities, water supplier
(purveyor), and the fire protection district will certify, prior to the filing of the final BSP, on the
face of said water plan that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be drafted on a transparency
suitable for reproduction.
9. The purveyor will also certify prior to filing the final BSP on a copy of said water plan that
appropriate contractual arrangements have been made with the BSP sponsor for construction of the
water system, in accordance with the approved plan and time schedule. The time schedule will
provide, in any case, for completion of the water system and inspection by the appropriate health
authorities prior to application for building permits within the BSP. The contractual arrangements
will include a provision holding Spokane County, Spokane Regional Health District, and the
purveyor harmless from claims by any lot purchaser refused a building permit due to failure of the
BSP sponsor to satisfactorily complete the approved water system.
10. A public sewer system will be made available for the BSP and individual service will be provided
to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized.
11. A statement shall be placed in the dedication to the effect that: "A public sewer system will be
made available for the Binding Site Plan and individual service will be provided to each lot prior to
sale. Use of individual on-site sewage disposal systems shall not be authorized."
12. The dedicatory language on the BSP shall state: "Use of private wells and water systems is
prohibited."
13. The final BSP dedication shali contain the following statement: "The public water system,
pursuant to the Water Plan approved by county and state health authorities, the local fire protection
district, County Building and Safety Department and water purveyor, shall be installed within this
subdivision and the applicant shall provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot and prior to issuance of a building permit for each
lot." WASHINGTON STATE DEPARTMENT OF TRANSPORTATION (WSDO'1)
1. Should development within this BSP generate traffic in excess of the 82 available PM peak hour
trips, the traffic study that was prepared for ZE-23-95 will need to be updated to reflect the
proposed uses. This updated study will need to be accepted by WSDOT and Spokane County.

is also considered the Notice of Final Decision and Notice of Right to Appeal. This administrative
decision and SEPA determination is final and conclusive unless within fourteen (14) calendar days after
the decision is issued, a party aggrieved by such decision files an appeal with the Spokane County
Hearing Examiner. The appropriate appeal application and fee information can be obtained from the
Division of Building and Planning. Upon receipt of a complete appeal application, a pubiic hearing will
be scheduled.

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. The Binding Site shall comply with those conditions found Zone Change File ZE-023-95.
2. Conditional approval of the Binding Site Plan by the County Engineer is given subject to
approval of the road system as indicated in the Preliminary Binding Site Plan of record.
3. Drainage plans and design calculations showing the alignment of drainage facilities be
submitted to the County Engineer for acceptance prior to the release of a building permit.
Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer.
4. No construction work is to be performed within the existing or proposed Public right-of-way until
a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.
5. Approach permits are required for any access to the County Road system.
6. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations
for roads, approaches, drainage and fees in new construction.
7. A traffic study was prepared and accepted for this site in conjunction with ZE-23-95. Should
development proposals in this proposed Binding Site Plan exceed the remaining 82 PM peak
hour trips available for the site, the traffic study shall be updated and accepted by Spokane
County and WSDOT.

Dear Mr. Webster;
- Thank you for the opportunity to comment on the above development proposal. The
following "Conditions of Approval" are submitted by the Washington State Department of
Transportation to the Spokane County Planning Department for inclusion in this Binding
Site Plan (BSP). 1. The site that was developed within this BSP differed from the.original proposal in ZE-
23-95 as the amount of development has changed as follows:
• The office building that was developed is 12,000 square feet, not the 20,000 square
feet that was proposed. This reduced size equates to a reduction in 23 pm peak hour
trips.
•_The hotel that was proposed to have 200 occupied rooms was constructed with only
105 rooms. This reduction in rooms equates to 59 less pm peak hour trips being
generated. Based on the above numbers, 82 pm peak hour trips remain available to this binding site
plan to use for the mitigation monies that were paid to WSDOT for improvements to the
Pines and Mission Intersection.
2. Should development within this BSP generate traffic in excess of this 82 available pm
peak hour trips, the traffic study that was prepared for ZE-23-95 will need to be
. -updated to reflect the proposed uses. This updated study will need to be accepted by
WSDOT and Spokane County. .
