FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the responsibility for rendering the decision by the Director of Spokane County Division of Building and Planning. 2. The proposal is to divide approximately 11 acres into 5 parcels for commercial use. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of parcels to be recorded over time, individualiy or in groups; provided each parcel and the proposed use can meet the minimum development standards of Spokane County. Specific parcels can be recorded at different times, but prior to sale, lease or transfer of the particular parcel. 4. The proposal is located south of and adjacent to Indiana Avenue and approximately 300 feet west of Sullivan Road, in the SE'/4 of Section 11 and the NE'/o of Section 14, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 5. The existing zoning of the property described in the application is Community Business (B-2), which was established in 1991. Pursuant to RCW 58. ] 7.195 the proposal does confonn to the requirements of the existing B-2 zone. 6. The Spokane County Comprehensive Plan designates this area as Industrial. The development and uses, as proposed and conditioned are in accord with the Industrial Category. This proposal is also compatible with the surrounding uses, which are primarily industrial and commercial. 7. The site is located within the Public Transportation Benefit Area (PTBA) of Spokane County. The Spokane Transit Authority (STA) Pines/Sullivan Express Route 71 provides connecting services to the site. 8. The Spokane County Arteriat Road Plan identifies Indiana Avenue as a Minor Arterial with a future right of way width of 80 feet. The existing right of way width is 80 feet. Therefore, as conditioned, the proposal conforms to the Road Plan. 9. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. No written comments were received from any adjoining property owners. 10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County Division of Building and Planning. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Ptan, and other County policies and guidelines. The Building and Planning Division has determined that "No probable signifcant adverse impacts" would result from the proposal being developed and issued a Determination of Nonsignificance (DNS) on November 6, 1998. The DNS was circulated for review and comments to those agencies of jurisdiction affected by this proposal. The DNS was also advertised in the newspaper to the public 14 calendar days before the i, ~ comment period ended on November 20, 1998. In response to the environmental review, written comments were received from Spokane County Air Pollution Control Authority. 11. In conjunction with the conditions of approval and Spokane County development standards, the proposed binding site plan is not detrimental to the public health, safety and general welfare. Moreover, this proposal implements the underlying zoning, as well as the Comprehensive Plan and complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County Subdivision Ordinance. DECISION Based upon the above Findings of Fact and Conclusions, B~' din~gSite Plan Application BSP-67-98 is hereby APPROVED for five (S) years, specifically until J!dirruar-Y"'7 !~►Z~84~and subject to the conditions noted below. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL All the below conditions imposed shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. SPOKANE COUNTY DIVISION OF BUILDING AND PLANNING 1. The proposal shall comply with the PE-1504-85, ZE-180-78, Community Business (B-2) zone and all other applicable Zoning Code chapters, as amended. 2. The preliminary Bindings Site Plan was given conditional approval for five (5) years, specifically to ~nnn~ri, 1?~ '~1'4f. The applicant may submit an extension of time application at least thirty (30) days prior o t e above expiration date. Application(s) for extension of time shall be processed under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary approval and conditions wi11 be changed to reflect the adopted policy and development rebulations at the time of the extension apptication. 3. Prior to recording the final binding site plan, the applicant shall submit to the Building and Planning Director/designee for review any proposed final binding site plan to ensure compliance with these Findings and Conditions of Approval. 4. The initial overall final binding site plan shall be designed substantially in conformance with the "Preliminary Binding Site Plan of Record." The initial recording of this final binding site plan shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels that can comply with the development standards at that time. 5. Any subsequent divisions of land within the recorded original final binding site plan shall be reviewed by the Building and Planning Director/designee. The number of parcels proposed will be determined by the development standards, such as the Zoning Code and shall be fleYible within the terms of the original final binding site plan's conditions of approval. After the Division of Building and Planning has reviewed the specific parcel(s) and determined their compliance with all applicable regulations and provisions of the original final binding site plan, an "Amendment to the Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor. 6. A survey is required of the subject property prior to recording the final binding site plan. 7. Appropriate road name and street address for each parcel shall be indicated on the final binding site plan map. Findings and Decision BSP-67-93 2 , ~ • r~~ ~ 8. Appropriate utility easements shall be indicated on the final binding site plan map. Written approval of utility easements by utility companies must be received prior to recording the fnal binding site plan. 9. Th,,`e final binding site plan map shall indicate by a dashed line the required setbacks from all private and public roads. The dedication shall contain the following statement: "Side yard and ruEr yard setbacks shall be determined at the time building permits are requested unless these s~etbacks are specifically drafted on this final binding site plan. The setbacks indicated on this inding site plan may be varied from if proper zoning or variance approvals are obtained." 10. I our (4) current certifcates of title shall be furnished to the County Division of Building and llanning prior to recording the final binding site plan. 11. The applicant shall contact the Division of Building and Planning at the earliest possible stage in order to be informed of code requirements adm in i stered/en forced as authorized by the State Building Code Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydrant/flow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code regulations. 12. A specific and detailed Site Development Plan will be submitted to the Division of Building and Planning for review and approval prior to issuance of a building permit, Change of Use Permit or Certificate of Occupancy. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS l. The conditional approval of the binding site plan by the County Engineer is given subject to approval of the road system as indicated in the Preliminary Binding Site Plan of Record. 2. Drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for acceptance prior to the release of a building permit. Drainage plans to be prepared under the direction of a licensed professiona) Civil Engineer. 3. Prior to recording the final binding site plan, the applicant shall comply with the underlying conditions of approval for PE-1504-85, ZE-180-78 and the Spokane County Board of County Commissioners Resolution No. 98-0862 "IN THE MATTER OF EXECUTING A SATISFACTION OF CONDITIONS AGREEMENT WITH HANSON, INDUSTRIES INC." 4. Prior to the recording the final binding site plan, the applicant shall demonstrate that reciprocal ingress/egress easements exist for access to the County road system. SPOKANE COUNTY DIVISION OF UTILITIES 1. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed. Sewer connection permit is required. Commercial developments shall submit historical and or estimated water usage prior to the issuance of the connection permit in order to establish sewer fees. 2. Tip final binding site plan dedication shall contain the following statement: "Public sewers shall constructed to provide for the connection of each parcel to the County's system of sewerage. on properties within the project shall be required to connect to the sewer and pay applicable s rges per the County Sewer Ordinance. Applicant shall submit expressly to Spokane County Division of Utilities "under separate cover," only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. Commercial developments shall submit historical and/or estimated water usage as part of the sewer plan submittal. 6. Sewer plans acceptable to the Division of Utilities shall be submitted prior to recording the final binding site plan. 7. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of Utilities. 2. Water service shall be coordinated through the Spokane County Division of Utilities. 3. Water service shall be by an eYisting public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. Prior to recording the final binding site plan, the applicant shall demonstrate to the satisfaction of the Spokane Regional Health District that an adequate and potable water supply is available to each tract of the plat. 5. Prior to recording the final binding site plan, the applicant sha11 present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 6. A plan for water facilities adequate for domestic use, domestic irrigation use and fire protection use shall be approved by the water purveyor. Said water plan must have been approved by the fire protection district and the appropriate health authorities. The health authorities, water supplier (purveyor) and the fire protection district will certify, prior to recording the final binding site plan, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. 7. The purveyor will also certify prior to recording the final binding site plan on a copy of said water plan that appropriate contractual arrangements have been made with the plat applicant for construction of the water system, in accordance with the approved plan and time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County, Spokane Regional Health District and the purveyor harmless from claims by any tract purchaser refused a building permit due to failure of the plat applicant to satisfactorily complete the approved water system. 8. A public sewer system will be made available for the plat, and individual service will be provided to each tract prior to sale.
