paving waiver per Section 14.802.080 of the Spokane County Zoning Code. The request is

Dear Mr. Manson:
We are currently attempting to finalize the seven lot Binding Site Plan referenced above, located
within an existing I-2 zoned area of East Mission Avenue. We received preliminary approval on
November 5, 1998 and have enclosed a copy of our site plan for your reference. We are requesting
that the paving requirement for the private road access within this plat- be waived as allowed under
Section 14.802.080 of the current Zoning Code of Spokane County, Washington. The paving
requirement has just recently been brought to our attention, as we were informed during the
preliminary design process that this would not be a requirement. The added cost of paving cannot
be factored into the project at this late date without jeopardizing the entire project, at great expense
to our client.
Our preliminary submittal was prepared showing private gravel roadway access, which we were told
by County Planning personnel was not required to be paved, and could be held as an option at a later
date. There is nothing in the Findings of Fact and Conclusions that refers to roadway surfacing
materials or measures to control potential air pollution. Likewise, nothing was contained in the Pre-
Conference Form or SEPA Checklist comments addressing this issue. We submitted a preliminary
roadway plan to support a Design Deviation Request for a flatter profile grade and hammerhead
terminus, which was approved with no mention of any pavement requirement. During subsequent
discussions with County Engineering personnel, it was brought up that the project lies within the
PM10 Nonattainment Area. It is unfortunate that this was revealed to us so far into our design,
especially since we were keeping in close contact with County personnel throughout the whole course
of the project.

IN THE T'E BINDING ) FINDINGS OF FACT,
SITE - ~ ) CONCLUSIONS AND
) DECISION
THIS MATTER, an application to divide industrial land from the East 6815 Mission Association, LLC
and Steve & Judy West, has been received and was decided upon, pursuant to Spokane County
Subdivision regulations, on the Sth day of November, 1998.
FINDINGS OF FACT AND CONCLUSIONS
l. The individual signing below has been properiy delegated the responsibility for rendering the
decision by the Director of Spokane County Division of Building and Planning.
2. The proposal is to divide approximately 11.98 acres into seven (7) parcels for the development of
those uses allowed in the existing Light Industrial(I-2) zone.
3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number
of parcels to be recorded over time, individually or in groups; provided each parcel and the
proposed use can meet the minimum development standards of Spokane County. Specific parcels
can be recorded at different times, but prior to sale, lease or transfer of the particular parcel.
4. The proposal is located at 6815 E. Mission Avenue; north of and adjacent to Mission Avenue,
approximately 1,350 feet west of Park Road in the SE '/4 of Section 12, Township 25N, Range
43EWM, Spokane County, Washington.
5. The existing zoning of the property described in the application is Light Industrial (I-2), which was
established in 1991. Pursuant to RCW 58.17.195 the proposal does conform to the requirements of
the existing I-2 zone.
6. The Spokane County Comprehensive Plan designates this area as Industrial. The development and
uses, as proposed and conditioned are in accord with the Industrial Category. This proposal is
compatible with the surrounding use, which are primarily Industrial.
7. The site is located within the Public Transportation Benefit Area (PTBA) of Spokane County.
8. The Spokane County Arterial Road Plan identifies Mission Avenue as a Collector Arterial with a
future right of way width of 70 feet. The Arterial right of way width is 60 feet. In order to
implement the Arterial Road Plan, the County Engineer has requested feet be dedicated on and that
a strip of property five (5) feet in width along the Mission Avenue frontage be set aside as a Future
Acquisition Area. Therefore, as conditioned, (such as improvements, sidewalks, dedicatiofls and
acquisition areas) the proposal conforms to the Road Plan.
9. The required public notice was provided for this proposal and agencies having a potentia) interest
in the project were notified and recommendations solicited.
10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane
County Division of Building and Planning. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible standard
Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and
guidelines. The Building and Planning Division has determined that "No probable significant
adverse impacts" would result from the proposal being developed and issued a Determination of
Nonsignificance ("DNS") on October 20, 1998.
.
The "DNS" was circulated for review and comments to those agencies of jurisdiction affected by
this proposal. The "DNS " was also advertised in the newspaper to the public 15 calendar days
before the comment period ended on November 4, 1998.
11. In conjunction with the conditions of approval and Spokane County development standards, the
proposed binding site plan is not detrimental to the public health, safety and general welfare.
Moreover, this proposal implements the underlying zoning, as well as the Comprehensive Plan and
complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County
Subdivision Ordinance.
DECISION
Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-68-98 is
hereby APPROVED for five (5) years, specifically until December 1, 2003 and subject to the conditions
noted below. This decision is final unless appealed in writing, consistent with adopted appeal
procedures.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant", which term shal) include the
owner or owners of the property, heirs, assigns and successors.
SPOKANE C4UNTY DIVISION OF BUILDING AND PLANNING
l. The proposal shall comply with the Light Indusirial (I-2) zone and other applicable Zoning Code
chapters, as amended.
2. The preliminary Bindings Site Plan is given conditional approval for five (5) years, specifically to
December l, 2003. The applicant may submit an extension of time application at least thirty (30)
days prior to the above expiration date. Application(s) for extension of time shall be processed
under the provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County
Subdivision Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the
preliminary approval and conditions will be changed to reflect the adopted policy and development
regulations at the time of the extension application.
3. Prior to recording the final binding site plan, the applicant shall submit to the Building and
Planning Director/designee for review any proposed final binding site plan to ensure compliance
with these Findings and Conditions of Approval.
4. The initial overall final binding site plan shall be designed substantially in conformance with the
"Preliminary Binding Site Plan of Record". The initial recording of this final binding site plan
shall show, at a minimum, the perimeter boundary of the total site and any specific internal parcels
that can comply with the development standards at that time.
5. Any subsequent divisions of land within the recorded original final binding site plan shall be
reviewed by the Building and Planning Directorldesignee. The number of parcels proposed will be
determined by the development standards, such as the Zoning Code and shall be flexible within the
terms of the original final binding site plan's conditions of approval. After the Division of
Building and Planning has reviewed the specific parcel(s) and determined their compliance with all
applicable regulations and provisions of the original final binding site plan, an "Amendment to the
Final Binding Site Plan by Survey" may be recorded with the Spokane County Auditor.
6. A survey is required of the subject property prior to recording the final binding site plan.
7. Appropriate road name(s) and street address for each parcel shall be indicated on the final binding
site plan map.
Findings and Decision BSP-68-98 ?
8. Appropriate utility easements shall be indicated on the final binding site plan map. Written
approval of utility easements by utility companies must be received prior to recording the final
binding site plan.
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all
private and public roads. The dedication shall contain the following statement: "Side yard and
rear yard setbacks shall be determined at the time building permits are requested unless these
setbacks are specifically drafted on this final binding site plan. The setbacks indicated on this
binding site plan may be varied from if proper zoning or variance approvals are obtained."
10. Four (4) current certificates of title shall be furnished to the County Division of Buildinb and
Planning prior to recording the final binding site plan.
11. The applicant shall contact the Division of Building and Planning at the earliest possible stage in
order to be informed of code requirements adm in i stered/en forced as authorized by the State
Building Code Act. Design/development concerns include: addressing, fire apparatus access
roads, fire hydrant/flow, approved water systems, building accessibility. construction type,
occupancy classification, exiting, exterior wall protection, and energy code regulations.
12. The Spokane County Division of Building and Planning shall prepare and record with the County
Auditor a Title Notice stating that the subject propetly is subject to a variety of special conditions
imposed as a result of approval of a land use action. This notice shall be recorded at the same time
as the final binding site plan and provide the foilowing.
13. The Spokane County Division of BuiIding and Planning shall prepare and record with the County
Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities.
The reserved future acquisition area Title Notice shall be released, in full or in part, by the
Building and Planning Division. The notice should be recorded the same time as the final binding
site pian and shall provide the following:
a. A strip of property five (5) feet in width from the existing right of way is reserved for future
acquisition area for additional road right-of-way width along Mission Avenue.
b. Future building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located
within the future acquisition area for road right-of-way and utilities. If any of the above
improvements are made within this area, they shall be relocated at the applicant's expense
when roadway improvements are made.
d. The future acquisition area, unti) acquired, shall be private property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parking, surface
drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at the
time Spokane County makes roadway improvements after acquiring said future acquisition
area.
SPOKANE C4UNTY DIVISIDN OF ENGINEERING AND ROADS
1. That conditional approval of the Binding Site Plan by the County Engineer is given subject
to dedication of right-of-way and approval of the road system as indicated in the
Preliminary Binding Site Plan of record.

2. Road plans, profiles and cross sections as designed to County standards showing proposed
street centerline and curb grades be submitted to the County Engineer for acceptance prior
to construction andlor the filing of a the Binding Site Plan. Road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
3. Drainage plans and design calculations showing the alignment of drainage facilities be
submitted to the County Engineer for acceptance prior to construction and/or the filing of
the final Binding Site Plan. Drainage plans to be prepazed under the direction of a licensed
Professional Civil Engineer.
4. All construction within the existing or proposed Public Right of Way is to be completed
prior to filing the final Binding Site Pian or a bond in the amount estimated by the County
Engineer to cover the cost of construction of improvements. construction certification, "As
Built" plans and monumenting the street center}ines shall be filed with the County
Engineer.
5. The County Engineer has designated a Coilector Arterial Roadway Section for the
improvement of Mission Avenue which is adjacent to the proposed Binding Site Plan. This
will require the addition of approximately 8.5-10.5 feet of asphalt along the frontage of the
development. The construction of curbing and sidewalk is also required. The applicant
shall grant applicable border easements adjacent to Spokane County Right of Way per
Spokane County Standards.
6. The private road shall be constructed to Spokane Country Standards serving 7-201ots.
7. All vested owners shall sign and record private road documents as prescribed by the
Spokane County Engineer. These documents shall be reviewed and approved by the
Spokane County Engineer prior to recording with the Spokane County Auditor. Recording
numbers shall be referenced in the language of the Binding Site Plan.
8. That the fotlowing statement be placed in the dedication of the final Binding Site Plan
document:
• WARNING: Spokane County has no responsibility to build, improve, maintain or other
wise service the private roads contained vrnthin or providing service to the property
described in this Binding Site Plan. By accepting this Binding Site Plan or subsequently by
allowing a building permit to be issued on property on a private road, Spokane County
assumes no obligation for said private road and the owners hereby acknowledge that the
County has no obligation of any kind or nature whatsoever to establish, examine, survey,
construct, alter, repair, improve, maintain, provide drainage or snow removal on a private
road. This requirement is and shall run with the land and shall be binding upon the owner,
their heirs, successors or assigns including the obligation to participate in the maintenance
of the private road as provided herein.
9. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 95-0498, as amended, which establishes
regulations for roads, approaches, drainage and fees in new construction.

10. The County Arterial Road plan identifies Mission Avenue as a 70 Foot Urban Collector
Arterial. The existing right of way width of 60 feet is not consistent with that specified in
the Plan. In order to implement the Arterial Road Plan it is recommended that a strip of
property 5 in width along the Mission Avenue frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when Arterial Improvements are
made to Mission Avenue.
11. The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set aside
future acquisition. Spokane County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with the applicable utilities
and Spokane County Engineer to determine whether the applicant or utility is responsible
for adjustment or relocation costs and to make arrangements for any necessary work.
SPOKANE COUNTY DIVISION OF UTILITIES
WATER SERVICE
l. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SEWER SERVICE
1. The dedicatory language on the binding site plan shall state: "Each new dwelling unit shall be
double-plumbed for connection to future area-wide collection systems. "NOTE: Plan acceptable
to the Division of Utilities may be required.
2. The dedicatory language on the binding site plan shall state: "The double plumbed dry side sewer
shall be extended to the public right-of-way or as required by the Division of Utilities. To
facilitate connection to the future public sewer system. Double plumbing dry side sewer plans
acceptable to the Division of Utilities may be reyuired."
3. The dedicatory language on the binding site plan shall state: "Public dryline sewers shall be
constructed to provide for the future connection of each parcel to the County's system of sewerage.
When the dryline sewers become wet (live), uses on properties within the project shall be required
to connect to the sewer and pay applicable charges per the County Sewer Ordinance. Sewer
connection permits shall be required.
4. The applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover," only those plan sheets showing sewer plans and specifications for the "double plumbed dry
side sewer" for review and approval.
5. The applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover," only those plan sheets showing sewer plans and specifications for the public dryline sewer
connections for review and approval.
6. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the
project.
7. Security shall be deposited with the Division of Utilities for the construction of the public dryline
sewer connection and facilities and for the prescribed warranty period. Security shall be in a form
acceptable to the Division of Utilities and in accordance with the Spokane County Sanitary Sewer
Ordinance.

SPOKANE REGIONAL HEALTH DISTRICT
1. The final binding site plan shall be designed as indicated on the preliminary binding site plan of
record and/or any attached sheets as noted.
2. Appropriate utility easements shall be indicated on copies of the preliminary binding site plan of
record for distribution by the Planning Department to the utility companies, Spokane County
Engineer, and the Spokane Regional Health District. Written approval of the easements by the
utility companies shall be received prior to the submittal of the final binding site plan.
3. A combined surface water and sewage disposal detailed plan shall be approved by the Spokane
County Engineer and Spokane Regional Health District prior to the issuance of any on-site sewage
disposal permit or building permit for this project.
4. Sewage disposal method shall be as authorized by the Director of the Spokane County Division of
Utilities.
5. Water service shall be coordinated through the Spokane County Division of Utilities.
6. Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
7. Prior to filing the final binding site plan, the applicant shall demonstrate to the satisfaction of the
Spokane Regional Health District that an adequate and potable water supply is available to each
tract of the plat.
8. Prior to filing the final binding site plan, the applicant shall present evidence that the plat Iies
within the recorded service area of the water system proposed to serve the plat.
9. A plan for water facilities adequate for domestic use, domestic irrigation use and itre protection
use shall be approved by the water purveyor. Said water plan must have been approved by the fire
protection district and the appropriate health authorities. The health authorities, water supplier
(purveyor) and the fire protection district will certify, prior to recording the final binding site plan,
on the face of said water plan that the plan is in conformance with their requirements and will
adequately satisfy their respective needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction.
10. The purveyor wil) also certify prior to recording the final binding site plan on a copy of said water
plan that appropriate contractual arrangements have been made with the plat applicant for
construction of the water system, in accordance with the approved plan and time schedule. The
time schedule will provide, in any case, for completion of the water system and inspection by the
appropriate health authorities prior to application for building permits within the plat. The
contractual arrangements will include a provision holding Spokane County, Spokane Regional
Health District and the purveyor harmless from claims by any tract purchaser refused a building
permit due to failure of the plat applicant to satisfactorily complete the approved water system.
11. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
12. Prior to filing the final binding site plan, the applicant shall demonstrate to the satisfaction of the
Spukane Regional Health District that suitable sites for on-site sewage disposal systems are
available on all lots.
13. Prior to filing the final binding site plan, the applicant shall demonstrate to the satisfaction of the
Spokane Regional Health District that the existing on-site sewage disposal sysiem serving the
structures located on lot 1 is wholly located within the boundaries of the lot.
14. Subject to specific application approval and issuance of permits by the Health Officer, the use of
individual on-site sewage disposal systems may be authorized.

15. The final binding site plan shall contain the following statement:
"Subject to specific application approval and issuance of permits by the Health Officer, the use
of individual on-site sewage systems may be authorized."
16. The final binding site plan dedication shall contain the following statement: "Use of private wells
and water systems is prohibiied."
17. The final binding site plan dedication shall contain the following statement: "The public water
system, pursuant to the Water Plan approved by County and State health authorities, the local fire
district, County Division of Building and Planning, and water purveyor, shall be installed within
this binding site plan, and the applicant shall provide for individual domestic water service as well
as fire protection to each tract prior to sale of each tract and prior to issuance of a building permit
for each tract."
SPOKANE COUNTY FIRE DISTRICT NO. 1
1. The Spokane Valley Fire Department will require an approved fire apparatus turnaround. The
one shown on the site plan is too small. See attached standards. Water will be addressed at
pre-construction. ~
SPOKANE COUNTY WATER DISTRICT NO. 3
1. A water plan be required to insure domestic water service and fire flow is provided in
accordance with WA State Department of Health regulations. ~
2. Any on-site as well as off-site water system improvements necessary to provide the required
fire flow will be the responsibility of the owner.

10. The County Arterial Road plan identifies Mission Avenue as a 70 Foot.
Urban Collector Arterial. The existing right of way width of 60 feer_
is not consistent with that specified in the Plan. In order to
implement the Arterial Road Plan it is recommended that a strip of
property 5 in width along the Mission Avenue frontage be set aside in
reserve. This property may be acquired by Spokane County at the time
when Arterial Improvements are made to Missicn Avenue.
11. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, includin,.-j
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.

I received the above referenced application on Oct.2, 1998.
This project lies in an area of approved soils so a concept drainage plan is not required.
I have no knowledge of any critical areas on this site.
I consider this application to be technically complete.
I recommend the following condition of approval:
• A Professional Engineer, licensed in the State of Washington, shall submit tinal road and
drainage plaas, a drainage report and calculations that conform to all current standards and
laws governing stormwater management in Spokane County for any requircd road and/or
drainage improvements. Final drainage plans and a draioage report shall receive the County
Engineer's acceptance prior to release of a construction or building permit or approval of the
land action.
