BEFORE
THE SPOKANE COUNTY DIVISION OF CURRENT PLANNING
IN THE MATTER OF PRELIMINARY) FINDINGS OF FACT,
BINDING SITE PLAN, BSP-69-99 ) CONCLUSIONS AND
DECISION
THIS MATTER, an appiication to divide industrial and commercial land from Donwood, Inc. has been
received and was decided upon, pursuant to Spokane County Subdivision Ordinance, Section 12.500, on
the 6T" day of January, 2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility for rendering the
decision by the Director of Spokane County Division of Current Planning.
2. The proposal is to divide approximately 14 acres into 6 parcels for those uses allowed in the
Regional Business Zone (6-3) and in the Light Industrial Zone (I-2) and as amended pursuant to
Rezone Approvals ZE-27-97 and ZE-139A-76. More specifically, Parcels A, B, C, D and E are
zoned Regional Business (B-3) and Parcel F is zoned Light Industrial (I-2). Pursuant to RCW
58.17.195 the proposal does conform to the requirements of the existing B-3 and I-2 zones. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any number of
parcels to be recorded over time, individually or in groups; provided each parcel and the proposed
use can meet the minimum development standards of Spokane County. Specific parcels can be
recorded at different times, but prior to sale, lease or transfer of the particular parcel.
4. The proposal is located approximately 1,000 feet east of Barker Road, befinreen Broadway Avenue
and Appleway, and fronting on both Broadway and Appleway, in the SW%4 of Section 17, Township
25 N., Range. 45 EWM., Spokane County, Washington.
5. The existing zoning of the property described- in the application is Regional Business (B-3) and Light
Industrial (I-2). More specifically, Parcels A,B,C,D and E are zoned Regional Business (B-3) and
Parcel F is zoned Light Industrial (I-2). Pursuant to RCW 58.17.195 the proposal does conform to
the requirements of the existing B-3 and I-2 zones.
Zoning designations within the vicinity of the proposal range from Urban Residential-3.5 (UR-3.5)
Zone, which is primarily a medium density single family residential zone, to the Regional Business
(B-3) Zone which is the most intensive commercial zone in Spokane County, to Light Industrial (I-2)
Zone allowing for light industries and regional businesses. Most zone reclassifications in the area
occurred between the mid 1970's through the mid 1980's and were primarily for the development of
land for those uses allowed in the Regional Business (B-3) Zone. Specifical{y, the surrounding
zones are as follows:
Site: Regional Business Zone (B-3) established in 1991 and Light Industrial Zone (I-2)
established in 1999.
North: Regional Business (B-3) established in 1991 consistent with the Program to
Implement the Spokane County Zoning Code, previously established as Freeway
Commercial (FC) in 1976 (ZE-139A-76C).
South: Urban Residential-3.5 (UR-3.5) established in 1991 consistent with the Program to
Implement the Spokane County Zoning Code, previously established as Agncultural
(A) in 1958 (ZE-376-58).
East: Light Industrial (I-2) established in 1991 consistent with the Program to lmplement
the Spokane County Zoning Code, previously establishe~ as Agricultural (A) in
1958 (ZE-376-58).
West: Urban Residential-3.5 (UR-3.5) established in 1991 consistent with the Program to
Implement the Spokane County Zoning Code, previously established as Agricultural
(A) in 1958 (ZE-376-58).
6. The surrounding neighborhood encompasses a mix of land uses including commercial and light
industria) businesses. Recreation vehicle and mobile home sales businesses are the dominant land use
north and west of the subject site. Single family residences extend west of the project site, however,
most of the residences appear to include some type of home based business to include leasing land for
commercial and industrial storage. Overhead transmission lines provide electrical service to the
neighborhood. Most roads providing access to properties within the neighborhood are paved but
without curb or sidewalk.
7. The subject property is located within the Urban category of the Comprehensive Plan and also
within the Interim Urban Growth Area (IUGA). The Urban category is primarily a residential
category of single family, two-family, multiple family and condominium buildings along with
neighborhood commercial, light industnal, and public and recreational facilities. The more intensive
land uses such as light industrial and neighborhood commercial will be located near heavily traveled
streets, such as Appleway, while the least intensive single-family residential uses will be isolated
from noise and heavy traffic.
The text within the Urban category of the Comprehensive Plan does not address or support light
industrial land uses nor does the text identify specific goals, objectives and decision guidelines that
encourage light industrial uses within the Urban category. Most Urban category policies apply to
residential dzvelopment with the most intensive policies addres.sing multifamily residential
development.
However, the project site may be subject to the "transition area" definition on page 11of the
Comprehensive Plan. A"transition area" is an area of land located along the boundary between the
two land use categories. The subject property is located within the Urban category and west of and
adjacent to an Industrial designation of the Comprehensive Plan. It is the intent of the
Comprehensive Plan that the established boundaries befinreen land use categories are accurate and
definable on the ground, but it is also recognized that a specific proposal may be located adjacent to
these boundaries. In these instances, depending on the impact to existing land use categories and
the distance a use intrudes into an adjacent category, a Comprehensive Plan amendment may not
be required in order to allow a land use that is not consistent with the Goals, Objectives and
Decision Guidelines of the land use category in which a property is located but rather that land use
category that is located adjacent to a proposal. The "transition area" policy can allow developments
complying with either of the Land-Use map categories depending upon specific proposed site
development.
Considering the purposes and intent of the Comprehensive Plan's Urban designation and the
purposes and intent of the I-2 and B-3 Zones, the project does not appear consistent with the
Comprehensive Plan. However, if the area is deemed a land use transition area as described on
page 11 of the Comprehensive Plan certain industrial and commercial projects locating in such an
area would be deemed to be consistent with the intent and spirit of the Comprehensive Plan. The
above factors indicate that the proposal is a good candidate for application of the "transition area"
policy. The proposal does not intrude excessively into the Urban category, and is well-buffered from
the manufactured home park located south of Appleway Avenue. The site is not suitable for
residential development under the Urban category, considering its proximity to Appleway Avenue,
and I-2 and B-3 zoning. As finding number 9 below specifies, Appleway is a Principal Arterial
having a high traffic flow and as such, contributes to the transitional charactenstic of the project site.
Based on this finding and findings Number 5 and 6 herein, the project site is located in a transition
area subject to the intent and spirit of the "transition area° policy specified above and therefore the
project is essentially not inconsistent with the intent and spirit of the plan, and as such may go
forward without the need to amend the Comprehensive Plan.
8. The subject property includes 2 geographical terraces. Parcel F is located on a flat terrace roughly 8
feet under the upper terrace which consists of Parcels A through E. The western portion of Parcel F
adjacent to Appleway Street is currently occupied by a recreational vehicle and used car sales
business with associated storage yard and repair shop. The parking/storage area on site is unpaved
but is provided with night lighting; No landscaping is present on the site. A six (6) foot high sight
obscuring, board-on-board fence is located along the west property line of Parcel F. Parcels B and C
are currently occupied by a mobile home sales business. Parcels A, D, E and the eastern 4/5 of
Parcel F are vacant and undeveloped with native grasses and a few Ponderosa Pines. An overhead
transmission line borders the subject property along the south property line adjacent to Appleway
Avenue. •

9. The site is located within the Public Transportation Benefit Area (PTBA) of Spokane County. The
Spokane Transit Authority (STA) Route 82 (Greenacres) provides connecting services to the vicinity
of the project site.
10. The Spokane County Arterial Road Plan identifies Broadway Avenue as a Local Access Road with a
future right of way width of 60 feet_ The existing right of way width is 60 feet. In addition, The
Spokane County Arterial Road Plan identifies Appleway as Principal Arterial with a future right of way
width of 100 feet. The existing right of way width is 160 feet. Therefore, this project conforms to the
Road Plan. No roadway improvements are required for this binding site plan at this time. Broadway
Avenue has been constructed per plans J-25 and K-15 on file at the County Engineers Office.
11. The required public notice was provided for this proposal and agencies having a potential interest in
the project were notified and recommendations solicited. No written comments were received from
any adjoining property owner(s).
12. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County
Division of Current Planning. The review considered the specifics of the proposal, other available
information, County ordinances, other regulations and laws, possible standard Conditions of
Approval, the Generalized Comprehensive Plan, and other County poticies and guidelines. The
Current Planning Division has determined that "No probable significant adverse impacts" would result
from the proposal being developed and issued a Determination of Nonsignificance (DNS) on October
1, 1999.
The DNS was circulated for review and comments to agencies of jurisdiction affected by this
proposal. The DNS was also advertised in the newspaper to the public 15 calendar days before the
comment period ended on October 16, 1999. In response to the environmental review, written
comments were received from Division of Utilities-Stormwater Utility and Spokane County Air
Pollution Control Authority.
13. In conjunction with the conditions of approval and Spokane County development standards, the
proposed binding site plan is not, detrimental to the public health, safety and general welfare.
Moreover, this proposal implements the undertying zoning, as well as the Comprehensive Plan and
complies with the provisions of Chapter 12.500 (Binding Site Plans) of the Spokane County
Subdivision Ordinance.
14. The project site is visible from Interstate 90 and signage visible from said highway is regulated by
federal laws for aesthetic purposes.
15. This project is located within the Aquifer Sensitive Area (ASA) and the Priority Sewer Service area
(PSSA).
16. Potable and fire flow water service will be provided by Consolidated Irrigation District #19. Sewer
Service will be provide by Spokane County.
DECISION
Based upon the above Findings of Fact and Conclusions, Binding Site Plan Application BSP-69-99 is
hereby APPROVED for five (5) years, specifically until January 6, 2005 and subject to the conditions
noted below. This decision is final unless appealed in writing, consistent with condition 2 below.
CONDITIONS OF APPROVAL
All the below conditions imposed shall be binding on the "Applicant," which term shall include the
developer of the project, the owner or owners of the property, heirs, assigns and successors.
SPOKANE COUNTY DIVISION OF CURRENT PLANNING
1. The project shall comply with all requirements of the Regional Business (B-3) and Industria) (I-2)
Zones and all other applicable Zoning Code chapters, as amended, and specifically all conditions of
Rezone Approvals ZE-27-97 and ZE-139A-76. •

2. The Preliminary Bindings Site Plan is given conditional approval for five (5) years, specifically to
January 6, 2005. The applicant may submit an extension of trme application at least thirty (30) days
prior to the above expiration date. Application(s) for extension of time shall be processed under the
provisions of Chapter 12.100.118 (Extension of Time) of the Spokane County Subdivision
Ordinance. If the applicant complies with the criteria of Chapter 12.100.118, the preliminary
approval extension will be granted with conditions attached that reflect the adopted policy and
development regulations in effect at the time of the extension application.
3. Prior to recording the final binding site plan, the applicant shall submit to the Division of Current
Planning for review any proposed final binding site plan to ensure compliance with these Findings
and Conditions of Approval.
4. The initial overall final binding site plan shall be designed substantially in conformance with the
"Preliminary Binding Site Plan of Record.° If the Binding Site Plan is finalized in phases, each phase
shall be consistent with the Preliminary Binding Site Plan as approved therein. The initial recording
of this Final Binding Site Plan shall show, at a minimum, the penmeter boundary of the total site and
any specific internal parcels that can comply with the development standards at that tirne.
5. Any subsequent divisions of land within the recorded original final binding site plan shall be
reviewed by the Division of Current Planning. The number of parcels proposed will be determined
by the development standards, such as the Zoning Code and shall be flexible within the terms of the
original final binding site plan's conditions of approval. After the Division of Current Planning has
reviewed the specific parcel(s) and determined their compliance with all applicable regulations and
provisions of the original final binding site plan, an °Amendment to the Final Binding Site Plan by
Survey" may be recorded with the Spokane County Auditor.
6. A survey is required of the subject property prior to recording the final binding site plan.
7. Appropriate road name and street address for each parcel shall be indicated on the Final Binding
Site Plan Map.
8. Appropriate utility easements shall be indicated on the final binding site plan map. Written approval
of utility easements by utility companies must be received prior to recording the final binding site
plan.
9. The final binding site plan map shall indicate by a dashed line the required setbacks from all private
and public roads. The dedication shall contain the following statement: "Side yard and rear yard
setbacks shall be determined at the time building permits are requested unless these setbacks are
specifically drafted on this final binding site plan. The setbacks indicated on this binding site plan
may be varied from if proper zoning or variance approvals are obtained."
10. Four (4) current certificates of title shall be furnished to the County Division of Current Planning
prior to recording the final binding site plan.
11. The applicant shall contact the Division of Building at the earliest possible stage in order to be
informed of code requirements administered/enforced as authorized by the State Building Code Act.
Design/development concerns include: addressing, fire apparatus access roads, fire hydranUflow,
approved water systems, building accessibility, construction type, occupancy classification, exiting,
exterior wall protection, and energy code regulations.
12. A specific and detailed site devefopment plan will be submitted to the Division of Current Planning
for review and approval prior to issuance of a building permit, Change of Use Permit or Certificate of
Occupancy.
13. Signage on the project site which is visible from Interstate 90 needs to be consistent with state and
federal signage requirements. The Washington State Department of Transportation will be
contacted prior to the issuance of any signage building permit to determine compliance with the
Federal Scenic Vista Act.
14. The Division of Current Planning shall prepare and record with the Spokane County Auditor a Title
Notice noting that the properry in question is subject to a variety of special conditions imposed as a
result of approval of th:s proJect. This Title Notice shall serve as public notice of the conditions of

approval affecting the property in question. The Title Notice should be recorded within the same
time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of
Current Planning. The Title Notice shall clearly communicate to owners and/or potential
buyer(s)/lessee(s) that County enforceable restrictions/conditions exist and run with the property
and such restrictions shall be set forth therein.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to release of a building permit or use of the property as proposed: ,
1. Applicant shall comply with all conditions of approval for land use actions ZE-139A-76 and ZE-27-97.
2. Approach Permits are required for any access to the Spokane County road system.
3. No construction work is to be performed within the existing or proposed Public right-of-way until a
permit has been issued by the County Engineer. All work is subject to inspection and approval by the
County Engineer.
4. A Professional Engineer, licensed in the State of Washington, shall submit final road and drainage
plans, a drainage report and calculations that conform to all standards and taws governing stormwater
management in Spokane County if road and/or drainage improvements are required by other
conditions of approval. Final drainage plans and a drainage report shall receive the County Engineer's
acceptance prior to release of a construction or building permit.
5. Any required stormwater management systems and roads for this binding site plan or building permit
shall be constructed and certified to be constructed in accordance with the accepted road and
drainage plans, or all the required improvements must be bonded for in accordance with Spokane
County regulations. Record drawings and all construction documentation shall be submitted with the
proper certification statement.
6. A Temporary Erosion and Sedimentation Control (TESC) plan is to be prepared by a WA State
licensed Professional Engineer or Landscape Architect, and implemented throughout the duration of
construction. The TESC plan is to be prepared using best management practices (BMP's) currently
accepted within the Civil Engineering profession, and shall address limits on amount and duration of
disturbed areas which have not been stabilized. The TESC plan is to include, as a minimum, a
grading plan, location and details of silt control structures, and street cleaning program. Runoff from
exposed areas must be filtered prior to discharging into a detention pond, 208 swale, or infiltration
facility. The TESC plan is to be included in the road and drainage plans. The Sponsor's Engineer is
to submit the TESC plan and supporting calculations to Spokane County for review, and shall receive
acceptance as part of the plan review process prior to site disturbance. The TESC major structures
(such as silt ponds, silt traps) are to be installed prior to other site work and the TESC measures are
to be implemented and maintained throughout the duration of construction.
7. A bond for the anticipated engineering inspection and certification portion of the project shall be
posted with the County Engineer prior to final plat if the required improvements have not yet been
built, certified and accepted by Spokane County.
8. Any drainage system outside of the public right-of-way will neither be maintained nor operated by
Spokane County agencies. Prior to plan acceptance by the County Engineer, the Sponsor shall
provide a mechanism, acceptable to the County Engineer, for the perpetual maintenance of the
stormwater drainage system, if the facilities that are proposed are different than the standard grassy
swale with drywells that are located adjacent to the roadway.
9. This proposed subdivision or development proposal is located within a drainage basin which has been
identified by the Spokane County Engineer's and Utilities offices as having stormwater runoff
problems. Since this proposed subdivision or development proposal is affected by or is a contributor
to stormwater flows, property owners should participate in the planning and implementation of a future
basin wide stormwater management system.
10. The following statements shall appear within the dedicatory language of the final Binding Site Plan:

The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or
to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in
interest hereby request and authorize Spokane County to include the above described property
in a Road Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement District
pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID, and (3) that the property within the
proposed RID is sufficiently developed; provided, themselves, fheir heirs, grantees, assigns
and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any
assessment(s) on the property as a result of the improvements called for in conjunction with
the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW
and to appeal to the Superior Court the decision of the Board of County Commissioners
confirming the final assessment roll; provided further, it is recognized that actual assessments
may vary from assessment estimate so long as they do not exceed a figure equal to the
increased true and fair value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Improvement project is authorized by Spokane County, the improvements required shall
be at the sole expense of the owner(s) of property within the RID or served by the
improvements without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to that portion of Broadway Avenue to be
realigned and including Barker Road.
"The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining or
operation of stormwater control facilities."
11. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for
roads, approaches, drainage and fees in new construction.
SPOKANE COUNTY DIVISION OF UTILITIES
1. This proposal must meet the requirements of the Spokane Counry Guidelines for Stormwater
Management. The Guidelines for Stormwater Management require that impervious area within the
ASA must drain to grassed percolation area (GPA) swales. The applicant shall show drainage
easements on the site plan.
2. Language shall be added to the dedication that states the footpad of any signage should not be
placed in, nor should it impact, the drainage easements. The plans show an abandoned irrigation
canal right-of-way. To clarify the drainage issues, provide documentation that this canal has been
abandoned as well as documentation of ownership of the abandon right-of-way.
3. The dedicatory language on the Final Binding Site Plan shall state:
Public sewers shall be constructed to provide for the connection of each parcel to the
County's system of sewerage. Uses on properties within the project shall be required to
connect to the sewer and pay applicable charges per the County Sewer Ordinance. sewer
connection permits shall be required.

4. The applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover," oniy those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
historical and/or esbmated water usage as part of the sewer plan submittal.
5. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the finalization of the
project.
6. Security shall be deposited with the Division of Utilities for the construction of the public sewer
connection and facilities and for the prescribed warranty period. Security shall be in a form
acceptable to the Division of Utilities and in accordance with the Spokane County Sanitary Sewer
Ordinance.
7. Arrangements for payment of applicable sewer charges must be made prior to issuance of sewer
connection permit. Sewer charges may include special connection charges and general facilities
charges. Charges may be substantial depending upon the nature of the development.
8. Any water service for this project shall be provided in accordance with the Coordinated Water
System Plan for Spokane County, as amended.
SPOKANE REGIONAL HEALTH DISTRICT
1. Sewage disposal meihod shall be as authorized by the Director of the Spokane County Division of
Utilities.
2. Water service shall be coordinated through the Spokane County Division of Utilities.
3. Prior to recording the final binding site plan, the applicant shall demonstrate to the satisfaction of
the Spokane Regional Health District that an adequate and potable water supply is available to
each'tract of the plat

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. Applicant shall comply with all conditions of approval for ZE-139A-76 and ZE-27-97.
2. No roadway improvements are required for this binding site plan at this time. Broadway
Avenue has been constructed per plans J-25 and K-15 on file at the County Engineers Office.
3. Approach Permits are required for any access to the Spokane County road system.
4. No construction work is to be performed within the existing or proposed Public right-of-way until
a permit has been issued by the County Engineer. All work is subject to inspection and
approval by the County Engineer.
5. A Professional Engineer, licensed in the State of Washington, shall submit final road and
drainage plans, a drainage report and calculations that conform to all standards and laws
governing stormwater management in Spokane County if road and/or drainage improvements
are required by other conditions of approval. Final drainage plans and a drainage report shall

management practices (BMP's) currently accepted within the Civil Engineering profession, and
shall address limits on amount and duration of disturbed areas which have not been stabilized.
The TESC plan is to include, as a minimum, a grading plan, location and details of silt control
structures, and street cleaning program. Runoff from exposed areas must be filtered prior to
discharging into a detention pond, 208 swale, or infiltration facility. The TESC plan is to be
included in the road and drainage plans. The Sponsor's Engineer is to submit the TESC plan
and supporting calculations to Spokane County for review, and shall receive acceptance as part
of the plan review process prior to site disturbance. The TESC major structures (such as silt
ponds, silt traps) are to be installed prior to other site work and the TESC measures are to be
implemented and maintained throughout the duration of construction.
8. A bond for the anticipated engineering inspection and certification portion of the project shall be
posted with the County Engineer prior to final plat if the required improvements have not yet
been built, certified and accepted by Spokane County.
9. Any drainage system outside of the public right-of-way will neither be maintained nor operated
by Spokane County forces. Prior to plan acceptance by the County Engineer, the Sponsor shall
provide a mechanism, acceptable to the County Engineer, for the perpetual maintenance of the
stormwater drainage system, if the facilities that are proposed are different than the standard
grassy swale with drywells that are located adjacent to the roadway.
10. This proposed subdivision or development proposal is located within a drainage basin which has
been identified by the Spokane County Engineer's and Utilities offices as having stormwater
runoff problems. Since this proposed subdivision or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning and
implementation of a future basin wide stormwater management system.
11. The following statements shall appear within the dedicatory language of the final Binding Site
Plan:
• The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or to
be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in
interest hereby request and authorize Spokane County to include the above described property
in a Road Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement District
pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030,
and/or by not filing a protest against the formation of a RID being formed under the alternative
. resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW.

If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree: (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed; provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on
the property as a result of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll; provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property.
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RID or served by the improvements
without any monetary participation by Spokane County.
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below. This provision is applicable to that portion of Broadway Avenue to be
realigned and including Barker Road.
• "The owner(s) or successor(s) in interest agree to join in any County-approved stormwater
management program and to pay such rates and charges as may be fixed through public
hearings for service or benefit obtained by the planning, design, constructing, maintaining or
operation of stormwater control facilities."
12. The proposed Binding Site Plan shall be improved to the standards set forth in Spokane County
Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations
for roads, approaches, drainage and fees in new construction.

l. What is an Aercemcnt to Pav Fecs ?
~ The current "Agreement to Pay Fees" was authorized through Resolution No. 80-1592 that was
adoptcd by the Spakane County Commissioncrs on Dccember 22, 1980. The Resnlution authorires thc
County Engineer to collect .1 fee for time that is expended by Spol:ane County personnel who are
~ chargcd ivith revicw and inspection dutics that :ire required to be performed for thc applicablc
dcvelopment proposals. The fec agreemcnt is bascd on thc individuals achial timc spent plus 10%.
These costs are billed out on a monthly b.isis. Thc amount of time snent on review of a project will Ue
dircctly proportional to thc camplcxity of thc proposal ancl thc quality of thc submittals from the
appticant and his agcnts. It is thc go.il of Spolc:inc County to minimiu as much as possible our rcvicw
and inspection time on a project. If the applicant sclects agents to represent him who are familiar
ivith the process and submittal/inspcctinn rcquircmcnts anel thcsc rcquircmcnts arc foUowecl, therc
