FINDIlYGS OF FACT AND CONCLUSIONS 1. The individual signing below has been properly delegated the.responsibility for rendering the decision by the Director of Spokane County Division of Alanning. 2. The proposal is to divide approximately 1.37 acres into 2 lots for commercial uses. 3. The Binding Site Plan Chapter of the Spokane County Subdivision Ordinance allows any nunnber of parcels to be recorded over time, individually or in groups; provided each parcel and the proposed use can meet the minimum development standards of Spokane County Zoning Code. Specific parcels can be recorded at different times, but must be recorded prior to sale, lease or transfer of the particular parcel. 4. The proposal is located on the west side of Sullivan Road, approximately 200 feet south- of ValleyWay at 307 N. Sullivan in the SE 1/4 of Section 14, Township 25 N., Range 44 EWM, Spokane County, Washinbton. ~ 5. The existing zoning of the property described in the application is Regional Business (B-3) ' established in 1987 (ZE-28-87C), and previously classified as Agriculture (A) in 1941. Pursuant to 58.17.195 the proposal does conform to the requirements of the existing Regional Business (B-3) zone. - 6. The Spokane County Comprehensive Plan designates this area as Commercial and Urban. The development and uses, as proposed, are compatible with the Commercial catecyory but not tlle Urban category 7. The proposed site is located within the Public Transportation Benefit Area (PTBA) of Spokane County. The nearest connecting services are available aloncr Sullivan Road located south of and adjacent to the site. 8. The Spokane County Arterial Road Plan identifies Sullivan Road as a Principal Arterial. As proposed, the Preliminary Binding Site Plan conforms to the Plan. 9. The required public notice was provided for this proposal and agencies havin., a potential interest in the project were notified and recommendations solicited. No written comments were received from any adjoining property owners regarding this proposal. 10. An Environmental Checklist was submitted by the sponsor and was reviewed by the Spokane County Division of Planning. The review considered specifics of the proposal, other available information, County Ordinances, other regulations and laws; possible standard Conditions of Approval, the Generalized Comprehensive Alan, and other County policies and Quidelines. The Planning Division has determined that "No probable significant adverse impacts" would result from the proposal being developed and issued a"DNS" April 27, 2000. The "DNS" was circulated to eleven (11) agencies of jurisdiction affected by this proposal for revieNv and comments. The "DNS" was advertised in the newspaper to the public 15 calendar days Findings and Decision BSP-73-00 3 8. Appro ri utility easements shall be indicated on the final binding site plan map. Approval of utili sernents by utility companies must be received prior to recording the final binding site pla 9. e final binding site plan map shall indicate by a dashed line the required setbacks from all rivate and public roads. The dedication shall contain the following statement: "Side yard and rear yard setbacks shall be determined at the time building permits are requested unless these setbacks are specifically drafted on this final binding site plan. The setbacks indicated on this binding site plan may be varied from if proper zoning or variance approvals are obtained." 10. Four (4) current certificates of title shall be furnished to the County Division of Planning prior to recording the final binding site plan. 1 1. The applicant sliall contact the Division of Buildinb and Code Enforcement at the earliest_possible stage in order to be informed of code requirements administered/enforced as authorized by the State Building Code Act. Design/development concerns include: addressing, fire apparatus access roads, fire hydrandflow, approved water systems, building accessibility, construction type, occupancy classification, exiting, exterior wall protection, and energy code re~ulations. 12. A specific and detailed Site Development Plan will be submitted to the Division of Building and Code Enforcement for review and approval prior to issuance of a building permit, Change of Use Permit or Certificate of Occupancy. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS 1. Conditional approval of the Binding Site Plan by the County Engineer is given subject to approval of the road system and access plans as indicated in the Preliminary Binding Site Plan of record. 2. Prior to the release of a buiiding permit on any portion of the Preliminary or Final Binding site Plan, The applicant shall submit drainage plans for review and acceptance by the County Engineer 3. Approach Permits are required prior to any access to the Spokane County road system. . 4. The proposed Binding Site Plail shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 99-0265, as amended, which establishes regulations for roads, approaches, drainage and fees in new construction. 5. Prior to the release of a building permit on any portion of the Preliminary or Final Binding Site Plan, the applicant shall submit a Traffic Distribution Letter for review and acceptance by the County Encrineer. The applicant is advised that acceptance of the Traffic Distribution Letter cnay require the submission of additional traffic information or studies, roadway improvements and/or ,onther forms of mitigation, on or off-site, as prescribed by the County Engineer. ~ i 6. he applicant shall submit documentation to the satisfaction of the County Engineer that reciprocal ingress/egress easements have been perfected for the proposed 30' easements across Tract "A" of SP-87-509 and across Parcel "A" of the Preliminary Binding Site Plan.
